FAILURE to comply with any of the following conditions will result in the rejection of copy, and no responsibility can be accepted if such rejection should affect any date contained in such copy or any requirement of publication on a specific date.

Persons drafting any kind of notices are strongly advised to follow the guidance offered in—

(a) the Instructions Relating to the Drafting and Typing of Legislation (Attorney-General’s Circular 1 of 1978); and

(b) the Manual of Style for the Drafting and Preparation of copy published by Printflow (Private) Limited;

which two booklets are intended for complementary use.In these conditions, other than where a particular kind of copy is

specified, “copy” means copy for all matter contained in the Gazette itself and for subsidiary legislation issued as supplements to the Gazette.

1. (1) Other than by prior arrangements, only original typing is accepted.

(2) Carbon-copies are not normally acceptable, other than in cases where the original typing has to be legally retained, elsewhere, as, for example, in the case of a proclamation.

(3) Computer print-outs are not accepted automatically, as discussion may be necessary with regard to the extra time and costs involved.

2. (1) All copy must be clear and legible, and there must be double or one and a half spacing between the lines.

(a) which is of national importance, and which is originated as a matter of urgent necessity, may,by prior arrangement, be accepted late for the current week;

(b) may, due to shortage of staff or to technical considerations, be delayed until conditions permit its processing.

If printed forms forany such notices are unavailable, advertisers must prepare their own forms. While it is not necessary to include the preamble, the box-headings must be there, and, where applicable, the number of the form; for example, “Insolvency Regulations—Form 3”.

(2) In the case of copy for tabular notices, the provision of subsection (2) of section 3 does not apply.

9. Copy for all advertisements, whether sent by post or delivered by hand, must be accompanied by a requisition or a letter which clearly sets out—

(a) the name and address of the advertiser; and(b) the debtor’s code number, if any; and(c) the required date or dates of publication.

10. If a typographical error occurs in the Gazette, it is rectified as soon as possible by a correcting notice without charge to the ministry or department concerned, subject to the following conditions—

(a) that such error is reported to the editor within three months from the date of publication; and

(b) that the relevant copy, upon re-examination, is proved to be abundantly clear; and

(c) that the correction of such error is legally necessary.(2) If a drafting error is not detected before publication,

the originating ministry or department is required to draft its own correcting notice, take it to the Attorney-General for vetting and pay for such notice to be published.

Clemency Order 1 of 2020

IT is hereby notified that His Excellency the President has, in terms of section 112(1)(a) and (d) of the Constitution of Zimbabwe, made the order set out in the Schedule.

8. Full remission of sentence is hereby granted to all prisoners who have served life imprisonment for at least twenty-five (25) years. This include—

(i) prisoners sentenced to life imprisonment;(ii) prisoners whose sentences were commuted from death to

life imprisonment; and(iii) prisoners whose sentences were altered to life imprisonment

on appeal or review.The 25-year period shall include any period spent under the

sentence of death.Commutation of death sentence to life imprisonment

9. A commutation of death sentence to life imprisonment is hereby granted to all prisoners who have been on the death row for at least ten years and above.

Remission of sentence for all convicted female prisonersQuarter remission of sentence for prisoners serving effective2. Fuh remission of the remammg period of impnsonment is tereby sentence above 36 months

granted to all female prisoners, save for those convicted of specified offences. The inmate should have served at least half of her sentence.

Remission of sentence for all juveniles3. Full remission of the remaining period of imprisonment is

hereby granted to all juvenile prisoners under the age of eighteen (18), save for those convicted of specified offences. The prisoners should have served at least one third of his or her sentence.

10. Prisoners serving an effective period of imprisonment of more than thirty-six months who have served a third of their remaining sentence are hereby granted an additional one-quarter remission ofthe remaining effective period of imprisonment.

Prisoners excluded from the proposed amnesty11. The following persons are excluded from the amnesty:

any prisoner who was previously released on amnesty;any prisoner serving a sentence imposed by a Court Martial;any prisoner who has a record of escaping from lawful custody;any prisoner convicted of committing any specified offence.

Definitions12. For the purposes of this amnesty—

'specified offence” means—(a) murder, treason;(b) rape or any sexual offence;(c) carjacking, robbery;(d) stock theft;(e)(f)

36 months and below4. Full remission of the remaining period of imprisonment is hereby

granted to all those prisoners serving effective period of thirty-six (36) months and below and who would have served half of their sentence by the date of gazetting of this Clemency Order, provided they are not excluded from benefitting in terms of paragraphs 11 and 12.

Remission of sentence on medical grounds5. Full remission of the remaining period of imprisonment is hereby

granted to all prisoners who have been bed ridden for a prolonged period without recovery upon certification by a Correctional Medical Officer or a Government Medical Officer. The Department of Correctional Service should liaise with social welfare so that a commitment for providing medication is attained.

Remission of sentence for prisoners at the Open Prison6. Full remission of sentence is hereby granted to all prisoners

serving a term of imprisonment at the Open Prison regardless of offences committed. (g)

public violence;any conspiracy, incitement or attempt to commit any of the offences referred to in paragraph (a), (b), (c), (d) or (e);being an accessory after the fact to any of the offences referred to in paragraphs (a), (b), (c), (d) or (e).

IT is hereby notified that, the Minister of Higher and Tertiary Education, Science, Innovation andTechnology Development and has in terms of section 6 of the Manpower Planning and Development Act [Chapter 28:02], established an Institute known as the Management Training Bureau.

PARTI

PRELIMINARy

Title

1. These regulations may be cited as the Management Training Bureau Regulations, 2020.

Interpretation

2. In these regulations.“Board” means the Management Training Bureau Board

referred to in section 4;“commercialisation” means to alter in order to raise revenue

for self-sufficiency, investment and expansion;“curriculum” means a document produced by a body or

institution showing—(a) all the courses that are needed to attain a particular

named standard or qualification;(b) the periods within which such courses are taken

during the academic year of the body or institution;

“examination” means any examination and or assessment that the Secretary has directed the institute to conduct in terms of these regulations;

“Executive Director” means the Executive Director of the institute appointed in terms of paragraph 13 of the Schedule;

“funds” means the funds of the institute referred to in section 7 of these regulations;

“Institute” means the Management Training Bureau referred to in terms of section 3.

“member” means the chairman or any other member of the Board;

“Minister” means the Minister responsible for Higher and Tertiary Education, Science, Innovation andTechnology Development or to any other Minister to whom the President may from time to time assign the administration of these regulations;

“Secretary” means the Permanent Secretary responsible for Higher andTertiary Education, Science, Innovation and Technology Development.

PART II

Management Training Bureau

Management Training Bureau3. The Management Training Bureau, which existed before the

date of commencement of these regulations shall continue to operate in accordance with these regulations and it shall be a body corporate, capable of suing and being sued in its corporate name.

Board of Management Training Bureau

4. (1) The operations of the Institute shall, subject to these regulations, be controlled and managed by a board to be known as the Management Training Bureau Board.

(2) The Board shall consist of not less than five (5) and not more than nine (9) members appointed by the Minister, and of whom at least—

(a) one member shall be a representative of the Ministry of Higher and Tertiary Education, Science, Innovation and Technology Development;

(b) one member shall be a representative of the National Manpower Advisory Council;

(c) one member shall be the Executive Director appointed in terms of paragraph 13 of the Schedule;

(d) one member shall be a registered legal practitioner registered in terms of the Legal Practitioners Act [Chapter 27:07\,

(e) one member shall be a Chartered Accountant;(f) one member shall be a Human Resources consultant;

and(g) the remainder shall be appointed for their expertise in

education and training.

(3) The Minister shall ensure that at least half of the appointed members are women.

(4) The Minister shall, in writing, appoint a member as chairperson and another as vice-chairperson of the Board, and the vice-chairperson shall exercise the functions of the chairperson during any period that the chairperson is unable to exercise his or her functions provided that if the chairperson is male the vice chairperson is female or vice-versa.

Functions of Board

5. The functions of the Board shall be to—(a) implement appropriate training programmes that benefit

industry in Zimbabwe and beyond;(b) establish policies that ensure the effective management

control, administration and development of the Institute;(c) raise funds for the Institute, collect and retain fees, and

develop revenue generating commercial units;(d) put in place effective finance and management systems

that foster financial discipline;

(e) report to the Secretary Annual Audited accounts of the Institute;

(f) disseminate information relating to the Institute’s activities by cooperating with individuals, organisations and institutions; and

(g) ensure that the Institute is properly staffed and professionally managed.

Functions of Institute6. (1) The functions of the Institute shall be to—

(a) train and produce knowledgeable and skilled human capital for the industry focusing on priority programmes for strategic sectors that have impact to the economy and society including but not limited to business, leadership and entrepreneurship development, information communication technology, innovation management hospitality, international languages and diplomacy;

(b) collaborate with individuals, organisations and institutions to strengthen the provision of relevant training industry in and outside Zimbabwe;

(c) engage in commercial activities to generate funds for its own quality sustenance and expansion;

(d) benchmark the activities of the Institute to the best practices of the same institutes;

(e) undertake relevant research, participate in investment ventures as well as publish information and documents pertaining to the relevant held;

(f) charge fees or levy rates in respect of any services rendered by the Institute:

Provided that the Institute shall maintain its main focus as a public institute and engage in commercial activities to add value to the training function while raising revenueforself-sufficiency, investmentandexpansion; and

(g) do all such things as maybe necessary for incidental or conducive to attaining or advancing the objects or interests of the Institute and carrying out the provisions of these regulations.

PART III

Financial Provisions Reiating to the Institute

Funds of the Institute

7. (1) The funds of the institute shall consist of—(a) such moneys as may be payable to the Institute from

moneys appropriated for the purpose by the Act of Parliament; or

(b) such moneys obtained as gifts, donations, bequests, loans or any other financial assistance, subject to the approval of the Minister; and

(c) such other moneys as may vest in or accrue to the Institute, whether by charging of fees and levies, trading, disposal of assets, capital development funds, re-investments, acceptance of donations, interest and returns or investments or any other moneys accrued in the course of its operations or otherwise.

(2) The Institute shall in each financial year at such time and in such forms as the Minister may determine, submit a statement of its estimated income and expenditure for the ensuing financial year to the Minister for approval.

(3) The moneys referred to in subsection (1) shall be employed by the Institute in accordance with the approved statement of income and expenditure referred to in subsection (2) above and any unexpected balance shall be carried forward as a credit to the following year.

(4) Moneys not immediately required by the institute may be invested in such manner as the Board after consultation with the Minister considers appropriate.

Institute to make certain charges to revenue account

8. (1) The Institute shall charge to its revenue account all charges which, in the normal conduct of business, are regarded as proper to be charged to the revenue account and, in so doing, shall make in each financial year proper provision for—

(a) the depreciation or diminution in the value of assets;and

(b) the payment of interest on and all other charges and expenses incurred in connection with loans; and

(c) the redemption of loans in due times to the extent that such redemption exceeds provision for depreciation.

(2) In charging to its revenue account all charges which in the normal conduct of business are regarded as proper to be charged to revenue account as provided in subsection (1), the Institute may, in each financial year make provision for—

(a) meeting, in whole or in part, increases in the cost of replacing assets to an extent approved by the Minister after consultation with the Minister responsible for finance;

(b) making payments to any insurance scheme agreed upon by the Institute to meet, in part, such liabilities of the Institute in consultation with the Secretary; and

(c) making payments to pension fund agreed upon by the Institute to meet, in whole or in part, superannuation liabilities of the Institute.

Establishment and operation of reserve fund

9. (1) The institute may establish a reserve fund to which may be appropriated from a surplus of income over expenditure at the end of each financial year, such sums as the Board may recommend for approval by the Secretary with the concurrence of the Minister.

(2) Subject to this Part, moneys in the reserve fund established in terms of subsection (1) may be used for such purposes as the Board may consider expedient for the proper exercise by the Institute of its functions, including the establishment of capital development funds and the general development of its assets.

(3) The Board shall comply with any direction, which the Minister may give in relation to the management of the reserve fund established in terms of subsection (1).

Meeting of deficiencies

10. (1) If in any financial year the income of the Institute, together with any surplus to income brought forward from a previous

financial year, is sufficient to enable the Institute to meet the charges and to make the provisions required by section 8, the deficiency shall unless the meeting otherwise directs, be met from the reserve fund established in terms of section 10.

(2) If the moneys in the reserve fund are insufficient for the purpose of meeting the deficiency referred to in subsection (1), the Minister may out of money appropriated for the purpose by Parliament, meet the whole or any portion of the deficiency outstanding after the application of moneys in the reserve fund to that purpose either at the end of the financial year or at such time thereafter as he or she considers expedient.

(3) Any payment made in terms of subsection (2) shall be regarded as a loan made by the State to the Institute and shall be repayable by the institute on such terms and conditions as the Minister, with the concurrence of the Minister responsible for finance, may fix.

Financial year of Institute

11. The financial year of the Institute shall be the period of twelve months ending on the 31st December in each year or on such date as may be prescribed.

Accounts of Institute

12. (1) The Institute shall keep such proper accounts and other records in respect of all its operations, undertakings and property, including financial statements and such other particular accounts and records as the Minister may direct.

(2) Budgeting for a deficit in any financial year shall be prohibited.

Audit of accounts of Institute

13. (1) The Institute shall appoint as auditors one or more persons approved by the Minister, who are registered as public auditors in terms of the Public Accountants and Auditors Act [Chapter 27:!2\ or who, in the opinion of the Minister, are otherwise competent to carry out the functions of auditors in terms of this section.

(2) The accounts of the Institute shall be examined by the auditors appointed in terms of subsection (1).

(3) The auditors shall make a report to the Board and the Secretary, of the same content but submitted separately, on the statement of accounts prepared in terms of section 13(1) and such report shall state whether or not in their opinion the statement of accounts gives a true and fair view of the state of li nancial affairs of the Institute.

(4) In addition to the report referred to in subsection (3), the Minister may require the Board to obtain from the auditors such other reports, statements or explanations in connection with the operations, undertakings and property of the Institute as the Minister may consider expedient.

(5) If, in the opinion of the auditors —(a) they have obtained the information and explanation that

they require; or(b) any accounts and records relating thereto have not been

properly kept by the institute; or(c) the Institute has not complied with provision of this Part;

the auditors shall include in their report made in terms of subsection (3) or (4), as the case maybe, statements to that effect.

(6) The Board shall pay due regard to any observations as and recommendations made by the auditors and shall report to the Secretary on any action taken to rectify any anomalies and deficiencies with respect to which the auditors will have made observations.

(7) The Minister shall reserve the right, either in his or her capacity or acting on the advice of the Secretary, to direct the Board to take remedial action in respect of any anomalies or deficiencies upon which the auditors will have made observations.

(8) Fees due to the auditors appointed in terms of this part shall be charged to the revenue account.

Powers of auditors14. The auditors appointed in terms of this Part shall be entitled

at all reasonable times to require to be produced to them all accounts and other records kept by the Institute or its agents and to require from any member or person employed by the Institute or it agents such information and explanations as in their opinion are necessary for the purpose of their Audit.

PART IV

General

Exemption from liability of Institute members and employees

15. No liability shall attach to the Institute or to any member of any loss or damages sustained by any person as a result of the bona

fide exercise or performance by the Institute, the Board, a Committee, the Executive Director of the Institute or any employee or agent of the Institute acting in the ordinary course of his or her employment in terms of these regulations:

Provided that this section shall not be construed so as to prevent any person from recovering by action in a court of competent jurisdiction, compensation for any loss or damage sustained by him or her which was caused by negligence or breach of contract.

Indemnity of member and employees of Institute

16. The Institute shall indemnify every member of the Board or of a committee of the Board and the Executive Director and every auditor, staff or agent of the Institute against any costs incurred by him or her in—

(a) defending any proceedings, whether civil or criminal, which arise out of his or her duties as member, Executive Director, auditor, employee or agent of the Institute, as the case may be, and in which judgement is given in his or her favour or in which he or she is acquitted, as the case may be: and

(b) instituting any court proceedings on behalf of the Institute.

Student’s enrolment disciplines and fee structure

17. (1) The Board may, with the concurrence of the Minister, prepare internal rules in respect of student enrolment, academic conduct, performance and the maintenance of good discipline at the institute.

(2) Students due for enrolment at the Institute shall be required to uphold the rules, regulations and requirements of the Institute and shall sign undertakings to that effect, by which they shall be bound.

(3) The Minister may from time to time, on recommendations of the Board, set the fees chargeable at the Institute.

Student discipline and investigation into affairs of the Institute

18. (1) The Board may, with the concurrence of the Minister, appoint persons to supervise student conduct, to maintain good discipline at the Institute and to investigate into the general affairs of the Institute.

(2) Any person appointed in terms of subsection (1) shall have the same powers as are conferred upon a Commissioner by the Commissions of Inquiry Act [Chapter 10:07], except the power to order a person to be detained in custody and sections 9 to 13 and 15 to 19 of that Act shall apply, with the necessary modifications, in relation to an investigation made in terms of subsection (1) and to any person summoned to give or who is giving evidence at that investigation.

Failure by Executive Director, Board and Institute to comply with regulations

19. (1) If at any time the Minister is satisfied that the Executive Director, the Board or the Institute has failed to comply with these regulations, he or she may, by notice in writing, require the Executive Director, the Board or the Institute as the case may be to make good the default within a specified time.

(2) If the Executive Director, the Board or the Institute fails to comply with a notice issued in terms of subsection (1), the Minister may apply to the High Court for an order compelling the Executive Director, the Board or the Institute, as the case may be to remedy the default and the High Court may make such order on the application as it deems fit.

Offices of the Institute

20. (1) The Head Office of the Institute shall be in such place as the Board, with the approval of the Minister, may fix.

(2) The Board may, with the approval of the Minister establish branch offices, within or outside Zimbabwe.

Standing orders and internal instruction

21. The Board may, in consultation with the Minister, make standing orders and internal instructions to regulate any activity occurring within the mandate of the Institute including administrative and accounting instructions, the regulations of meetings or any other matter which in its opinion is necessary or convenient to be provided for in that manner:

Provided thatthe Board may, in consultation with the Minister, amend its standing orders and internal instructions as deemed necessary from time to time.

Transitional provisions

22. All employees who are currently conducting business on behalf of the Institute will automatically be the Institute’s employees unless they opt out.

Conditions of Office of Members

1. (1) Subject to paragraphs 2 and 3 of this Part, a member shall hold office for such period, being not more than five (5) years, and subject to any other terms and conditions, as the Minister may fix on appointment.

(2) Members shall be eligible for reappointment for not more than one term.

(3) On reappointing members, the Minister shall ensure that at least one third of the members are retired by rotation.

Disqualification from appointment as members

2. The Minister shall not appoint a person as a member who has, in terms of a law in force in any country—

(a) been adjudged or otherwise declared insolvent or bankrupt and has not been rehabilitated or discharged; or

(b) has been convicted of an offence involving dishonesty.

(c) is a sitting member of Parliament.

Vacation of office by member

3. A member shall vacate his or her office and the office shall become vacant—

(a) one month after the date he or she gives notice in writing to the Minister of intention to resign from office or after the expiration of such shorter period as he or she may agree with the Minister; or

(b) on the date he or she is convicted of an offence involving dishonesty in the last five years; or

(c) if he or she ceases to be a Zimbabwean resident; or

(d) if he or she is required in terms of paragraph 4 to vacate his or her office.

Minister may require member to vacate office

4. (1) The Minister may require a member to vacate his or her office if the member—

(a) has been found guilty of any conduct which renders him or her unsuitable to be a member; or

(b) has failed to comply with the conditions of his or her office as fixed by the Minister in terms of paragraph (1); or

(c) is incapable of efficiently performing his or her functions as amember, either mentally or on other health grounds.

(2) The Minister may, on the recommendation of the Secretary, and following representations from the Board, require a member to vacate his or her office if the Minister is satisfied that the member has been absent without permission of the Board for three consecutive meetings of the Board of which he or she has had due notice, and that there was no just cause for the member’s absence.

Filling of vacancies on Board

5. On the death of or vacation of office by a member, the Minister shall, subject to paragraph 4 appoint a person to fill the vacancy within ninety (90) days of the post falling vacant.

Meetings and procedures of Board

6. (1) The Board shall hold its first meeting on such date and at such place as the Secretary, after consultation with the Minister, may fix and thereafter the Board shall meet for the dispatch of business at such place and reasonable time as chairperson may direct:

Provided that the Board shall meet at least four times in a year.

(2) The Chairperson of the Board may at any time and shall at the request in writing of not less than two members, convene a special meeting of the Board.

(3) If at a meeting of the Board the chairperson and the vice-chairperson are both absent; the members present may elect one of their members to preside at that meeting as chairperson.

(4) Three quarters of members shall form a quorum at a meeting of the Board.

(5) All acts, matters or things authorised or required to be done by the Board may be decided by a majority vote at a meeting of the Board at which a quorum is present.

(6) At all meetings of the Board each member present shall subject to paragraph 7 have one vote on each question before the Board and in the event of an equality of votes the chairperson shall have a casting vote in addition to a deliberative vote.

(7) Any proposal circulated among all members and agreed to in writing by a majority of all members shall be adopted at a duly constituted meeting of the Board and shall be incorporated into the minutes of the next succeeding meeting of the Board:

Provided that if a member requires such proposal to be placed before a meeting of the Board, this subparagraph shall not apply to such proposal.

(8) The Board may, with the approval of the Minister, co-opt any person to the Board or its committees, for his or her expertise in matters placed before the Board but such co-opted person shall have no vote in any decision by the Board.

(9) Subject to this paragraph, the Board may regulate its own procedures.

Committees of Board

7. (1) For the better exercise of its functions, the Board may establish one or more committees in which may be vested and on which may be imposed such of the functions of the Board as the Board, with the written consent of the Minister may direct:

Provided that—

(a) the vesting or imposition of any functions in a committee shall not divest the Board of such functions; and

(b) theBoardmayamendorwithdrawanydecisionof any such committee in the exercise of its functions.

(2) The procedure of a committee of the Board shall be fixed by the Board.

(3) The Chairperson of the Board may at a convenient time and place, convene a meeting of a committee of the Board.

(4) The Board—

(a) shall appoint one of its members to chair any committee established by the Board;

(b) may appoint as members of any of its committees, on such terms and conditions as the Board may fix, persons who are not members of the Board.

Remuneration and expenses of members of Board and committees

8. A member of the Board or its committee shall be paid by the institute—

(a) such remuneration, if any, as the Minister, with the approval of the Minister responsible for finance, may fix for members generally; or

(b) such allowances as the Minister, with the approval of the Minister responsible for finance, to meet any reasonable expense incurred by him or her in connection with the business of the Board or that committee, as the case may be.

Members to declare conflict of interest

9. (1) If a member or his or her spouse—

(a) tenders for or acquires or holds a direct or indirect pecuniary interest in a contract with the institute; or

(b) knowingly acquires or holds a direct or indirect pecuniary interest in a company, cooperative or association of persons applying or negotiating for a contract with the institute; or

(c) Owns immovable property or a direct or indirect pecuniary interest in a company, cooperative or association or persons which results in his or her private interest coming or appearing to come into conflict with his or her duties as a member;

the member shall forthwith disclose the fact to the Board.

(2) A member referred to in subparagraph (1) shall take no part in the consideration of discussion of, or vote on, any question before the Board which relates to any contract, right, immovable property or interest referred to in that subparagraph.

(3) The Executive Director shall not take any part in the consideration or discussion of any question before the Board, which relates to the terms and conditions of his or her appointment as Executive Director.

Validity of decisions and actions of Board

10. No decision or act of the Board done under the authority of the Board shall be invalid by reason of the fact that—

(a) the Board consisted of fewer than the number of persons for which provision is made in paragraph 6(4); or

(b) a disqualified person acted as a member at the time the decision was taken or the act was done or authorised;

if the decision was taken or the act was done or authorised by a majority of the persons who at the time were entitled to act as members.

Execution of contracts and instruments by Board and Institute

11. An agreement, contract, or instrument approved by the Board may be entered into or executed on behalf of the Institute by any person or persons generally or specifically authorised by Board for that purpose.

Minutes of proceedings of Board and committees

12. (1) The board shall cause minutes of all proceedings of and decisions taken at a meeting of the Board or a committee of the Board to be entered in books kept for that purpose.

(2) Any minutes referred to in subparagraph (1) which purport to be signed by the chairperson of the meeting to which the minutes relate or by the chairperson of the next following meeting of the Board or the committee concerned, as the case may be, shall be accepted for all purposes as prima facie evidence of the proceedings of and decisions taken at the meeting concerned.

Appointment of Executive Director of Institute

13. (1) The Board may in consultation with the Minister appoint a person to be the Executive Director of the Institute, on such terms and conditions as it may fix.

(2) No persons shall be appointed as Executive Director and no person shall be qualified to hold office as Executive Director if he or she is not a citizen of Zimbabwe or ordinarily resident in Zimbabwe.

(3) The appointment of the Executive Director shall terminate if he or she would be required in terms of paragraphs 3 and 4 to vacate his or her office had paragraph 2 applied to him or her.

(4) The Board may, with the approval of the Minister, assign to the Executive Director such functions of the Institute as the Board thinks fit.

Functions of the Executive Director

14. (1) The functions of the Executive Director shall be to—

(a) ensure the efficient realisation of the Institute’s objects, and shall for that purpose have power to appoint employees as may be delegated to him or her by the Board;

(b) prepare annually for the consideration of the Board such programmes of activity relating to the functions of the institute as may be required by the Institute, together with such supporting budgets as may be necessary;

(c) carry out any other duties that deems the efficiency of the Institute.

(2) Assignment of functions in terms of paragraph 13(4) —

(a) may be made either generally or specifically and subject to such restrictions, reservations and exceptions as the Board may determine;

(b) may be revoked by the Board at any time;

(c) shall not preclude the exercise of the functions by the Board itself.

(3) The Executive Director of the Institute shall have the right to attend meetings and to take part in the proceedings of the Board as if he or she was a member but shall not have a vote on any question before the Board.

Principles to be observed by the Institute

15. (1) In the exercise of its functions in terms of these regulations, the Institute—

(a) may co-operate with any government departments, private institutions or institutions of Higher and Tertiary learning relevant to its pursuits in and outside Zimbabwe;

(b) shall have regard to the national interest of Zimbabwe in all its dealing with or in relation to external institutions and co-operating partners;

(c) shall, generally, direct its activities towards implementing Government policy in the field of technical and vocational training as it pertains to the tourism and hospitality industry.

(2) The institute shall invest its excess funds obtained from its commercial activities towards its own expansion and standards development, including the upliftment of the conditions of services of its employees by way of remuneration, allowances and gratuities as may be approved by the Board in consultation with the Minister on the advice of the Minister responsible for Finance.

Reports of the Institute

16. (1) In addition to any annual report which the Institute is required to submit to the Secretary, who is the accounting officer in terms of the Public Finance and Management Act [Chapter 22:19], the Institute—

(a) shall submit to the Secretary such other reports as the Minister may require;

(b) may submit to the Secretary such other reports as the Board may consider advisable in regard to the operations, undertakings and property of the institute.

(2) The institute shall give the Secretary such information relating to the operations, undertakings or property of the Institute as the Minister at any time require.

(3) The Minister may lay a report submitted to him or her by the Institute in terms of subsection (1), before Parliament.

Minister may give policy directions

17. (1) The Minister may, after consultation with the Board, issue such directions of a general character relating to the policy which the Institute is to observe in the exercise of its functions as the Minister considers to be requisite in the national interest.

(2) The Institute shall, with all due expedition, comply with directions given to it in terms of subparagraph (1).

IT is hereby notified that the Commission has, with the approval of the Minister of Information, Publicity and Broadcasting Services, in terms of section 91 of the Access to Information and Protection of Privacy Act [Chapter 10:27], made the following regulations: —

1. These regulations may be cited as the Access to Information and Protection of Privacy (Registration, Accreditation and Levy) (Amendment) Regulations, 2020 (No. 8).

2. With effect from the 1st January, 2020, the First Schedule to the Access to Information and Protection of Privacy (Registration, Accreditation and Levy) Regulations, 2002, published in Statutory Instrument 169C of2002, is repealed and the following is substituted—
