(i) वे �कसान िज) ह7ने फसल वष� 2017-18 के दौरान अफ2म पो� त क2 खेती क2 थी और उनके माफLन क2 औसत उपज 4.9 �क.Oा/ह.े या अफ2म क2 औसत उपज 52 �क.Oा/ह.े स ेकम नहR थी । �ट� प�ट� प�ट� प�ट� पणीणीणीणी :- 1. �ित ह,े टेयर �कOा म( माफLन के अवयव क2 औसत अह�क उपज को इस अिधसूचना म( एतिSमन पS चात् ) यूनतम अह�क उपज (एम,यूवाई-एम) कहा जाएगा।

2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 2. �ित ह,ेटेयर �कलोOाम म( �दए जाने वाले अफ2म क2 औसत अह�क उपज को इस अिधसूचना म( एतिSमन पUात )यूनतम अह�ता� उपज( एम,यूवाई) कहा जाएगा (ii) �कसान िज) ह7ने इससे संबंिधत �ावधान7 के अनुसार के) *ीय � वापक W यूरो क2 दखेरेख म( फसल वष� 2015-16, 2016-17 और 2017-18 के दौरान अपनी संपूण� पो� त क2 फसल क2 जुताई क2 हो, पर� तुपर� तुपर� तुपर� तु िज� ह�िज� ह�िज� ह�िज� ह�ने इसी तरह फसल वष" 2014ने इसी तरह फसल वष" 2014ने इसी तरह फसल वष" 2014ने इसी तरह फसल वष" 2014----15151515 के दौरान अपनी स* पूके दौरान अपनी स* पूके दौरान अपनी स* पूके दौरान अपनी स* पूण" पो� तण" पो� तण" पो� तण" पो� त फसल क- जुताई नह/ थी फसल क- जुताई नह/ थी फसल क- जुताई नह/ थी फसल क- जुताई नह/ थी । (iii) �कसान िजनक2 लाइस(स मंजूर न करने के िखलाफ अपील को फसल वष� 2017-18 म( िनपटान क2 अंितम तारीख के बाद अनुमित द ेदी गई हो। (iv) �कसान िज) ह7ने फसल वष� 2015-16 अथवा �कसी अगले वष� म( पो�ट क2 खेती क2 हो और जो अनुवत[ वष� म( लाइस(स के िलए पाI थ,े �क) तु �कसी कारणवश, � वेच् छा से लाइस(स �ा/ त न �कया हो अथवा, िज) ह7ने अनुवत[ फसल वष� म( लाइस(स �ा/ त करने के बाद �कसी कारणवश अफ2म पो� त क2 खेती वा� तव म( न क2 हो। (v) �कसान िजनको �क �कसी �दवंगत पाI �कसान ने फसल वष� 2017-18 के िलए फॉम� सं. 1 ( दखे( िनयम 7 ) के कॉलम 11 म( नािमत �कया गया हो 2 (क) उन �कसान7 के अलावा जो�क उपयु�H पैरा 2 के अनुसार अफ2म को खेती के िलए लाइस(स के पाI ह ̂, वे �कसान (उनके िविधक उ_रािधकारी भी) इसके िलए पाI ह7ग( िजनक7 फसल वष� 2004-05 से लेकर 2016-17 तक लाइस(स से वंिचत कर �दया गया था । बशत̀ �क वे िनaिलिखत शतb पूरी करते ह̂ (क) ऐसे �कसान के लाइस(स को िनa म( स े�कसी भी आधार पर रd न �कया गया हो :- (i) फसल वष� 2004-05 म( और उससे आगे भी लाइस(स �ाe fेI, 5 �ितशत क2 अितgर, त f�य सीमा तक,से अिधक fेI म( वा�तिवक hप से खेती कर रह ेह7 (ii) फसल वष� 2003-04 के दौरान और उसके आगे भी अपिमिjत अफ2म या घgटया �क�म के hप म( वग[कृत अफ2म क2 आपूmत क2 हो और सरकारी अफ2म एवं fारोध कारखाना नीमच/गाजीपुर म( �कए गए पgरfण के अनुसार उनम( माnकग क2 माIा 9 �ितशत स ेकम रही हो । (ख) ऐसे �कसान िज)ह7ने िपछले लगातार 5 वष> म( कुल एम,यूवाई ( अगले फसल वष� के िलए लाइस(स �दए जाने के िलए िनधा�gरत) के कुल औसत के बराबर या 100 �ितशत से अिधक क2 अफ2म क2 आपूmत क2 हो ऐसे 5 वष> म( वे वष� भी शािमल ह ̂ िजनम( लाइस(स रd �कए जाने के पहले के वष> म( औसत अफ2म क2 आपूmत क2 गई ह7 लाइस(स को िविधक उ_रािधकारी को अंतgरत �कए जाने के मामल7 म( �दवंगत कृषक +ारा �दए गए औसत पर भी दी गई अफ2म के कुल औसत क2 गणना करने म( िवचार �कया जाएगा । (ग) ऐस िविधक उ_रािधकारी िजनको क2 के)*ीय �वापक Wयूर7 के �कसी अिधकारी ने लाइस(स से मना न �कया हो और ऐसा लाइस(स को अंितम hप से पूण� माना गया हो । (घ) वष� 1997-98 के बाद से तथा लाइस(स का रd �कए जाने के पूव� तक कम से कम 5 वष� तक कृषक ने अफ2म दी हो । �प0ीकरण�प0ीकरण�प0ीकरण�प0ीकरण :::: पैरा 2 क के उdेSय के िलए 1. कुल एम,यूवाई क2 गणना के िलए य�द �कसी वष� के िलए एक से अिधक एम,यूवाई िनधा�gरत क2 जाती ह ैतो इनम( स ेजो सबसे कम एम,यूवाई होगी उसी पर िवचार �कया जाएगा बशत̀ क2 ऐसी एम,यूवाई( fितO�त fेI के िलए िनधा�gरत िवशेष एम,यूवाई से िभo ) को फसल वष� के चालू रहने के दौरान ही घोिषत �कया गया हो 2. इस 5 वष� क2 अविध म( ऐसा कोई वष� शािमल नहR �कया जाएगा िजनम( �कसी िवशेष कृषक को �कसी फसल वष� म( कम �कए गए एम,यूवाई का लाभ िमला हो

¹Hkkx IIµ[k.M 3(i) Hkkjr dk jkti=k % vlk/kj.k 3 2(ख) ऐसे कृषक भी (उनके िविधक उ_रािधकारी समते ) जो�क फसल वष� 1999-2000 स ेफसल वष� 2017-18 तक लाइस(स के पाI तो थे ले�कन उनको �कसी कारण से लाइस(स नहR िमल पाया था,अफ2म पो�ट क2 खेती लाइस(स के पाI ह7गे 2(ग) ऐसे कृषक (उनके िविधक उ_रािधकारी समेत) िजनके 01.04.2004 से फसल वष� 2014-15 तक लाइस(स को इस आधार पर रd कर �दया था �क उ)ह7ने CBN/NC के +ारा जारी �कए गए �कसी िवभागीय िनदश̀ का उ�लंघन �कया था, अफ2म पो�ट क2 खेती लाइस(स के पाI नहR ह7गे । 2(घ) ऐसे जीिवत कृषक भी (उनके िविधक उ_रािधकारी समेत), िज)ह7ने नीचे दशा�एं के अनुसार औसत अफ2म क2 आपूmत क2 थी,अफ2म पो�ट खेती लाइस(स के पाI ह7गे फसल वष� कम एम,यू वाई के लाइस(स को रd �कया जाने वाले वष� फसल वष� 2018- 19 म( �फर से लाइस(स �दए जाने के िलए िनधा�gरत एम,यूवाई मEय �दशे और राज�थान के िलए उ_र �दशे के िलए 1998-1999 1999-2000 40 से अिधक या उससे बराबर ले�कन 41 से कम 40 से अिधक या उससे बराबर ले�कन 41 से कम 1999-2000 2000-2001 48 से अिधक या उससे बराबर ले�कन 49 से कम 40 से अिधक या उससे बराबर ले�कन 41 स ेकम 2000-2001 2001-2002 50 से अिधक या उससे बराबर ले�कन 51 से कम 42 से अिधक या उससे बराबर ले�कन 43 स ेकम 2001-2002 2002-2003 50 से अिधक या उससे बराबर ले�कन 51 से कम 43 से अिधक या उससे बराबर ले�कन 44 स ेकम 2002-2003 2003-2004 51 से अिधक या उससे बराबर ले�कन 52 से कम 45 से अिधक या उससे बराबर ले�कन 46 स ेकम 2(ड.) मEय �दशे राqय के उन सभी गांव7 के वे कृषक ,िज)ह7ने फसल वष� 2013-14 म( अफ2म पो�ट क2 खेती क2 थी और फसल वष� 2013-14 म( िनधा�gरत औसत उपज से कम अफ2म क2 आपूmत �कए जाने के कारण अगले फसल वष� अथा�त 2014-15 म( लाइस(स को रd कर �दया गया था, अफ2म पो�ट क2 खेती के लाइस(स के पाI ह7गे बशत̀ �क (क) िजला �शासन ने फसल वष� 2013-14 म( उस गांव म( �ाकृितक आपदा के आने और उसके कारण फसल7 के fित होने क2 gरपोrटग क2 हो (ख) फसल वष� 2013-14 म( उस गांव म( अफ2म क2 औसत उपज फसल वष� 2012-13 म( उसी गांव क2 औसत उपज क2 तुलना म( कम रही हो ;और (ग) उसी गांव के 50 �ितशत से अिधक �कसान,िज)ह7ने फसल वष� 2013-14 म( अफ2म क2 आपूmत क2 थी, फसल वष� 2014-15 म( लाइस(स स ेवंिचत कर �दए गए थ;े बशत̀ �क ऐसे �कसी गांव म( जहां �क 10 �कसान7 न( फसल वष� 2013-14 म( अफ2म क2 आपूmत क2 थी, उपयु�H् 50 �ितशत के मानदडं के �थान पर 30 �ितशत कर �दया जाएगा 2(च) ऐसे �कसान भी,िजनके लाइस(स को फसल वष� 1999 और उससे आगे इस आधार पर रd कर �दया गया था �क उनको �कसी सfम )यायालय ने एनडीपीएस, 1985 और उसके अतंगत� बनाये गए �कसी िनयम7 के अतंग�त �कसी अपराध का दोषी पाया था, बशत̀ �क उनक �कसी िविधक )यायालय ने उसी मामले म( दोषमुH कर �दया हो और दोषमुH का ऐसा आदशे 31 जुलाई 2018 तक अंितम hप स ेपूण� हो गया हो,अफ2म पो�ट क2 खेती लाइस(स के पाI ह7गे

4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 2 (छ) ऐसे �कसान िजनके लाइस(स को फसल वष� 1999 से 2017 तक इस आधार पर रd कर �दया गया था �क उ)ह7ने घgटया अफ2म क2 आपूmत क2 थी ले�कन सरकारी अफ2म एवं fारोद कारखाना नीमच /गाजीपुर म( �कए गए परीfण के अनुसार उनके अफ2म म( मा:फन क2 माIा 9 �ितशत से अिधक थी, अफ2म पो�ट क2 खेती के पाI ह7गे 3.3.3.3. लाइस1स क- शत3लाइस1स क- शत3लाइस1स क- शत3लाइस1स क- शत3 �कसी भी �कसान को तब तक लाइस(स मंजूर नहR �कया जाएगा जब तक वह िन� निलिखत शत> को पूरा न करता हो/करती हो:- (i) उसने फसल वष� 2017-18 के दौरान पो� त क2 खेती के िलए लाइस(सशुदा वा� तिवक fेI से 5% f� य fेI से अिधक fेI म( खेती न क2 हो; (ii) उपयुH्� पैरा 2 आने वाल ेमामल7 को छोड़कर, उसने कभी भी अफ2म पो� त क2 अवैध खेती न क2 हो तथा � वापक औषिध तथा मन:�भावी *u य पदाथ� अिधिनयम, 1985 और उसके अंतग�त बनाये गए िनयम7 के अंतग�त उस पर �कसी अपराध के िलए �कसी सfम ) यायालय म( आरोप नहR लगा िसv �कया गया हो ; (iii) फसल वष� 2017-18 के दौरान उसने के) *ीय नाकwgट, स W यूरो/नाकwgट, स आयु, त +ारा �कसान7 को जारी �क) हR िवभागीय अनुदशे7 का उ� लंघन नहR �कया हो; 4.4.4.4. अिधकतम 5े� अिधकतम 5े� अिधकतम 5े� अिधकतम 5े� (i) सभी पाI �कसान7 को 10 एयर10 एयर10 एयर10 एयर के िलए लाइस(स �दया जाएगा।ऐसे �कसान लाइस(स �ाe fेI स े�कतने भी कम fेI म( खेती कर सकते ह̂। (ii) �कसान अिधकतम दोदोदोदो भूखंड7 म( अफ2म पो� त बो सकते ह;̂ (iii) य�द �कसान चाह( तो उनको दसूर7 के � वािमB व वाले भखंूड7 को पyे पर लेने क2 अनुमित दी जा सकती ह,ै ता�क उतनी जमीन पर खेती कर सक( िजतने के िलए लाइस(स �दया गया है। 5.5.5.5. पूव" चेतावनी पूव" चेतावनी पूव" चेतावनी पूव" चेतावनी (i) आने वाले वष� 2019-20 म( अफ2म पो� त क2 खेती के िलए लाइस(स �ा/ त करने क2 पाIता हतूे फसल वष� 2018-19के दौरान 5.9 5.9 5.9 5.9 7कलो8ाम7कलो8ाम7कलो8ाम7कलो8ाम माफ9न :ित हे; टेमाफ9न :ित हे; टेमाफ9न :ित हे; टेमाफ9न :ित हे; टेयरयरयरयर क2 ) यूनतम अह�क उपज दनेा जhरी ह।ै (ii) वष� 2018-19 के दौरान दी गई अफ2म म( माफLन क2 माIा को फसल वष� 2019-20 के भगुतान का आधार माना जा सकता ह ैऔर इसे ही य�द सरकार इस बारे म( िनण�य ले तो फसल वष� 2018-19 के िलए लाइस(स क2 पाIता भी माना जा सकता है;;;; (iii) ऐसे �कसान िज) ह7ने फसल वष� 2015-16, 2016-17 और 2017-18 के दौरान अपनी पूरी फसल क2 जुताई कर दी थी उनको फसल वष� 2019-20 के िलए लाइस(स का पाI नहR माना जाएगा, य�द वे फसल वष� 2018-19 म( भी पुन: अपने फसल7 क2 पूरी तरह जुताई कर दी हो। (iv) भिव;य म( य�द सरकार अितरकH लाइस(स दनेा चाहती ह ैतो वह उन �कसान7 के रd �कए गए लाइस(स को पुन: द ेसकती ह ैिज)ह7ने ऐसी अफ2म/मा:फन क2 आपूmत क2 थी िजनक2 लगातार 5 वष� म( कुल एम,यूवाई/एम,यूवाई-एम (अगले फसल वष� के िलए लाइस(स के िलए िनधा�gरत) के कुल 108 �ितशत के बराबर या उससे अिधक का कुल औसत था । (v) ऐसे �कसान फसल वष� 2018-19, 2019-20 और 2020-21 म( खेती �कए गए कुल fेI के 50 �ितशत स ेअिधक क2 अफ2म फसल पो�ट फसल क2 जुताई कर दी थी आने वाल ेफसल वष� अथा�त 2021-22 म( अफ2म पो�ट क2 खेती के लाइस(स के पाI नहR ह7गे 6.6.6.6. माफ- यो< यमाफ- यो< यमाफ- यो< यमाफ- यो< य सीमा सीमा सीमा सीमा य�द खेती �कया गया वा� तिवक fेI लाइस(सशुदा fेI से 5 �ितशत तक अिधक ह ैतो ऐसा अिधक fेI f� य हो सकता ह।ै

¹Hkkx IIµ[k.M 3(i) Hkkjr dk jkti=k % vlk/kj.k 5 7.7.7.7. िविवध िविवध िविवध िविवध (i) जो �कसान वष� 2018-19 के दौरान अफ2म पो� त क2 खेती अपने भ-ूखंड पर अथवा दसूर7 से पyे पर िलये गये भ-ूखंड पर करता ह,ै भ-ूखंड के � वामी का W यौरा, सव̀fण संz या और � वापक आयु, त +ारा िनदि̀शत अ) य W यौरा �दान करेगा। (ii) इन सामा) य लाइस({सग शत> से नाकwgट, स आयु, त/नाकwgट, स उपायु, त के �कसी भी लाइस(स को जारी करने/उस ेरोकने के अिधकार को उस ि� थित म( कोई fित नहR पFचंती जब कभी � वापक औषिध एवं मन:�भावी पदाथ� अिधिनयम, 1985 के उपबंध7 और उसके अंतग�त बनाए गए िनयम7 के अनुसार ऐसा करना ठीक समझा जाए। (iii) लाइस(स इस शत� पर �दया जाएगा �क �कसी भी खेत को सरकार +ारा अथवा सरकार +ारा िविश; ट सं� था अथवा एज(सी के साथ सहयोग करके �कये जाने वाल ेअनुसंधान के �योजनाथ� अिधगृिहत �कया जा सकता ह।ै िजस �कसान के खेत7 को अनुसंधान के िलए चुना जाएगा उसका अगले वष� लाइस(स मंजूर करने पर िवचार �कया जाएगा बशत̀ उसने िनधा�gरत ) यूनतम अह�क उपज �� तुत क2 हो और वह अ) यथा पाI हो। अनुसधंान हतूे चुने गए fेI को उपज क2 गणना करते समय लेखे म( नहR िलया जाएगा। (iv) लाइस(स इस अितgर, त शत� के अE यधीन होगा �क अफ2म को िनकाले िबना पो� त भूसी �ा/ त करने के िलए �कसी भी खेत को चुना जा सकता ह।ै िजन �कसान7 के खेत ऐसे उपयोग के िलए चुने जाएंगे वे अ) यथा पाI होने पर अगले फसल वष� के िलए लाइस(स के िलए पाI ह7गे। (v) �कसी �कसान +ारा स~पी गई अफ2म क2 माIा क2 गणना राजक2य अफ2म एवं fारोद काय�शाला, नीमच अथवा गाजीपुर म( �कए गए िवS लेषण7 के आधार पर 70 िडOी गाढ़ेपन पर क2 जाएगी। (vi) ऐसे �कसान िजनका �कसी िवशेष गांव म( अफ2म क2 खेती का लाइस(स ह ैले�कन वे पास के लगे दसूरे गांव के िनवासी ह ̂तो उनको अपने आवास पर अफ2म को इकटा करने क2 अनुमित होगी बशत̀ क2 ऐसी मानव व�ती और गांव के बीच लगातार आना जाना होता हो । (vii) नमुना लेने और अ)य मापन क2 �या, ल�बदार7 क2 िनयुिH आ�द स े संबंिधत �शासिनक िनद`श7 को ऐसे �याकलाप के काफ2 पूव� तथा अलग- अलग से जारी �कया जाएगा [फा. सं. 14011/01/2018-� वापक िनयंIण-I] टी. के. सB पथी, अवर सिचव

NOTIFICATION

New Delhi, the 28th September, 2018

No. 02/2018-Narcotics Control-1

G.S.R. 942(E).—In pursuance of rule 8 of the Narcotic Drugs and Psychotropic Substances Rules,

1985, the Central Government hereby notifies the general conditions for grant of license specified below for

cultivation of opium poppy on account of the Central Government during the Opium Crop Year Commencing

on the 1st day of October,2018 and ending with the 30

th day of September, 2019.

1. Place of Cultivation

Opium poppy cultivation may be licensed in any tract as may be notified in this behalf by the Central

Government.

2. Eligibility for Cultivation

Subject to clauses 3 and 7 of this notification, the following shall be eligible for a license to cultivate

opium poppy:

(i) Cultivators who had cultivated opium poppy during the crop year 2017-18 and tendered an

average yield of Morphine not less than 4.9 kg per hectare or 52 kg Opium per hectare. -

Note-

1. Average qualifying yield of Morphine in opium tendered in kilograms per hectare will

be termed as Minimum Qualifying Yield (MQY-M) in the notification hereinafter.

2. Average qualifying yield of opium tendered in kilograms per hectare will be termed as

Minimum Qualifying Yield (MQY) in the notification hereinafter.

(ii) Cultivators who ploughed back their entire poppy crop cultivated during the crop year

2015-16, 2016-17 & 2017-18 under the supervision of the Central Bureau of Narcotics in

accordance with the provisions in this regard, but had not similarly ploughed back their

entire poppy crop during 2014-15.

(iii) Cultivators whose appeal against refusal of License has been allowed after the last date of

settlement in the crop year 2017-18.

(iv) Cultivators who cultivated opium poppy in the crop year 2015-16 or during any subsequent

crop year and were eligible for a license in the following crop year, but did not voluntarily

obtain a license for any reason, or who after having obtained a license for the following crop

year, did not actually cultivate opium poppy due to any reason.

(v) Cultivators who is nominated by deceased eligible cultivator in column No. 11 in Form No. 1

(see rule 7) for the crop year 2017-18.

2A. In addition to cultivators eligible for license to cultivate opium poppy in terms of Para 2 above,

Cultivators (including their legal heirs) who were de-licensed in the crop year 2004-05 onwards till crop

year 2016-17 provided they fulfill the following conditions shall also be eligible for a license to

cultivate opium poppy:

(a) The cultivator should not have been de-licensed on any of the grounds mentioned: -

(i) Of actually cultivating in an area exceeding the area licensed for poppy cultivation during

the crop year 2004-05 or onwards beyond the 5% ‘Condonable Limit’ allowed in the

licensing policy.

(ii) Of tendering adulterated opium or opium classified as ‘inferior opium’ having Morphine

Content less than 9% in the test results by the Government Opium and Alkaloid Works,

Neemuch/ Ghazipur during crop year 2003-04 or onwards.

(b) Cultivators who have tendered opium having total average equal to or more than 100 percent of the total of MQY (fixed for licensing in the next crop year) for last five consecutive tendered

years. Such five years would include average opium tendered in the year/ years before year/

years of such de-licensing. In case of transfer of license to legal heir, average tendering by

deceased cultivators would be taken into account for computation of total of averages of opium

tendered.

(c) Legal heirs who has not been refused license by any officer of Central Bureau of Narcotics and such order has since become final.

(d) Cultivator should have tendered opium for minimum of five years after crop year 1997-98 before being de-licensed.

Explanation: - For the purpose of Para 2A

1. If more than one MQY has been fixed for a crop year, then for the purpose of calculating total MQY, the MQY which is least of such MQY shall be considered, provided such least MQY

(other than special MQY for damage area) has been declared under the currency of that crop

year.

2. The period of 5 years shall not include any year in which a particular cultivator availed the benefit of reduced MQY in any crop year.

2B. Cultivators (including their legal heirs) who were eligible for license starting from crop year 1999-2000

till crop year 2017-18 but did not obtain the same till date for any reason, shall also be eligible for a

license to cultivate opium poppy.

2C. Cultivators (including their legal heirs) who were de-licensed on or after 01.04.2004 till crop year 2014-

15 on the ground of violating any departmental instruction issued by CBN/ NC, shall also be eligible for

a license to cultivate opium poppy.

2D Living cultivators (excluding legal heirs) who tendered average opium as indicated below, shall also be

eligible for a license to cultivate opium poppy :-

2E. Cultivators of all those villages in the State of M.P. who cultivated opium poppy in the crop year 2013-

14 and got de-licensed in the subsequent crop year, namely 2014-15 for tendering opium below the

stipulated average yield of the crop year 2013-14, shall also be eligible for a license to cultivate opium

poppy, if:-

(a) Natural calamity and resultant crop damage had been reported by the District Administration in

that village in the crop year 2013-14; and

(b) The average yield of opium in that village in the crop year 2013-14 had gone down when

compared to the average yield of that village in the crop year 2012-13, and

(c) More than 50% of the cultivators in that village who tendered opium in the crop year 2013-14 got

de-licensed in the crop year 2014-15:

Provided that in a village where less than 10 cultivators tendered opium in the crop year 2013-14, the

percentage criteria of 50% mentioned above shall be substituted as “30%”.

2F. Cultivators who were de-licensed during the crop year 1999 or onwards on the ground of charge in any

competent court for any offence under NDPS Act, 1985 and the Rules made there under provided that

they have been acquitted by the competent court of Law in said case/ cases and such order of acquittal

has become final as on 31st July, 2018, shall also be eligible for a license to cultivate opium poppy.

2G. Cultivators who were de-licensed during crop year 1999 to 2017 on the grounds of tendering inferior

opium but their morphine content was found more than 9% in the test results of the Government Opium

Alkaloid Works at Neemuch or Ghazipur, shall also be eligible for a license to cultivate opium poppy.

3. Conditions of License

No cultivator shall be granted license unless he/she satisfies that:

(i) He/She did not, in the course of actual cultivation, exceed the area licensed for poppy

cultivation during the crop year 2017-18 beyond the 5% ‘Condonable Limit’ allowed in the

licensing policy.

(ii) He/she did not at any time resort to illicit cultivation of opium poppy and was not charged in

any competent court for any offence under the Narcotic Drugs and Psychotropic Substances Act, 1985, and the Rules made there under except cases covered under Para 2F above.

(iii) He/she did not during the crop year 2017-18 violate any departmental instructions issued by

the Central Bureau of Narcotics/ Narcotics Commissioner to the cultivators.

4. Maximum Area

(i) All eligible cultivators will be issued license for 10 Ares each. The cultivators can cultivate

in any area less than the licensed area.

(ii) Cultivators can sow opium poppy in not more than two plots.

(iii) Cultivators will be permitted to take on lease, land belonging to others, to make up the licensed

area, if they so desire.

5. Forewarning

(i) A minimum qualifying yield (MQY –M) of 5.9 Kg Morphine / Hectare of Morphine in

opium tendered should be achieved during the crop year 2018-19 to become eligible for a

license to cultivate opium poppy in the following year i.e. 2019-20.

(ii) Morphine content of opium tendered during 2018-19 may become the basis for payment for

the crop year 2018-19, if the Government decides to do so in this regard.

(iii) Cultivators who had fully ploughed back their entire poppy during crop year 2015-16, 2016-

17, and 2017-18 would not be entitled for license in the crop year 2019-20, if they also plough

back their crop fully in the crop year 2018-19.

(iv) In future, if Government intends to grant additional licenses, it may consider re-licensing of de-

licensed cultivators who had tendered opium/ Morphine having total average equal to or more

than 108 percent of the total of MQY/ MQY-M (fixed for licensing in the next crop year) for

last five consecutive tendered years.

(v) The cultivators who get their opium poppy crop ploughed back in excess of 50% of total of

areas cultivated during the crop years 2018-19, 2019-20 and 2020-21 may not be eligible for a

license to cultivate opium poppy in the following year i.e. 2021-22.

6. Condonable Limit:

If the area actually cultivated is up to 5% in excess of the licensed area, such excess cultivation maybe condoned.

7. Miscellaneous

(i) Any cultivator who cultivates opium poppy during 2018-19 in his own land or in the land

leased from others shall provide details of owner of the plot, survey number and any other

details as may be directed by the Narcotics Commissioner.

(ii) These General Licensing conditions are without prejudice to the right of the Narcotics

Commissioner/ Deputy Narcotics Commissioner to issue/ withhold a license whenever it is

deemed proper so to do in accordance with the provisions of the Narcotic Drugs &

Psychotropic Substances Act, 1985 and the Rules made thereunder.

(iii) The license will be subject to the condition that any field may be taken over for any research

that may be conducted by the Government directly or in collaboration with any specialized

Institution or Agency. The cultivator whose field is selected for research shall be considered

for license for the next year, if he has tendered the stipulated MQY and is otherwise eligible.

The area taken over for research will not be taken into account while calculating the yield.

(iv) The license shall be subject to the further condition that any field may be selected for obtaining

poppy straw without extraction of opium. The cultivators whose fields are selected for such

use shall be eligible for a license for the next crop year, if otherwise eligible.

(v) For the purpose of making payment of opium tendered by the cultivator, the quantity of opium

tendered by a farmer will be calculated at 70° consistency, on the basis of analysis by the

Government Opium and Alkaloid Works, Neemuch or Ghazipur.

(vi) In respect of cultivators having opium cultivation license in a particular village but are having

residence in adjacent village, such cultivators may be allowed to store opium in their residence,

provided that there is continuous human settlement between such villages.

(vii) The administrative instructions with respect to method of sampling and other weighment

operations, appointment of lambardars etc. will be issued separately well before

commencement of these operations.
