The review of restrictions was initiated at the beginning of 1958 and, consequently, th«= series of consul- tations with countries acting under Article XII should begin early in 1959 and those with countries acting under article XVIII, early in I960. 2* In accordance with its terms of reference the Working Party has considered the arrangements and procedures to be adopted for the carrying out of these consultations, in the light of the experience gained in the course of the consultations held in 1957 and the recommendations submitted by the Executive Secretary in W.l3/l4o Contents of the Consultations 3. The Working Party notes that consultations held under Articles XH*A and XVIII<12, are to cover the nature of the balance-of-payments difficulties of the contracting party applying the restrictions, alternative corrective measures which may be available, and the possible effect of the restrictions on the economies of other contracting parties. In the past, consultations on import restrictions have always provided an opportunity for the free exchange of views which usually contributed to a better understanding of the problems facing the consulting countries, of the various kinds of measures taken by contracting parties to deal with their problems, and of the possibilities of further progress in the direction of freer, multilateral trade. II» f.a noted *l~jBfy the Committee on Balance-of-Payments Restrictions (the establish- ment of which is recommended below) will need to take account of the new provisions of Article XII:A(c) and Article XVIII:12(c) in carrying out the consultations. The Working Party suggests that these new consultations on import restrictions should continue to be so conducted as to give an oppor- tunity for a free and full exchange of views between delegations concerned. 4, In conducting consultations on balance-of-payments restrictions in the past, the CONTRACTING PARTIES have develope^and relied upon certain "Plans" which set out the questions to be discussed. In the light of past experience the Working Party has drawn up a new Plan of Discussion and recommends that it be adopted for the consultations to be held under Article XII»A(b) and Article XVIIIil2(b) in future (see Annex I ) . Having regard to the diversity of circumstances, the Plan should not be regarded as a rigid programme but might require suitable adaptation in each case. Contents of the Consultations

3 . The Working Party notes tha t consultat ions held under Ar t ic les XH*A and XVIII<12, are to cover the nature of the balance-of-payments d i f f i cu l t i e s of the contracting party applying the r e s t r i c t i o n s , a l te rna t ive correct ive measures which may be ava i l ab le , and the possible e f fec t of the r e s t r i c t i o n s on the economies of other contracting p a r t i e s . be given careful consideration; the Committee conducting the consultations should take in to account a l l f ac to r s , both in t e rna l and ex te rna l , which affect the balance-of-payments pos i t ion of the consulting country.

Documentation for the Consultations

5. Past experience has shown tha t advance preparation i s of great value both in expediting the consultat ions and in making them more meaningful and f r u i t f u l . The bas ic documents prepared by the s e c r e t a r i a t for the 1957 consultations were found to be very useful and the Working Par ty recommends that t h i s pract ice be continued. On the basis of available information, including data obtained from the contracting p a r t i e s concerned and from other sources, the s e c r e t a r i a t should compile a bas ic document for each consul ta t ion. (In the case of countries which consulted in 1957, t h i s w i l l mean the keeping up to date and revision of the baBio documents prepared in tha t year . ) As the f inancia l aspects of t h e r e s t r i c t i o n s w i l l be fu l ly deal t with in the background papers supplied by the In terna t ional Monetary Fund, the s e c r e t a r i a t paper should concentrate on the trade aspects of the r e s t r i c t i o n s , giving as far as possible a precise and comprehensive descript ion of the r e s t r i c t i v e systems, t he i r administrat ion, and the effects of the r e s t r i c t i o n s . A chronological account should also be given of the more important changes made in the controls and r e s t r i c t i o n s in the preceding year or since the preceding consul tat ion. In preparing these papers the s e c r e t a r i a t , as in the p a s t , should consult as fu l ly as possible with the contracting pa r t i e s concerned, and f u l l opportunity should be given to the l a t t e r to examine the contents of the papers . In so fa r as p rac t i cab le , the consulting government should be inv i ted to supply a statement on i t s current pol icy i n the use of import r e s t r i c t i o n s , to be attached to the basic document.

6 . Such papers should in general be circulated a month before the relevant consultations are to be held. In order tha t t h i s may be achieved, the co-operation of the contracting p a r t i e s concerned wi l l be e s s e n t i a l . The contracting pa r t i e s applying import controls and r e s t r i c t i o n s should keep the s ec r e t a r i a t regular ly informed of any changes in t h e i r control systems, and transmit to i t a l l relevant documentation (such as new laws and decrees, regula t ions , programmes, policy statements, public not ices and l icensing i n s t ruc t i ons , e t c . ) which would enable the s e c r e t a r i a t to prepare the basic documents for the consul ta t ions . The Working Party also recommends tha t each contracting par ty applying r e s t r i c t i o n s be asked to designate an o f f i c i a l for the purpose of keeping contact with the s e c r e t a r i a t .

Time Schedule for the Consultations

8 , The Working Par ty noted the recommendation of the Chairman of the CONTRACTING PARTIES tha t i t be placed on record t h a t twelve of the contracting pa r t i e s applying balance-of-payments import r e s t r i c t i o n s a t present f u l f i l the requirements of Ar t ic le XVTII«4 and t h a t t h e i r r e s t r i c t i ons be considered as being applied under Ar t ic le XVIIIîB ra ther than Art ic le XII (W.13/20/Add.l), consoquontly, tho other fourteen contract ing pa r t i e s applying r e s t r i c t i o n s are considered as acting under Art ic le XII , and are therefore required to consult under Ar t ic le XII*4(b) in 1959. Two other contracting pa r t i e s (as well as four among the four teen) , on account of t h e i r r e so r t to cer ta in provisions of Art ic le XIV, are required to consult annually under Art ic le XIV*1(g), and for the purpose of programming, i t w i l l be convenient to take a l l these in to account. The countries which are required to consult i n 1959 are the following*

The Working Party understands t ha t the CONTRACTING PARTIES have planned to hold two regular sessions i n 1959 and considers that there w i l l be advan­tage in holding the consultations a t the same time as these sess ions . Some members f e l t tha t i t should be feasible to complete the consultations in two groups during these sess ions; t h i s would make i t eas ie r for t he i r governments to provide adequate representa t ion. The Working Party considers, however, t ha t i t would be d i f f i c u l t to complete such a large number of consultations in two shor t periods and t ha t a t l e a s t three groups w i l l be necessary. With these considerations in mind and having consulted the representat ives of the In te rna t iona l Monetary Fund about the Fund's prospective consultation schedule and taking account of other relevant information, the Working Party has drawn up a ten ta t ive t ime-table for the consultations i n 1959» as s e t out in Annex I I and recommends t h a t the executive Secretary be authorized to de te r ­mine the precise date for each consultation a f te r consultation with the contracting pa r t i e s concerned, the In te rna t iona l Monetary Fund and the Chairman of the Committee conducting the consul ta t ions . The jixecutive Secretary may change a consultation from one pa r t to another, but due regard should be had to the d e s i r a b i l i t y of avoiding the oonoen*-:n''_^on of consultat ions in any one par t o* the schedule.

10, The Working Party considers that as far as practicable thu first and third groups of meetings of the Committee should be held at the same time as the sessions of the CONTRACTING PARTIhS, although it is recognized that for reasons of secretariat staffing and conference arrangements it might be unavoidable for the third group of meetings to be held, at least in part, in advance of the autumn session of the CONTRACTING PARTED. Should there be need for another subsidiary body of the CONTRACTING PARTIES, e.g. the Intersessional Committee, to meet at about the middle of the year, it should be so arranged that its meetings are held as closely as possible, if not entirely simultaneously, with those of the Committee conducting the consul­tations.

Committee on Balance-of-Payments Restrictions

11. The Working Party considers that as on the previous occasions the consultations should be entrusted to r. Cc-imnittee comprising governmental representatives. The composition of the Committee should reflect as far as possible the characteristics of the contracting parties generally in terms of their geographical location, external financial position and stage of economic development, and its size should be suited to the nature of its work. The Working Party recommends that the CONTRACTING PARTIES appoint a Committee on Balance-of-Payments Restrictions to conduct consultations in 1959^* whose membership may be as follows»

The Committee will conduct the consultations under Article XII»4(b) and such other consultations as may be initiated during the year under Article XII»4(a) or Article XVIII»12(a) (see paragraph 20 below).

12. In accordance with the rules of procedure of the CONTRACTING PARTIES any contracting parties which are not members of the Consultations Committee, but which are interested in one or more of the consultations, will be en­t i t l ed to be represented and participate fully in the discussions. Observers representing non-contracting parties may attend the meetings in accordance with those rules of procedure.

13» The Working Party has considered ways in which the work of the Committee conducting the consultations may be fac i l i ta ted . In view of the large number of consultations to be held, i t feels that i t may be difficult for each member of the Committee to familiarize himself intimately with the problems of a l l the consulting countries. On the other hand, i t i s essential that the proceedings should be such as to fac i l i t a te the broadest possible interest and participation in the discussions. To this end i t i s proposed that the Committee should designate among i t s membership several sub-groups for the purpose of examining the documentation and deciding on the questions and issues that appear to be most useful to discuss in each consultation, bearing in mind the interests of the contracting parties in general.

H . Each sub-group will consist of perhaps four members and wil l be engaged in the preparation for the consultation with one or more countries. The preliminary process will occupy a short period, and the consultations would begin with the whole Committee as and when one or more of the sub-groups completed their work. Although the consultations would naturally focus largely on the questions formulated by the sub-groups, other members of the Committee should feel free to put questions or raise issues not covered by the suggestions of the competent sub-group.

15* Although the sub-groups could be designated at the beginning of each meeting of the Committee, there would be an advantage in designating them, as far as possible, immediately after the appointment of the Committee at this Session. This would enable more thorough study of particular country situations by their members.

16. A representative was doubtful of the value of this arrangement of appointing sub-groups which, in his view, might lengthen the proceedings and create duplication of work. The Working Party was, however, in favour of i t s adoption, at least on an experimental basis for the 1959 consultations* I t may be modified, adapted or discontinued in the l ight of experience and according to circumstances.

Consultations with the IMF

17. In accordance with paragraph 2 of Ar t ic le XV, the CONTRACTING PARTIiiS should inv i t e the In te rna t iona l Monetary Fund to consult with them in connexion with these consul tat ions. The ijcecutive Secretary should therefore be authorized to extend the necessary inv i t a t ions to the Fund. Documents supplied by the Fund as a par t of the consultations should be c i rcula ted to the contracting pa r t i e s as ea r ly as possible before the opening of each consul ta t ion. The Fund would be inv i ted to be represented a t meetings of the Consultations Committee,,

Reports on the Consultations

18 . At the conclusion of each consul ta t ion, the Committee should draw up a report on the discussion. Such reports should provide a succinct record ©f the important points discussed. I t i s not considered useful to have a de ta i led rendering of the individual in tervent ions ; the aim should be to produce a s e t of documents which r e j e c t the important problems and the col lec t ive vie*rs of the CONTRACTING PARTIiS ra ther than a record of individual speeches or statements on points of d e t a i l . The reports should be c i rculated to the contracting pa r t i e s as and when they are ample ted by the Committee, and should be submitted to the CONTRACTING PARTIES for approval a t the l a s t plenary session to be held in 1959.

19. In addition to the reports on individual consultations the Committee should decide, in the l i g h t of i t s proceedings whether there i s need to submit a f i na l report to the CONTRACTING PARTIES to present comments or observations of a general nature c

Other consultations

20 . The Working Party has taken note of the recommendations made by the Working Party on Organization regarding the powers of the In te rsess iona l Committee. I t agrees tha t a l l consultations and other matters a r i s ing under Art ic les XII - XV could be entrusted to the Committee s e t up to conduct the 1959 consul ta t ions . The Working Party suggests tha t paragraph 8 of the current in te r sess iona l procedures (BISD, F i f th Supplement, page 18) should be modified to read as follows:

" 8 . When a matter a r i ses under Ar t ic les XÏI - XV the Committee on Balance-of-Payments Res t r i c t ions , subject to ru les es tabl ished by the CONTRACTING PARTILS, i n i t i a t e s and engages in consul ta t ions , or otherwise deals with the matter , under those A r t i c l e s . I t reports or makes appropriate recommendations to'"the CONTRACTING PARTIES."

AND XVIII; 12(b)

For each consultation held under the provisions mentioned above the Committee conducting the consultation should, on the basis of the written submissions and documentation available, successively discuss the four main subjects listed below. In the discussions the Committee may find it convenient to take into account the topics listed under each of these main subjects. It is not suggested that each of these topics will be appropriate for all consultations nor that the Committee should not take up any other questions which may be considered relevant to the provisions of Article XII or of Section B (together with paragraphs 1 - 5) of Article XVIII,

I. Balance-of-Payments Position and Prospects

Balance-of-payments situation and level of monetary reserves.

Balance of payments prospects and expected movement in reserves.

Special considerations affecting the availability of or the need for monetary reserves.

Factors; either external or internal, affecting the various elements of the balance of payments, such as exports and imports.

Effects of the restrictions on the balance of payments and expected duration of the restrictions.

Prospects of relaxation or elimination and likely effect of such action on the balance of payments.

II, Alternative Measures to Restore equilibrium

Internal monetary and fiscal situation and other relevant matters which may affect the balance of payments.

Internal action to preserve or restore equilibrium including long-term measures such as those designed to raise productivity and export capacity or to reduce structural disequilibr-'/Ti or rigidities.

Other measures which may help to restore the country's balance of payments.
