News from The PresidentJanuary 2, 2014

Hello from Rochester Area Builders! I’m Kevin Worden, Executive Director of Rochester Area Habitat for Humanity by day (and by many evenings!), and I am thrilled to serve as the RAB Board President for 2014. I’ve been active with RAB since 2006, when Sandy Friend asked me to join the Government Affairs Committee, and I have served on the Board since 2011. I’m looking forward to focusing on the most

important thing about RAB this year…..YOU!! As DMC ramps up, everyone in our region that will be hiring a builder, remodeler, or trade company needs to know that RAB members agree to adhere to high-quality, code-surpassing construction standards, as well as to a stringent Code of Ethics. When firms and households hire RAB members for their projects, they’ve hired quality, they’ve hired dedication to the community, and they’ve hired a commitment to results. Concerned about laws that affect your business, but don’t have time to follow the legislation? We’ve got your back! RAB staff is in contact with our elected and appointed officials regularly, and they work hard to make sure that our laws and regulations will foster a strong building climate. DMC can propel this city into a prosperous future for decades, but we’ll only maximize its potential if we have a healthy building environment, and a vibrant, entrepreneurial community culture that makes room for everyone. We at Rochester Area Builders are all here to serve you. Our fine staff is happy to work with you, and you are always welcome to contact me at [email protected], or by phone at 252-0849 x2 if I can be of service. Here’s to a strong and successful 2014!

You’ve probably read Dr. Eisenberg’s articles in our Newsletter, and you may have heard him speak at previous events. If so, you know that not only is Elliot extremely knowledgable about economics, he is able to discuss what many find to be a dry topic in a fresh and interesting way.

Dessert Sponsor:

We all know how important the economic climate is to our businesses, especially with all the new opportunities coming our way thanks to DMC. Elliot is able to break down economics in a way that is easy to understand, while still keeping it interesting enough to keep you from dozing off!

Design contests are extremely popular with today’s consumers, and they’re a great way for designers to show off their creativity and workmanship. That’s why we’ve decided to bring Doors Unhinged to the RAB Home Show. We’ll be giving 10 RAB Members the chance to show what they do by taking old doors and transforming them into whatever they can come up with! Tables, benches, curio cabinets and shelving are just some of

the possibilities!

Besides being great advertising for our designers, Doors Unhinged will also be a benefit for Habitat for Humanity’s ReStore. The finished projects will be raffled off to the

public at the Home Show.

Also new in 2014 A monthly column highlighting a local project by a member of RAB. We’re currently looking for projects. Anything from a commercial building to a home remodel will be considered. If you’re interested, please contact Ryan at 507-282-7698 or [email protected]

In 2013, a lot happened on the government affairs front. First and foremost, we bid adieu to Rick Dold, our previous Public Affairs Director. Rick did a wonderful job working with RAB, and we are grateful for the talents and efforts he brought to RAB.

Opportunity knocks! Let’s see, what else…… there was something…. Oh yeah! DMC! Destination Medical Center infrastructure funding was approved by the state legislature. This provides $455 Million from the state, with the city of Rochester providing another $128 Million towards infrastructure. Because this is a giant undertaking, there is a great amount of planning that needs to happen. To do this, the DMCC (Destination Medical Center Corporation) has established an EDA (Economic Development Agency). The EDA will be in charge of developing a plan for DMC. The EDA is currently in the process of hiring consultants to develop this plan.

Trees, trees, trees. After many years of debate, review, and revision, the Tree Ordinance was finally passed and approved. Keep in mind that the tree ordinance only applies to trees in the boulevard for new construction. That being said, 2014 might see more proposed regulation on trees, but we will keep you updated on that as more information becomes available.

Fire Sprinkler Mandate and the ALJ. RAB and the Builders Association of Minnesota continue to fight a proposed code change mandating fire sprinklers

be installed in new homes larger than 4,500 square feet. This is an unnecessary and costly mandate. The current code states that new construction must have hard-wired interconnected smoke alarms. Having these kind of smoke alarms in homes has proved to be 100% effective at preventing fatalities in fires. An administrative law judge heard the case December 12, 2013. We presented our case well, and we look forward to the verdict.

2014 brings big things to RAB’s newsletter. One of the new things happening is a new monthly column, “Hey Matt, What’s up with that?” This feature will be a question and answer section of the newsletter. Our members are free to submit questions to me that they have about something going on with DMC, City of Rochester, Fire Sprinklers, Tree Ordinances, or even “what is being built on that corner?” I hope to get a number of questions from members, whether it be via email ([email protected]), phone call (507-282-7698), or even conversation during meetings. Look forward to “Hey Matt, What’s up with that?” It is going to be riveting and informative.

Settling In. Lastly, I would like to say thank you to our members, for helping to make the transition into the role of Public Affairs Director as smooth as possible. I look forward to working with all of you in the near future.

Matt

Hey Matt, Can you recap 2013 for us?

BAM Update: December 2013

The holidays are a time to count your blessings and give thanks. Membership with the Builders Association of Minnesota is the gift that keeps on giving. Remember to “open” these gifts and take them out for a spin if you haven’t already!

Legislative, Regulatory, and Legal Protection - The biggest benefit of membership is represen-tation and protection at the state Capitol, and before regulatory agencies and the courts. Together with your industry peers, your voice is stronger. It’s important to fight for the best building codes and laws possible. Member-ship means standing shoulder-to-shoulder with your peers to fight for what’s right.

Contract Templates - This is a gift that will keep on giving for years to come. Drafted by attorneys that specialize in residential construc-tion, and updated when the law changes, these six members-only contract templates (and one change order) are available in both word and pdf so you can download and edit them right on your computer. These contracts are worth over $10,000. That is a holiday miracle! Members only section - contracts here.

Code Guides - When the government puts out a new code, the language is provided but not the how. Enter BAM. For members-only we put together detailed code guides - written by experts - so you know exactly how to build to the new code. Members only section - code guides here.

Discounts - An obvious gift of membership is the discounts on stuff you use. Members have access to discounts on fuel at Holiday, office supplies at Office Depot, and a 22% discount on your Verizon plan to name just a few. We have a rebate program that gives you money back and we haven't even talked about the perks at your local and national associations. These awesome savings can more than pay for your annual membership. Members only - get these sweet discounts now!

Industry-specific Insurance - The residential construction industry requires special insurance coverage and as a BAM member

you have access to high quality, discounted coverage from The Builders Group for workers’ comp, Corporate Four for general liability, and RMC for risk management. Check out our insurance deals here.

Information - BAM membership means information. We make sure you're in the know and provide details on what's happening in the industry, the economy, at the Capitol, and right here at BAM. We're tweeting, blogging, posting on facebook, emailing, writing white papers, and more. Like us on Facebook, Follow us on Twitter, sign up to receive our Blog, and as member you get so much more.

Action - Membership means getting influence, leadership training, political education, and networking. As a member you make decisions about real issues that affect your business. In serving on BAM’s committees you step up as a leader and make decisions for 3,000 member companies. At BAM it’s all about politics and by participating you get in on the action. And of course, BAM committee work and events mean networking with your statewide peers and the opportunity to meet, learn, and grow your business.

Unity - One of the most important benefits of builders association membership is banding together with your industry peers across the state to create a strong unified front.

BAM was created in 1974 to be the statewide voice of Minnesota’s builders and remodelers. We represent you and your business at the State’s Capitol, regulatory agencies and courts because industry unity and doing business with members is good business. Together we work to protect your business and bottom line - for a better industry, a better economy, and a better state!

We hope you enjoy the gifts of membership now and in the new year! Happy holidays from all of us at BAM!

PUBLIC WORKS DEPARTMENT NEWSContributed by: Megan Duffey, Storm Water Educator, Rochester Public Works Department

Rochester Public Works Department, 201 4th Street SE, Room 108, Rochester, MN 55904, 507-328-2440

This article is based on a guide developed by the Environmental Protection Agency for construction sites. A SWPPP describes all the construction site operator’s activities to prevent storm water contamination, control sediment and erosion, and comply with the requirements of the Clean Water Act. Each construction site is required to have a SWPPP, including all residential construction sites in Rochester. Most residential site owners and contractors in Rochester have not developed SWPPPS for their sites. Now is the time to get your site in compliance. If you are new to managing storm water at a construction sites, we recommend reading the entire guide, found at: http://cfpub.epa.gov/npdes/stormwater/swppp.cfm. If you have experience with SWPPPs, this article will remind you of the basics. An effective SWPPP includes sediment and erosion controls plus good housekeeping practices to prevent discharges of sediment and other pollutants from your site.

1. Review the MN state construction general permit requirements.Understand all the provisions and follow the specific instructions contained in the Construction Storm Water Permit (details located here: http://www.pca.state.mn.us/y3dqf96). By applying for coverage, you are acknowledging compliance – so be sure to implement what your application and SWPPP promise!

2. Perform a Site Assessment. Before construction starts, conduct a walk-through to assess site-specific conditions including soil types, drainage patterns, existing vegetation, and topography. Create a drawing identifying the significant features to help protect natural features that will remain after development.

3. Select Erosion and Sediment Control (ESC) Best Management Practices (BMPs)BMPs are the controls and activities used to prevent pollution. Select proven BMPs that suit the site’s unique conditions. There are many options available and they work much better when used in combination.

4. Select Good Housekeeping BMPsSince a large amount of waste can be generated at construction sites, it is imperative that waste is managed properly. Your SWPP should include the following: plans for proper waste containment, building material staging areas, paint and concrete washout areas, equipment/vehicle fueling and maintenance and washing areas, and spill prevention and response.

5. Develop Plans for Inspections, Maintenance, and RecordkeepingConduct and keep detailed reports of your required regular inspections to ensure that your BMPs are working properly. Fix and clean BMPs, being sure to document the maintenance performed. Add BMPs where problems can potentially develop. All records and reports must be kept for at least 3 years after permit coverage ends.

6. Training, Signature and CertificationWorkers assigned to ESC tasks and SWPPP development must be properly trained. An authorized site operator must sign all SWPPPs and inspection reports to guarantee their ability to implement the BMPs and other permit requirements. A site sign must be posted with a copy of the Notice of Intent, location of the SWPPP, and contact person for viewing the SWPPP. It is always best to keep a SWPPP on site so it can be referenced during construction.

SWPPPs are intended to be dynamic documents, so as site conditions and ESC decisions change, note them on the SWPPP. Implementing these practices and activities will maximize pollutant load reductions from your construction sites and protect our waterways.

Back to Basics: Developing Your Storm Water Pollution Prevention Plan (SWPPP)
