WAGE REQUIREMENTS AND BENEFIT AMOUNT INFORMATION

What are the wage requirements?Toqualifyforbenefits,youmusthavebeenpaidwagesforinsuredwork,forcivilianemploymentwiththefederalgovernment,orforactivedutyinthemilitaryserviceintwoormorequartersofyourbaseperiod.Wagesfromanotherstate(s)canbeusedto establish a combined wage claim.

How are benefit amounts calculated?• Yourweeklybenefitis1/26thofthewagespaidinthehighestquarterofyourbaseperiod,uptoamaximumamount

determinedbythestate’saverageweeklywage.Yourwagesinthishighquartermustbeatleast$728.• Also,yourwagesintheotherthreequartersofyourbaseperiodmustbeatleast20timesyourweeklybenefit.

Themaximumamountpayableinyourbenefityearisone-thirdofyourtotalbaseperiodwages,butnotmorethan26timesyourweeklybenefit.

What is the base period?Thefollowingchartscanbeusedtodeterminetheregularbaseperiodorthealternativebaseperiod.Theregular base period isthefirstfourofthelastfivecompletedcalendarquartersbeforetheeffectivedateofyournewclaimforunemploymentinsurancebenefits.

Ifyoufileanewclaim,andarenoteligibleusingtheregularbaseperiod,youmaybedeterminedmonetarilyeligibleunderanalternativebaseperiod that uses more recent wages.

There is also an alternate base period forpersonswhoarenotmonetarilyeligiblebecausetheyhavenotworkedforanextendedperiodduetoawork-related injury.Thisbaseperiodisthefirstfourofthelastfivecompletedcalendarquarterspriortotheinjuryandcanonlybeusedifaclaimisfiledwithin24monthsaftertheinjury.

Examples:IfyoufileyourclaiminMay,yourregularbaseperiodisthepreviousJanuarythroughDecember.However,ifnotmonetarilyeligibleusingtheregularbaseperiod,youralternativebaseperiodwouldbethepreviousAprilthroughMarch.

Each square represents a calendar quarter. The squares with regular borders designate the quarter during which the claim wasfiled.Thesquareswithstrongbordersdesignatethebaseperiodusedtoestablishtheclaim.

SEASONAL WAGESSeasonalwagesarewagesearnedwithanemployerwhocustomarilysuspendsoperationforaperiodoffivemonthsormorewithinacalendaryear.Tobeeligibleforaseasonaldesignation,anemployerrequeststhedesignationandthenmustbeapprovedbytheDepartmentofLaborandRegulation.

Seasonalwagesareusedtodetermineyourweeklybenefitamount.However,theonlytimeyoucandrawagainstseasonalwages is during the period the employer would normally be open for business.

Youarenotifiedonyourmonetarydeterminationifyouhaveseasonalwages.

How will I know if I meet the wage requirements?You will receive a monetarydeterminationindicatingyourweeklyandmaximumbenefitamounts.Thisdeterminationisusuallymailedwithinfivedaysafteryournewclaimisfiled.Missingwagesmaycauseadelayinthemailingofamonetarydetermination.

Thisisthefirststepindeterminingyoureligibility.Youmaybedisqualifieddependingonthereasonyoubecameunemployedoryoumaybedeniedbenefitsifyoudonotmeetothereligibilityrequirements.

Ifyouhavenotreceivedamonetarydeterminationaftertwoweeks(threeweeksforout-of-stateclaimants),youshouldcallCustomerServiceat605.626.2452.

What if I disagree with the monetary determination?Examineyourmonetarydeterminationcarefully.Ifyouthinkyouhavenotbeengivencreditforallwages:

• CallCustomerServiceat605.626.2452.• Requestare-determination.• Provideproofofyourwages(paycheckstubsorW-2forms).• Continuetofileyourweeklyrequestforpaymentunlessyoubecomeemployed.

Ifyoudonotagreewiththedetermination,youmayfileanappeal(seepage10).

Can I cancel my claim?Ifforsomereasonyouwanttocancelyourclaim,youhavefifteendaysfromthedatethemonetarydeterminationwasmailedtosubmitawrittenrequestforcancellation.However,youcannotcancelyourclaimafteradeterminationdisqualifyingyoufromreceivingbenefitshasbeenissued.

You must still meet all eligibility requirements for the non-paid waiting week.

calculatedbymultiplyingyourhourlyrateofpaytimesthenumberofhoursyouworkedduringtheclaimweek.• Reportthereasonablecashvalueofgoods(lodging,food,billpaid,etc.)receivedinsteadofwages.• Earningsthatmustbereportedalsoincludethingssuchasfeesreceivedbydirectorsofacorporation,feesorpayments

paidtopublicofficialsorbonuses.• Ifyouworkedbuthadnoearnings,wasitbecauseyouattemptedcommissionsales,wereself-employed,orhaveother

Do I have to register for work with the South Dakota Department of Labor and Regulation, or my designated state workforce agency?Allindividualsfilingforunemploymentinsurancebenefitsarerequiredtoberegisteredforworkandtoseekworkunless:

• Youhaveadefiniterecalldatetoreturntofull-timeworkwithanemployerwhopaid50percentormoreofyourbaseperiodwagesand,duetoweather-relatedseasonalfactors,workisnotavailableinyourprimarybase-periodoccupationandothersuitableworkisnotavailable,or

• Youareamemberingoodstandingwithareferringunionthroughwhichyounormallyobtainemployment,or• Youwillberecalledtofull-timeworkwithin10consecutiveweeksbyanemployer.

In-stateclaimantsareautomaticallyregisteredwithSDWORKSwhentheirunemploymentclaimwasfiled.Out-of-stateclaimantsarerequiredtoregisterwiththeirdesignatedstateworkforceagency,jobservice,workforcedevelopment,etc.

Do I have to look for work?Youmustactivelyseekworkwhilereceivingbenefits,startingwiththeweekinwhichyoufileyourclaim,unlessweinstructyouotherwise.Anactiveworksearchincludesthefollowing:

• Makingaminimumoftwojobcontactsineachweekyouarerequestingbenefits.Thisincludesthenon-paidwaitingweek.Theminimumnumberofjobcontactsrequiredmaybeincreaseddependingonthestatusofyourclaim.

• Contactsshouldbemadeusingamethodcustomarilyrequiredbytheemployer.Contactsbytelephonearenotvalid.• Yourworksearchmustbeareasonableandhonestefforttofindwork.Contactswithcloserelativesandspousesare

not considered reasonable. • Youmustbewillingtoacceptthegoingwageinyourareaforthejoboroccupationinwhichyouhavethemost

• Repeatjobcontactswiththesameemployerarenotacceptableunless30calendardayshaveelapsedbetweenthejobcontacts.

What if I am on recall?Ifwehaveverifiedwithyouremployerthatyouwillreturntoworkfull-time(andyoumeettheworkregistrationexemptioncriteriadescribedonpage7),youwillnotberequiredtomaketwojobcontactseachweek.Youwillberequiredtonotifyusimmediatelyofanychangeinyourrecallstatus.Ifyoudecidethatyouwillnotbereturningtoworkforthatemployer,youmustreopenyourclaimandbeginmakingtwojobcontacts.Ifyoudonotreturntoworkbythedateyouremployerprovidedus,andyouarestillgoingtobecalledbacktowork,youremployerwillberesponsibleforcontactingustoextendyourrecalldate.

What kind of record must I keep of my work search?Youwillberequiredtoprovideinformationonjobcontactswhenyoufileyourweeklyrequestforpayment.Keeprecordsofyourcontactswithenoughdetailssotheycanbeverified.Ifyouareapplyingforjobsontheinternet,itishelpfultokeepyoursentandreceivedemailsfromtheemployerandanyconfirmationnumbersthatarereceived.TheEmployerContactformsonpages16-19areavailableforyourconveniencetokeeparecordofyourjobcontacts.TheEmployerContactsformcanalsobefoundonlineatdlr.sd.gov/ui/uiforms.aspxtoprintadditionalpages.

Your work search contacts will be verified. Any individual who willfully or fraudulently misrepresents any fact concerning their work search will be denied benefits for four weeks for each week of misrepresentation. Also, any individual who falsifies job contacts, or dates of contacts, will be subject to a penalty of 50 percent of the amount of benefits obtained by fraud for the first offense and a 100 percent penalty for each subsequent offense.

What does it mean to be able to work?Tobeabletoworkyoumustbe:

• Physicallyandmentallyabletoworkinyourusualoccupationorinotherworkforwhichyouarereasonablyqualified.• Abletoworkthemajorityoftheweek(morethanthreedays).

What does it mean to be available for work?Evenifyouareabletowork,youarenotconsideredamemberofthelaborforceunlessyouarealso“willing”towork.

• Youmustbeavailableforfull-timework.Theremaybeanexceptionforanindividualwhoearnedbaseperiodwagesworkingpart-time.

• Theremustbenopersonalreasonspreventingyoufromacceptingajobimmediately(caringforchildren,lackoftransportation,vacation,etc.).

• Youmustnotplacerestrictionsontheworkyouwillaccept,makingthejobyouwantpracticallynon-existent.• Youmustbewillingtoacceptworkyouarequalifiedbyeducationandexperiencetoperform.• Ifyouworkinanoccupationwheredifferentshiftsarecommon,youmustbeavailabletoworkanyshiftunlessyou

havecompellingpersonalreasonsfornotworkingaparticularshift.• You must accept the going wage in your area. You cannot hold out for your last wage.

Your availability is questioned if you travel, are on vacation, care for relatives or others, are on a leave of absence, or are attending school or college.

What happens if I become incarcerated/imprisoned?YouwillberequiredtonotifyCustomerServiceat605.626.2452ifyoubecomeincarcerated.PaymentswillceaseuntilyounotifyCustomerServiceuponyourrelease.FailuretonotifyCustomerServicecouldresultinoverpaymentsandpenalties.

Can I go to school and still be eligible?Ifyouaregoingtoschoolandmeetallthenecessaryeligibilityrequirements,youmaybeeligibleforunemploymentbenefits.Ifyouarereceivingtrainingorattendingclasses,thisinformationmustbereported.Theinformationwillbereviewedtodetermineifyouareeligibleforunemploymentbenefits.

Ifyourequest,andareallowed,ApprovedTrainingstatus,youwillnotberequiredtolookforwork.ApprovedTrainingstatusisusuallygrantedifithasbeendeterminedthatyouneedfurthertrainingtore-enterthejobmarket.Thisstatusdoesnotextendthelengthofunemploymentbenefits.

You will still be required to file your weekly request for payment in order to receive payments.

DEDUCTIONS FROM BENEFITSCan I work part of the week and still be eligible for benefits?Youmaybeeligibleforpartialunemploymentbenefitsifyoucontinuetowork.Inordertobeeligibleforpartialbenefitsyoumustreportyourhoursandearningsforthecalendarweekwhichyouarefilingforandmakeanactivesearchforwork. Earningswillreduceyourbenefits.Seventy-fivepercentofearningsover$25willbedeductedfromyourweeklybenefitamount.

• Youwillnotbeeligibleforbenefitsifyourgrossearningsareequaltoormorethanyourweeklybenefitamount.• Youwillnotbeeligibleforbenefitsifyouworked40hoursormore,regardlessoftheamountofearnings.

What if I am self-employed or working on a commission basis?Youmustaccuratelyreportanyhoursandearnings(afterreasonableexpenses)fromself-employment.Self-employedmeansearningincomedirectlyfromyourownbusiness,trade,professionorserviceinsteadofwagesorearningsfromanemployer.Netincomeafterreasonable businessexpenseswillbedeductedfromyourbenefits.Expensesmustbereportedwithintheweektheyareincurred.YoumayrequestaformtoassistyouwithyourcalculationsbycontactingCustomerServiceat605.626.2452.Thefactthatyourbusinesshasno taxable income,orevenaloss,doesnotmeanhoursorearningsdonotneedtobereported.Forhelp,callCustomerServiceat605.626.2452.

Ifyoudosalesworkonacommissionbasis,thehoursyouworkeachweek,aswellasyourgrossearnings,mustbereported.Ifyouworkfulltime(40ormorehours),orearnmorethanyourweeklybenefitamount,youwillnotbeeligibleforbenefitsforthatweek.

What if my job ends?Ifatanytimeduringyourbenefityearyoureturntoworkandthenseparatefromajob,youmusteitherfileontheInternetatwww.sd.uiclaims.comorcalltheTelephoneClaimsCallCenterat605.626.3179immediatelytoreopenyourclaim.Youreligibilityforbenefitswillbebasedonthereasonyouseparatedfromtheemployment.

You must reopen your claim after any length of employment ends, even one day or less.

What types of payments are deductible from my benefits? Paymentsyoureceivearededucteddollar-for-dollarfromyourbenefitsbasedonyournormalhoursworkedinaweek.Deductiblepaymentsmustbereportedonyourweeklyrequestforpayment.IfyoureceivedalumpsumpaymentpriortoestablishingyourclaimyoumustreportittotheDepartment.Deductiblepaymentsinclude,butarenotlimitedto: •Vacationpay •Dismissalpay

Are pension benefits deductible?Pensions,annuitiesandretirementpayments,includinglumpsumpayments,aredeductibleifearnedwithabase period (seepage3)employer.Youmustprovidedetailedinformationaboutyourretirementplan,includingthenameandaddressoftheplanadministrator,aswellastheportionthattheemployercontributedtotheplan.Yourcontributionstotheplanarenotdeductible.Anychangeinyourpension,annuityorretirementshouldbereportedtoCustomerServiceat605.626.2452immediately.

Are Social Security benefits deductible?PrimarySocialSecurityretirementbenefitsbasedonyourearningsarenotdeductiblefromunemploymentinsurance.

Are disability payments deductible?Military-service-connecteddisabilitypaymentsarenotdeductiblefromyourbenefits.Temporarypartialworkers’compensationisdeductiblefromyourbenefits.

DISQUALIFYING CIRCUMSTANCES

What if I quit or was discharged from a job?Ifyouvoluntarilyquityourjobwithoutgoodcause,orweredischargedfromworkduetomisconduct,youmaybedisqualifiedfromreceivingunemploymentbenefits.Ifyouhavenotreportedthisseparation,youwillneedtoreopenyourclaimimmediately(Seepage5).

What if I am disqualified?Ifyouaredisqualified,youwillbedeniedbenefitsuntilyouhaveatleastsixcalendarweeksofinsuredemploymentduringyourcurrentbenefityear.Youmustearnwagesofatleastyourweeklybenefitamountineachofthoseweekstore-qualifyforbenefits.

AppealingDisqualificationsandDenialsWhat if I disagree with a disqualification or denial?Ifyoudisagreewithadetermination,youhavetherighttoappealthedetermination.Theappealmustbeinwriting. OVERPAYMENTS

youwereatfaultincausingtheoverpayment,interestof12percentperyearwillaccruebeginningwiththedateoftheover-paymentdetermination.Ifyouwerenotatfault,interestwillnotaccrueuntilsixmonthsafterthedeterminationdate.Failuretorepayyouroverpaymentmayresultinrecoveryoftheoverpaymentthroughcivilactionandgarnishmentofyourwages.Youmayrequestarepaymentagreementtorepaytheamountyouowe.

Can I still file for benefits if I have an overpayment?Youmaycontinuetofileyourweeklyrequestsforpayment.Anyfuturebenefitsforwhichyouwouldotherwisebeeligiblefor,maybeusedtooffsetorreducetheamountofyouroverpayment.

PENALTIES FOR MISREPRESENTATION(Fraud)

What if I misrepresent facts, make false statements, fail to disclose information or fail to report changes?Ifyoucommittedfraudtosecureorincreasebenefits,apenaltyof50percentoftheamountofbenefitsobtainedbyfraudisappliedforthefirstoffenseanda100percentpenaltyisappliedforeachsubsequentoffense.Afourweekadministrativepenaltyshallbeimposedforeachweekthatanindividualwillfullyorfraudulentlymisrepresentsafacttosecureorincreasebenefits.

Anindividualwhocommitsfraudwillberequiredtopaytheunemploymentinsurancebenefitsback.• Youwillberequiredtopayinterestof12percentperyear.Theinterestaccruesimmediately.• Youmaybedeniedfuturebenefitsupto52weeks.• Youmaybeconvictedofamisdemeanorandimprisoneduptooneyearinthecountyjail,orfinedupto$2,000,orboth.• Youmaybeconvictedofafelonyifyouunlawfullyobtainedmorethan$200,andimprisoneduptotwoyearsinthestate

penitentiary,orfinedupto$4,000,orboth.

What if I have an administrative penalty?Inordertosatisfythepenaltyyoushouldcontinuetofileyourweeklyrequestsforpayment.Alleligibilityrequirementsmustbemet.Youwillnotbepaidfortheseweeks,butwillreceivecredittowardsthepenalty.
