The following enactment of the Parliament of the Union of South Africa, applies directly to South West Africa.

TO PROVIDE FOR THE ACQUISITION AND WORK­ING OF THE RAILWA'.'S AND HARBOURS IN THE MANDATED TERRITORY OF SOUTH WEST AFRICA, AND FOR THE SETTLEMENT OF SUNDRY MATTERS INC IDENTAL THERE­TO.

BE IT ENACTED by the King's Most Excellent M ajesty, the Senate and the House o f Assembly of the Union of South Africa, as fo llows :-

1. (1) The railways and harbours in the territory of So uth West Africa (hereina,fter referred to as the "territory") a:s they existed on the t•enth day of January, 1920, shall as from that date be transferred. to and vested in the Oovemor-Oeneral of the Union and shall be controlJ,ed, managed and wo rked by the railway administration of the Union (hereinafter referred t-o as the "administration") as part of the system of the railways and harbours of the Union.

The term "raihvays" does no t include private sidings or any lines specified in the First Schedule to this Act.

T he railways. to be so transferred include, save as he11ein excepted, lines of railways, lands, rights to water, waterworks, statio ns, buildings, .plan.t, machin­,ery, rolling stock and all other movable and immovaMe property and servitudes used in connectio n therewith. In so far as immovable property is transferred it is transferr,ed in full d o· min i um and as regards lines of raihvays the do mini um transferred includes so much as is necessary for the wo rking of the railwa_y. The harbours to be so transferred include the lands, :;vharves, docks, b reakwaters and such machinery, plant, 'tools and other property appertaining thereto as were being used o r co ntro lled by the administration on the said date.

(2) The transfer of the s~id railways and harbo urs sh all be recorded in the railways and harbours capital account at s1uch value as is deemed to he fair an d

OM VOORZIENINO TE MAKEN VOOR DIE VER­WERVINO VAN DE SPOORWEGEN EN liA­VENS IN HET MANDAAT OEBIED VAN ZUID­WEST AFRIKA, EN VOOR DE REOELINO VAN SOMMIGE ZAKEN IN VERBAND DAARMEE.

ZIJ HET BEPAALD door Zijn Majes,teit de Koning, de Senaat en de Volksraad van de Uni,e va,n Zuid Afrika, als volgt :-

1. (1) De spoorweg,en en hav,ens in het gebi.ed Zuid-West Afrika (hierna genoemd "het gebied") zoals ze bestonden o p de ticnde dag van Januariie 1920,: wo rden vanaf die datum overgedragen a-an en gevestigd in de Goev,erneur-generaal van diie Unie en worden bestuurd, beheerd en geeksploiteerd door de spoorweg administratie van de Uni.e (hierna genoemd "de ad­mi.nistratie") als gedeelte van het stelsel va:n de spoor­wegen en havens van d e Unie.

De benaniing "spoorwegen" sluit niet in private zijl ijnen o f de lijnen uiteengezet in de Eer5;te Bijlage tot deze Wet.

De aldus over t,e dragen spoorwegen o mvatten., behalv-e als hierin u itgezonderd, spoorweglij'lllen, gron­den, rechten o p wate r, wate rwerken, s,tatio ns, ge­bouwen, bedrijfsuitrusting, machiin,eriie, roUend materieel en alle an dere roerende· en o nroeirende goederen, e,n s-ervituten gebruikt in verba111d daarmee. Voor zover onroerende goedere11 overgedrage n word,en ges.chiedt die overdracht met vol recht van eigendom en met betrekking tot spoorweglijnen o mvat he t overgedragen recht van ,eigendom zoveel als, nodig is voor de -eks­plo itati,e van <le spoorweg. De akius ov,er te dragen havens omvatten de grond, kaaien, dokken, breek­waters en zodanige machineri•e, bedrijfsui,trusting, ge­reedscha ppen en andere goederen daarbij behorende die op genoemde datum doo r de adminis.traU.e gebruikt of bestuurd warden.

(2) De overdracht van de geno emde spoorwegen en havens wordt ,opg ebracht in de kapitaalrekening van de spoorwegen en hav-ens tegen zulke waarde ~s door de administratie billik ·en redelik geadtt wonlt,

reasonabl•e bv the administration and certified by the controller and auditor-general and a like amount' shall be added to the capitai receipts of the· administration under the head of n·on-interest bearing capita! as at the thirtv-fi rst day of March, 1922. ·

(3) Any portion of a line of railway the construction whereof was authorized bv Proclamations No. 30 of 1921 and No. 4 7 of 1921, of the territ-orv shall aiso be vested in the Oovemor-General of th·e Union as from the date on which the construchon of such portion wa.s or is oomp]eted and shall also he controlled managed and \\'orked by the a

dministration in th~ manner aforesaid. Any such portion in respect of which the cost of oonstruction has been or will be defrayed out of the revenues -of the territ-orv shall be recorded in the: capital account -of the ad-;ninistration a t the cost 10f its construction as certified bv the controller and auditor-g-eneral, and a like amount shall be added to the capital receipts nf the administrati:>n under the head err non-interest bearing capital as at the thirty­first day of March, 1922. Any purtion in respect of which the cost ,of constmction has not been and wili not be defrand from the revenues of the territorv shall :be deemed to be a line the construction where.of has been authorized bv Parliament: Provid,ed that this shall not apply to any extens.ion beyond Ondekaremba (approximately twenty-seven miles from Windhoek), b ,,:hich the provisions of sections on e hundred and t \\' en t v - five and on e hundred an d th i rt v of the South Africa Act, 1909, shall apply. ·

2. (1) The loss arising from the contrul, manage­ment and working of the raihvays and harbours from the first day of August, 1915, to the thirty-first day qf March, 1922, inclusive, shall be charged to the railway and harbour capital account and met from the sum of £ 1,500,000 app110priated as Loan Vote A1, tinder Act No. 39 of 1921, to railways and harbours, which sum was a temporary loan from the exchequer account of the Union.

('.2) The provis~ons of sub-section (1) shall be deemed to be an. appropriation of railway and harbm1r fund moneys kl the extent of the Loss incurred during the period from the first day of August, 1915, to the thirty-first day of March, 1922, inclusive.

(3) Anything to the oontrary notwithstanding in sections o n e hundred and seven tee 11 and o ,n e h u 11 d red and twenty or in any ~Jther provision of the South Africa Act, 1909, aH the revenues of the administration arising fr.om the said railways and harbours, as als·o all other receipts appertaining thereto from whatevei· source arising, shall be pa.id into the railway and harbour fund of the Union from whicl1 appropriations shall be made by Parliament to defray the expens,es incidental thereto.

( 4) The Acts •of the Union which are ~pecified in the Se0ond Schedule to this Act shall, save as in that Schedule excepted, apply in respect of the said railways and harbours in the territorv to the same extent as they apply in respect of rail{\'ays and harbours in the Union and the Governor-General may foom time to time add to that ScheduJ.e the whole or any part ,of the provisions of any other law in force in any part of the Unto□ relating to railways -or harbours.

3. (1) The value of all stores and materials in the territory which were transferred under section on P or taken over previous,Jy by the administration, shall be deemed ~o have accmed to the capital account of the administration and shall be available to meet expenditure on the reconstruction and impr,ovement of the railways and harbours in the territory ..

(3) Enig gedee!te van -een spoorweg!ijn waarvan de aanleg gemachtigd werd door Proklamaties No. 30 van 1921 en No. 47 van 1921 van het gehied, wordt ook in de Ooe\·erneur-generaa! van de Unie gevestigd als Yan de datum waarop de aanleg van zulk gedeelte werd of is v·olto oid en wordt ook hestuurd, behcerd en geekspl•oiteerd door de administratie op voornoemde \Yijze. Elk zulk gedeelte teu opzichte waarvan de kcisten van, (a;an!eg bestreden zijn of zuHen w orden uit de inkomsten van het gebied ,rnrdt in de kapitaalrekening van de administratie opgebracht volgens de kosten van zijn aanleg zoals gecertificcerd d-oor de Kontroleur en Auditeur-generaal en een gelijk hedrag wordt aan d,e kapitaatontvangs,ten van de administratie toegevocgd onder het lmotd va.n niet-rentedragend kapi,taal als op de een en de1:tigst-e dag van Maart 1922. Enig ge­deelte, ten opz1chte waarvan de kosten van aanlerr niet bestreden zijn of zullen Worden uit de inkomste; van het gebied wordt geacht een lijn te' zjjn, waarvan de aanleg door het Parlement gemachtigd is : Met dien versfande dat dit ni-et van toepassing zal zijn op een verl,enging verder dan Ondekaremba (ongeveer zeven en twinti,g i11ijL van Windhoek) waarop de bepalingen van artikels h on d er d v i j f en t win ti g en h •o n -de rd d e r ti g van de Zuid Afrika Wet, 1909, van toepassing zijn.

2. (1) Het verlies rnuridoeiendc uit het bestnur beheer en de eks,ploitatie van de spoorwegen en havens van de eerste dag van Augustus 1915 tot en met de eer1 en dertigste dag van Maart 1922, wordt ,opge­bracht tcgen de spoorweg en haven kapitaatrekening en gedekt uit de som van £1,500,000 beschikbaar ge­steld als Lenings Begrotingspost Al, krachtens \Vet Nu. 39 van 1921, voor spoorwegen en havens, wel-ke som een tijdelike lening was uit de schatkistrekening van de Unie.

(2) De bcpaiingen van sub-artikel (1) worden ge· acht en cen beschi.kbaarstel!ing te zijn van spoorweg en haventonds geLden in de ·omvang van het verlies geJ.eden gedurende hct ti_idperk vanaf de eerste dag van Augustus 191 S tot en met de een en dertigste dag van Maart 1922.

(3) Nicttegenstaande het bepaaldc ,in artike1s hon de rd z event i en, en hon de rd twin ti g, of cnigc andere be paling van de Zuid Afrika Wet, 1909, worden alle inkomsten van de administratie voortdoei­endc uit de genocmde spoorwegen en havens, alsmede alle andere ontvangs.ten in verband da.armee en n iort­vloci.ende uit welke bron ook, in het Spoorweg- en Havenfonds van de Unie gestort, v,aaruit de middelceu door het Parlcement toegestaan worden om de 11itgaven in verband daarmee t e bestrijden.

(4) De \Xfetten van de Uni,e, die vermdd worden in de Tweede Bijlage van deze Wet, hehalve z;overre in die Bijlage voorhehouden, zijn van bepas.sing ,op de genoemde s.poorwegen en havens in het gebied in dezelfde omvang als zij van toepassing zijn op de spoorwegen en havens in de Un~e, en de Goeverneur­generaal kan van tijd tot tijd aan die Bijlage toevoegen het geheel of enig' gedeelte- van de bepalingen van een andere wet van kracht in enig gedeelte v_an de Unie betreffende spoconv-egen of havens.

, .. 3. (1) De wa~rde van alle v-oorraden en materialen

in het gebied, ,velke ingevolg,e artikel e en overge­dragen werden of vroeger door de admi.nistratie over­genomen werden, wordt geacht toegevaIIen te zijn aan de ka pitaalrekening van de adrninistratie en is be­schikbaar om de uitgaven voor wedempbouw ,en v_er­betering van de spoorwegen en havens in het gebied te hekostigen.

4. 5. The administratio n shall fix atld alter fro m time to time the wharf dues, rates, fare.ii; licences and other dues and charges on the railw E!}'S or at the harbours in the t errito ry. . In the disN_dio-n o f the administration, such charges may be fixfi:1 on a hi.g her scale than is applicable within the U nion, notwith­s tandi-ng the applicatio n in r-espect -of th fl sa.id railwa_ys and harbours of any Act s pedf£ed tn thg Second Sche-dule to this Act. ·

6, No adjustment such as is CQ j'itemplated in sectio n sev e n ,of the financial Adjustmf hts Act, 1917, shall be made en respect o f any asset tak f.l-h over b-y the administratio n for use ,vithi;n the Unitm o n a date subsequent to the thirty-fiirst ,day of Mart h, 1922.

7. In the applicatio n of section o !1 e hundr e d and thirty of the South Africa ~Act, 1909, to any works o r line h ereafter constructed irJ the territo ry the revenue fund of the territo.ry shall !Je substitu ted for the Conso lidated Revenu e fund.

8. The provis-ions of this Act shall be regarded as the ,other determinatkm of Parliament_ oontempla ted by s ection th i rt e e n of Act No. 38 -qf 1921.

(2) Niettegenstaande d-e bepahng-en van de Zuid Afrika Wet, 1909, bedoeld in sub-artikel (3) van artikel twee van deze W et, wo rdt het Spoorw-eg- en Haven­fo-nds van de Uni~ hi.erbij b-elast m et zulke bedragen als nodig moc:hten zijn om te voorzien voo r zulke wedero pbouw en na-euwe werken bij de spoorwegen en havens in het g eb ied a ls in de Derde Bijl.age van deze W et vermeld zijn. De bedragen aldus aangewend worden bekostigd uit de kred,ieten bedo eld in sub­artikel ,(1) van dit a rtikel en u it amlere kredieten in de. s poorwegen en havens kapitaalrekening, onder voor~ beho ud dat mlk krediet to t tw intig dui2:end pond b e­perkt wordt.

4. De ov-erdracht krachtens artike.l e en is o nde-r­worpen aan a.He rechten toevaUend aa n of verplichtinge-n aangegaan door de admi.nis tratie ten aanz.i.en va.n de genoemde spoo rwegen o f havens v66r de tiende dag van Januari e 1920, zuJlende de ad ministra lie alle gelden kunnen o pvo rderen verschuldigd aan of o pvo rde,rbaar doo r elk vroeger g ezag ten aanzien van de spoorwegen of havens.

5. De administratie stelt de kaa.igelden, vracht­!onen, vervoerprijzen, licenti-es en andere betalin-gen en o n.kos ten o p de spo-orwegen of in de havens in het g ebied vast, en \Vijzigt ze van. tijd t,ot tijd. N aa1- g10ed, dun.ken van de ad ministratie kunne n zulke prijze-111 vast­gesteld worden o p een ho g.ere schaal dan in de Uni,e toegepast wo rdt, niettegens ta.and:e de toepass~ng ten o pzichte van de g ezegd:e spoorwegen en havens van een wet vermeld in de Twe-ede Bijlage van . deze W,et.

6. Geen vereff.ening zoals bedoeld wordt bij artike l z e v e n van d-e Financii.'le Reg-elings W.et, 1917, wordt gemaakt ten o pzichte van een ba te overgenomen door de administratie voor gebruik hi1nne n die Un~e o p een da tum na de ee.n, en dertigste dag .van Maart 1922.

WHEREAS it is desirable to indemnify the Ad­ministration of South West Africa, its officers and all other persons acting under its or their authority in respect of acts advised, commanded, ordered, directed or done in good faith in relation to measures taken for the preventio n and suppression of rebellion, disorder or disturbance and the restoration and maintenance of good order and government and public safety in this Territory;

NOW THEREFORE, under and by virtue of the powers in me vested, I do hereby proclaim, declare and make known as, tioll-ows:-'- ·

1. (1) No action, indictment, or any other legal proceeding whatever shall be brought or instituted fo any · Cm.i.rt of law in the Territory of Sou,th West Africa against-

for or o n account of or in respect of any act, ma,tter or thing 'whatsoever i;n good faith advised,, commanded, ordered, directed or done on or after th,e fifteenth day of May, 1922, and prior to the ta!:dng effect of this Procla­mation with intent to maintaiiQ. good _order and govern­ment and puhli-c safety in. this Territory, or fo.r the purposes of preventing or suppressing rebellion, dis­order and disturbance an.cl.. punishing treasonable, seditious or rebellious conduct.

Any such action, indictment, or any other. legal proce-ed-ing what-ever which may hav,e been commenced prior to the taking, -effect of thfa Prodarnation shall be discharged and shall become and be made void.

(2) Every such officer, member o r person as is des rcibed in sub-s,ection (1) by whom a;ny such ad, -matter o r thing has been advised, oommanc:1:ed, ·ordered, directed or c!O:ne tor any purpose in, _that sub-section specified shall be freed, acquitted, discharged, released and indemnifiied in respect thereof agai;nst all persons .whomsoever.

(3) Every act, matter or thin.g referred to in sub­section (1) shall be presumed to have been advised, comma,nded, order;ed, directed or_ done (as the case may be) in good faith or, as. far as ooncerns acts done prior to the· fifteenth day of May, 1922, to have heen necessary until the contrary is alleged and proved by the party oomplain.ing.

( 4) The provisions of this section shaH apply also in respect of any default by any such officer, member or persJOn aforesaid in complying with any provision of a law or s tatutory regu.Lation in connection with advising, commanding, ordering, directing or doing any such act, matter, or thing aforesaid.

2. (1) Every person who, during the existence of military operations conducted fo r the purpose of preventing and suppressing rebellion and disorder and maintaining good order and government ~nd public safety -within the Territory, has, in good faith and under the authority of a person described in section one hereof, ·been arrested or committed to or .·detained in any prison, gaol, lock-up or other place whatever on suspicion that he has committed or was intending to commit an offence whether statutory or at common law, o r on suspicion that he was assisting or adhering to or was intending to assist or adhere to rebels, shall be deemed tio have been as lawfully arrested, committed or detained as if the arrest, co mmit­tal or -detention had been under a warrant or order issued in accordance with law.

(2) Every recognizance taken during the period aforesaid in respect of which a person referred to in sub-section (1) has been admitted to bail is hereby declared to be of full force and effect.

I. The Official Gazette will be published on. the 1st and 15th day of each month; in the event of either of those days falling on a Sunday or Public Holiday, the Gazette will be published on the next succeeding working day.

2. Adv,ertisements for insertion in the Gazette must be delivered at the office of the Secretary for South West Afdca (Room 46, Government Build­fngs, Windhoek) in the languages in which they are to be published, at not later than 4.30 p. m. on the ninth day before the date of publi.cation or the Gazette· in which they are to be inserted.

3. Advertisements will be inserted in the Gazette after the official matter or in a supplement to the Gazette at the discretion of the .Secretary.

4, Advertisements will be published in the Official Gazette in the English, Dutch or German lan­guages; the necessary translations must be fur­nished by the advertiser or his agent. It should be borne in mind however, that the German version of the Gazette is a translation only and not the authorised issue.

5. Only legal advertisements are accepted for publi· cation in the Official Gazette, and are subject to the approval of the Secretary for South West Africa, who can refuse to accept or decline further publication of any advertisement.
