The Argentine Republic has the following observations to make with regard to the "Revised Labelling Provisions in Milk Product Standards" (Doc. CL 1986/65-MILK):

(i) It agrees with the list of ingredients referred to in document MDS 86/8-Rev.l;

(ii) As regards the country of origin, it is repeated once again that the declaration should be compulsory (this requisition is in line with point 4.5 of Standard A-l for butter, page 4 of the document MDS 86/8-Rev.l; point 4.5 of Standard A-2 for milkfat, page 5; point 4.6 of Standard A-3 for evaporated milk, page 8; point 4.6 of Standard A-4 for sweetened condensed milk, page 10; point 5.5 of Standard A-5 for whole milk powder, page 12; point 4.5 of Standard A-6 for cheese, page 14; point 5.5 of Standard A-7 for whey cheese, page 16; point 6.5 of Standard A-8(a) for processed cheese, page 19; point 6.5 of Standard A-8(b) for spreadable processed cheese, page 22; point 6.5 of Standard A-8(c) processed cheese preparations, page 24; point 5.5 of Standard A-9 for cream, page 26; point 4.5 of Standard A-10 for cream powder, page 29; point 4.5 of Standard A-ll(a) for yogurt, page 31; point 5.5 of Standard A-ll(b) for flavoured yogurt, page 34; point 5.4 of Standard A-12 for acid casein, page 36; and point 5.4 of Standard A-13 for caseinates, page 37);

Brazil

Brazil has notified full acceptance of 180 Codex Maximum Residue Levels (MRLs) for 38 pesticides included in the First Edition of Volume XIII of the Codex Alimentarius. This corresponds to about 11 per cent of the MRLs contained in that volume. Some seven other MRLs in force in Brazil were indicated in the communication as being practically identical with the corresponding Codex MRLs. The position of Brazil concerning the remaining MRLs in Volume XIII, Edition I, has not been communicated.

EEC

The EEC has submitted to the Codex Committee on Pesticide Residues a communication concerning Codex MRLs contained in Volume XIII, Edition II of the Codex Alimentarius. It indicates the Community's position on 45 pesticide compounds as well as on 450 pesticide/crop combinations. The communication was prepared on the same basis as earlier submissions, i.e. an indication of the extent of free circulation within the Community of products complying with Codex MRLs, for which Community provisions also exist. In addition to fruits and vegetables, the communication includes references to cereals and products of animal origin, following the entry into force of Directives for these groups of products force on 30 June 1988.

Finland

Finland has notified its acceptance with specified deviations of the Codex Stan 118-1981 for gluten-free foods.

Hungary

Hungary accepts the Codex Pesticide Maximum Residue Limits included in Volume XIII, Edition II, of the Codex Alimentarius. Acceptance is effected on the date of declaration.

Hungary would like to add that the NFD form has been used in those cases where a pesticide has not been registered for the particular commodity, but where food products complying with Codex Limits may be freely distributed within Hungary.

Altogether, 89 per cent of the Codex Limits have been accepted for imported commodities and only 11 per cent of the Limits were considered to be unacceptably high. In the latter cases, the Hungarian MRLs will be taken into consideration.

Hungary has returned the completed acceptance form indicating full or limited acceptance of approximately 25 per cent of the Codex MRLs. Hungary has also indicated approximately 43 per cent of the Codex MRLs to be suitable for giving free entry to food complying with the Codex MRLs in question (NFD). This form of response was given in respect of pesticides not registered in Hungary. Only about 11 per cent of the Codex MRLs were indicated as not being acceptable for trading purposes (NND).

India

The establishment of national MRLs under the Food Law requires that the pesticide be registered under the "Pesticide Act". To date, MRLs have been established for 31 pesticides. A further 30 pesticides are being studied.

Republic of Korea

A study of pesticide residues in food and agricultural products is being carried out. Following this study, the Republic of Korea intends to notify acceptances of Codex MRLs.

New Zealand

New Zealand has communicated that it gives "limited acceptance" to all Codex MRLs included in Volume XIII of the Codex Alimentarius and indicated that any food imported into New Zealand may contain proportions of pesticides not greater than the proportions specified for that food in the current edition of the FA0/WH0 Codex Alimentarius Commission publication entitled "Codex Maximum Limits for Pesticide Residues" (CAC/VOL.XIII).

Portugal

Portugal has notified acceptance of Codex MRLs in CAC/VOL.XIII, Edition II, and Supplement 1 as follows: "full acceptance" of Codex MRLs which are identical with the limits of the EEC; "limited acceptance" of all remaining Codex MRLs, bearing in mind further limits to be established by the EEC.

Switzerland

Switzerland is envisaging or has envisaged the following measures:

Acceptance of standards

For juridical reasons, Switzerland will have to make declarations of "free entry" only. At the request of the Swiss National Codex Alimentarius Committee, a comparative study of Swiss legislation and Codex standards was undertaken in 1987.

Switzerland has notified a review of all Codex standards up to 31 May 1987, with the specified deviations referred to the Labelling Section and Methods of Analysis and Sampling.

The United States indicated its position regarding the acceptance of Codex MRLs in Volume XIII, Edition II, of the Codex Alimentarius and Supplement 1, in conformity with the US objective of granting full acceptance to as many Codex limits for pesticide residues as possible. Reasons for non-acceptance were provided in each case, with information on whether or under what conditions commodities in conformity with the Codex limit may be distributed in the United States.

The United States has also informed the secretariat that before a Codex MRL may be fully accepted by the US, it must be determined that the Codex limit complies with the requirements of the Federal Food, Drug and Cosmetics Act, and a regulation establishing such a US tolerance must have been promulgated. The establishment of a tolerance under US regulation is a condition precedent to accepting a Codex MRL. Non-acceptances should not be used to mean that the United States will be unable to give full acceptance at some future time.
