Shri Raj Kumar, PGT in Economics, Govt. Sr. Sec. School, Kahria (Sirsa)was chargesheeted under Rule 7 of Haryana Civil Services (Punishment and

Appeal) Rules, 1987 by Director Secondary Education, Haryana vide order

16/68-2009 HRL (4)/2,036 dated 8/11.06.2010 on the following charge:-

1. That on 28.05.2009, the villagers blocked NH-10, as a consequence of

showing obscene CD in GSSS Jodhwan Sirsa and further there was

lock out in the school on 28.05.2009 and 29.05.2009. Thereafter, an

FIR No. 68 dated 28.05.2009 was registered against the incumbent in

PS Ding (Sirsa). This has adversely affected the image of the

department.

He was placed under suspension vide order dated 29.05.2009 and

reinstated vide order dated 14.12.2011. He replied to the chargesheet on

17.08.2010. Findings his reply as unsatisfactory, Sh. V.P. Batra, IAS (Retd.)

was appointed as enquiry officer vide order dated 19.07.2010, who vide his

report dated 20.05.2011 did not prove the charge against the incumbent.

Thereafter, a copy of the enquiry report alongwith a dissenting note was sent to

him on dated 18.11.2011/14.12.2011 so as to make representation, if any

within a period of one month as provided in Rule 7(6) of Haryana Civil Services

(Punishment and Appeal) Rules, 1987. Accordingly, he submitted hip

representation on 21.01.2012, wherein he stated that enquiry officer has

absolved him of the charge and he has also been acquitted by the criminal

court in the matter.

I have gone through the file, contents of chargesheet, reply thereof, report

of regular enquiry officer, dissenting note issued in the matter, representation

submitted by the incumbent and connected provisions of Haryana Civil

Services (Punishment and Appeal) Rules, 1987. In this case, it is clear that

aspersions have been cast on the reputation of the School Education

Department and further this fact can also not be denied that some incidents of

showing obscene CD in school resulting in blocking the NH-10 and complete

lock out in the school for two days has taken place. Due to casting aspersion

on the incumbent, he has managed to show his attendance in another school.

Hence, the charge is proved to that extent.

Taking an overall view of the matter, a penalty of stoppage of one grade

increment without cumulative effect is inflicted upon Shri Raj Kumar, PGT in

Economics, Govt. Sr. Sec. School, Kahria (Sirsa) as provided in Rule 7(7) read

with Rule 4(1)(v) of Haryana Civil Services (Punishment and Appeal) Rules,

1987.
