Ocean Waters Adjacent to the Clarence River

I, PAUL O’CONNOR, Principal Director, Fisheries & Compliance, with the delegated authority of the Minister for Primary Industries and the Director-General of the Department of Industry and Investment pursuant to sections 227 and 228 of the Fisheries Management Act 1994 (“the Act”), do by this notifi cation pursuant to section 8 of the Act, prohibit the taking of all species of fi sh, by all endorsement holders in the Ocean Trawl Fishery, by the methods of fi shing specifi ed in Column 1 of the Schedule to this notifi cation, from the waters described opposite in Column 2 of that Schedule.

The whole of the waters within the area bounded by a line commencing at a point on the mean high water mark closest to 29°25.000′S and 153.21.848’E (east of the Iluka water tower), then generally south along the mean high water mark (and across the river entrance) to Angourie Point at 29°29.180′S and 153°22.200′E, then due east 0.5 nautical miles to a point 29°29.180′S and 153°22.720′E, then 0.7 nautical miles north to a point adjacent to Yamba Point at 29°26.480′S and 153°23.120′E, then to a point 0.6 nautical miles east of Iluka Breakwall at 29°25.600’S and 153°23.020’E, then generally north to a point at 29°25.000’S and 153°23.176’E, then due west to the point of commencement.

In this Schedule, latitude and longitude coordinates are in WGS84 datum.

The provisions of this fishing closure in respect of endorsement holders in the Ocean Trawl Fishery have effect despite any provisions in the Fisheries Management (Ocean Trawl Share Management Plan) Regulation 2006.

In this fi shing closure, Ocean Trawl Fishery means the share management fi shery of that name, as described in Schedule 1 to the Act.

This fi shing closure is effective immediately until 18 November 2009 unless sooner amended or revoked, noting that this notifi cation may be amended or revoked by way of a special supplement in the Government Gazette on any week day.

1.3 Repeal of Metropolitan High Capacity Bus Trial Mass Limit Exemption Notice 2008The Metropolitan High Capacity Bus Trial Mass Limit Exemption Notice 2008 is repealed from the date of publication of this Notice.

1.4 EffectThis Notice remains in force until 1 September 2014 unless it is amended or repealed earlier or when a suitable pricing arrangement to recover the additional road wear becomes available.

1.5 Interpretation1.5.1 Unless stated otherwise, words and expressions used in this Notice have the same meaning as those de ned in the

Dictionary to the Road Transport (Mass, Loading and Access) Regulation 2005 (the Regulation).1.5.2 Notes do not form part of this Notice.

PART 2 – APPLICATION

2.1 Application2.1.1 This Notice applies to buses which are Class 3 vehicles operated by Sydney Buses as Metrobus Services on the

metropolitan high capacity routes speci ed in Part 3 and that meet the mass limits in this Part.2.1.2 Where the bus is a rigid ultra-low oor bus not longer than 14.5 metres that has a rear tandem axle group tted with

single tyres on one axle and dual tyres on the other axle, the following mass limits:(a) 6.5-tonnes on the front axle;(b) 14.5-tonnes on the rear axle group; and(c) 20.8 tonnes total when loaded.

2.1.3 Where the bus is an articulated ultra-low oor bus that has no axle groups and only three single axles, the following mass limits:(a) 6-tonnes on the front axle;(b) 9-tonnes on the central axle;(c) 11.8 tonnes on the rear axle; and(d) 26.8 tonnes total when loaded.

PART 3 – CONDITIONS AS TO OPERATION AND TRAVEL

3.1 Conditions as to Mass 2.1.4 The sum of the mass on the axle groups of an ultra-low oor bus to which this Notice applies must not exceed the

total mass limit speci ed in Schedule 1 Clause 2(6)(a) and 2(6)(c) of the Regulation by more than 800kg.

3.2 Conditions as to Travel 3.2.1 Buses to which this Notice applies may operate only on the routes set out in following Tables.

I, Phillip Costa, MP, Minister for Water, with the approval of the Treasurer, hereby direct Sydney Water Corporation to:

• Extend the Hawkesbury Heights and Yellow Rock service area to include non urban residential properties along Singles Ridge Road and Heather Glen Roads, Yellow Rock.

Reasons:The Priority Sewerage Program provides improved

sewerage services to villages in environmentally sensitive areas. These areas are typically near drinking water catchments, rivers, beaches or national parks. The program provides important environmental and social bene ts.

A signi cant number of on site systems fail to meet community expectations for public health protection and environmental standards. The Priority Sewerage Program eliminates these failing systems.

Yellow Rock predominantly drains to the east through Yellomundee Regional Park to the Nepean River at Castlereagh. A small portion of the suburb drains west to a tributary of Frasers Creek. Frasers Creek discharges to the Nepean River to the north of Yellow Rock. There are a number of natural drainage lines emanating from the residential area. These areas drain directly to the Nepean River through Yellomundee Regional Park. Due to the steep slopes, run-off is high.



Given the nature of the lots in Singles Ridge and Heather Glen Roads and their proximity to the Yellomundee Regional Park and sensitive Blue Mountains’ streams that nd their way to the Nepean River, it is appropriate that they be provided with a point of connection to a sewerage system.

I am satis ed that these are exceptional circumstances that render it necessary to give the direction in the public interest.

vertically and horizontally by the Burdened Land, each by means of the existence on the Easement Site (and wholly within the Easement Site) of a Relevant Support.

2. For the purposes of this easement, the Owner of the Burdened Land covenants to not do or allow to be done any act or thing (including by using the Easement Site or permitting the Easement Site to be used in a manner or for a purpose) which will, does or is likely to:(a) injure or damage the means of support of the

Bene ted Land or the Improvements or in any way affect the ef ciency or effectiveness of that means of support; or

(b) otherwise affect the use of the Bene ted Land for the purposes of rail infrastructure facilities or for railway purposes generally, including the operation of rail infrastructure facilities and the safe, ef cient and effective operation of railway passenger or freight services.

3. For the avoidance of doubt, the Owner of the Burdened Land may use or permit the use of the Easement Site and the land or airspace above the Easement Site for the purpose of land lling operations, including the drilling of boreholes of diameter no greater than 300mm for the purposes of monitoring potential gas or contamination on the Burdened Land or the Easement Site or its migration to the Bene ted Land, provided that such use does not constitute a breach of paragraph 2.

4. Where the Owner of the Burdened Land is in breach of paragraphs 1, 2 or 3 or any Relevant Support falls into disrepair, the Authority and each of its Authorised Users may enter onto the Easement Site and the land or airspace above the Easement Site upon reasonable written notice to the Owner of the Burdened Land (or without such notice in the event of emergency) and do such things as may be necessary or desirable for the purpose of maintaining or repairing the Relevant Support or rectifying the breach.

In exercising the rights in this paragraph 4, the relevant person must:(a) do so in a manner which causes as little inconvenience

as possible to the Owner of the Burdened Land and any Authorised User of the Burdened Land; and

(b) make good, at its cost, any damage caused in the exercise of such rights.

5. In this easement, the following de nitions apply:(a) Authorised User means a person who is lawfully

entitled to do anything on or in relation to the Bene ted Land or the Burdened Land (as the case may be) or the Easement Site, or in relation to any activity on that land or the Easement Site, and includes any person with an estate or interest in possession in, or other right to enter onto, that land or the Easement Site and any employee, agent, contractor, lessee or licensee of the Authority from time to time.

(b) Authority means Rail Corporation New South Wales as constituted from time to time, and includes its successors and assigns and any administrator of it or other person appointed by or on behalf of the New South Wales Government or any Minister of the New South Wales Government and any body in which it is merged or which as at the relevant time substantially ful ls the functions of it insofar as they relate to the subject matter of this easement and, for the purposes of this easement, includes its Authorised Users.

(c) Benefi ted Land means the land comprised in folio identi ers 101/1143827 and 102/1143827 or, if the context permits, any part of it.

(d) Burdened Land means the land comprised in folio identi ers 103/1143827 and 104/1143827 or, if the context permits, any part of it.

(e) Easement Site means the area denoted (D) on Deposited Plan 1143827.

(f) Improvements means all structures, infrastructure or other improvements erected on the Bene ted Land from time to time, and includes rail infrastructure facilities.

(g) Owner of the Burdened Land means the owner, from time to time, of the Burdened Land and that person's successors and permitted assigns and every person who is at any time entitled to an estate or interest in the Burdened Land, including any freehold or leasehold estate or interest in possession in the Burdened Land or any part of the Burdened Land.

(h) Relevant Support means any means of physical support for the Bene ted Land, including any earth batter.

6. The following rules of interpretation apply to this easement:(a) "includes" in any form is not a word of limitation; (b) one provision of this easement does not limit the

effect of another;(c) a reference to conduct includes any omission,

statement or undertaking, whether or not in writing; and

(d) any provision of, or wording in, this easement which is unenforceable or partly unenforceable is, where possible, to be severed to the extent necessary to make the easement enforceable.
