    After a DACA denial, take the following post-denial processing steps todetermine if NTA or other further action is required.

    DACA requestors cannot file a Motion to Reopen or Reconsider and canno t

    However, DACA requestors may requestreview of certain denials using the Service Request Management ToolSRMT) process if there is a claim that the denial was incorrect or the denial

    DACA Termination General Ineligibili tyIf removal under DACA was improperly deferred

    Reopen the case on Service Motion and issue a Notice of Intent toTerminate NOIT).

    The DACA requestor has 33 days to respond to the NOIT andprovide a brief or statement contesting the grounds cited in the intentto terminate.

    If the adverse grounds are not overcome, or no response is receivedto the NOIT, the officer should prepare a termination letter and seeksupervisory review of the draft termination letter prior to issuance.

    Adjudicating officers must ensure C3 is updated using the newly

    created HACs.

    DACA Termination Fraud or Misrepr esentatio n If an officer subsequently learns that a DACA requester committed

    fraud related td seeking the D C request, the officer should reopenthe case on Service Motion and issue a NOIT indicating the fraud/misrepresentation.

    The decision to issue a NOIT based on fraud should be supported bya fully documented Statement of Findings SOF) and any otherrelevant documents/information.

    The requester is allowed 33 days to respond .to the NOIT.

    If the adverse grounds are not overcome, or f O response is receivedto the NOIT, the officer should prepare a termination letter and seek

    supervisory review of the draft ermination letter prior to issuance.

    The terminated DACA case must be recorded in FDNS-DS.

    Adjudicating officers must ensure C3 is updated using the newlycreated HACs.

    Employment Authorization under D C

    The Secretary s memorandum provides that individuals whoseremoval has been deferred under D C may receive employmentauthorization.

    The .eligibility category for employment authorization based on a grantof deferred action is 8 CFR 27 4.12( c ) 14) and requires a showing of

    economic necessity.. . To identify DACA-related EADs, t ~ e c ) 3 3 )code will be used .

    D C requesters have been instructed to note the (c)(33) code on theirForm 1-765.

    The .EAD is predicated on deferred action under DACA. Therefore, the90-day EAD clock on the Form 1-765 begins after Form 1-821 D is

    approved.

    While it is contemplated that the same officer will routinelyadjudicate both Forms 1-821 D and 1-765 when that is not thecase and y ~are adjudicating only Form 1-765 review C3 toensure that there is no outstanding RFE and that Form 1-821 Dhas been approved.

    The RFtt would have been issued on Form 1-765 during thea .dj.udication of Form 1-821 D.

    An EAD based on deferred removal under D C requires a showing ofeconomic necessity.
