In exercise of the powers conferred by the pro­viso to Article 309 of the Constitution, read with the Government of India, Ministry of External Affairs letter No. F.7 (11) /62-Goa dated 25th July, 1963 and Ministry of Home Affairs letter No. F.l/29/ /68-GP dated 29th June, 1968 the Administrator of Goa, Daman and Diu is pleased to amend the Goa Government (Seniority) Rules, 1967, issued under Notification No. OSDjRRVS/43/66 dated 21st Fe­bruary, 1969 and published in Government Ga2ette Series I No. 49 dated 6th March, 1969 as follows:-

1. Short title and commencement. - (i) These rules may be called the Goa. Government (Seniority) (Second Amendment) Rules, 1977.

(ii) iThey shall come into force at once.

2 ... Amendment to Rule 4. - At the end of the -existing Rule 4 and the proviso notified under Noti­fication No. OSD/RRVS/43/66 dated 16th October, 1971 published in Official Gazette Series I No. 31 ·dated 28th October, 1971 the following proviso sh!!I1 .be added:-

"Provided further, when persons belonging to one grade but not to a Common Cadre are encadered together on formation of a Common Cadre for the said grade, the relative seniority of such persons shall be determined in accord­ance with the date of their appointment to the grade irrespective of. their being permanent or Officiating. The relative seniority· of such per­sons already determined in their respective cadres shall not be changed".

Whereas the Administrator of Goa, Daman and Diu is satisfied that district of Goa in the Union Territory of Goa, Daman and Diu is infected by,

.. and is threatened with, an outbreak of Malaria, which is a dangerous epidemic disease. . .

And whereas the Administrator of Goa, Daman and Diu is of the opinion that the ordinary provisions of the law for the time being in force are insuffi­cient to prevent the spread of the said disease;

Now, therefore, in exercise of the powers con­ferred by section 2 of the Epidemic Diseases Act, 1897 (3 of 1897), read with Notification of the Govt. of India, . in the Ministry of Home Mfairs, No. F-7/4/72-UTL·(ii) dated 22·9·1972, the Admi­nistrator of Goa, Daman and Diu hereby prescribes the following temporary regulations to be observed by the public and the class of persons in the district of Goa in the Union Terrritory of Goa, Daman and Diu namely:-

1. Short title, extent and commencement.·- (1) These regulations may be called the Goa, Malaria Regulations, 1977.

2 .. They shall extend to the district of Goa, in the Union Territory of Goa, Daman and Diu.

3. They shall come into force at once.

2. Definitions. - In these regulations, unless the context otherwise requires,-

(a) "building" includes a house, a outhollse, stable, latrine, godown, shed, wall (other than boundary wall not exceeding one metre in height) and other such structure whether of masonry, bricks, wood, mud, metal or any other material whatsoever;

(b) "infected area" means the area to which these regulations extend;

(c) "Malaria Controlling Officer" lfleans an Officer appointed as such by the Administrator of Goa, Daman and Diu.

3. Information to be given of persons suffering froni Malaria. - In theIDfected area ~

(a) every medical practitioner and every person in·charge of or in attendance· of any case, who knows or has reason to believe that any person

in any place including a hospital or dispensary is affected by malaria or is suspected to have been Sffected by fever which is likely to be malaria unless otherwise proved; and

c_ (b) every manager of a factory or educational

or other institutions, every contractor or employer of a ,labour camp, every head of Ii household and every owner or occupier of a building, who knows or has reason to believe that any person residing in any building or camp under his management or control is affected with malaria or.is suspected to have affected by fever which is likely to be malaria unless proved otherwise;

(c) may collect blood smears of such persons and get such smears despatched to the nearest malaria officer for examination and shall give in­formation with the least possible delay of such infected person or go to the nearest malaria Con­trolling Officer or any other officer authorised in this behalf by the malaria Controlling Officer and shall preserve all the signs, cards, records etc, entrusted to him or affixed to the premises by the staff engaged for the control of malaria ,and shall produce at on demand for future use.

4. Information to be given about the concentra­tion or labour or other groups. - In the infected area, every manager of a factory or construction work or fair or a contractor who intends to employ labour in small or large camps of more than 20 persons shall give detailed information about the nature and location of work, its duration, approxi­mate number of labourers and the staff to be em­ployed and the number of structure, to be raised, at least fifteen days in advance to the malaria Con­trolling Officer or any other officer authorised by the Malaria Controlling Officer in that behalf.

5. Powers of Malaria Controlling Officer. - The Malaria Controlling Officer may-

(i) direct that all bUildings in infected area should be permitted to be spn>.yed by the special staff employed by the Government with an insec­ticide provided for the purpose in such manner as may be laid down by the Government or any local authority in the area;

(ii) direct that any., person present in the loca­lity whether suffering from fever or not, should give blood smears when demanded by any officer authorised by the Government in this behalf;

(iii) direct that all persons suffering from fever and whose blood smears were taken should subject themselves for such treatnient as may be directed by the officer authorised in that behalf by the Government.

6. Measures for preventing breeding of mosqui­toes. - If in the opinion of the Malaria Controlling Officer-

(a) any pool, ditch, tank, wall, reservoir, pond, quarry, hole, drain, water course or any collection of water; or

(b) any cistern, or other receptacle for water .or any article or thing capable of collecting rain­water during the monsoon season whether inside or outside the bliilding; or _ (c) any land on whiCh water accumulates or is likely to be accumulated; or

(d) building Or part thereof whether occupied or unoccupied or, under COJ;lStruction, reconstruc­tion or demolition, is or is likely to become a, breeding place of mosquito, the Malaria Control ling Officer may, by a notice in writing require--

(i) the person by whose act, default or suffer-­ance, the breeding of mosquitoes has arisen or is likely to arise,

(ii) the owner or occupier of any building' in which the breeding of mosquitoes has arisen or is likely to arise,

(iii) where the breeding of mosquitoes has, arisen or is likely to arise in connection with the work of construction, reconstruction or de- -molition of any building or part thereof, the­architect, contractor or other person engaged in carrying out such work,

to prevent the breeding of mosquitoes and the reo-, currence thereof by taking such measures and by executing such work in such manner within such limit as may be specified in the notice and thereafter­notwithstanding that the breeding of mosquitoes ,may have been stopped; the Malaria Controlling, Officer, may, if he considers that the breeding of' mosquitoes is likely to recur, by like notice require all or any of the aforesaid persons to take all steps necessary to prevent such recurrence including such work to be executed or other measures to be carried out as may be specified in the notice.

7. Delegation of powers. - The Malaria Control-­ling Officer may delegate to his respective subor­dinates such of his powers under these regulations" as he may deem necessary. Provided that the dis­charge of the powers so delegated shall be subject to the control of the Malaria Controlling Officer. , '

8. Persons not to obstruct performance of duty. -­Every person on whom any order or notice is served under these regulations shall duly comply with the same and no person shall obstruct the performance­of any duty imposed by these regulations.

The Scheduled Castes and Scheduled Tribes Orders (Amendment! Act, 1976

AN

ACT

·toprovide for the inclusion in, and the exclU8lon from, the list of Scheduled Castes and Scheduled Tribes of certain castes and tribes, for the .re-ad­justm~t of representation of parliamentarY. and assembly constituencies in so far as such re-adJust­ment is necessitated by such inclusion or exclusion and for matters connected therewith.

Be it enacted by Parliament in the Twenty-seventh Year of the Republic of India as follows:-

1. Short title and Commencement. - (1) This Act may be called the Sc\1eduled Castes and Scheduled 'Tribes Orders (Amendment) Act, 1976.

,(2) It shall come into force on such date as the .Central Government may, by notification in the Official Gazette, appOint.

2. Definitions. - In this Act, unless the context .otherwise requires,-

(a) "census authority" means the Registrar Ge­neral and ex officio Census Commissioner for India;

(b) "Commission" means the Election Com­mission appointed by the President urtder a:rticle 324 of the Constitution;

(c) "Delimitation Act" means the Delimitation Act, 1972; 76 of 1972.

(d) "last census" means the census held in India in 1971;

(e) ";Scheduled Castes Order" means the Cons­titution (Scheduled Castes) Order, 1950, made by the President under article 341 of the Constitution;

(f) "Scheduled Tribes Orders" means the Cons­titution (Scheduled Tribes) Order, 1950 and the Constitution (Andaman and Nicobar Islands) Scheduled Tribes Order, 1959, made by the Presi­dent under article g!!2 of the Constitution;

(g) "State" means a State included in the Sche­duled Castes Order and the Scheduled Tribes Orders, and includes the Union territory of the Andaman and Nicobar Islands;

3. Amendment of Scheduled Castes Order. - The :Scheduled Castes Order is hereby amended in the manner and to the extent specified in the First .Schedule.

4. Amendment of Scheduwd Tribes Orders. - The ;Scheduled Tribes Orders are hereby amended in the manner and to the extent specified in the Second ;Schedule.

5. Determination of population of Scheduled Castes ,and Scheduled Tribes. - (1) As soon as may he after the commencement of this Act, the population as at the last census of the Scheduled Castes or, as the case may be, of the Scheduled Tribes, in each State shall be ascertained or estimated by the census authority.

(2) Where by reason of the amendments made by section 3 or section 4_

(a) any locality in a State specified in relation to any caste or trihe in any of the parts of the Schedules to the orders referred to in the said sections is varied so as to specify a larger area in relation to such caste or tribe, the census authority shall take into account the pOpulation figures of the caste or tribe as ascertained in the last census and in any previous census wherein the pOpulation figures of the caste or tribe in respect of the increa­sed area had been ascertained and determine the population of that caste or tribe as on the 1st day of April, 1971 by increasing or decreasing such figures by the proportion in which t.he general population of the State or, as the case may be, the division, district, taluk, tahsil, police station, deve­lopment block or other territorial division in rela­tion to which such caste or tribe has been specified by the said amendments has increased or decreased between the previous census aforesaid 'and the last census;

(b) any caste or tribe which is deemed to be both a Scheduled caste and Scheduled Tribe in relation to a State or part thereof is varied so as to specify such caste or tribe only as a Scheduled Caste or Scheduled Trihe in relation to that State or part, the census authoity shall take into account the popUlation figures of such Scheduled Caste and Scheduled Tribe as ascertained in the last census:

Provided that it shall" not be necessary for"the census authority to determine the population of any Scheduled Caste or Tribe as on the 1st day of April, 1971, if the population of that caste or tribe was not ascertained at the last census and in any of the pre­vious censuses and is, in the opinion of that autho­rity, numerically small.

Explanation. - Where the population figures of any caste or tribe in respect of any increased area referred to in clause (a) had been a~K-'€rtained iu more than one previous census, the census authority shall take into account, for the purposes of that clause, the population figures of such caste or tribe as ascertained in the previous census which is nearest in point of time to the last census.

(3) The pOpulation figures ascertained or deter­mined under sub-section (2) shall be notified by the census authority in the Gazette of India.

(4) The popUlation figures so notified shall be taken to be the relevant population figures as ascer­tained at the last census and shall supersede any figures previously published; and the figures so notified shall he final and shall not be called in ques­tion in any court.

6. Re-adjustment of constituencies by the Election "Commission. - (1) After the population ,figures have heen notified for any State under section 5, it shall he the duty of the Commission to make such amendments as' may he necessary in the Delimitation of Parliamentary and Assembly Constituencies ,Order, 1976, (without altering the extent of any cons­tituency as given in such Order), having regard to the provisions of articles 81, 170, 330 and 332 of, th~ Constitution, of section 8 of the Delimitation Act, and

of, this'Act, for, the pUrpose of giving proper representation to the Scheduled Castes, or, as the .case may. be, totpe .Sche­duled Tripes of that State' on .the basis of the number of reserved seats as speci­fied hi that Order as hereunder amended by tpe Comtpission, and the First. Sche­dule and Second Schedule to the Repre-sentation oithe People Act, 1950 shall be 43 of 1950. deemed to have been amended accord-ingly. . .

(2) In making any amendments under sub_section (1), the Commission shall, as far as may be neces­sary, have regard to the provisions of clauses (c) and (d) of sub-section (1) of section 9 of the Delimi­tation Act.

(3) The Commission shall-(a) publish its proposals for the amendments in

the Gazette of India and the Official Gazette of the State concerned and also in such other manner as it thinks fit;

(b) specify a date On or after which such pro­posals will be further considered by it;

(c) consider 'all objections and suggestions which may have been received by it before the date so specified; and

(d) thereafter make the necessary amendments in the order.

7. Procedure and powers of the Com­mission. - (1) In the discharge of its functions under this Act, the Commis­sion shall determine its own procedure and shall have all the powers of a civil court under the Code of Civil Procedure, 1908, while trying a suit in respect of the 5 of 1908. following matters, namely:-

(a) smnmoning and enforcing the attend;mce of witnesses;

(b) requiring the production of any document; and

(c) requisitioning any public r~ord from any court or office.

(2) The Commission shall have the power to require any person .to furnish any information· on such points or matters as, in the opinion of the Commission, may be useful for, or relevant to, any matter under the consideration of the Commission.

(3) The Commission shall be deemed to be a civil court for the purposes of sec­tions 345 and 346 of the Code of Criminal Procedure, 1973. 2 of 1974

Explanation. - For the purpose of enforcing the attendance of witnesses, the local limits of the juris­diction of the Commission shall be the limits of the territory of India. '.

8. Publication of amendments and their dates of operation. - (1) The Commission shall cause the amendments made by it in the Delimitation of Par­liamentary and Assembly Constituencies Order,1976 to be published in the Gazette of India and in the Official Gazettes of the States concerned.

(2) Upon,publication in the Gazette of India, every such amendment shall have the force of law and shalI not be calIed in question in any court.

(3) As SoOiLM may be after such publiCation in in the Gazette of India, every such amendment shall be laid before the House of the People and the Legis-· lative Assemblies of the States concerned.

(4) Subject to the provisions of sub­-section (5), the readjustment ()f repre­sentation of any territorial constituencies in the House of the People or in the Le­gislative Assembly of a State necessitated by. any amendments made by the Com­mission in the Delimitation of Parliamen­tary and Assembly Constituencies Order, 1976 and provided for in that Order as sO amended shall apply in relation to very election to the House or, as the. case may be, to the Assembly, held after the publi­cation in the Gazette of India under sub­-section (1) of· such amendments and shall so apply in supersession of the pro­visions relating to representation contai­ned in the Representation of the People Act, 1950. 43 of 1950.,

(5) Nothing contained in the foregoing sub-sec­tions Shall affect the representation in the House of the People or in the Legislative Assembly of a State, existing on the date of publication in the Gazette of India under sub-section (1) of the amendments made by the Commission under this Act.

9. Certain other powers of Election Comm'ission. - (1) The Commission may, from time to time, by' notification in the Gazette of India and in the Official Gazette of the State concerned-

(a) correct any printing mistake in the Delimi-, tation of Parliamentary and Assembly Consti-, tuencies Order, 1976 as amended under this Act, or any error occurring therein from any inadver-· tent slip or omission; and

(b) where the boundaries or the name of any district or any territorial division mentioned in the said Order are or is altered, make such amend­ments as appear to it to be necessary or expedient for bringing the Order up-to-date.

(2) Every notification under this section shall be laid, ,as soon as may be after it is issued, before the House of the People and the Legislative Assembly of the State concerned.

10. Validation of acts done prev'iou8 to the com-' mencement of the Act. - All things done, and all steps taken, before the commencement of this Act by the census authority for the d,~termination of population of Scheduled Castes and Scheduled Tri­bes, or by the Commission for the purpose of re-ad-· justment of constituencies shall, in so far as they are in conformity with the provisions of this Act, be deemed to have peen done or taken under these provisions as if such provisions were in force at the time such things were done or such steps were taken.,

G. S. R. 571- In exercise of the powers conferred by section 5, read with sub-section (1) of section 7

of the Employees' Provident Funds and Miscellaneous Provision Act, 1952 (19 of 1952), the Central Go­vernment hereby makes the following Scheme further to amend the Employees' Provident Funds Scheme, 1952 namely:-

1. This Scheme may be called the Employees' Provi­dent Funds (Third Amendinent) Scheme, 1977.

2. In the Employees' Provident Funds Scheme, Scheme, 1952 in clause (b) of sub-paragraph (3) of paragraph 1.

(a) sub-clause (i) shall be renumbered as sub-clause (ia) and before sub-clause (ia) as so

renumbered, the. following sub-clause shall be inserted, namely:-

"(i) as respects every establishment which is a factory engaged in any industry mentioned herein, namely, cement, cigarettes, electrical, iron and steel, paper and textiles (made wholly or in part of cotton or wool or jute or silk, whether natural or artificial), be deemed to have come into force with effect from the 2nd day of September, 1952".

(b) sub-clause (lxxii) shall be omitted.
