    2.1GENERAL2.1.1 Scope2.1.1.1 ThisCodeiscalledtheGhanaBuildingCode,hereinafterreferredtoastheCode.2.1.1.2 ThispartcoverstheadministrativeaspectsoftheCode,suchasapplicability,organizationofthe

    buildingdepartment for the enforcementof theCode,procedure forobtainingdevelopmentandbuildingpermitsandtheresponsibilityoftheowner.

    2.1.2 Definitions

    Forthepurposesofthispart,thefollowingdefinitionsshallapply.

    Access(Exit) Thatpartofameansofingressoregresswithinafloorareathatprovidesentryandanaccesstoanexitservingthefloorarea.

    Accessory Use Any use of the premises subordinate to the principal use and customarilyincidentaltotheprincipaluse

    Alteration A change from one occupancy to another, or a structural change, such as anaddition to the area or height, or the removal of part of a building, or any change to thestructure, such as the constructionof cutting intoor removalof anywall,partition, column,beam,joist,floororothersupport,orachangetoaclosingofanyrequiredmeansofingressoregressorachangetothefixturesorequipment.ApprovedApprovedbytheAuthorityhavingjurisdiction.Authorityhaving jurisdictionTheAuthoritywhichhasbeencreatedbyastatuteandwhich,forthepurposeofadministeringtheCode/Part,mayauthorizeacommitteeoranofficialtoactonitsbehalf,hereinaftercalledtheAuthority.BuildingAnystructureforwhatsoeverpurposeandofwhatsoevermaterialsconstructedandeverypart thereofwhetherusedashumanhabitationornotand includes foundation,plinth,walls, floors, roofs, chimneys, plumbing and building services, fixed platforms, verandah,balcony, cornice or projection, part or a building or anything affixed thereto or any wallenclosingor intended toencloseany landor spaceand signsandoutdoordisplay structures.Tents, tarpaulin shelters, etc. erected for temporary and ceremonial occasions with thepermissionoftheAuthorityshallnotbeconsideredasbuilding.Building,HeightofTheverticaldistancemeasured,inthecaseofflatroofs,fromtheaveragelevelofthegroundaroundandcontiguoustothebuildingorasdecidedbytheAuthoritytothehighestpointofthebuildingadjacenttothestreetwalls;andinthecaseofpitchedroofs,uptothepointwhere the external surfaceof theouterwall intersects the finished surfaceof theslopingroof,andinthecaseofgablesfacingtheroad,themidpointbetweentheeavesleveland

    the ridge.Architectural features serving no other function except that of decoration shall beexcludedforthepurposeofmeasuringheights.

    BuildinglineThelineuptowhichtheplinthofabuildingadjoiningastreetoranextensionofastreetoronafuturestreetmaylawfullyextend.Itincludesthelinesprescribed,ifany,inanyscheme.ThebuildinglinemaychangefromtimetotimeasdecidedbytheAuthority.ConversionThechangeofoccupancyorpremisestoanyoccupancyoruserequiringadditionaloccupancypermit.DevelopmentDevelopmentwithgrammaticalvariationsmeansthecarryingoutofbuilding,engineering,miningorotheroperationsin,orover,orunderlandorwater,orintheuseofanybuildingor land,and includes redevelopmentand layoutand subdivisionofany land;and todevelopshallbeconstruedaccordingly.DrainAconduitorchannelofthecarriageofstormwater,sewageorotherusedwater.DrainageTheremovalofanyliquidbyasystemconstructedforthepurpose.Licensed Architect/Engineer/Structural Engineer/Supervisor/Town Planner/QuantitySurveyor/SurveyorValuerAqualifiedarchitect/engineer/structuralengineer/supervisor/townplanner/quantitysurveyor/surveyorvaluerwhohasbeenlicensedbytheauthority.OccupancyorUsegroupTheprincipaloccupancyforwhichabuildingorapartofabuildingisused or intended to be used; for the purposes of classification of a building according tooccupancy, an occupancy shall be deemed to include the subsidiary occupancies which arecontingentuponit.OccupierOccupierincludesanypersonforthetimebeing,payingorliabletopayrentoranyportion of rent of the building in respect of which the ward is used, or compensation orpremiumonaccountoftheoccupationofsuchbuildingandalsoarentfreetenant,butdoesnotincludealodger,andthewordsoccupyandoccupationdonotrefertothelodger.An owner living in or otherwise using his own building shall be deemed to be the occupierthereof.OperationalconstructionAconstructionputupbyGovernmentDepartmentsforoperationalpurposes.Owner The personwho receives the rent for the use of the land or building orwould beentitledtodosoifitwereletout.Italsoincludes:a) Anagentortrusteewhoreceivessuchrentonbehalfoftheownerb) A receiver,executororadministratororamanagerappointedbyanycourtofcompetent

    jurisdictiontohavethechargeof,ortoexercisetherightsoftheowner;c) Anagentortrusteewhoreceivestherentofor isentrustedwithor isconcernedwithany

    buildingdevotedtoreligiousorcharitablepurposes;and

    d) Amortgageeinpossession.PermitApermissionorauthorization inwritingbytheAuthoritytocarryoutworkregulatedbytheCode.RoadSeeStreet.RoadlineSeeStreetLine.RoomheightTheverticaldistancemeasured from the finished floor surface to the finishedceilingsurface.Whereafinishedceilingisnotprovided,theundersideofthejoistsorbeamsortiebeamsorraftersorpurlinsshalldeterminetheupperpointofmeasurementfordeterminingtheheadroom.SanctionedplanThesetofplansandspecificationssubmittedundertheCode inconnectionwithabuildinganddulyapprovedandsanctionedbytheAuthority.ServiceroadAroad/laneprovidedattherearorsideofaplotforservicepurposes.SetbacklineA lineusuallyparalleltotheplotboundariesand laiddown ineachcasebytheAuthority,beyondwhichnothingcanbeconstructedtowardsthesiteboundaries.Site(plot)Aparcel(piece)oflandenclosedbydefiniteboundaries.Street Any means of access, namely, highway, street, lane, pathway, alley, stairway,passageway, carriageway, footway, square, place or bridge,whether a thoroughfare or not,over which the public have a right of passage or access or have passed and had accessuninterruptedforaspecifiedperiod,whetherexistingorproposed inanyschemeand includesall bunds, channels, ditches, stormwater drains, culverts, sidewalks, traffic islands, roadsidetreesandhedges,retainingwalls,fences,barriersandrailingwithinthestreetlines.Street levelofgrade Theofficially established elevationor gradeof the centre lineof thestreetuponwhichaplotfrontsandifthereisnoofficiallyestablishedgrade,theexistinggradeofthestreetatitsmidpoint.StreetlineThelinedefiningthesidelimitsofastreet.ToerectToerectabuildingmeans:a) Toerectanewbuildingonanysitewhetherpreviouslybuiltuponornot;

    b) To reerectanybuildingofwhichportionsabove theplinth levelhavebeenpulleddown,

    burntordestroyed;and

    c) Conversionfromoneoccupancytoanother.

    UnsafebuildingUnsafebuildingarethosewhicharestructurallyunsafe,insanitaryornotprovidedwithadequatemeansofegressorwhichconstituteafirehazardorareotherwise

    dangeroustohumanlifeorwhichinrelationtoexistinguseconstituteahazardtosafetyorhealthorpublicwelfare,byreasonofinadequatemaintenance,dilapidationorabandonment.

    2.1.3 Applications

    2.1.3.1Part2anditssectionsapplytoallbuildings.

    2.1.3.2Parts3,4,and5applyto:

    (a) Allbuildingsusedforassembly,institutionalandhighhazardindustrialoccupancies.

    (b) Allbuildingsexceeding220m2inbuildingarea,orexceeding2storeysinbuildingheightusedfor residential, business and personal services, mercantile, medium hazard industrialoccupanciesandlowhazardindustrialoccupancies.

    2.1.3.3 Part6applies tobuildings2 storeysor less inheight,havingabuildingareanotexceeding

    220m2 and which are used for residential, business and personal services, mercantile,mediumhazardindustrialoccupanciesandlowhazardindustrialoccupancies.

    2.1.3.4 ApplicabilityoftheCode(1) Whereabuildingiserected,theprovisionsofthisCodeshallapplytothedesignandconstruction

    ofthebuilding

    (2) Whenabuildingoranypartthereofisaltered,theprovisionsofthisCodeshallapplytothepartsofthebuildingthatarealtered.

    (3) Whenthewholeoranypartofabuildingisdemolished,theprovisionsofthisCodeshallapplyto

    theworkinvolvedinthedemolitionandtoworkrequiredtoanypartsremainingafterdemolitiontotheextentthatdeficienciesremainingafterdemolitionarecorrected.

    (4) Whenabuildingisdamagedbyfire,earthquakeorothercause,theprovisionsofthisCodeshall

    applytotheworknecessarytoreconstructdamagedportionsofthebuilding.

    (5) Whentheoccupancyofabuildingoranypartthereofischanged,theprovisionsofthisCodeshallapplytoallpartsofthebuildingaffectedbythechange.

    (6) Whendevelopmentof land isundertaken, theprovisionsof thisCodeshallapply to theentire

    developmentoftheland.

    (7) ExistingBuildings/DevelopmentNothing in thisCode shall require the removal,alterationorabandonment, nor prevent continuance of the use or occupancy of an existingbuilding/development, unless in the opinion of the Authority, such building/developmentconstitutesahazardtothesafetyoftheadjacentpropertyortheoccupantsofthebuildingitself.

    2.1.3.5 InapplicabilityoftheCode

    ThisCodedoesnotapplyto:

    (a) Farmbuildingsotherthanthoseusedasresidencies

    (b) Publicworkslocatedonastreetorinapublictransitrightofway

    (c) Public utility towers and poles, television and radio or other communication aerials andtowers,exceptforloadsresultingfromthoselocatedonorattachedtobuildings.

    (d) FloodcontrolandhydroelectricdamsandstructuresormechanicalorotherequipmentandappliancesnotspecificallyregulatedinthisCodeor

    (e) Anaccessorybuildingnotgreaterthan9.0m2inbuildingareaprovideditdoesnotcreateahazard.

    2.1.4 Referenceddocuments

    2.1.4.1 The provisions of referenced standards and other referenced documents prescribed in the

    CodeapplytothisCodeonlytotheextentthattheyrelatetobuildings.2.1.4.2 IncaseofconflictbetweentheprovisionsofthisCodeandthoseofareferenceddocument,

    theprovisionsofthisCodegovern.2.1.5 Prohibitions

    2.1.5.1 Anyperson,firmorcorporationwhichfailstocomplywithanyorderornotice issuedbythe

    authorityhavingjurisdiction,orwhichallowsaviolationofthisCodetocontinue,contravenestheprovisionsoftheCode.

    2.1.5.2 Nopersonshallworkorauthorizeorallowworktoproceedonaprojectforwhichapermitisrequiredunlessavalidpermitexistsfortheworktobedone.

    2.1.5.3 No person shall deviate from the approved plans and specifications forming part of the

    building permit,oromitor fail tocomplete,prior tooccupancy,work requiredby the saidapprovedplansandspecifications,withoutfirsthavingobtainedinwritingtheapprovaloftheauthorityhavingjurisdictiontodoso.

    2.1.5.4 No person shall occupy or allow the occupancy of any building or part thereof, unless the

    ownerhasobtainedtheoccupancypermitfromtheauthorityhavingjurisdiction.2.1.5.5 No person having authority in the construction, reconstruction, demolition, alteration,

    removal, relocationoroccupancyof abuilding shall causeor allowormaintain anyunsafecondition.

    2.1.5.6 Noperson shallexcavateorundertakeworkon,overorunderpublicproperty,orerector

    placeanyconstructionorworkorstoreanymaterialsthereon,withoutapprovalhaving firstbeenobtainedinwritingfromtheappropriategovernmentauthority.

    2.1.5.7 NopersonshallallowthepropertyboundariesofabuildinglottobesochangedastoplaceabuildingorpartthereofincontraventionoftheprovisionsofthisCode,unlessthebuildingorpartthereof issoalteredafterobtainingthenecessarypermit,sothatnocontraventionwilloccurasaresultofthechangeofthepropertyboundary.

    2.1.5.8 Anypersonwhoknowinglysubmitsfalseormisleadinginformationcontravenestheprovisions

    ofthisCode.

    2.2ORGANIZATIONANDENFORCEMENT

    2.2.1DepartmentofbuildinginspectionorMetropolitan/DistrictEngineer/Planner/Surveyor office2.2.1.1Thedepartmentofbuildinginspectionshallbecreatedinthemetropolitan/district engineer/planner/surveyorofficeandtheexecutiveofficerinchargethereofshallbeknownasTheDirectorofWorks.2.2.1.2AppointmentTheDirectorofWorksshallbeappointedbytheAuthority.

    2.2.1.3OrganizationTheDirectorofWorksshallappointsuchnumberofofficers,technicalassistants,inspectorsandotheremployeesasshallbenecessaryfortheadministrationoftheCodeandasauthorizedbytheAuthority.2.2.1.4DelegationofPowersTheDirectorofWorksmaydesignateanemployeeor employeeswhoshallexerciseallthepowersoftheofficeduringthetemporaryabsenceordisabilityoftheDirectorofWorks.2.2.1.5 QualificationofDirectorofWorksTheDirectorofWorks shallbea licensableEngineeror StructuralEngineerorArchitectorTownPlannerorQuantitySurveyor/SurveyorValuerwhosequalificationshallnotinanycasebelessthanthoseprescribedinAppendixA.2.2.1.5.1Insmalllocal/districtbodieshavinginsufficientfundstoappointsuchofficialswiththeabove qualifications,twoormoresuchbodiescouldjointogetherandhaveonequalifiedDirectorofWorks.2.2.1.6 Qualifications ofBuildingAssistant/Supervisor No person shall be appointed as Building Assistant/Supervisorunlesssuchapersonhasthequalificationsprescribed inAppendixAfora licensedbuildingSupervisor.2.2.1.7 Restriction on Employees No official or employee connectedwith the department dealing withbuildinginspectionexceptonewhoseonlyconnectionisthatofamemberoftheBoardof Appeals,establishedunder subsection2.2.6 shallbeengageddirectlyor indirectly inawork connectedwiththefurnishingoflabour,materialsorappliancesfortheconstruction,alteration ormaintenanceofabuilding,orthepreparationofplansorofspecificationsthereofunlessheis theownerofthebuilding;norshallsuchofficeroremployeeengageinanyworkwhichconflicts withhis/herofficialdutiesorwiththeinterestsofthebuildinginspectiondepartment.

    2.2.1.8 OfficersnotLiableforDamageNoofficialoftheAuthorityshallnotrenderhimself/herself liablepersonallyandheshallberelieved fromallpersonal liabilities foranydamagethatmay accruetopersonsorpropertyasaresultofanyactrequiredorpermittedinthedischargeofhis officialduties.Anysuit institutedagainstanyofficeroremployeebecauseofanactperformed byhim intheofficialdischargeofhis/herdutiesandundertheprovisionsoftheCodeshallbe defended by the legal representative of the Authority until the final termination of the proceedings. Innocaseshalltheofficialoranyofhis/hersubordinateemployeesbe liablefor costs inanyaction,suitorproceedingthatmaybe instituted inpursuanceoftheprovisionsof theCodeandanyofficialofthebuildinginspectiondepartmentactingingoodfaithandwithout maliceshallbefreefromliabilityforactsperformedunderanyoftheprovisionsorbyreasonsof anyactoromissionintheperformanceofhisofficialdutiesconnectedtherein.2.2.2 DutiesandresponsibilitiesoftheAuthorityhavingjurisdiction(DirectorofWorks)

    2.2.2.1 Theauthorityhaving jurisdiction is responsible for theadministrationandenforcementof the

    provisions of this Code and shall act on any question relative to the mode and manner ofconstructionandthematerialstobeusedintheerection,addition,alteration,repair,removal,demolition,installationofserviceequipmentandthelocationuse,occupancyandmaintenanceofallbuildingsexceptasmayotherwisebespecificallyprovided.

    2.2.2.2 Application and permits The authority having jurisdiction shall receive all applications andissuepermitsfortheerectionandalterationofbuildingsandexaminethepremisesfoewhichsuchpermitshavebeenissued

    2.2.2.3 InspectionTheauthorityhavingjurisdictionshallmakeallrequiredinspectionsormayacceptreportsofinspectionsofauthoritativeandrecognizedservicesorindividuals;andallreportsofinspectionsshallbeinwritingandcertifiedbyaresponsibleofficerofsuchauthoritativeserviceor by the responsible individual or engage any such expert opinion as he/she may deemnecessarytoreportuponunusualtechnicalissuesthatmayarise;subjecttotheapprovaloftheauthorityhavingjurisdiction.

    2.2.2.4 Records The authority having jurisdiction shall keep records of all applications received,permitsandordersissued,inspectionsandtestsmade,andcopiesofallpapersanddocumentsconnectedwiththeadministrationofthisCodeforsuchtimeasotherregulationsrequire.

    2.2.2.5 Theauthorityhavingjurisdictionshallacceptanyconstructiononconditionthatlawfullyexistedprior to theeffectivedateof thisCodeprovided thatsuchconstructionorconditiondoesnotconstituteanunsafecondition.

    2.2.2.6 BuildingnoticesandordersTheauthorityhavingjurisdictionshallissueinwritingsuchnoticesorordersasmaybenecessarytoinformtheownerwhereacontraventionoftheprovisionsofthis Code has been observed; and shall issue to the owner an order or notice inwriting tocorrectanyunsafeconditionobservedinanybuilding.

    2.2.2.7 Theauthorityhavingjurisdictionshallprovidewhenrequestedtodosoallreasonsforrefusalto

    grantapermit.

    2.2.2.8 The authorityhaving jurisdiction shall answer such relevantquestions asmaybe reasonablewith respect to theprovisionsof thisCodewhen requested todoso,butexcept forstandarddesign aids, shall refrain from assisting in the layingoutof anywork and from acting in thecapacityofanengineeringorarchitecturalconsultant.

    2.2.2.9 The authority having jurisdiction shall issue a permit to the ownerwhen, to the best of his

    knowledge, theapplicableconditionsasset forth in thisCodeoranyotherbylawhavebeenmet.

    2.2.3 PowersoftheAuthorityhavingjurisdiction(DirectorofWorks)2.2.3.1 RightofentryUponthepresentationofpropercredentials,theauthorityhaving jurisdiction

    mayenteranybuildingorpremisesatanyreasonabletimeforthepurposeofadministeringorenforcingthisCode.

    2.2.3.2 Theauthorityhavingjurisdictionisempoweredtoorder:

    (a) ApersonwhocontravenesthisCodetocomplywiththeCodewithinthetimeperiodspecified;

    (b) WorktostoponthebuildingoranypartthereofifsuchworkisnotproceedingaccordingtothesanctionedplanorisincontraventionofprovisionsofthisCode,oranyotherapplicableCode,Regulation,ActorByelawor if there isdeemed tobeanunsafecondition;heshallnotify theowner, and all further construction shall be stayed until correction has been effected andapproved;

    (c) Cancelthebuildingpermitissuedshouldtheownerfailtocomplywiththerequirementsatany

    stageofconstruction,andshallcausenoticeofsuchcancellationtobesecurelyposteduponthesaidconstruction,iftheownerisnottraceableathisaddressgiveninthenotice.Postingofsucha notice shall be considered sufficient notification of cancellation to the owner thereof.Nofurtherwork shall be undertaken or permitted upon such construction until a valid buildingpermit thereafter has been issued. If the owner, in violation of the notice for cancellation,continuestheconstruction,theAuthoritymaytakeallnecessarymeanstostopsuchwork;

    (d) Theremovalofanyunauthorizedencroachmentonpublicproperty;

    (e) TheremovalofanybuildingorpartthereofconstructedincontraventionofthisCode;

    (f) Thecessationofanyoccupancy if thebuilding isbeingusedcontrary to theprovisionsof this

    Code or if any unsafe condition exists because ofwork being undertaken or not completed.Noticeshallbeservedonanyperson,causingsuchusetobediscontinued;andsuchpersonshalldiscontinuetheusewithin10daysafterreceiptofsuchnoticeormakethebuildingorportionsthereof,complywiththerequirementsofthisCode.

    2.2.3.3 The authority having jurisdiction may direct that tests of materials, equipment, devices,constructionmethods, structural assemblies or foundation conditions bemade, or sufficientevidenceorproofbesubmittedattheexpenseoftheowner,wheresuchevidenceorproof isnecessary todeterminewhether thematerial,equipment,device, constructionor foundationconditionmeetstherequirementsofthisCode.

    2.2.3.4 Theauthorityhavingjurisdictionmayrequireanyownertosubmitanuptodateplanofsurveypreparedbyaregisteredlandsurveyorwhichshallcontainsufficientinformationregardingthesiteandthelocationofanybuilding:

    (a) ToestablishbeforeconstructionbeginsthatallrequirementsofthisCodeinrelationtothis

    informationwillbecompliedwith,and

    (b) Toverifyuponcompletionoftheworkthatallsuchrequirementshavebeencompliedwith.

    2.2.3.5 Modification When site conditions, size, complexity of the work or wherever practicaldifficulties are involved in carrying out any provision of this Code, the authority havingjurisdictionmayrequirethatallplansandspecificationsoranypartthereofbecertifiedandtheconstruction or alteration of any building or part thereof be generally reviewed duringconstructionbyanarchitectorengineerregisteredor licensedtopractice inthe jurisdiction inwhichtheworkisbeingundertaken.Suchreview(variationormodification)maybeorderedbytheauthorityhaving jurisdictionuponapplicationof theownerorhisrepresentativeprovidedthespiritand intentoftheCodeshallbeobservedandpublicwelfareandsafetyareassured.Theapplicationforreviewandthefinaldecisionoftheauthorityhaving jurisdictionshallbe inwriting and shallbeofficially recordedwith the application for thepermit in thepermanentrecordsbuildinginspectiondepartment.

    2.2.3.6 Temporary/ApprovalinPartPermitsTheauthorityhavingjurisdictionmayissueapermit:

    (a) when inhisopinion it iswarrantedwith respect toabuildingoroccupancy inwhichexistingrelatedconstruction isnot incompletecompliancewith isCode inwhichcasethepermitmaybeissuedsubjecttocertainconditions;

    (b) attheriskoftheowner,withconditionsnecessarytoensurecompliancewiththisCodeandanyotherapplicablebylaw, toexcavateor toconstructaportionofabuildingbefore theentireplansofthewholeprojecthavebeensubmittedorapproved;

    (c) fortheentireprojectconditionaluponthesubmission,priortocommencingworkthereon,of

    additional information not available at the time of issuance, if such data are of secondaryimportance,andareofsuchnaturethatthewithholdingofthepermituntilitsavailabilitywouldunreasonablydelaythework;

    (d) subjecttocompliancewithprovisionstosafeguardpersons inoraboutthepremises,toallowtheoccupancyofabuildingorapartthereoffortheapprovedusepriortocommencementorcompletionoftheconstructionordemolitionwork.

    2.2.3.7 RefusalofpermitTheauthorityhavingjurisdictionmayrefusetoissueanypermit:

    (a) wheneverinformationsubmittedisinadequatetodeterminecompliancewithprovisionsof

    thisCode;

    (b) wheneverincorrectinformationissubmitted;

    (c) thatwouldauthorizeanybuildingworkoroccupancythatwouldnotbepermittedbythisCode;

    (d) thatwouldbeprohibitedbyanyotherbylaw,actorregulation.

    2.2.3.8 RevocationofPermitTheauthorityhavingjurisdictionmayrevokeapermitif:

    (a) thereisacontraventionofanyconditionunderwhichthepermitwasissued;

    (b) thepermitwasissuedinerror;

    (c) thepermitwasissuedonthebasisofincorrectinformation.

    2.2.3.9 PermitfeesTheauthorityhavingjurisdictionmayplaceavalueonthecostoftheworkforthe

    purposeofdeterminingpermitfeestobeapplicable.

    2.2.3.10Whenanybuilding,constructionorexcavationorpartthereofisinanunsafeconditionasa resultofbeingopenorunguarded,orbecauseofdangerfromfireorriskofaccidentbecause ofitsruinousordilapidatedstate,faultyconstruction,abandonmentorotherwise,andwhen duenoticetocorrectsuchconditionhasnotbeencompliedwith,theauthorityhaving jurisdictionmay:

    (a) demolish,removeormakesafesuchbuildings,construction,excavation,orpartthereofat

    theexpenseoftheownerandmayrecoversuchexpenseasmunicipaltaxes;

    (b) takesuchothermeasuresashemayconsidernecessarytoprotectthepublic.

    2.2.3.10 Whenimmediatemeasuresmustbetakentoavoidanimminentdangeroffireorriskofaccident,theauthorityhavingjurisdictionmaytakesuchactionasisappropriate,withoutnoticeandattheexpenseoftheowner.

    2.2.3.11 Beforeissuinganoccupancypermit,authorityhavingjurisdictionmayrequiretheownertoprovideletterstocertifythattherequirementsofthisCodeandthenecessarypermitshavebeenmet.

    2.2.4 DutiesandResponsibilitiesoftheOwner

    2.2.4.1 Thegrantingofapermit,theapprovalofthedrawingsandspecificationsor inspectionsmadebytheauthorityhavingjurisdiction,shallnotinanywayrelievetheownerofabuildingfromfullresponsibility forcarryingouttheworkorhavingtheworkcarriedout inaccordancewiththe

    terms of the occupancy permit, and including compliancewith any special conditions madeundertheprovisionsofsubsection1.7.6.

    2.2.4.2 Everyowner:

    (a) shallallowtheauthorityhavingjurisdictiontoenteranybuildingorpremisesatanyreasonabletimeforthepurposeofadministeringandenforcingtheprovisionsoftheCode;

    (b) shallsubmitadocumentofownershipofthesite;

    (c) shall obtain all permits or approvals required in connection with proposed work, prior to

    commencingworktowhichtheyrelate;

    (d) shallensure that theplansand specificationsonwhich the issueof thebuildingpermitwasbasedareavailablecontinuouslyatthesiteofworkforinspectionduringworkinghoursbytheauthorityhavingjurisdictionandthepermitortruecopythereofisposedconspicuouslyonthesiteduringtheentireexecutionofthework;

    (e) shallgivenoticetotheauthorityhaving jurisdictionofthedatesonwhichhe intendstobeginworkpriortocommencingworkonthebuildingsite;

    (f) shallgivenotice inwritingtotheauthorityhaving jurisdiction,priortocommencingthework,listing;

    (i) thename,addressandtelephonenumberof;

    a. theconstructororotherpersoninchargeofthework;

    b. theengineerorarchitectreviewingthework;

    c. anyinspectionortestingagencyengagedtomonitorthework.

    (ii) any change in or termination of employment of such persons during the course ofconstructionimmediatelythatsuchchangeorterminationoccurs;

    (g) shallgivenoticetotheauthorityhavingjurisdiction;

    (i) ofintenttodoworkthathasbeenorderedinspectedduringconstruction;

    (ii) ofintenttocoverworkthathasbeenorderedtobeinspectedpriortocovering;

    (iii) whenworkhasbeencompletedsothatfinalinspectioncanbemade.

    (h) shallgivenoticeinwritingtotheauthorityhavingjurisdiction;

    (i) immediately that any change in ownership or change in the address of the ownersoccurspriortotheissuanceofanoccupancypermit;

    (ii) priortooccupyinganyportionofthebuildingifitistobeoccupiedinstages.

    (i) shall give such other notice to the authority having jurisdiction as may be required by the

    provisionsofthisCode;

    (j) shall make or have made at his own expense, tests or inspections as necessary to provecompliancewith theprovisionsof theCodeand shallpromptly fileacopyofall such testorinspectionreportswiththeauthorityhavingjurisdiction;

    (k) shallprovideanuptodate surveyof thebuilding sitewhenandas requiredby theauthority

    havingjurisdiction;

    (l) shall when required by the authority having jurisdiction, uncover and replace at his ownexpenseanywork thathasbeencoveredcontrary toanorder issuedby theauthorityhavingjurisdiction;

    (m) isresponsibleforthecostofrepairoranydamagetopublicpropertyorworkslocatedthereon

    thatmayoccurasaresultofundertakingworkforwhichapermitwasrequiredbythisCode.2.2.4.3 NoownershalldeviatefromtherequirementsofthisCodeoroftheconditionsofthepermitor

    omitworkrequiredbytheCodeortheconditionsofthepermitwithoutfirstobtainingfromtheauthorityhavingjurisdictionpermissioninwritingtodoso.

    2.2.4.4 Everyowner shallobtainanoccupancypermit from theauthorityhaving jurisdictionprior to

    any:(a) occupancyofabuildingorpartthereofafterconstruction,partialdemolitionoralterationof

    thatbuilding;

    (b) changeintheoccupancyofanybuildingorpartthereof.2.2.4.5 Everyownershallensurethatnounsafeconditionexistbecauseoftheworkbeingundertaken

    or not completed, should occupancy occur prior to the completion of any work beingundertakenthatrequiresapermit.

    2.2.4.6 WhenrequiredbytheauthorityhavingjurisdictioneveryownershallprovidealettertocertifycompliancewiththerequirementsofthisCodeandofanypermitsrequired.

    2.2.4.7 Whenabuildingorpart thereof is inanunsafe condition, theowner shall forthwith takeall

    necessaryactiontoputthebuildinginasafecondition.

    2.2.5 DutiesandResponsibilitiesoftheConstructor2.2.5.1 Every constructor shall ensure that all construction safety requirements of this Code are

    compliedwith.

    2.2.5.2 Everyconstructorisresponsibleforensuringthatnoexcavationorotherworkisundertakenonpublicpropertyandthatnobuilding iserectedormaterialsstored inwholeor inpartthereonwithout approval first having been obtained in writing from the appropriate governmentauthority.

    2.2.5.3 Every constructor is responsible jointly and severally with the owner for any work actually

    undertaken.

    2.2.6 BoardofAppeal2.2.6.1 Unlessmunicipal legislation provides for aBoard ofAppeal, the authority having jurisdiction

    maycreatesuchaboardand ifcreated itshallhavethefollowingestablishmentandtermsofreference.

    2.2.6.2 TheBoardofAppealshallconsistofat least7members,whoarequalifiedbyexperienceand

    training topass judgementuponmatterspertaining tobuilding construction.Theboard shallincludeaChairmanandViceChairman,whoarequalifiedbyexperienceandtrainingtoconsidermatterspertainingtobuildingdesignandconstruction.

    2.2.6.3 ThemembersoftheBoardofAppealshallbeappointedforsuchperiodsasmaybe

    deemedappropriate.2.2.6.4 IntheabsenceoftheChairmanandViceChairmanatanymeeting,themembersshall

    electaChairmanfromamongthosepresenttopreside.

    2.2.6.5 TheDirectorofWorks shallbeanexofficiomember, shallactas secretary to theboardandshall have no voting privileges. The secretary shall be responsible for maintaining records,correspondenceandkeepingminutesofBoardmeetings.

    2.2.6.6 Five(5)membersoftheBoardconstituteaquorum.2.2.6.7 TheBoardshallhearappealsfromdecisionsofthedesignatedofficials,

    pertainingtotherequirementsof thisCode,andshallconfirm,alterorrejectsuchdecision inaccordancewiththeintentofthisCode.

    2.2.6.8 AnappealagainstadecisionofthedesignatedofficialmaybesubmittedtotheBoardof

    Appealbyapersonwho:(a) hasappliedundertheprovisionsoftheCodeforapermitwhichhasnotbeengranted;

    (b) hashadapermitrevoked;

    (c) feelshimself/herselfadverselyaffectedbyadecisionofadesignatedofficial.

    2.2.6.9TheappellantshallfilewiththeSecretaryoftheBoardofAppealastatementinwriting

    insuchdetailaswillenabletheBoardproperlytoconsidertheappealaddressedtotheBoardofAppealandsettingout:(a) thenatureandsubjectmatteroftheappeal;

    (b) theaddressofthebuildingaffectedbytheappeal;

    (c) thesectionsofthisCodeapplicabletotheappeal.2.2.6.10 TheBoardshallmeetasoftenasitdeemsnecessarytoconductworkof

    theBoardinanexpeditiousmanner.2.2.6.11 TheBoardshallconsideranyappealfiledwiththeSecretarywithin15

    calendar days after a decision of the designated official and need not consider anyappealfiledthereafter.

    2.2.6.12 TheBoardshallmeettohearappealwithin15calendardaysaftertheappealhasbeenfiled.

    2.2.6.13 TheBoardshallcommunicate itsdecisiontothepersonmakingtheappealwithintwo(2)workingdaysafterthedecisionhasbeenreached.

    2.2.6.14 TheAppellantandthedesignatedofficialortheirrespectiverepresentativesmayattend

    themeetingoftheBoardandmaymakerepresentationsconcerningthematterunderappeal.

    2.2.2.15 TheBoardinmakingitsdecisionsmayinformitselfinanymanneritdeemsappropriate

    andwhichitconsidersnecessarytoarriveatadecision.2.2.6.16 TheBoardshallinformtheappellantanddesignatedofficialofanyadditional

    informationconsidered,andshallprovideanopportunityforeitherpartytorespond.2.2.6.17 ThedecisionsofamajorityofmembersoftheBoardpresentatahearing

    shallbethedecisionoftheBoard,whosedecisionshallnotbesubjecttofurtherappeal.2.2.6.18 Thesecretaryshallnotifytheappellantandthedesignatedofficialofa

    decisionoftheBoardinwriting,andsuchdecisionsshallformpartofthepublicrecord.

    2.2.6.19 ApersonwhoappealsinaccordancewiththeprovisionsofthesectionshallnotberelievedofcomplyingwiththeprovisionsofthisCodependingadecisionontheappeal,norshalltheauthorityhavingjurisdictionbeprecludedfromenforcingtheprovisionsoftheCodeduringsuchperiod.

    2.3 ALTERNATIVEMATERIALS,METHODSOFDESIGN,TESTSANDCONSTRUCTIONREVIEW2.3.1General2.3.1.1TheprovisionsofthisCodearenotintendedtopreventtheuseofanymaterialormethodof designorconstructionnotspecificallyprescribedbytheCode,providedanysuchalternative hasbeenapprovedbytheauthorityhavingjurisdiction.2.3.1.2TheAuthoritymayapproveany suchalternativeprovided it is foundby the respective localauthoritythattheproposed alternative is satisfactory and conforms to the provisions of relevantpartsregardingmaterial,designandconstructionandthatmaterial,method,orworkofferedis,forthepurposeintended,atleastequivalenttothatprescribedinthisCodeinquality,strength,compatibilityeffectiveness,fireandwaterresistance,durabilityandsafety.2.3.2Tests2.3.2.1WheneverthereisinsufficientevidenceofcompliancewiththeprovisionsoftheCodeorevidencethatanymaterialormethodofdesignorconstructiondoesnotconformtotherequirementsoftheCodeorinordertosubstantiateclaimsforalternativematerials,designormethodsofconstruction,theAuthoritymayrequiretestssufficientlyinadvanceasproofofcompliance.Thesetestsshallbemadebyanapproved,competentagencyattheexpenseoftheowner.2.3.2.2TestmethodsshallbespecifiedbytheCodeforthematerialsordesignorconstructioninquestion.Testmethodsshallbebasedonapprovedstandardsandspecification.Compliance may beshown in a number of ways such as Ghana Standards, British Standards, Indian Standards andequivalentnationalspecifications.Iftherearenoappropriatetestmethodsspecified intheCode,theAuthorityshalldeterminethetestprocedure.Formethodsoftestforbuildingmaterials,referencemaybemadetoPart8BuildingMaterials.2.3.2.3CopiesoftheresultsofallsuchtestsshallberetainedbytheAuthorityforaperiodofnotlessthanfive(5)yearsaftertheacceptanceofthealternativematerial.

    2.3.3 ConstructionReview2.3.3.1 Wheneverareviewofthewholeorpartoftheconstructionprocessisrequiredbyaconsultant

    orprojectmanager,duringconstruction,such reviewshallbe tostandardssatisfactory to theauthority having jurisdiction; specifically by the Director of Works of the Local Authority(Metropolitan,Municipal,DistrictAssembly).

    2.3.3.2 Uponcompletionoftheworkforwhichreviewwasrequired,areportshallbesubmittedtotheauthorityhaving jurisdictionby theconsultantorprojectmanagerstatingwhatwasreviewed,andwhere applicable,whatwas not reviewed, stating the extent towhich the constructionconformstothisCode.

    2.4 PERMITSANDPERMITFEES2.4.1 Development/BuildingPermits2.4.1.1 Apermitisrequiredwheneveranydevelopment,erection,reerection,alterationsordemolition

    of any building as regulated by this Code is to be undertaken. A separate permit shall berequiredforeachsuchdevelopment/buildingfromtheauthorityhavingjurisdiction.Nopermitsshall,however,berequiredforworksreferredtoinsubsection2.4.2.2.1.

    2.4.1.2 Permits inadditiontothepermitsrequired in2.4.1.1withrespecttobuildingcomponentsandservicesmayberequiredbytheauthorityhavingjurisdiction.

    2.4.1.3 Anoccupancypermitisrequired:

    (a) toallowtheoccupancyofabuildingorpartthereof;

    (b) whenoccupancyofabuildingorpartthereofischanged.2.4.2 ApplicationforPermit2.4.2.1 NoticeEverypersonwhointendstodevelop,erect,reerectormakealterationsinanyplacein

    a building shall file an application in writing to the Authority of the said intention in theprescribed form (see Appendix B) and such notice shall be accompanied by plans andstatements in triplicateas requiredunder subsection2.4.3,except for specialbuildings (highrise,nonresidential)whereadditionalcopiesmaybesubmittedasdesiredbytheAuthority.

    2.4.2.2 RegardingsubmissionofplansbyGovernmentDepartments,theprocedureshallbeasgivenin2.4.2.2.1and2.4.2.2.2.

    2.4.2.2.1 TheoperationalconstructionoftheGovernment,whethertemporaryorpermanent,which

    isnecessary for the operation, maintenance, development or execution of any of thefollowing servicesmaybeexemptfromthepointofviewofbyelaws:

    (a) Railways;(b) Nationalhighways;(c) Nationalwaterways;(d) Majorports;(e) Airwaysandaerodromes;(f) Posts,telephones,wireless,broadcastingandotherlikeformsofcommunications;(g) Regionalgridforelectricity;(h) Any other service which the Government may, if it is of the opinion that the

    operation,maintenance,developmentorexecutionof such service isessential tothelifeofthecommunity,bynotification,declaretobeaserviceforthepurposeofthisclause.

    2.4.2.2.2 However the followingconstructionsof theGovernmentdepartmentsdonotcomeunderthepurviewofoperationalconstructionforthepurposeofexemptionunder2.4.2.2.1.

    (a) New residential buildings (other than gate lodges, quarters for limited essentialoperational staff and the like), roads and drains in railway colonies, hospitals, clubs,institutesandschools,inthecaseofrailways;

    (b) Anewbuilding,new constructionornew installationoranyextension thereof in thecaseofanyotherservices.

    2.4.2.3 InformationaccompanyingNoticeExceptotherwiseallowedbytheauthorityhavingjurisdiction

    everyapplicationshall:

    (a) identify and describe in detail thework and occupancy to be covered by the permit forwhichapplicationismade;

    (b) describelandonwhichtheworkistobedone,byadescriptionthatwillreadilyidentifyandlocatethebuilding/plot;

    (c) include plans and specifications, unless otherwise approved by the authority having

    jurisdiction,andshowtheoccupancyofallpartsofthebuilding;

    (d) statethecostoftheproposedwork,andbeaccompaniedbytherequiredfee;

    (e) state thenames, addresses and telephonenumbersof theowner, architect, engineerorotherdesignerandconstructor;

    (f) inthecaseofbuildingplansformultistoreyed/specialbuildings(that is,buildingsthatare

    morethan15m inheightand forspecialbuildings likeeducational,assembly, institutional,industrial, storageandhazardousandmixedoccupancieshavingareamore than500m2),requirethefollowingadditionalinformation,asapplicable;

    (i) access to fire appliances/vehicles with details of vehicular turning circle and clear

    motorableaccesswayaroundthebuilding;(ii) width of main and alternative staircases along with balcony approach, corridor,

    ventilatedlobbyapproach;(iii) locationanddetailsofliftenclosures;(iv) locationandsizeoffirelift;(v) smokestoplobby/door,whereprovided;(vi) refusechutes,refusechamber,serviceduct,etc;(vii) vehicularparkingspaces;(viii)refusearea,ifany;(ix)detailsofbuildingservices.

    2.4.2.4 Anapplicationforapermitmaybedeemedtohavebeenabandoned6monthsafterthedateoffilingunlesssuchapplicationhasbeenproceededwith.

    2.4.2.5 Ifanydevelopment/building,permit forwhichhasbeen issuedbefore thecommencementofthisCode,isnotwhollycompletedwithinaperiodoffive(5)yearsfromthedateofsuchpermit,thesaidpermitshallbedeemedtohaveelapsedandfreshpermitshallbenecessarytoproceedfurtherwiththeworkinaccordancewiththeprovisionsofthisCode.

    2.4.3 PlansandSpecifications2.4.3.1 Sufficient information shall be submitted with each application for a permit to enable the

    authorityhaving jurisdiction todeterminewhetherornot theproposedworkwillconform tothisCodeandwhetherornotitmayaffectadjacentproperty.

    2.4.3.2 Whenrequiredbytheauthorityhavingjurisdictionplansandspecificationsshallbeprovided.2.4.3.3 Plansdrawntoscaleuponpaper,clothorothersubstantialmaterialshallbeclearanddurable,

    andshallindicatethenatureandextentoftheworkorproposedoccupancyinsufficientdetailtoestablish thatwhencompleted theworkand theproposedoccupancywillconform to thisCodeandotherrelevantbylawsandregulations.

    2.4.3.4 Siteplan(1)Siteplansshallbereferencedtoanuptodatesurveyandwhenrequiredtoprovecompliancewith this Code, a copy of the survey shall be submitted to the authority havingjurisdiction.(2)Siteplansshallshow:(a) bydimensionsfrompropertylines,thelocationoftheproposedbuilding;

    (b) thesimilarlydimensionedlocationofeveryotheradjacentexistingbuildingontheproperty;

    (c) existingandfinishedgroundlevelstoanestablishedGhanadatumatoradjacenttothesite.

    2.4.3.5 In lieu of separate specifications the authority having jurisdiction may allow the essential

    informationtobeshownontheplans,butinnocaseshallsuchtermsasinaccordancewiththeCode,legalorsimilartermsbeusedassubstituteforspecificinformation.

    2.4.4 ApprovalinPart2.4.4.1 When inorder toexpeditework,approvalofaportionof thebuilding isdesiredprior to the

    issuanceofapermitforthewholeproject,applicationshallbemadeforthecompleteproject,and completeplansand specifications covering theportionof thework forwhich immediateapprovalisdesiredshallbefilledwiththeauthorityhavingjurisdiction.

    2.4.4.2 Shouldapermitbeissuedforpartofabuilding,theholderofsuchpermitmayproceedwithoutassurancethatthepermitfortheentirebuildingwillbegranted.

    2.4.4.3 After issuance of the permit, application may be made for revision of the permit and such

    applicationshallbemadeinthesamemannerasfortheoriginalpermit.

    2.4.4.4 Apermitshallexpireandtherightofanownerunderthepermitshallterminateif:

    (a) Theworkauthorizedby thepermit isnot commencedwithin6months from thedateofissuanceofthepermitandactivelycarriedoutthereafter,or

    (b) Workissuspendedforaperiodof6months.

    2.4.4.5 Permit fees and allprocedures and conditions applicable thereto shallbe establishedby theauthorityhavingjurisdiction.

    2.4.5 PermitforaTemporaryBuilding2.4.5.1 Notwithstandinganythingcontainedelsewhere inthisCode,apermitforatemporarybuilding

    may be issued by the authority having jurisdiction, authorizing for a limited time only theerection and existence of a building or part thereof for an occupancy which because of itsnaturewillexistforashorttimeundercircumstanceswhichwarrantonlyselectivecompliancewiththeprovisionsofthisCode.

    2.4.5.2 Apermit for a temporarybuilding shall state thedate afterwhich and the conditionsunderwhichthepermitisnolongervalid.

    2.4.5.3 Apermitforatemporarybuildingmaybeextendedprovidedpermissioninwritingisgrantedby

    theauthorityhavingjurisdiction.

    2.4.5.4 Apermitforatemporarybuildingshallbepostedonthebuilding.

    2.5 DEMOLITIONOFBUILDING2.5.1 Before a building is demolished, the owner shall notify all utilities having service

    connections within the building, such as water, electric, gas sewer and otherconnections. A permit to demolish a building shall not be issued until a release isobtained from the utilities stating that their respective service connections andappurtenantequipment suchasmetersand regulatorshavebeen removedor sealedandpluggedinasafemanner.

    2.6VALIDITY2.6.1PartialInvalidityIntheeventanypartorprovisionofthisCodeisheldtobeillegalorvoid,this shallnothavetheeffectofmakingvoidor illegalanyoftheotherpartsorprovisionsthereof, whichmayor shallbedetermined tobe legal,and it shallbepresumed that theCodewould havebeenpassedwithoutsuchillegalorinvalidpartsorprovisions.2.6.2 Segregationof InvalidProvisionsAny invalidpartof theCodeshallbesegregated from the remainderof theCodeby thecourtholdingsuchpart invalid,and theremaindershallremain effective.2.6.3 Decisions involving ExistingBuildings The invalidity of any provision in any clause ot the

    Code asappliedtoexistingbuildingsandstructuresshallnotbeheldtoeffectthevalidityofsuch sectioninitsapplicationtobuildingshereaftererected.

    2.7EFFECTIVEDATE2.7.1ThisCodeshallcomeintoeffectwhenproclaimedbytheauthorityhavingjurisdiction.

    2.7.2AnypersonwhocarriesoutworkunderthetermsoftheCodeafteritsadoptionbutbeforeits effectivedate,maydoso,butallsuchworkshallcomplywiththisCode.2.6.4 ThisCode,oranyamendmenttoit,shallnotaffecttherightsofanownerunderapermitissued

    priortotheeffectivedateofthisCodeorsuchamendmentprovidedtheownerhascommencedworkwithin6monthsof thedateof issuanceofthepermitandhasactivelycarriedoutworkthereafter.

    A1. ESSENTIALREQUIREMENTSA1.1 Every building work for which permission is sought under the Code shall be designed and

    supervised by a licensed architect/engineer/structural engineer/supervisor/townplanner/surveyor. Qualifications which an architect or engineer or structural engineer orsupervisorortownplannerorsurveyorshallhavebeforebeingregisteredbythelocalbodyandpermitted to practice within the local bodys jurisdiction are given in A2.1 to A2.5. ThecompetenceofsuchlicensedpersonnelisalsoindicatedinA2.1.1toA2.5.1.

    A2. QUALIFICATIONS FOR ARCHITECTS, ENGINEERS, STRUCTURAL ENGINEERS, SUPERVISORS,

    TOWNPLANNERS,SURVEYORSANDCONSTRUCTIONMANAGERSA2.1 ARCHITECTTheminimumqualificationsforanarchitectshallbetheAssociateMembershipof

    b) Structuraldetailsandcalculations for residentialbuildingsonplotup to500m2andup tothreestoreysor11minheight.

    c) Certificateofsupervisionandcompletionofallbuildings.

    d) All plans and related information connected with development permit of area up to 1

    e) Certificateofsupervisionfordevelopmentoflandofareaupto1hectare.A2.2 ENGINEER Theminimum qualifications for an engineer shall be the CorporateMember of

    Institution of Engineers (Ghana) or such degree or diploma in civil, municipal or structuralengineeringwhichmakeshimeligibleforsuchmembership.

    A2.2.1COMPETENCEThe licensedengineershallbecompetenttocarryouttheworkrelatedtothe

    buildingpermitasgivenbelowandshallbeentitledtosubmit:

    e) Certificateofsupervisionfordevelopmentoflandofareauptoonehectare.A2.3 STRUCTURAL ENGINEER The minimum qualifications for a structural engineer shall be

    graduateincivilengineeringofrecognizedGhanaianorforeignuniversity,orCorporateMemberofInstitutionofEngineers(Ghana)orequivalentoverseasinstitutionandwithminimum3yearsexperienceinstructuralengineeringpracticewithdesigningandfieldwork.

    NOTE: The3yearsexperienceshallberelaxedto2years inthecaseofpostgraduatedegreeofrecognizedGhanaianor

    foreign university in the branch of structural engineering. In case of doctorate in structural engineering, theexperiencerequiredwouldbeoneyear.

    A2.3.1COMPETENCEThe licensedstructuralengineersshallbecompetent tosubmit thestructural

    detailsandcalculationsforallbuildingsandsupervision.A2.3.1.1 IncaseofbuildingshavingspecialstructuralfeaturesasdecidedbytheAuthority,whichare

    withinthehorizontalareasandverticallimitsspecifiedinA2.1.1(b),A2.2.1(b)andA2.4.1(a)shallbedesignedonlybystructuralengineers.

    A2.4 SUPERVISORTheminimumqualificationsforasupervisorshallbequalificationinarchitecture

    or engineering equivalent to the minimum qualification prescribed for recruitment to nongazetted service by the Government of Ghana plus 5 years experience in building design,constructionandsupervision.

    A2.4.1COMPETENCEThelicensedsupervisorshallbeentitledtosubmit:

    a) Allplansandrelatedinformationconnectedwithbuildingpermitforresidentialbuildingsonplotupto200m2anduptotwostoreysor7.5minheight;and

    b) Certificateofsupervisionforbuildingsin(a).A2.5 TOWN PLANNER The minimum qualification for a town planner shall be the Associate

    Membership of the Institute of Planners or postgraduate degree or diploma in town andcountryplanningwhichmakeshimeligible for suchmembershipor recognizedby thePublicServicesCommissionforthepostofassistantTownPlanner.

    A2.5.1 COMPETENCEThelicensedtownplannershallbeentitledtosubmit:

    a) Allplansandrelatedinformationconnectedwithdevelopmentpermitofallareas;and

    b) Certificateofsupervisionfordevelopmentoflandofallareas.

    A2.6 SURVEYOR/CONSTRUCTIONMANAGERTheminimumqualification foraquantitysurveyor/ surveyorvaluer/constructionmanagershallbegraduateinquantitysurveying,landeconomyor construction technology andmanagement of a recognizedGhanaian or foreign university or CorporateMemberof the Institution of Surveyors (Ghana)or equivalentoverseas institution and with a minimum of 3 years of experience in surveying and construction management practicewithfieldwork.A2.6.1COMPETENCETheSurveyor/Constructionmanagershallbeentitledtosubmit:

    a) Project management and valuation information connected with the development of allareas;and

    b) Certificateofprojectcosting,supervisionandmanagementofdevelopmentof landofallareas.

    A3 SERVICESPERSONNELA3.1 Forbuildingsidentifiedin12.2.5.1,theworkofbuildingandplumbingservicesshallbeexecuted

    underthesupervisionofcompetentpersonnel.Thequalificationforlicensedelectricalengineerandplumbersforcarryingouttheworkofelectricalinstallationsandwatersupply,drainageandsanitation installations respectively shall be as given in part VII Building services, Section 2ElectricalInstallations;PartIXPlumbingservices,SectionIWatersupply,andSection2Drainageandsanitation.
