INTRODUCTION

The EJTN has developed in 2015 for the first time a

detailed calendar of activities composed of tables ordering

the seminars by dates, topics and venue, plus a one-page

description of each activity, as well as useful annexes referring to the

deadlines for application and allocation of places where applicable.

Following the success and usefulness of the 2015 calendar, we have continued

to implement this tool in 2016 and 2017 and we are now presenting the 2018

Calendar of activities which contains 100 activities to be developed in 2018 in

the fields of Administrative, Civil and Criminal Law, Human and Fundamental

Rights, Linguistics, Judicial Training Methods, THEMIS, Summer Schools and

Catalogue plus.

Catalogue of Members’ activities and Judicial Exchanges, including study visits,

are not covered by this calendar and will be addressed separately, following a

procedure identical to that of previous years.

The Calendar of Activities has been designed to answer two main concerns

expressed by the training institutions: the need to receive all relevant information

regarding EJTN trainings before the start of their implementation year, and the

need to decrease the number of emails received from the Secretariat.

As a consequence, the Calendar of Activities will replace the individual Calls

for Application previously sent a few months in advance of each seminar. Only

one monthly reminder listing the approaching deadlines for application will be

sent at the beginning of each month, together with information highlighting any

updates made to the calendar. In this Calendar, training institutions will find all

the information required to select participants to each EJTN activity. In addition,

a table listing all application deadlines for the year 2018 is available in Annex I.

DESCRIPTIONThis two-day training will raise awareness to the European dimension in the field of civil procedure; provide training on the EU Regulations including the relevant case law on cross-border taking of evidence and service of documents; promote contacts between national judges from different Member States.

The seminar is designed to be practice-oriented and focused on peer and expert training.

Participating judges will deal with concrete situations and be faced with real questions by means of case studies and workshops in which active participation is encouraged. The training will serve as a forum for the exchange of knowledge and best practices between judges and prosecutors from across the EU.

DESCRIPTIONTwo-days-and-a-half training based on a ‘learn-by-doing’ methodology. Judges and prosecutors from three different EU Member States will be involved in a simulation of the different stages of a migrant smuggling case, inspired by real facts and involving both national and cross-border judicial cooperation. This training will require strong interaction between the participants forming the 3 different national Core Groups. Participants will comment on the practical cases according to their national legal systems and, most importantly, learn about their colleagues’ systems in counterpart Member States. The simulation will call for the use of EU instruments of mutual legal assistance and recognition, in particular, Freezing Orders (FO), the European Arrest Warrant (EAW), and Mutual Legal Assistance (MLA) requests. Participants will be assisted by international and national experts, EJN contact points and EUROJUST representatives. The training will include presentations on the role of the EJN and EUROJUST in judicial cooperation in criminal matters, as well as a framework lecture on the topic of the training’s practical case.

TOPIC: Professional Practice

DESCRIPTION: The conference addresses judges of all jurisdictions as well as prosecutors.

Around the world, work ethics of judges and prosecutors have become an issue of debate. During the last years, the topic has spread increasingly around Europe as well. Several countries have developed national ethics policies, e.g. Austria where, in 2007, the Association of Austrian Judges has passed a declaration of ethics containing principles by which the judges declare to be guided in their work.

The conference wants to illustrate the status quo of development using the example of Germany and the ideas, principles and expectations the German Constitution and the German Judiciary Act associate with judges. There will also be selected examples from other countries. The conference aims at collectively breaking the everyday would, enabling and encouraging a debate on the topic and raising the following questions for the participants:

• What is it that makes a good judge or a good prosecutor?

• Could and should judges and prosecutors in Germany give themselves ethical principles for their work?

• Which ethical principles should prevail?

• Should these principles be put into writing?

• Which values influence my professional behavior?

• What does independence of mind mean and how is it put into practice?

The conference will also be announced as part of the European Judicial Training Network (EJTN). It is particularly suitable for foreign participants.

For participation in the intended workshops at least basic command of English would be preferable.

Participants will be assisted by international and national experts, Europol and Eurojust representatives. The training will include presentations on the role of Europol and EUROJUST in judicial cooperation in criminal matters, as well as a framework lecture on the topic of the training’s practical case.

DESCRIPTIONDay-and-a-half training aimed at promoting effective way of cooperation on obtaining evidence in criminal matters between EU Member States in view of securing its admissibility abroad. The seminar, divided in national breakouts sessions, international workshops and plenaries, will give the opportunity to the practitioners to have an in-depth knowledge on the Directive on the European Investigation Order (EIO) and reflect on legal and practical implications in cross-border investigations: which changes with the EIO and national challenges in the implementation of the Directive.

The seminar, through key notes and study cases, also intends to provide participants with a forum of discussions to raise those questions which can help them in daily praxis on how to solve problems in cross-border investigations as issuing / executing judicial authority and highlight differences and common approaches in gathering, obtaining and use of evidence in view of its admissibility abroad. Within this context, participants will be aware of the current legal landscape of EU cross border evidence and different regimes for the obtaining of evidence based upon Mutual Legal Assistance and Mutual Recognition Principle.

DESCRIPTIONThe added value of the two day-long training consist of delivering in-depth insights on highly specialized topics pertaining to diversified aspects of Cross-border Insolvency.

Cross-border insolvency (sometimes called international insolvency) regulates the treatment of financially distressed debtors where such debtors have assets or creditors in more than one country. Typically, cross-border insolvency is more concerned with the insolvency of companies which operate in more than one country rather than the bankruptcy of individuals. Like traditional conflict of laws rules, cross-border insolvency focuses upon three areas: choice of law rules, jurisdiction rules and enforcement of judgment rules. However, in relation to insolvency, the principal focus tends to be the recognition of foreign insolvency officials and their powers. The training will be carried out by leading academics and practitioners, expert speakers will be called to expand upon such aspects as jurisdiction, applicable law, EU instruments, recognition and enforcement of decisions and cooperation in matters relating to the subjects of the seminar. DESCRIPTIONDay-and-a-half training aimed at offering a better understanding and providing an overview of criminal defense rights under EU law through a set of Directives designed to strengthen procedural safeguards (interpretation and translation, information, access to a lawyer, presumption of innocence, children’s rights and legal aid). This training, particularly focused on the most recent Directives on presumption of innocence and legal aid, will combine presentations and key notes on EU procedural rights and ECHR and CJEU case-law. The structure of the seminars is aimed at requesting significant interaction among practitioners though practical workshops and plenary briefings directed by leading experts.

The training will serve as a forum for the exchange of knowledge and best practices between judges and prosecutors who will be called to resolve the challenges posed by the Directives. DESCRIPTION:Two-days-and-a-half training based on a ‘learn-by-doing’ methodology. Judges and prosecutors from three different EU Member States will be involved in a simulation of the different stages of a case related to protection of the financial interests of the EU, inspired by real facts and involving both national and cross-border judicial cooperation. This training will require strong interaction between the participants forming the 3 different national Core Groups. Participants will comment on the practical cases according to their national legal systems and, most importantly, learn about their colleagues’ systems in counterpart Member States. The simulation will call for the use of EU instruments of mutual legal assistance and recognition, in particular, Freezing Orders (FO), the European Arrest Warrant (EAW), and Mutual Legal Assistance (MLA) requests, role of the EPPO. Participants will be assisted by international and national experts, EJN contact points and EUROJUST representatives. The training will include presentations on the role of the EJN and EUROJUST in judicial cooperation in criminal matters, as well as a framework lecture on the topic of the training’s practical case.

DESCRIPTIONThe protection of EU public money against all forms of criminal conduct, including fraud and the effective and equivalent legal action throughout the Union has to become a priority for the national authorities. To investigate, prosecute and bring to justice those who commit criminal offences affecting the Union’s financial interests is a key goal where judicial training has a role to play. For the first time, the EJTN is organizing a seminar to make judges and prosecutors aware on how to counter all forms of illegal activity affecting the EU financial interests and to detect the misuse of the EU budget.

Day-and-a-half training aimed at providing the participants with the information on international legal framework with regard to protection of EU financial interests and measures taken at EU level to protect the EU’s financial interests. The role of the European Anti-Fraud Office (OLAF) especially in those cases with a cross-border dimension and the new Regulation setting up a European Public Prosecutor’s Office will be examined in the seminar. The training will combine lectures, presentations and workshops with study cases to enhance practical knowledge of practitioners in order to achieve effective investigations and prosecutions of offences affecting the Union’s financial interests.

DESCRIPTION: This 2-day training aims at creating a platform to address cultural (including religious) diversity and the challenges it poses to judicial institutions (prosecutors as well as judges) throughout Europe today. It follows a survey conducted among judges from 14 European countries by the European Network of Councils of the Judiciary (ENCJ) in cooperation with the Law & Anthropology Department of the Max Planck Institute for Social Anthropology.

The training addresses two dimensions: Judges will be given a key role in discussing selected cases in-depth and they will be given the opportunity to do so in the presence of socio-cultural anthropologists. The latter act as expert bystanders providing additional input. The cases selected will cover four areas: labor law (diversity in the workplace); family law (application of foreign personal statuses); asylum (how to assess cases of persecution), and criminal law (i.a. cultural defense).

The learning objective of this training is an increased awareness and sensitivity to take account of cultural diversity. Participants will learn how to access relevant sources of information/expertise on issues of cultural diversity and gained familiarity with a range of techniques that facilitate reflection on and taking account of cultural diversity in their individual decision-making processes.

Judges and prosecutors from three different EU Member States will be involved in a simulation of the different stages of a drug and weapons trafficking case, inspired by real facts and involving both national and cross-border judicial cooperation. This training will require strong interaction between the participants forming the 3 different national Core Groups. Participants will comment on the practical cases according to their national legal systems and, most importantly, learn about their colleagues’ systems in counterpart Member States. The simulation will call for the use of EU instruments of mutual legal assistance and recognition, in particular, Freezing Orders (FO), the European Arrest Warrant (EAW), and Mutual Legal Assistance (MLA) requests. DESCRIPTIONIn cooperation with the CEPOL, the EJTN funds the annual participation of judges and prosecutors from the different EU Member States to CEPOL’s seminars on Join Investigation Teams, aiming at fostering a greater cooperation and information-exchange between magistrates and law enforcement officers at the EU level. DESCRIPTION:This joint CEPOL-EJTN training will bring together prosecutors and senior police officers from different EU MS with the aim to reinforce cooperation in cross-border financial cases, to strengthen multidisciplinary cooperation about financial investigations between law enforcement and judicial authorities; to enhance knowledge on gathering evidence through financial investigations; to improve asset tracing and asset recovery.

TARGET GROUP:

Law enforcement officials (funded by CEPOL) and judges/prosecutors (involved in cases with financial investigations

(funded by the EJTN). The aim, target group and the specific learning outcomes shall be developed in close cooperation

CEPOL-EJTN to comply with the requirements set as follows:

• Understand the impact of underground banking, the use of virtual currencies and new technologies (TORnet, Darknet)

on financial investigations

• Exchange best practices on law enforcement and judicial cooperation in (cross-border) financial investigations, through

the review of concrete practical cases.

• Identify opportunities for financial investigations, e.g. large banking frauds, investment frauds

• Understand forensic financial analysis, risk analysis and profiling

• Discuss asset identification, valuation and investigative measures

• Explain national and international structures in place for financial investigation assistance

• Present non-conviction measures

• Understand the role of various international actors, such as Europol, Eurojust as well as OLAF and networks such as FIU,

CARIN, the Egmont Group and ALEFA

To incorporate financial investigations into Trafficking in Human Beings (THB) investigations by improving the cooperation

between THB investigators and specialists on financial investigations. To use multidisciplinary, alternative and complementary

approaches pro-actively in addressing THB by enhancing online modus operandi and financial investigation aspects.

• Demonstrate benefits of financial investigations in the context of THB
