Ahh, February in South Dakota!

Our 2016 Legislative Reception is in the books! The event was held Monday evening, January 25th. This year we combined with the South Dakota Trucking Association to host the event. This was the first time that car dealers have combined with the South Dakota Trucking As-sociation for one reception. Everyone is reported

to have enjoyed themselves immensely! For all our fellow dealers across South Dakota, this is an opportunity to meet, greet, and just be nice to folks who represent us all for forty days each year.

A SDADA tradition for several years has been to print personalized stationary for each and every legislator. This stationary as well as a stuffed teddy bear from the SDTA was given to each legislator as thanks for their dedicated service. I can imagine there may be some smug snickering erupting. Let me say that our guests sin-cerely loved these sweet, stuffed toys as well as the personalized stationary! They were a joy to give and to receive.

While at the reception a Rotary pal of mine, Wayne Steinheuer of Sioux Falls called me over to his table. He introduced me to a fellow legislator, Thomas Holmes. As I turned to greet Tom he said, “You’re Bruce Eide.” Of course, I responded in the affirma-tive. Tom then went on to say, “You graduated from Washington High School in 1973.” A bit set back, I tried to identify this fel-low student. Then Tom really rocked my boat. He said, “I taught you American History - sixth period.” This fellow, whom I thought looked younger than me was a VERY fresh faced teacher indeed so many years ago. Tom then proceeded to look back in time and locate my seat in the classroom. Finally, he named classmates seated around me. So shocked was I at speaking with this person from my distant past that all I could do was apologize to him for any idiocy that I might have been a part of so long ago. As our legislators finally begin to address our issue of teacher pay, I am very much reminded of who our real heroes are.

President’s Message

Greetings from what I customarily call "Winter Camp" in Pierre for the 91st Session of the South Dakota Legislature. If you have been reading my weekly updates, you will already know this session is not much different from the past sessions. As far as the interests of the retail auto, RV, heavy truck and power sport in-dustry goes, I am basically doing damage con-trol. Since the 2015 Legislature imposed a fuel tax increase, there is little talk about repeating that move. This year, the money talk is focused

on expansion of Medicare, a 1/2 cent sales tax increase and some other ideas to fund teacher pay. Stay tuned, I will keep you informed on a weekly basis until the bitter end which does not come until March 29th. As always, if you wish to have "the rest of the story" on a bill or wish to voice your concern about a bill, please contact me. For a somewhat dated status on the bills being considered, please review that report contained in this publication.

Your SDADA Board of Directors Winter Meeting was held on the 26th of January with the usual lively discussion. As I reported in my January column, this year, the SDADA Legislative Reception was combined with the reception of your sister association, the South Dakota Trucking Association. This was a huge success with record attendance. I am quite sure we will continue with this combined reception. Not only is it good for legislators, it is also makes more economic sense for both groups. I received great feedback from truckers, auto dealers and legislators.

If you have not heard, Mr. Darrel Kaiser sold his dealership which created a vacancy in the SDADA Executive Committee. Plus, during this time of year we try to find another willing dealer to go through the chairs as terms expire. As always, the SDTA Nominating Committee went to work to recruit replacements. Please join me in congratulating Mr. Jim Burgess and Mr. Shawn Chase for their appointments to the Executive Committee. Welcome aboard Gentlemen!

The SDADA Board approved the proposed changes to the association bylaws. The main changes were to create three more director positions. Two for NextGen Dealers and one seat for a non-franchised dealer. My staff will be creating interest in serving cards after which we will assemble ballots and get these new positions filled. The board also asked me to prepare another change to the bylaws regarding who is eligible to serve on the SDADA Executive Board. Stay tuned for those changes. If anyone wishes to review the bylaws, they are on the SDADA Website or I can email a copy to you at anytime.

During the 1st Annual NextGen Dealer Summit held last August, I challenged the attendees to join me for a day in the state Capitol to observe how the South Dakota Legislature functions (or does not function). I am glad to report that one NextGen Dealer has already been there and there will be three more joining me in the next 5 weeks. A great move that guarantees the political viability of this association for the future.

NADA Director’s MessageIf you know me, you know of my interest in and passion for politics. I follow politics at all levels - whether local, state or national.

My affinity for politics is what initially drew my interest in NADA. I have had the opportunity to serve on the NADA Legislative Affairs Committee in six of my eight years on the board. I have enjoyed that work immensely and have learned a great deal from the NADA Legisla-tive Affairs staff.

NADA Chairman Jeff Carlson has appointed me as the chairman of the Legislative Affairs Committee for 2016. I am grateful for Jeff's confidence and I am looking forward to work-

ing with the tremendous Legislative Affairs staff at NADA in the coming twelve months. Our challenges are many. You have read about them in this space.

If you have followed this space, you know that we are defenders. We defending our business model, the franchise system, our product, our customers, general business practices and our OEMs. I never liked defending when I played sports, but I believe that I have gotten better at it. With practice comes proficiency!

CFPB: Ready, Fire, Aim! The House Financial Services Committee recently said the Consumer Finance Protection Bureau could be sending payments from Ally Financial’s $80 million settlement fund to non-Hispanic white borrow-ers because of a potentially unreliable race identification method. This, according to internal CFPB documents.

In fact, the administration is literally just making up victims to meet the number prosecutors announced in the settlement two years ago. The government has had to send out more than 400,000 queries to Ally borrowers asking them if they are black or Hispanic.

From Investors Business Daily:

Of course, it’s Obama and his race-mongers who are hurting consumers.

With their meritless discrimination cases, they are jacking up the cost of auto loans for average Americans — in-cluding minorities with good credit. And with their bogus payouts to phantom victims, they are also denying employ-ees of Ally and these other auto companies, many of whom are minorities, tens of millions of dollars in pay raises and bonuses.

Meanwhile the racketeering agency has added Toyota Motor Credit to the list of auto lenders it has extorted (along with Ally, Fifth Third Bank and Honda Financial Services). The payments by these lenders now total over $112 mil-lion. We can look forward to seeing how the rest of this money will be distributed!

NADA Convention Fast Approaching: Online registration for the 2016 NADA Convention & Expo in Las Vegas is open. As one of the most popular destinations in the country for meetings and conventions, several hotels in NADA’s convention block have already sold out.

A young lady entered the dealership asking to take a test drive. The dealership's employee judged her to be the required 20 years of age, and allowed her to take a vehicle. During the test drive, the customer picked up some friends, and later, caused an accident, injuring herself and her passengers. THE EXECUTIVE PROCLAMATION READ:WHEREAS, Jenny Wegner has been involved in the automobile dealer business since 1986; and

WHEREAS, Jenny Wegner, following her fathers retirement in 1992 acquired ownership of Wegner Auto Company with her brother Jim Wegner; and

WHEREAS, Jenny Wegner, in addition to her duties at the dealership has been actively involved in the Pierre community for over 25 years with groups such as the Pierre Area Chamber of Commerce and the Pierre Economic Development Corporation; and

WHEREAS, Wegner Auto received the Prairie Family Business of the Year Award, honoring businesses that have been passed down to multiple generations and in 2007 celebrated their 100th year in business.; and

WHEREAS, Jenny Wegner is not only the first female recipient of this award, but Wegner Auto Company also set a record for the first South Dakota dealership to have three generations of Franchised Dealers of the Year; and

WHEREAS, Wegner Auto Company has been a Buick dealer for 105 years and are believed to be the oldest in the world.; and

WHEREAS, Jenny Wegner has been an active member and Board Member of the South Dakota Automobile Dealer’s Association; and

WHEREAS, Time Magazine annually honors one franchised dealer in each state with a Time Magazine Quality Dealer Award, in partner-ship with Ally that was awarded to Jenny Wegner for the year of 2015.

The legislative reception was held for the first time in conjunction with the South Dakota Trucking Association’s annual Legislative Reception. It proved to be a very successful joint venture. It will be held together for many years to come. The Skilled Workforce Advocacy Council discussed Amendment R with the Board. Greg Von Wald, retired Execu-tive Director of Mitchell Technical Institute and Mike Sheehan, Sheehan Mack Sales & Equipment talked about the needs of South Dakota’s technical institutes and how to support their mission.

Sam Nash of US Autoforce talked to the Board about their produts and services as well as the changes to their preferred provider agreement with SDADA.

HOSTING A MEMBER OF CONGRESSMost Senators and Representatives do not understand how an auto dealership works. When members of Con-gress learn about your business, they become better informed about how their actions affect your ability to grow your business. Congressional dealership visits are an excellent starting point for building long-term relation-ships with members of Congress.
