ORDINANCE NO. P 8-2012

AN ORDINANCE OF THE TOWNSHIP OF HAVERFORD, COUNTY OF DELAWARE, COMMONWEALTH OF PENNSYLVANIA, REVISING THE GENERAL LAWS OF THE TOWNSHIP OF HAVERFORD, ORDINANCE 1960, AS AMENDED, CHAPTER 169, TRAFFIC CALMING DEVICES, BY FURTHER AMENDING SECTION 169-5, CRITERIA.

BE IT ENACTED AND ORDAINED by the Board of Commissioners of the Township of Haverford, County of Delaware, Commonwealth of Pennsylvania, and it is hereby enacted and ordained by the authority of the same:

ARTICLE I. TEXT AMENDMENT

Ordinance 1960, Chapter 169, Traffic Calming Devices, §169-5, Criteria, further subsections F and G, is hereby amended to read as follows:

F. The distance between speed humps shall be not less than JOO 250 nor greater than 600 feet apart. However, should an intersection controlled by a stop sign or yield sign be located on the affected roadway, the distance between humps may exceed 600 feet. The existing stop sign or yield sign may be reevaluated to see if it continues to meet the warrants of the Commonwealth of Pennsylvania after the installation of humps. G. Speed humps shall not be less than JOO 150 feet from an intersection roadway or within 300 feet of a signalized intersection.

ARTICLE II. REPEALER Any ordinance or part of an ordinance to the extent that it is inconsistent herewith is hereby repealed.

AN ORDINANCE OF THE TOWNSIDP OF HAVERFORD, COUNTY OF DELAWARE, COMMONWEALTH OF PENNSYLVANIA, FURTHER AMENDING AND SUPPLEMENTING ORDINANCE NO. 1960, ADOPTED JUNE 30, 1986, AND KNOWN AS "GENERAL LAWS OF THE TOWNSIDP OF HAVERFORD" CHAPTER 175, VEIDCLES AND TRAFFIC.

BE IT ENACTED AND ORDAINED by the Board of Commissioners of the Township of Haverford, County of Delaware, Commonwealth of Pennsylvania, and it is hereby enacted and ordained by the authority of the same:

SECTION 1. That Section 175-28 PARKING OF TRUCKS OR COMMERCIAL VEIDCLES PROBHIBITED AT ALL TIMES

In the 2400 block of Merwood Lane from East Eagle Road to Cherry Lane.

SECTION 2. That Section 175-95- SPECIAL PURPOSES PARKING ZONES:

On Myrtle Road (between E. Manoa and Ashurst.

SECTION 3. Upon effective date of this ordinance, the Highway Department shall install appropriate signs in the designated section or zones giving notice of the regulations aforesaid.

SECTION 4. Any ordinance or part of an ordinance to the extent that it is inconsistent herewith is hereby repealed.

RESOLUTION NO. 1848-2012

WHEREAS, the Minor Subdivision/Reverse Subdivision Plan for Angela C. O'Donnell, 207 Hastings Avenue, Haverford Township, Delaware County, and known as D.C. Folio Nos. 22-03-01173-00 and 22-03-0117 4-00 has been submitted to transfer 1 ,250 square feet to the property located at 201 Hastings Avenue, Haverford Township, Delaware County and known as D.C. Folio No. 22-03-01172-00. The subject properties are zoned R-6 Residential District, and are located in the 3rd Ward. The aforesaid plans were prepared by H. Gilroy Damon, Associates, Inc., Sharon Hill, PA, dated February 20, 2012; and

WHEREAS, the Planning Commission of Haverford Township at the public meeting of Thursday, March 8, 2012, did vote to recommend approval of the plans subject to the following:

A. Applicant must install concrete markers at all property corners and angle pointes along the proposed lot line. All monuments, both found and to be set, should be indicated on the final plan. (§160-5.B(8) of the General Laws of the Township of Haverford)

B. The Planning Commission recommends that the following waivers be granted by the Board of Commissioners:

1. from the requirement to depict two (2) foot contours to be indicated (§160-4.G(2)(b)) and 2. from the requirement to indicate soil data (§160-4.G(2)(c) of the General Laws of the Township of Haverford.)

C. A Signature block should be provided for the Township Planning Commission, and a separate signature block for the Township Engineer's signature (§160-4.H(1)(e) of the General Laws of the Township of Haverford.)

WHEREAS, said plans have been submitted before the Board of Commissioners of the Township of Haverford for consideration in accordance with the Pennsylvania Municipalities Planning Code, Act 247, as amended, and pursuant to the Haverford Township Subdivision and Land Development Regulations, Ordinance 1960, Chapter 160, Sections 4. A and B.

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Township of Haverford, County of Delaware, Commonwealth of Pennsylvania, that the recommendations and findings of the Planning Commission are hereby adopted and Minor Subdivision/Reverse Subdivision Plan for Angela C. O'Donnell, 207 Hastings Avenue, Haverford Township, Delaware County, dated February 20, 2012, is approved subject to compliance with the recommendations described hereinabove.

RESOLUTION NO. 1850-2012 RESOLUTION OF THE BOARD OF COMMISSIONERS

OF THE TOWNSHIP OF HAVERFORD WITH RESPECT TO THE COMMUNITY DEVELOPMENT PROGRAM

WHEREAS, Haverford Township, as a recipient of Federal funds from various funding sources, has

an obligation to affirmatively further Fair Housing; and

WHEREAS, this obligation entails:

a) eliminating housing discrimination; b) promoting fair housing choice for all persons; c) providing opportunities for racially and ethnically inclusive patterns of housing

occupancy; d) promoting housing that is physically accessible to, and usable by, all persons,

particularly those with disabilities; and e) fostering compliance with the nondiscrimination provisions of the Fair Housing Act; and

WHEREAS, Haverford Township has prepared an analysis to identify impediments to fair housing choice and determined on the basis of the data that no impediments exist; and

WHEREAS, Haverford Township has taken positive steps to comply with the spirit and letter of the law, through its operation and support of various programs;

NOW, THEREFORE BE IT RESOLVED by the Board of Commissioners of the Township of Haverford:

1 . That April is designated Fair Housing month.

2. That all employees and officers are directed to continue to promulgate fair housing

objectives and continue to assist all persons who may fall within the scope of the Fair

Housing Act.

SCOPE OF COVERAGE

SELECT SERVICE MAINTENANCE PROGRAM

Routine maintenance inspections are performed throughout the year. The Schedules of Maintenance Form provides a summary of the schedules and types of inspections. Preventative maintenance inspections are designed to reduce the overall life cycle cost ofthe HVAC equipment through improved operating efficiencies and the reduction of downtime and repairs.

EMERGENCY SERVICE

Emergency service and repairs are available on a 24-hour-per-day basis and will be invoiced at the prevailing straight-time or overtime rate. Emergency calls shall be placed by dialing our 24/7 emergency service line at 610-962-1650.

REPLACEMENT PARTS AND COMPONENTS

• Filter changes are included in this agreement and shall be provided by Tozour-Trane on a quarterly basis.

• Belts are not included in this agreement and shall be provided by the customer.

• Tozour-Trane shall provide all necessary materials for annual condenser cleaning. • All parts and materials necessary for repairs are not included and shall be invoiced accordingly. As a contract

customer, Haverford Township shall receive 15% off of list price on all parts purchased through Tozour­Trane Parts and Supplies

• Refrigerant is not included in this contract and shall be invoiced upon use unless provided by customer.

WRITTEN REPORTS

Written reports will be provided to the customer representative following each regular inspection or emergency call. The customer shall be provided online access to work orders and shall receive training on Dispatch Me Now, our online work order website.

This contract includes preferential service to the customer over non·contract customers. For work outside the scope of service, the specified contract rate applies. The current contract customer rates are as follows.

COOLING SEASON STARTUP/ CHECK OUT PROCEDURE

1. Verify the operation of the oil heater. 2. Check oil level. 3. Verify full water systems, including the cooling tower, the condenser, and the evaporator.

4. Verify clean cooling tower and strainers. 5. Start the condenser water pump, the chilled water pump, and the cooling tower fan(s).

6. Test all flow-proving devices on the chilled water and the condenser water circuits.

7. Verify the flow rates through the condenser and the evaporator.

8. Start the chiller. 9. Verify the starter operation, amperage, and voltage. 10. Verify the operation of all timing devices. 11. Check the setpoint and sensitivity of the temperature control. Verify the operation.

12. Verify the operation of the current control device. 13. Check the setpoint and sensitivity of the chilled water temperature control device. Verify the operation.

14. Verify the operation of the condenser water temperature control device.

15. Test the high condenser pressure safety device. 16. Test the low refrigerant temperature safety device. 17. Verify the operation of the "load" and the "unload" solenoid valves.

18. Verify the operation of the capacity control slide valve. 19. Verify the operation of the electronic expansion valve (RTHB only).

6. Review operating procedures with operating personnel. 7. Provide a written report of completed work, operating log, and indicate any uncorrected deficiencies

detected.

1. General Assembly a) Leak-test the chiller and report the leak check results. b) Repair minor leaks as required (e.g. valve packing, flare nuts). c) Calculate refrigerant loss rate and report to customer. d) Visually inspect condenser tubes for cleanliness.

2. Controls and Safeties a) Inspect the control panel for cleanliness. b) Inspect wiring and connections for tightness and signs of overheating and discoloration. c) Verify all settings in the electronic control panel. d) Test the low oil pressure safety device. Calibrate and record setting .. e) Test the high motor temperature safety device. Calibrate and record setting. f) Test the operation of the chilled water pump and condenser water pump starter auxiliary

contacts. g) Verify the setting of the current control device.

3. Lubrication System a) Pull oil sample for spectroscopic analysis. b) Test the oil for acid content and discoloration. Make recommendations to the customer based on the

results of the test. c) Change the oil filter. d) Verify the operation of the oil heater. Measure amps and volts and compare the readings with

the watt rating of the heater. 4. Motor and Starter

a) Clean the starter and cabinet. b) Inspect wiring and connections for tightness and signs of overheating and discoloration. c) Check tightness of motor terminal connections. d) Check condition of the contacts for wear and pitting. e) Check contactors for free and smooth operation. f) Check the mechanical linkages for wear, security and clearances. g) Meg the motor and record the readings. h) Verify the operation of the electrical interlocks. i) Measure voltage and record. Voltage should be nominal voltage ±10%.

WATER-COOLED CONDENSERS BRUSH TUBES

g) Verify clean condensate pan. h) Verify proper operation of the condensate drain. i) Verify clean air filters. j) Verify clean coils. k) Verify proper operation of the spray pump, if applicable.

I) Verify smooth fan operation. m) Log operating conditions after system has stabilized. n) Provide a written report of completed work, operating log, and indicate any uncorrected deficiencies

a) Lubricate the fan shaft bearings, if applicable. b) Lubricate the motor bearings, if applicable.

3. Controls and Safeties a) Test the operation of the low temperature safety device, if applicable.

b) Test the operation of the high static pressure safety device, if applicable.

c) Test the operation of the low static pressure safety device, if applicable.

d) Check the thermal cutout on electric heaters, if applicable.

e) Check the step controller, if applicable. f) Check and record supply air and control air pressure, if applicable.

g) Verify the operation of the control system and dampers while the fan is operating.

4. Motor and Starter a) Clean the starter and cabinet. b) Inspect the wiring and connections for tightness and signs of overheating and discoloration. This

includes wiring to the electric heat, if applicable. c) Check the condition of the contacts for wear and pitting.

d) Check the contactors for free and smooth operation. e) Meg the motor and record readings.

HEATING INSPECTION

1. Check the general condition of the fan. 2. Verify smooth fan operation. 3. Check and record supply and control air pressure, if applicable.

VARIABLE FREQUENCY DRIVES MAINTENANCE PROCEDURE

1. Report in with the Customer Representative. 2. Record and report abnormal conditions, measurements taken, etc. 3. Review customer logs with the customer for operational problems and trends. 4. Clean the heat sink. 5. Inspect wiring and connections for tightness and signs of overheating and discoloration. 6. Visually inspect panel for loose or damaged parts or wiring; also check for any accumulation of dirt and/or

moisture. 7. Verify proper operation of the unit. 8. Verify proper DC buss voltage.

PUMPS {CHILLED WATER & CONDENSER)

ANNUAL INSPECTION

1. Report in with the Customer Representative 2. Record and report abnormal conditions, measurements taken, etc. 3. Review customer logs with the customer for operational problems and trends.

1. General Assembly a) Check motor shaft and pump shaft for alignment, if applicable. b) Inspect the coupling for wear. c) Verify that the shaft guard is in place and tight, if applicable. d) Verify water flow through the pump. e) Check for leaks on the mechanical pump seals, if applicable. f) Verify proper drip rate on the pump seal packing, if applicable. g) Verify smooth operation of the pump.

PUMP RUN INSPECTION

1. Verify smooth operation of the pump. 2. Check for leaks on the mechanical pump seals, if applicable. 3. Verify proper drip rate on the pump seal packing, if applicable. 4. Provide a written report of completed work, operating log, and indicate any uncorrected deficiencies

detected.

BUILDING CONTROL SYSTEM

CONTROL PANEL MAINTENANCE INSPECTION

1. Report in with the Customer Representative. 2. Review customer reports with the customer for operational problems and trends.

1. Control Panel a) Verify secure connections on all internal wiring, LAN, and communication links. b) Check for loose or damaged parts or wiring. c) Check for any accumulation of dirt or moisture. Clean if required. d) Remove excessive dust from heat sink surfaces e) Verify proper system electrical grounding. f) Verify proper output voltages on control panel power supplies. g) Check LED Indications to verify proper operation of BCU transmit/receive activity on the ARCNET LAN. h) Verify LAN communications, if applicable, between work stations and BCU'S. i) Verify that cards are seated and secured. j) Check UCM wiring trunks and check for possible Error Code Indications k) Check voltage level of BCU Supercap. I) Verify the proper operation of critical control processes and points associated with this unit an make

adjustments if necessary. m) Check Volatile memory available n) Cheek Non volatile memory available

p) Dump the BCU System Diagnostic Array and Analyze

q) Run the BCU Mini-monitor for each BCU to check for any error statements and/or codes

r) Clean external surfaces of the panel enclosure.

t) Via PC work station, view the event log and input/output points for any unusual status or override

CONTROLS WORKSTATION MAINTENANCE INSPECTION

1. Contact appropriate customer personnel 2. Review Tracer for critical follow-up and off-line status indications, i.e. system error encountered items.

3. Review System Event Log with customer, discuss Tracer operational concerns.

4. Perform or schedule Corrective Maintenance procedures as appropriate to resolve situations noted in the

preceding reviews. 5. Install appropriate Software refinement and problem correction revisions as per this agreement.

Note: Revisions to other software programs not produced by The Trane Company are not included.

PERFORMANCE REPORTING

Tozour Trane will set up continuous trending via existing control panel. The trends will contain all available data

from each rooftop unit and will be collected once a week for analysis. The data will be scanned by our data

analyzer and a System Performance Engineer will write up a detailed analysis of the system's overall

performance. A performance report will be generated and sent to the township each month for review. Each

report will have operational suggestions and possible system adjustments or repairs that should to be made to

the systems to improve building comfort and operating efficiency.

Scope of work: • Performance Reporting for below equipment: I Alarm Monitoring 24/7 on:

o (1) Trane Chiller and associated pumps, (3) Air Handling units and Building Controls

• When an alarm condition occurs a systems engineer will investigate the system and make changes as

needed or dispatch a technician to make needed repairs on systems.

• Work with QAS to ensure accurate transmittal of data for on-site Kiosks

PRICING AND ACCEPTANCE

Tozour-Trane Service Agreement

Tozour-Trane agrees to inspect, and maintain the equipment listed under the "Equipment Coverage" section

hereof (the "Equipment") according to the terms of this Service Agreement, including the "Terms and

Conditions" and "Scope of Coverage" sections hereof. Tozour-Trane agrees to give preferential service to

Customer over non-contract customers.

Service Fee Customer agrees to pay the annual fee as shown below over the 3 year(s) of this Agreement, payable in

quarterly installments not including tax to Tozour-Trane as the fee (the "Service Fee") for the inspection,

maintenance and repair services described in the Scope of Coverage section hereof with respect to the

Equipment. The Service Fee is subject to adjustment as provided in the Terms and Conditions.

GENERAL TERMS AND CONDITIONS

Payment shall be due in advance upon receipt of invoice. If the account

is delinquent by 30 days, Tozour-Trane reseiVes the right to withhold

seiVice until the account is current. Continued delinquency is grounds for termination of this agreement.

Preferred seiVice contract rates shall apply to all work beyond the scope

of this agreement.

All inspections and repairs will be performed during our regular working

hours which are Monday through Friday from 8:00 A.M. to 4:30 P.M.

unless otherwise stated. If for any reason we are requested to do work beyond our regular working hours, you agree to pay the overtime labor

unless otherwise stated in this agreement.

As a courtesy, any proposed changes in equipment operation or

proposed modifications to the equipment shall be reviewed with a representative ofTozour-Trane.

5. We shall carry workmen's compensation and liability insurance and will

furnish certificates of insurance upon request.

6. We shall not be responsible for the day-to-day operation of the equipment nor liable for injuries to person or damage to property except

where directly due to the negligent acts of our employees. In no event

shall we be liable for consequential damages. We shall not be held liable for any loss or damage due to delay in furnishing labor or materials

caused by strikes or labor troubles affecting our employees who perform the seiVice called for hereunder, delays in transportation, delays caused

by priority or preference rights or orders or regulations established by

any government authority or by delay in procuring supplies or other cause reasonable beyond our control.

7. TOZOUR-TRANE MAKES NO REPRESENTATION OR WARRANTY, EXPRESS OR IMPLIED, REGARDING PREVENTION OF MOLD, FUNGUS,

BACTERIA, MICROBIAL GROWTH, OR ANY OTHER CONTAMINATES.

8. TOZOUR-TRANE DISCLAIMS ANY LIABILITY FOR DAMAGES OF ANY

KINO ARISING FROM MOLD, FUNGUS, BACTERIA, MICROBIAL

GROWTH, OR ANY OTHER CONTAMINATES

9. Tozour-Trane wilt not handle, remove or dispose of any material containing asbestos. If asbestos is present, it is the owner's

responsibility to have it removed by a qualified contractor.

10. Water-cooled equipment covered under this agreement must have

adequate water treatment by a qualified water treatment firm.

11. On Full Maintenance and Full Labor Contracts only, the integrity of the refrigerant side of the equipment and major bearing assemblies are

covered, provided that the manufacturer's recommended major internal

inspections and eddy current tube analyses are performed on schedule.

12. The following are not included in the base agreement.

•Painting.

• Pneumatic piping leaks. • Moving or relocating components or equipment.

• Providing access to equipment for removal and replacement of major

unit components. • Repairs due to freezing, corrosion, lightning, electrolytic action,

electrical distribution faults, phase loss or reversal, unless protected by Trane approved micro electronic control equipment.

•Addition or modifications required by insurance companies,

governmental or other authorities.

• Replacement of complete unit.

TRANE

• Electric wiring including control wiring, starters, disconnects or seiVice

breakers, not directly provided by the chiller manufacturer.

• Fan cabinets and ductwork. •Damage due to improper operation, misuse of equipment or damage

caused by fire or explosion.

• Damage caused by war, sabotage or insurrection.

• Tower fill, grillage, water piping, steam piping, drain piping, condenser and evaporator shell and tube failure, heat exchangers, boiler shell,

boiler tubes, boiler refractory, unless Tozour-Trane furnishes water

treatment seiVices on the equipment.

• Providing stationary or permanent structures, devices, etc. for rigging

purposes.

• Unless specifically listed elsewhere in this agreement, the following items are excluded: Compressors, rotating equipment, heat

exchangers, combustion chambers, refrigerant, electronic components and other accessories not an integral part of the

equipment listed on the equipment schedule. If during the term of this agreement any of these items require replacements and are

under the manufacturer's warranty, labor and material are included

on agreements with Full labor and Full Maintenance.

13. This agreement presupposes that all major pieces of equipment are in

proper operating condition at the signing of this agreement.

14. It shall be the responsibility ofTozour-Trane to make recommendations and to assist the Customer in restoring the equipment to proper

operating condition. However, all of the actual restoration costs shall be paid by the Customer.

15. After equipment restoration to original operating conditions has been approved byTozour-Trane, coverage will become effective in accordance

with the terms of this agreement.

16. Tozour-Trane reseruesthe right to cancel any agreement, with thirty (30) days written notice, and will refund any unused portion of the

agreement. If the customer wishes to cancel this multi-year agreement

prior to the end of the three year term, the following cancellation fee shall apply: $2,000.00 if cancelled prior to the end of year 2, or, $4000 if

cancelled prior to the end of year 3.

17. If during the term of this agreement labor rate adjustments are made,

not under the control ofTozour-Trane, these adjustments will be passed on to the customer at the discretion ofTozour-Trane

18. AUTOMATlC RENEWAL - This contract will automatically renew on the

anniversary date unless either party receives a written cancellation letter

30 days prior to the anniversary date. The term of the automatic renewal will be for (1) one year.

19. RENEWAL PRICE ADJUSTMENT- Tozour TRANE will provide Customer with

notice of any adjustments in the Agreement price applicable to a renewal period no later than forty-five (45) days prior to the commencement of

that renewal period. Unless the Customer terminates the Agreement as

provided in the Term/Automatic Renewal provision of this Agreement, the adjusted price shall be the price for the renewal period.

20. TOZOUR THANE EMPLOYEES- The Customer acknowledges that

TOZOUR TRANE's employees are a valuable asset to TOZOUR TRANE.

The Customer agrees to pay TOZOUR TRANE an amount equal to 12 months of salary for each TOZOUR TRANE employee who worked at the Customer's facility that is then hired by the Customer at any time

during the term of this Agreement and for 60 days thereafter. In

addition, the Customer agrees to reimburse TOZOUR TRANE for all

costs associated with any training TOZOUR TRANE provided to such employees during the three years before the date the Customer hires such employees

ORDINANCE NO. P 8-2012 AN ORDINANCE OF THE TOWNSHIP OF HAVERFORD, COUNTY OF DELAWARE, COMMONWEALTH OF PENNSYLVANIA, REVISING THE GENERAL LAWS OF THE TOWNSHIP OF HAVERFORD, ORDINANCE 1960, AS AMENDED, CHAPTER 169, TRAFFIC CALMING DEVICES, BY FURTHER AMENDING SECTION 169-5, CRITERIA. BE IT ENACTED AND ORDAINED by the Board of Commissioners of the Township of Haverford, County of Delaware, Commonwealth of Pennsylvania, and it is hereby enacted and ordained by the authority of the same:

ARTICLE I. TEXT AMENDMENT

Ordinance 1960, Chapter 169, Traffic Calming Devices, §169-5, Criteria, subsections A through K are hereby repealed and the following inserted in lieu thereof: A. Speed humps will not be installed on state roadways.

B. The legally posted speed limit on the street shall not exceed 25 miles per hour (mph).

C. The minimum length of the street, or portion thereof, measured from the nearest intersecting street, shall be at least 1,000 feet.

D. The average daily traffic (ADT) shall not be less than 1,000 vehicles per day, which shall be determined by a seven-day automated traffic count conducted by the Department's Traffic Safety Unit. Manual counts may be instituted at the Department's discretion. E. The average vehicle speed (based upon the 85th percentile of the speeds recorded during the traffic count) shall not be less than five mph over the legally posted speed limit, which shall be determined by a seven-day automated traffic count.

F. The Department will analyze the number of accidents on the affected roadway over the most recent three-year period to ascertain the extent to which excessive or unsafe speeds were a major contributing factor.

G. The distance between speed humps shall not be less than 250 or greater than 600 feet apart; provided, however, that should an intersection controlled by a stop sign or yield sign be located on the affected roadway, the distance between humps may exceed 600 feet. The existing stop sign or yield sign may be reevaluated to see if it continues to meet the warrants of the Commonwealth of Pennsylvania after the installation of humps.

H. Speed humps shall not be less than 150 feet from an intersecting roadway or within 250 feet of a signalized intersection.

I. Speed humps shall not be installed on hills or curves that could affect the safe control of vehicles.

J. Speed humps shall traverse the entire roadway, allowing one foot on each side for the flow of storm water.

K. Speed humps shall be no less than 12 feet in width.

L. Signs indicating HUMP shall be erected in each direction at the location of the hump and a sufficient distance before the hump to warn approaching motorists. For increased visibility, reflective stripes shall be painted on the humps.

M. Other traffic calming measures:

(1) Notwithstanding whether or not a petition has been submitted under §169-4.B, nothing herein shall limit the Township's right to unilaterally consider and install any traffic calming measures whatsoever, including but not limited to speed humps, bulb outs, chicanes, raised crosswalks, etc., as it may deem necessary to protect the health, safety, and welfare of a specific neighborhood or the public in general.

(2) This section shall apply to any street within the Township, especially streets where the Township determines there is a high concentration of pedestrian and vehicular traffic, such as those near schools, parks and recreation areas, churches, and business districts.

(3) The Township shall notify the residents and businesses on any streets for which such traffic calming measures are being considered to permit their input before such measures are approved and installed.

ARTICLE II. REPEALER Any ordinance or part of an ordinance to the extent that it is inconsistent herewith is hereby repealed. ADOPTED this day of ,2012.

RESOLUTION NO. _______-2012

WHEREAS, the Township of Haverford owns certain real property located at

2080 Old West Chester Pike (a/k/a 600 Glendale Road), Havertown, Delaware

County, and known as Delaware County Folio No. 22-09-02760-00 (the

“Township Property”).

WHEREAS, the Radnor-Haverford-Marple Sewer Authority is a duly authorized municipal

authority responsible for the conveyance of wastewater principally from the

municipalities of Radnor, Haverford and Marple; and

WHEREAS, the Radnor-Haverford-Marple Sewer Authority desires to engineer, construct

and install an equalization tank on the Township Property.

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Township of

Haverford, County of Delaware, Commonwealth of Pennsylvania, hereby

authorize, following approval by the Township Engineer and Solicitor, the

Township Manager to execute an easement to provide the Radnor-Haverford-

Marple Sewer Authority the authority to construct and install an equalization on

the Township Property.
