- Admission is free for professionals, invited guests, trade and business visitors only. The exhibition is open to

public on Saturday and Sunday.

- The Organizer reserves the rights to refuse admission or to remove any person from the event without having to

specify a reason.

- No photography or video equipment is allowed in the hall unless approval is obtained from the Organizer.

- Business attire or smart casual are compulsory. Shorts, sandals and slippers are not permitted on trade days.

- Minors aged 15 and below are not allowed into the exhibition halls on trade days.

WIFI cards for wireless internet access for can be purchased from the Business Centre located at the lobby of

Challenger 1 and IMPACT Hall 6. In addition, the Business Centre is equipped with meeting rooms, business support

Kid’s Corner is available at the lobby of Challenger 1 and IMPACT Hall 4 for children from 5 to 10 years old.

1.1 Official Stand Contractor

Xcon Co.,Ltd. has been appointed as the Official Stand Contractor for THAIFEX – World of Food Asia, World

of Seafood, World of Coffee & Tea, and World of FoodService 2017. Raw Space Exhibitors may employ a

contractor of his choice to construct and install any stands they may require. Raw Space Exhibitors who appoint

their own stand contractors must submit detailed drawings for approval by the Organizers before 26 April 2017. For

details, please refer to Form 9 of this Exhibitor Manual. The Organizer reserves the right to reject any construction

and design they deem inappropriate.

1.4 Standard/Display Booth Package

(i) Additional furniture and electrical items can be rented from the Official Stand Contractor. Please place your

order by completing the respective forms within this manual and returning them by the stipulated deadlines.

Any additional orders or changes made will be charged according to rates stated in the manual.

(ii) No additional fittings or displays, including additional name boards, stickers, logos, balloons etc. are to be

attached, nailed, screwed or drilled to the Shell Scheme/Display Shell Scheme fascia board. If this

instruction is ignored, the Official Contractor reserves the right to charge the Exhibitor or Contractor

concerned for any damages to his material. The cost of repair of any damages will be assessed by the Official

Stand Contractor and/or Venue Owner. (refer Figure 1.0 for illustration)

(iii) No painting, wallpapering or using of strong adhesives on the panels is allowed. Exhibitors who wish to

have such works done on the panels must inform the Official Contractor, who will provide a quotation and

carry out the work. Any double-sided or adhesive tape belonging to the Exhibitor or Contractor must be

removed from the panels after the Exhibition.

(iv) Any changes in the type or colour of the floor covering provided must be approved by the Organizer before

ordering with the Official Contractor. All costs incurred must be borne by the Exhibitor.

(v) An Exhibitor occupying a corner stand has the choice of wall or an additional open side to the aisle. And

any such wall may be required to be set into the stand by half metre as deemed necessary by the Organizer

for safety reasons or exposure of other Exhibitors.

(vi) No financial credit or exchange of items will be given by the Organizer for any Shell Scheme/Premium

Shell Scheme package entitlements not utilized.

It is also important to note any form of balloons, hanging banners and/or hanging structures from ceiling are

NOT allowed for this event.

1.5 Raw Space Stand Construction / Stand Structure and Design Restrictions

Exhibitors who have booked Raw Space stands are recommended to use the service of the Official Stand Contractor

appointed by the Organizer to undertake the job, as this will facilitate convenient installation. Otherwise, Exhibitors

are required to obtain consent from the Organizer before any of their own appointed contractors are permitted to

work onsite. The name of the contractor must be given to the Organizer by completing Form 9. The appointed

contractor will have to comply with the following rules and regulations:

(i) All materials used for stand construction and/or interior decoration works must comply with standards set

forth by the prevailing fire and safety regulations. Materials should specifically be non-combustible and

have a minimum flame spread rating of Class 2 as stipulated under the Fire Safety & Shelter Department

(FSSD) regulations.

(ii) All works in the Exhibition Hall should be confined to installation and minor alteration only.

Fabrication works like welding, cutting, sawing, laminating, painting, spraying etc. should not be

carried out inside the Exhibition Hall. Severe restrictions and penalties will be imposed on anyone

who infringes this regulation. This is a healthy and safety measure.

(iii) No structure may extend beyond the boundaries of the space allocated. Projections (including exhibits, signs,

company name boards, floral decorations and furnishings) into the gangways will not be permitted.

(iv) The company name and stand number of the Exhibitor must be prominently displayed. If this requirement

is not observed, the Organizer reserves the right to affix stand numbers and charge the cost incurred to the

Exhibitor concerned.

(v) Where the stand abuts onto another stand, the walls of the adjacent stand are strictly not allowed to be used

by the Exhibitor, i.e. every Exhibitor is responsible to build their own walls to separate their stand. Minimum

wall height of 2.5m must be constructed and properly finished in white. (refer Figure 1.1 for illustration)

(vi) Where a stand wall on the common boundary line is higher than the adjacent wall, the visible rear surface

must be of double cladding and finished in painted or laminated white. Name boards cannot be displayed

over an adjacent Exhibitor’s backwall and/or sidewall.

(vii) Depending on the location of the stand, stand structure or any form of fitting & display elements may be

erected to a height of 5 metres. Any higher is subject to the approval of the Organizer and Venue Owner

and on case-by-case basis. Professional Engineer (PE) Endorsement is required for stands above 5 metres.

The Organizer has the right to request the change, modification, lowering or shortening of any backwall or

sidewall, if such, in the opinion of the Organizer, may obstruct the view or exposure of other stands.

(viii) Stands beneath the fire curtains has limited height restrictions, please check with the Organizer for more

information.

(ix) Exhibitors may contact the Organizer if they require the stand heights of their adjacent neighbours for design

planning purpose. The Organizer reserves the right to only provide the information when deemed

appropriate.

(x) All stands must have at least 30% of any frontage facing an aisle left open, or fitted with transparent (see

through) material. This area must be visibly-free of obstruction. Island booths are not allowed to construct

a full wall.

(xi) A suitable floor covering, such as carpet, matting or platform must be provided for all stands. All carpet and

floor coverings must be affixed with residue resistant double-sided tapes. The Exhibitor will be responsible

for the removal of all tapes and residue marks within the demarcated booth. The use of paint or other

adhesives on the floors of the Exhibition Hall is strictly forbidden.

(xii) No fitting or display is to be attached, nailed, screwed or drilled on to the flooring. Platforms must be durable

and stable to carry and distribute the weight of the standfitting, stand personnel, visitors and exhibits, having

regards to the loading limits of the floors. If this instruction is ignored, the Exhibitor/Contractor concerned

will be responsible for any damage caused.

(xiii) Ceilings or lighting pelmets may be approved, provided that the materials used will allow water to flow

freely (e.g. egg box or mesh netting). Approval from the Organiser and Fire Safety Bureau (FSB) must be

obtained in writing. Portable sprinkler balls at a stipulated rate of one (1) per every twelve (12) square metres

of covered area are required.

(xiv) Neon lights or signs may be permitted; but continuously flashing ones are not permitted unless it forms an

integral part of an Exhibitor’s product. Sequentially lighted displays may be used subject to the Organizer’s

approval on the rate of light change. all neon lights or signs must be fitted with a safety ‘fireman’ switch.

(xv) Exhibitors are reminded that it is the responsibility of their nominated stand contractor to clean and vacuum

the stand upon completion of construction, before handing over to the Exhibitor.

(xvi) Exhibitors and their nominated stand contractor must adhere to the timings stated in the Exhibition Schedule

and are responsible for removing their excess materials including waste, paints, debris and off-cuts daily

during the buildup, and all their materials including all adhesive tapes and padding used in the laying of

floor coverings, at the end of the Exhibition.

(xvii) Any booth size of sixty (60) square meters and above has to be equipped with a fire extinguisher.

The Organizer reserves the right to reject any contractor and design deemed inappropriate.

1.5.1 Construction Height

The ceiling height is 16m throughout. The maximum permitted stand height is 7m. Exhibitors with booth higher

than 5 meters will require approval from a civil engineer and has to submit the Safety Certified Letter.

1.5.2 Double-Storey Stands (if applicable)

Exhibitors who wish to erect double-storey stands must have a minimum area of 60sqm and subject to approval from

the Organizer. Exhibitors may use either the Official Stand Contractor or appoint another contractor of their choice,

subject to the approval of the Organizer and Venue Owner. The Exhibitor/Contractor will also have to comply with

the following rules and regulations:

(i) The exhibiting company of the lower tier of a particular booth must be the same as that of the upper tier.

(ii) The rental rates for the contracted floor area at the upper tier shall be fifty percent (50%) of that of the lower

tier. That is, if the rental rate for the lower tier floor area is USD 500 per square metre, the rental rate for

the upper tier floor area is USD 250 per square metre.

(iii) The contracted upper floor space shall not exceed 50% of the contracted lower floor space.

(iv) All structures must be endorsed by a local Professional (Structural) Engineer, engaged by the Exhibitor or

his contractor.

(v) Stand design must be vetted by the Organizer and Venue Owner first before submission to Fire Safety

Bureau for final approval before commencement of installation. This process can take quite some time, up

to 6 to 8 weeks.

(vi) For double storey stand, the stand should be be an island stand but if it abuts to another stand, the upper

floor walls must be set-in at least 1m away from neighbouring stand.

(vii) Total stand height shall not exceed 7 metres.

(viii) Minimum width of staircases and corridors is 1.2 m. External staircases should not be enclosed. A

continuous handrail at a height of 1m from the treads and landings of the staircase is to be installed.The side

of the staircases shall be provided with skirting boards.

The design, construction and tear-down of double storey stands have to comply with the guidelines, operations

schedule and rules and regulations laid down by the relevant authorities including the Fire Safety Bureau, the

Organizer and the Venue Owner.

Design and layout plans of the double storey stand must be submitted to the Organizer for approval at least three (3)

months prior to the Exhibition. Please consult the Organizer immediately for a feasibility study and for more details

should you decide to erect such a stand.

1.5.3 Exhibitor Nominated Stand Contractor

(i) Exhibitors (or their nominated stand contractors) are required to submit all plans in duplicate by 26 April

2017 for approval by the Organizer, together with their nominated stand contractor’s details using Form 9.

This includes booth plan, elevation plan and artist’s impression with dimensions illustrating the design

of the stand. Scale drawings should not be smaller than 1:200. Late submission may mean that approval may

not be granted in time for construction to commence onsite. The Organizer will not be responsible for the

rejection of stand design by the relevant authorities or due to late submission and reserves the right to request

the Exhibitor concerned to modify certain portions of the stand to meet Venue or government or the

Exhibition’s prevailing conditions and circumstances.

Exhibitors are responsible and liable for their nominated contractor’s observance of all rules and regulations.

The Exhibitor and his nominated contractor(s) shall ensure the structural integrity of their booth design.

(ii) Before the approved nominated stand contractor is permitted to start work in-hall, he must lodge a refundable

Hall Clearance Deposit of THB1,000 per square meter, subject to a maximum amount of THB150,000. This

serves as a performance bond as well as a damage and rubbish clearance deposit. The Organizer reserves

the right to increase this maximum limit on any Exhibitor and their nominated stand contractor who had

previously performed or behaved unsatisfactorily, without having to assign any reasons. The nominated

stand contractor is also required to sign an undertaking to guarantee conduct and behavior, follow proper

schedule of works and observe the Exhibition and venue regulations.

All monies must be lodged in local (Thailand) cheque or cashier’s orders. Please note that any bank charges,

levies or exchange rate differences will be deducted accordingly from the deposit. Contractors will also have

to bear any charges levied by the Venue Owner for damages caused to their property and/or flooring. The

deposit shall be returned in full to the contractor within 6 weeks after the fair only if the space is deemed as

clean and clear of all rubbish and litter, with no damage and whatsoever caused (including any damage to

the allocated space or any part of the venue building). Expolink Global Network has been appointed by the

Organizer to collect all deposits on behalf, please attention all monies payable to ‘Expolink Global

Network Ltd’.

(iii) Upon receipt of the Hall Clearance Deposit, contractor badges will be issued and will be valid only during

move-in and move-out period. Contractors are to request Exhibitor Badge from their clients (exhibitor)

should they need to service the booth and enter the hall during event period.

All foreign employees and staff must be in possession of valid work permits issued by relavant

authorities.

Please note that the issuance of Exhibitor and/or Contractor badges by the Organizer does not imply in any

way that permission is granted for any person to work onsite without the necesary work permits.

B2. Hall Specifications

2.1 Floor Loading Capacity

Challenger 1-3 : 2,000 kilograms per square meter

IMPACT Hall 1-6 : 2,000 kilograms per square meter

Floor Material : Concrete sealed material (hardened concrete)

Special arrangements including the provision of a steel base plate may be required for any exhibit exceeding

these limits. The Organizer must be informed of any such exhibit. The Organizer’s delivery schedule for heavy

and large exhibits must be strictly adhered to.

2.2 Power Supply and Lighting

The Organizer will provide general lighting in the Exhibition Hall during exhibition opening hours only.

(i) The standard electrical current supply available for use are Single-Phase Alternating Current at 220V, 50Hz.,

and Three-Phase with Neutral Alternating Current at 380V, 50Hz. Exhibitors requiring different

voltages/frequency or special connections to equipment must arrange directly with the Official Stand

Contractor.

(ii) All electrical installation work from source of supply at the exhibition must be carried out solely by the

Organiser’s Official Contractor. No exceptions are permitted.

(iii) All electrical equipment and connection downstream from Organiser's supply should be tested and

appropriately grounded and approved by the Exhibitor's (or Exhibitor's appointed contractor's) local licensed

electrical engineers prior to turning on the electrical supply .

Exhibitors or their contractors who wish to bring in special lights, lamps and lighting to be used in their stand must

receive approval from the Organizer at least 4 weeks before the commencement of the exhibition. Applicants are

requested to submit the following information and documents when applying:

i) Specifications and its rating in watts / units of the light fitting

ii) Total units to be installed

iii) Layout line drawing of planned electrical installation

iv) Company name of the contractor

v) Names and identification card / passport numbers of all attending electrical personnel

vi) Electrical order form in the Exhibitor Manual (refer to Form 11)

Each electrical supply provided is intended for one equipment or machine on display. Multipoint socket outlets are

not permitted as an overload may be caused, leading to a trip in the incoming power supply. Severe trips may take

hours to rectify, thereby causing inconvenience to all Exhibitors.

During the move-out period, temporary electricity supply can be arranged by prior arrangements (at least 24 hours

in advance) with the Organizer.

Please place orders early to facilitate submission of electrical plans to the governing authority for approval. Late

or wrong orders will cause delays in the supply to your stand. Please note that the physical environment /

conditions of the Exhibition may be different from those in the Exhibitor’s premises which may affect the stability

of electrical supplies and installations; and thus allowances must be factored into the orders made and as a rule-

of- thumb practice 80% is deemed as full load.

2.3 Water and Compressed Air

For operational safety reasons, only the Official Contractor is permitted to carry out the installation work required.

For orders, please use Form 12.

2.4 Air-Conditioning

Air-conditioning within the Venue will be operational during official exhibition opening hours only. For any further

requirements for extension of air-conditioning operational hours, please contact the Organizer to make your request.

This will be chargeable.

2.5 Ceiling Height: 16 meters

B3. Freight and Exhibits

3.1 Official Freight Forwarder

The Organizer has appointed Agility – Fairs & Events as the Official Freight Forwarder, site handling and customs

clearance agent for THAIFEX – World of Food Asia 2017. Please refer to Form 16 for detailed guidelines on

freight forwarding services.

a) Exhibitors who do not wish to exhibit during public days are requested to obtain Move-out clearance forms

with their business cards at Agility’s site office after 18.00 hrs on 02 June 2017.

b) Without special approval from the Organizer, no additional exhibits are allowed to enter the exhibition hall

once the fair has opened. No exhibits are allowed to be taken away from the hall before the fair ends.

c) Exhibitors may use light trolleys to deliver hand-carried items, light exhibits or displays to the exhibition

stand(s) during move-in period.

d) For heavy exhibits, exhibitors are not allowed to use their own mechanical transportation equipment (e.g.

hoist, crane, forklift, truck, jack lift, trolley etc.) to deliver their exhibits to the stand. They have to make

arrangements with the Official Freight Forwarder appointed by the Organizer to make delivery to their

stands. For details, please contact the Official Freight Forwarder.

e) Delivery of exhibits and other exhibition stocks will not be permitted during the show period.

3.2 Storage

Direct arrangements should be made with the appointed Official Freight Forwarder. Otherwise, Exhibitors must

arrange for their boxes and cases to be transported back to their own premises. Exhibitors are not to store such items

within the exhibition hall. The Organizer reserves the right to remove/dispose of any boxes, cases and/or packing

materials left in the exhibition halls before, during and after the show. Any cost incurred will be borne by the respective

Exhibitor.

The Rules and Regulations listed below are designed for safety, security and to provide equal exposure for all

Exhibitors. Exhibitors and their personnel/appointed agents must observe the Rules and Regulations stated in this

Exhibitor Manual and those attached to the Exhibition Participation Agreement.

C1. Product/Exhibits Demonstrations & Presentations

The Organiser appreciates that demonstrations and presentations form an integral part of exhibitions. Exhibitors,

however, should exercise discretion to other exhibitors when carrying out demonstrations and presentations.

Loudspeakers/sound devices and/or image projection equipment are to be placed in such a way that

sound/image is directed downwards and into the stand, and not towards or across the aisles. The operation of

any sound device or image projector must not interfere with, or be an annoyance to neighbouring stands. Sound levels

recorded at adjacent or opposite stands should not exceed 70dB from source for all speech, music and sound effects.

The Organizers reserve the rights to discontinue any audio visual presentation that exceed the maximum

allowable sound level or which in their opinion is detrimental to the event.

The Organiser may also require such demonstrations or presentations to be carried out in accordance to a timetable

as laid down after consultations with the exhibitors involved. Exhibitors planning to stage demonstrations or

presentations must provide a reasonable space for the audience within the confines of the stand.

If product demonstration and introduction of machines/exhibits are needed on-site, exhibitors must abide the

following instructions strictly:

a) Exhibitors are required to submit detailed description of product demonstrations in writing, including

operational parts, flammable materials, laser, any dangerous articles etc. in order to get approval from the

Organizers prior to the opening of the event.

b) Exhibitors are required to ensure all working machines are equipped with protecting devices, and such

devices can only be removed when the power is shut down.

c) Exhibitors are required to ensure all working machines are operated by professionals. Any working machine

without professional control is strictly prohibited.

d) All machines must be installed safely. They must be fixed to a safe position to avoid possible sliding. The

position of the exhibits must not post any threat to the safety of visitors, staff or other people nearby.

e) All machines must be equipped with separate start-up facilities, and must not be operated by visitors or any

other non-professionals without permission.

f) To avoid emitting poisonous & waste gas or other irritations in the exhibition halls, any product

demonstration that may result in the above situation must seek approval from the relevant supervisory

department.

C2. Photography of Exhibits

No photography or video recording is allowed in the Exhibition Hall, other than authorized press personnel and those

with permission from the Organizer and Exhibitor concerned. Exhibitors wishing to restrict photographs for any

reason should place notice to that effect, adjacent to the exhibit, and are advised to hire their own security guards to

enforce this restriction.

C3. General Cleaning

The Organizer will provide general cleaning of the Exhibition Hall and stands (excludes Raw Space stands) prior to

the opening of the exhibition and daily thereafter. This only includes cleaning of shell scheme and aisle carpet and

rubbish disposal before the Exhibition opens in the morning and after the Exhibition closes in the evening. Cleaning

does not include exhibits and displays. It is the responsibility of each Exhibitor to maintain the cleanliness of his

booth at all times.

Should the Exhibitor need additional cleaning services, they may engage the services of the Official Cleaning

Contractor using Form 18.

C4. Removal of Waste

During the set-up and tear-down period, passageways in the exhibition hall must not be obstructed with packing

materials, construction materials or debris. Contractors building Raw Space booths or Shell Scheme booth interiors

are responsible for removing their own debris from the site at the end of each day. At the end of the exhibition, the

contractor must remove from the site all the materials from their client’s booth. Should they not do so; the deposit

paid will be used to pay for removal by the Official Cleaning Contractor.

Exhibitors are requested to place their debris in the aisle, where it will be removed by the cleaners at the end of each

show day. The Organizer reserves the right to charge Exhibitors for the cost of removal of excessive waste e.g.

stand construction debris, crates/pallets, cartons, packing materials or literature.

C5. Industrial Gas and Naked Flame Demonstration

Exhibitors must not bring in or use at the exhibition site any dangerous or hazardous goods and equipment such as

poisonous gas, fuel, kerosene, noxious materials, inflammables, and equipment using such inflammable materials as

gas stoves and electric stoves without prior written consent of the organizer. Even when consent is given, adequate

precautionary measures must be taken by exhibitors at all times. Exhibitors are also not allowed to carry out any fire

hazardous operation or work.

All safety precautions must be taken by the contractor or the Exhibitor to protect the public against any danger of

fire outbreak. The Venue may require site inspection to ensure maximum fire safety.

Smoking is not permitted in the exhibition hall and conference rooms at all times.

C6. Liabilities

General insurance will be covered and handled by the Organizer. However, it is the responsibility of each Exhibitor

to arrange insurance coverage for its own exhibits during the exhibition.

All Exhibitors must arrange at their own cost “all-risk” insurance coverage from their origin country up to their

exhibition booth including the exhibition period and return to domicile. Exhibitors must ensure that they are fully

covered by insurance and take up public liability and comprehensive protection. They should also provide an

insurance coverage for their own staff against injury.

Exhibitors are also responsible for making good any loss or damage to any item which they have rented or hired from

the official contractors/ suppliers. Though the Organizer maintains security surveillance at all times, Exhibitors are

reminded that goods / exhibits will still be at risk, especially during the final day of the show. Please ensure your

personal and valuable property, portable and rented items, are not left unattended at any time before, during and after

the show. Exhibitors are reminded that small, portable and valuable items are most at risk after exhibition opening

hours each day. Therefore, Exhibitors are advised to keep these items safely stored before leaving the exhibition area.

The Organizers reserve the rights for cancellation, partial opening or postponement of the exhibition.

C7. General Security

(i) General perimeter security service will cover the exhibition halls during the build-up, exhibition and

dismantling period. Nevertheless, the Organiser will not accept responsibility for theft, loss or damage of

exhibits or any other equipment belonging to Exhibitors, contractors or visitors.

(ii) It is strongly recommended that at least one representative is at the stand to supervise all deliveries, packing

and unpacking, installing and dismantling until the hand-over to your nominated agent is completed.

(iii) Exhibitors may want to arrange an insurance policy to cover for loss of exhibits or display equipment due to

theft or damage. Exhibitors are advised to be particularly careful to pack all items/exhibits immediately after

the exhibition ends. It is at this time that there is a higher risk of exhibits and valubles going astray.

(iv) For security & safety reason, no movement of exhibits will be allowed (inside or outside of halls) during

exhibition opening hours.

(v) If your exhibits are very valuable or sensitive and you wish to hire security personnel to attend to your stand

exclusively for off-show hours, please contact the Organizer. Please note that you are not allowed to hire

staff or personnel from another security agency. Refer to Form 18 for more details.

C8. Booth Operation

(i) The stand must be fully manned and exhibits displayed throughout the opening hours of the Exhibition.

(ii) Exhibitors are asked not to place stickers, signs or posters anywhere in the halls other than within their own

stand and on paid advertising poster sites and billboards. Likewise, exhibitor’s representatives may not

distribute brochures, invitations etc along gangways or near the entrance/exits of exhibition halls, F&B

outlets, show hospitality areas, or any other areas which, in the opinion of the Organisers, is deemed

inappropriate and causes inconvenience to visitors and other exhibitors.

(iii) Exhibitors must give proper consideration to the conditions under which their equipment will be

demonstrated. Precautions must be taken for protection of the public.

(iv) In view of the professional nature of the trade-fair, exhibitors are strictly prohibited from conducting direct

sale and open-price-labeling of exhibits or samples on the stands during trade days. The Organizer reserves

the right to take appropriate action as deemed necessary to stop such activities.

(v) Fire and Safety regulations require that no goods or packing materials may be stored in access areas behind

or between booths. Exhibitors should design proper storage areas with adequate access within their own

booth or approach the Official Freight Forwarder for storage solutions.

(vi) The Exhibitor and his staff shall be responsible for any damages to the structure, floor, walls, pillars and

any part of the Exhibition Hall, the Property of the Organizer, and other Exhibitors due to the transport,

removal of exhibits, refuse and / or decoration works.

(vii) Cleaning of paint containers or any other dirty items in the washroom is prohibited.

C9. Dangerous Materials

(i) No temporary gas (LPG) or naked live electrical fittings are to be used in the Exhibition Halls at any time.

(ii) No explosives, petrol, dangerous gases or highly inflammable substances are allowed in the Halls.

(iii) No radioactive substances are allowed unless prior approval in writing is obtained from the Organizer. Any

radioactive substances being used must strictly comply with the rules and regulations stipulated by the

relevant regulatory body.

(iv) The Exhibitor will be responsible and liable for the proper transportation and storage of all pressure tanks

containing helium, compressed air, argon, carbon dioxide and any other pressure medium.

(v) Pressure tanks improperly secured will be immediately removed.

(vi) All pressure vessels and equipment under pressure brought into the Exhibition Hall must conform to all

relevant safety standards and regulations.

(vii) Polluting substances such as chemicals, lubricants, acids and petroleum products cannot be discarded through

the standard drains.

(viii) Special drains can be arranged for the disposal of polluting waste upon request.

C10. Failure to Exhibit

Any organization which has signed and submitted a valid contract for space booking is deemed a confirmed Exhibitor.

If he fails to exhibit or turn up for the exhibition, and has not been released from the contract by the Organizer, he

shall be held liable for the full cost as stated in the contract, plus any additional cost incurred by the Organizer.

C11. Groups and National Pavilions

Organizers of groups and national pavilions are responsible for ensuring that all Exhibitors and or / Co- Exhibitors

on their stand are fully aware of and agree to, and abide with all the rules and regulations stated herein.

C12. Intellectual Property Rights

Koelnmesse Pte Ltd (hereinafter referred to as “Koelnmesse”), as a professional Organizer for international

exhibition, respects and expects our Exhibitors to respect the lawful rights of the owners of intellectual property

rights (hereinafter referred to as “IPR”). For the purpose of protecting the lawful rights of the owners of intellectual

property rights and facilitating the handling of intellectual property infringement complaints (hereinafter referred to

as “Complaint”) at the exhibition held by Koelnmesse, Koelnmesse hereby sets out the intellectual property

protection rules (“Rules”) to be complied with at the exhibition as follows according to the relevant Singapore laws

and regulations.

In these Rules the following expressions shall have the following meaning respectively:

“Exhibition” shall mean THAIFEX – World of Food Asia / World of Seafood / World of Coffee & Tea / World

of FoodService.

“Exhibition Items” shall mean any goods or products, exhibition boards and relevant promotion materials to be

exhibited, used, distributed, sold or provided at or in relation to the Exhibition.

“Relevant Activities” shall mean the display, promotion, advertising, reproduction, publication, distribution,

circulation, use, offer to sell, sale and provision of the Exhibition Items, either individually or collectively.

“Complaint Office” shall mean the office designated in the exhibition venue and composed of staffs of Koelnmesse,

the competent administration authorities of the Exhibition and the local intellectual property authorities (hereinafter

referred to as “Local IP authorities”).

1. Exhibitor’s representation and warranty

(a) The Exhibitor who participate in the Exhibition (hereinafter referred to as “Exhibitor”) represents and

warrants that its Exhibition Items and activities during the Exhibition do not and shall not:

Infringe any intellectual property right or any other right of a third party including but not limited

to any other Exhibitors at the Exhibition; or

Violate any Law.

(b) The Exhibitor shall undertake to indemnify and hold Koelnmesse and other Exhibitors harmless against

all claims of third parties in connection with the improper use of the IPR of the Exhibition Items

displayed and Relevant Activities performed by the Exhibitor which are not in accordance with the

stipulations of this Rules or the Law.

(c) The Exhibitor agrees that Koelnmesse shall not be responsible or liable for any actual or alleged

infringement of any of its intellectual property rights arising from or in connection with Exhibition Items

of any other Exhibitor at the Exhibition. In addition, the Exhibitor agrees that Koelnmesse shall not be

responsible or liable for any and all liabilities arising from or in connection with any decision made, or

any action taken or omitted, or any advice, recommendation or statement provided, by or on behalf of

Koelnmesse pursuant to, or in relation to, the Complaint and/or this Rules.

2. Procedures for handling Infringement Complaints

(a) In the case that an Exhibitor receives a Complaint

In the event you receive an Infringement Complaint, please refer the complainant directly to Koelnmesse

and/or the Complaint Office, at the designated office located in the exhibition venue.

Koelnmesse and/or the Complaint Office shall then handle the Complaint in accordance with the procedure

set out in section 2 lit d) below.

(b) If an IPR owner has a Complaint against any Exhibitor(s), it may contact Koelnmesse and/or the

Complaint Office at the designated office located in the exhibition venue or contact the competent local

IP administrative authorities directly.

(c) When lodging a complaint, the complainant shall provide the following materials:

Valid Certificate of the IPR in disputes:

o In case of patents, this shall be the patent registration certificate, the patent publication

documents, the identification certification of the patent right owner, the legal status

certification of the patent.

o In case of trademarks, this shall be the trademark registration certification affixed with the seal

of the complainant and the identification certification of the trademark right owner.

o In case of copyrights, this shall be the certification of the copyright and the identification of

the copyright owner.

o In case of any other types of IPR, we shall have the right to determine what shall constitute

appropriate evidence of ownership.

o In case that the registrant in an IPR registration certificate is different from the complainant,

the complainant shall provide supporting documents proving that the ownership of the IPR has

been assigned to the Complainant or the Complainant has been appointed by the IPR owner to

handle the Complaint.

Basic information of the complainant, such as name, address, contact person of the complainant

and the products or photos of the products which are claimed to be infringed if possible, etc.;

Basic information of the suspected infringement and infringers, such as the name of the suspected

infringer, exhibition counter of the Exhibition Items in question, photos, samples, brochures etc. of

the Exhibition Items in question, etc.;

(Reasons and evidence of the suspected infringement, e.g. the copy of the suspected Items;

Power of Attorney in the event that the complaint was filed by any one who is entrusted by the

owner of the IPR.

(d) Upon receiving an Infringement Complaint, Koelnmesse and/or the Complaint Office may require the

complainant to provide us with the relevant identity certificate and complete a complaint form.

Koelnmesse and/or the Complaint Office will then check completeness of the complaint materials and

act as follows:

If the complaint materials are complete, Koelnmesse and/or the Complaint Office will inform the

Exhibitor in question and forward the complaint to the relevant local IP administrative authorities

within 24 hours after we have received the complaint.

The Exhibitor in question will be required to provide Koelnmesse and/or the Complaint Office

with either one of the following:

o A written undertaking declaring that it has already removed or intends to remove the Exhibition

Items in question, has stopped or intends to stop Relevant Activities and that it shall stop

conducting any further infringing activities in connection with the Exhibition Items in

questions. The exact date when the Exhibition Items in questions are removed or will be

removed and when the Relevant Activities are stopped or will be stopped shall be clearly stated

in such written undertaking.

In this case, Koelnmesse and/or the Complaint Office shall have the right to forward a copy of

such undertaking to the relevant local IP administrative authorities and the complainant.

o A written declaration together with supporting documents claiming that the Complaint is

unjustified and Koelnmesse and/or the Complaint Office will, at our own discretion, review

the declaration.

If Koelnmesse and/or the Complaint Office believe the declaration is not satisfactory and

sufficient to prove that the Complaint is unjustified, the Exhibitor in question will be required

to remove the Exhibition Items in question and stop Relevant Activities immediately.

Koelnmesse and/or the Complaint Office will further require the Exhibitor in question to sign

a written undertaking stating that it shall stop conducting any further infringing activities in

connection with the Exhibition Items in questions. Koelnmesse and/or the Complaint Office

shall have the right to forward a copy of such undertaking to the relevant local IP

administrative authorities and the complainant.

If the complaint materials are not complete, Koelnmesse and/or the Complaint Office will require

the complainant to provide us with the supplementary materials and the complaint will not be

accepted if the supplementary materials are not provided.

In case of repeated Complaints, if the repeated Complaint is against the same Exhibition Items of

a previous exhibition organized by Koelnmesse Ltd., Koelnmesse and/or the Complaint Office

reserve the right to reject the Complaint if it was rejected under reasonable grounds and the repeated

Complaint does not provide supplementary document to support its statement.

(e) Timetable

Due to the time limit of the Exhibition, the following schedule shall be complied with in order to

facilitate the timely handling of any Complaint and Koelnmesse and/or the Complaint Office reserve

the rights to adjust the schedule when necessary.

Any Complaint shall be provided to Koelnmesse and/or the Complaint Office one day before the

Exhibition is closed;

Koelnmesse and/or the Complaint Office will have at least half a day during the term of the

Exhibition to review the completeness of the complaint materials of any Complaint and to require

and receive supplementary materials from a complainant;

The Exhibitor in question will have at least half a day during the term of the Exhibition to provide

the undertaking and declaration mentioned in the above item 3 lit d);

Koelnmesse and/or the Complaint Office will inform the complainant of the response from the

Exhibitor in question and the status or outcome of the Complaint either before or after the end of

the Exhibition.

Koelnmesse, as the Organizer of the Exhibition, reserves the right to reject, or to suspend or stop

the handling of any Complaint, if the above schedules are not complied with or if Koelnmesse, at

its own discretion, is of the opinion that there is insufficient time for us to complete the handling

of the Complaint. In such case, Koelnmesse shall not be liable or responsible for such rejection,

suspension or stop.

3. Cooperation of Exhibitors

(a) During the Exhibition, for the purpose of investigating the Complaint, Koelnmesse and/or the Complaint

Office shall have the right to take samples or photos of the Exhibition Items in question.

(b) Both the complainant and the Exhibitor in question shall cooperate and assist Koelnmesse and/or the

Complaint Office and relevant local IP authorities for the purpose of investigation of any Complaint.

(c) Upon request by Koelnmesse and/or the Complaint Office both before and during the Exhibition, the

Exhibitor shall provide us with the documentations and evidence which can prove the proper use of the

IPR of the Exhibition Items or can be used to against any actual or potential Complaint.

4. Non Compliance by Exhibitors

In case that the Exhibitors of the Exhibition Items of any alleged infringements refuse to cooperate, assist or

provide any necessary information upon request or refuse to comply with the above item 4 lit c), Koelnmesse

and/or the Complaint Office shall have the right to:

(a) Refuse to allow Relevant Activities of the Exhibition Items in question or remove the Exhibition Items

in question and take appropriate measures to prevent the commencement or continuance of all Relevant

Activities;

(b) Suspend or even terminate the right of the Exhibitor to participate in the current exhibition without

refunding any payment that has already been made by such Exhibitor;

(c) Prohibit the Exhibitor concerned from participating in future exhibitions organized by us or our affiliates.

C13. Unforeseen Occurrences

In the event of any unforeseen occurrences not stated, the decision of the Organizer shall be final.
