(Sirsa), now Govt. Senior Secondary School Abub Shahar (Sirsa) was suspended vide

order dated 12.05.2010 and thereafter, chargesheeted vide order No. 5/17-2010-HRG-

1(1)/2060 dated 18.08.2010 under Rule 7 of Haryana Civil Services (Punishment andAppeal) Rules, 1987 on the following charges: -

That Shri Satbir Singh, charged official remained absent from school from

03.02.2010 to 15.02.2010 without any information.

That Shri Satbir Singh has received a sum of Rs.1,96,045/- from November,

2008 to March, 2010 and out of this amount, he delivered an amount of

Rs.10,000/- to Shri Sandeep Kumar, Hindi Teacher-Incharge mid day meal

and no record was made available for the balance amount.

Shri Satbir Singh was DDO for 6 Primary Schools but he did not makepayment of 40% arrears of revised pay scales to them.

That Shri Satbir Singh had received a sum of Rs.25000/- to Rs.26000/- from

Board of School Education, Haryana, Bhiwani for retuning the same to

children in connection with their fee, but he did not do so.

That Shri Satbir Singh had not put up any record about the balance amount of

Rs.68555.70/- standing in the Cash Book.

That Shri Satbir Singh had not made the payment of Rs.14,372/- drawn from

the Treasury and kept the same with him, instead of clearing the payments of

A Arrears for the period 01.01.2009 to 31.03.2009 to Shri Ashok Kumar,

Science Teacher, Smt. Rajni Sukhija, Lecturer English, Shri Dilbagh Singh,Lecturer Hindi and Smt. Kailash, Sweeper .

He replied to the said chargesheetnon- 13.09.2010 and finding the same asunsatisfactory, Shri R. K. Taneja, IAS (Retd.) was appointed as regular Inquiry Officer

(10) vide order dated 23.11.2010 who vide his report dated 07.06.2011 has proved

charge No. 2 with the observation that due to suspension, he could not have any excess

to any information from school authorities so as to enable him to refund Rs.60,000/- in

time. Similarly, charge No. 3 regarding nonpayment of 40% arrears to the staff was

also proved with the observation that the said arrears was paid on 05.04.2010. Further,

regarding charge No. 5, it has been observed that Rs.38,107/- were received by the

school already and Rs.38,500/- were deposited on 09.05.2011, however, proving the

charge to that extent. Regarding charge No. 6, the charge was proved with theobservation that the payment of DA arrears to four staff members has been made in

April, 2010. Rest of the charges were not proved. Thereafter, after agreeing with the

report of regular enquiry officer, a copy of the enquiry report was sent to the said

incumbent on 14.10.2011 to submit representation within one month, if he so desires.

The said incumbent has sent his representation dated 11.11.2011, wherein he stated

that regarding charge No. 2, he could not deposit the amount due to being involved in

an accident, mental illness and in addition, non-cooperation of the staff and presently,

no balance is pending with him. Regarding charge No. 3, he submitted that the arrears

were distributed in the 3 schools on 05.04.2010 being incharge of 3 schools only

instead of 6 schools as alleged. Further, regarding charge No. 5, he submitted that

instead of Rs.68,550/- as alleged, only Rs.38,107/- were standing as balance in the

Cash Book and the same were deposited on 09.05.2011. He again cited the reason of

accidental, not keeping proper mental health and non-cooperation of the school staff.

Regarding charge No. 6, he submitted that the arrears were paid in September, 2009

instead of April, 2010 as alleged with the reason of delay as enunciated above. Finally,

he prayed for personal hearing before deciding the matter and accordingly, he was

heard on 29.03.2012. During personal hearing, he reiterated the submissions already

made in representation dated 11.11.2011. It is specific to mention here that at the time

of personal hearing, it has been observed that the incumbent is hard of hearing and

could not interact properly due to being involved in an accident.

•I have gone through the chargesheet, reply thereof, report of regular Inquiry

Officer, representation of the incumbent in consequence thereof, submissions made in

the representation and at the time of personal hearing and connected provisions of

Haryana Civil Services (Punishment and Appeal) Rules, 1987. It is clear that presently

nothing is outstanding against the incumbent; However, charges enunciated above has

been proved to the said extent, especially not keeping proper accounts and not

withdrawing timely claims of the staff, in addition to keeping the cash in hand, which

ultimately falls in the category of temporary embezzlement and is against the cannons

of financial proprietary.

Taking an overall view of the matter, a penalty of stoppage of one grade

increment without cumulative effect is inflicted upon Shri Satbir Singh, the then

Principal, Govt. Senior Secondary School Ganga (Sirsa), now Govt. Senior Secondary

School Abub Shahar (Sirsa) as provided in Rule 4(1)(v) of Haryana Civil Services

(Punishment and Appeal) Rules, 1987 as amended from time to time.

(Fatehabad) was chargesheeted vide order No. 5/9-2008-HRG- I1(2) dated

02.06.2009 under Rule 7 . of Haryana Civil Services (Punishment and Appeal)

Rules, 1987 on the following charges: -•That Shri Jitender, Pal purchased Pressure Cooking equipments,consisting of Gas Chullahs, Regulator for Rs.2,369/- each, includingVAT charges, after obtaining quotations from M/s Rasoi GAS, Tohana,which was not an approved source of Haryana Government whefrreasthe approximate cost of the above equipment is only Rs.1,300/-.

That Shri Jitender Pal, violated the instructions issued by the FinanceDepartment Haryana and caused a loss of Rs.75,600/- to the StateExchequer of Haryana and that the Chullahs purchased were not ISI

marked.

He replied to the said chargesheet on 22.07.2009 and finding the same

as unsatisfactory, Shri V. P. Batra, IAS (Retd.) was appointed as regular inquiryofficer vide order dated 26.04.2011 who vide his report dated 30.08.2011 hasproved the charges to the extent that the incumbent cannot escape from thejoint responsibility of purchasing gas chullahs without MI mark. Thereafter,

after disagreeing with the report of regular enquiry officer, a copy of the enquiryreport alongwith a dissenting note was sent to the said incumbent on

02.11.2011 to submit representation within one month. The said incumbent

has sent his representation dated 29.11.2011, in which he sought personal

hearing. Accordingly, he was heard in person on 10.04.2012.

During personal hearing, he submitted that he was Head Master at Govt.High School Akanwali at the relevant time and Sh. Ran Singh, Block EducationOfficer (BEO) Tohana was chairman of the committee with Shri Had Swaroop,Head Master, Govt. High School Dangra (Fatehabad) as another member. Hefurther submitted that Chairman has purchased the gas chullah himself andcreated documents (forged) later on and he made us to sign. He stated that gaschullahs wourth Rs.1.6 Lac were purchased for 68 primary schools and nochullah was purchased for his school. He further stated that primary schools'Centre Heads requested for purchase to BEO and he constituted thiscommittee and it is surprising that none of the Centre Heads were mademember of the committee. He emphasized that documents available in the file

show that supply orders were given on 16 th 86 17th of the relevant month

whereas the committee was constituted thereafter on 21 st of the said month.

I have gone through the chargesheet, reply thereof, report of regularinquiry officer, dissenting note, representation of the incumbent in

consequence thereof, submissions made at the time of personal hearing andconnected provisions of Haryana Civil Services (Punishment and Appeal) Rules,1987. It is clear that the incumbent, being Member of the Purchase Committee,is collectively responsible for purchasing gas bhattis at exorbitant rate ofRs.2,369/- against rate of Rs.1,300/ - prevalent in the adjoining block ofJakhal falling in the same district, that too from an unapproved source and.
