Electricity Industry Act 2004
Electricity Industry (Network Quality and Reliability of Supply) Amendment Code 2009
Made by the Minister under section 39(2a)(a) of the Act.
1. Citation
This is the Electricity Industry (Network Quality and Reliability of Supply) Amendment Code 2009.
2. Commencement
This code comes into operation as follows — (a) sections 1 and 2 — on the day on which this code is
published in the Gazette; (b) the rest of the code — on the day after that day.
3. Code amended
This code amends the Electricity Industry (Network Quality and Reliability of Supply) Code 2005.
4. Section 3 amended
In section 3(1) in the definition of interruption delete “customer concerned;” and insert:
person to whom the electricity is supplied;
5. Section 11 amended
Before section 11(1) insert:
(1A) In this section — customer includes an eligible person as defined in
section 16.
6. Part 3 heading amended
In the heading to Part 3 delete “to customers”.

7. Section 16 amended
(1) In section 16 delete the definition of eligible customer.
(2) In section 16 insert in alphabetical order:
eligible person means — (a) a customer who is supplied with electricity
from a distribution system operated by a corporation and who consumes not more than 50 MWh of electricity per year; or
(b) a person who — (i) at separately metered premises; or (ii) at premises, other than separately
metered premises, where the person principally resides or carries on a business,
is supplied with electricity from a distribution system operated by a corporation and who consumes not more than 50 MWh of electricity per year;
separately metered premises means premises, or part of premises, for which the supply of electricity is metered separately under the Energy Operators (Powers) Act 1979 section 62(5).
8. Section 20 amended
Delete section 20(2) and insert:
(2) Each premises or part of premises — (a) that are separately metered premises; or (b) where an eligible person principally resides or
carries on a business,
are separate premises for the purposes of subsection (1).

(1) The fees specified in Schedule 1 must be paid to the court to which the application or request or registration application concerned is made.
(2) The fees specified in Schedule 2 and Schedule 3 (other than items 1 and 2) for an action must be paid —
(a) if the action has been or will be done by — (i) the Sheriff or Marshal in Admiralty; or (ii) a Deputy Sheriff; or

(iii) a bailiff appointed under the Act section 107(2)(a) or (b); or

(b) if the action has been or will be done by — (i) a bailiff appointed under the Act
section 107(2)(c), (d) or (e); or (ii) an assistant bailiff appointed by a bailiff
appointed under the Act section 107(2)(c), (d) or (e),
to the bailiff.
(3) If under subregulation (2)(b) fees are paid to a bailiff, the bailiff is entitled to retain the fees for his or her own use.
(4) The fees in Schedule 3 items 1 and 2 must be paid to the Marshal in Admiralty.
9. Regulation 109 replaced
Delete regulation 109 and insert:
109. Recovery of unpaid fees
(1) If — (a) a fee specified in Schedule 1 is not paid under
regulation 107A(1) to a court; or (b) a fee specified in Schedule 2 is not paid under
regulation 107A(2)(a) to the Sheriff; or (c) a fee specified in Schedule 3 is not paid under
regulation 107A(2)(a) or (4) to the Marshal in Admiralty,
the unpaid fee is a debt due to the State and may be recovered in a court of competent jurisdiction.
(2) If a fee specified in Schedule 2 or Schedule 3 (other than items 1 and 2) is not paid under regulation 107A(2)(b) to a bailiff, the unpaid fee is a debt due to the bailiff and may be recovered in a court of competent jurisdiction.

4. Rule 2 amended
(1) In rule 2(1) delete the definitions of: rule the Act the Registry
(2) In rule 2(1) delete the definition of the Wills Act 1837 and “and” after it.
(3) In rule 2(1) insert in alphabetical order:

Supreme Court (Fees) Regulations 2002; Registry means the Probate Office of the Supreme
Court.

(a) the remuneration they are entitled to charge under that Act; and
(b) proper disbursements necessarily made or incurred,
in respect of the non-contentious administration of those estates.

HEALTH AMENDMENT LOCAL LAW 2009 The Shire of Kalamunda has recently amended its Health Local Laws. The purpose of the new local law is to prohibit the keeping of roosters, peafowl, geese or turkeys on land zoned residential, unless otherwise approved by the Local Government, so as to protect the amenity of the area. The effect of the local law is that the keeping of roosters, peafowl, geese or turkeys on land zoned residential will be prohibited, unless otherwise approved by the Local Government, and in accordance with any conditions imposed by the Local Government. The local law comes into operation on 20 November 2009. A copy of the local law may be inspected at, or obtained from, the Administration Centre, 2 Railway Road Kalamunda, between 8.30am and 5.00pm, Monday to Friday.

Shire of Wickepin ANNUAL FIREBREAK NOTICE 2009/2010
Action is required by owners and/or occupiers of all land in the Shire of Wickepin. Please read this notice carefully. Any queries should be directed to the Shire of Wickepin Administration Centre of Local Shire Bush Fire Control Officer. Pursuant to the powers contained in Section 33 of the Bush Fires Act 1954, owners and occupiers of property within the Shire of Wickepin are hereby required on or before 1 October 2009 and thereafter to 28 April 2010 to plough, scarify or otherwise provide and maintain firebreaks clear of all inflammable material at least 2.5 metres wide as follows—
Rural Land Inside the boundary of all land held by each owner or occupier, their firebreaks need not follow the perimeter of any paddock but will be acceptable following land contours in an endeavour to overcome water erosion; To subdivide each holding into lots of no greater than 200 hectares; and To surround the homestead, out buildings and fuel storages on any such land.
Townsite Land All lots within the townsites of Harrismith, Tincurrin, Toolibin, Wickepin and Yealering are required to be cleared and maintained free of all debris or inflammable material. Failure to comply with these requirements renders the owner or occupier liable to a penalty not more than $400.
Clearing of Fence Lines When clearing for new fence lines, landholders are asked to consider locating the fence three (3) metres inside their boundary to avoid any clearing on road reserves. Old fences should first be removed. If landholders wish to place their fence on the boundary, they may clear no more than one (1) metre beyond their boundary. This may be varied in special circumstances at the discretion of the CEO and Manager Works & Services. Any timber removed from the road reserve is to be pushed onto the owner’s property.
Fencing of Road Reserves Council encourages farmers to fence off road reserves running through their properties to protect trees on these reserves and to allow new growth of vegetation.
Burning on Roadsides Should property owners wish to carry out burning of the road reserve adjacent to their property, it is necessary to obtain council approval prior to any burning taking place.

(a) A potable water supply with a minimum storage capacity of 100,000 litres sourced from rainwater catchments or an alternative on-site supply approved by the Local Government in consultation with the WA Department of Health.
(b) An approved on-site effluent disposal system set back a minimum distance of 100 metres from any water course or wetland area and a minimum of 30 metres from any bore, well or dam, with a minimum of 2 metres vertical separation from the base of the apparatus and the highest known ground water level or bedrock.
4 All supply of potable water shall comply with the drinking water standards for public buildings as prescribed under the Australian Drinking Water Guidelines [NHMRC] 2004.
5 The seating for an Eating House/ Restaurant/Reception Centre building shall not exceed 100 persons, including the provision for alfresco dining.
6 The additional use of a ‘Gift Shop’ is limited to the sale of gifts, arts, craft and produce produced locally.
7 Carparking associated with a Restaurant/Reception Centre use shall be calculated at 1 bay for every 4 seats, with an Eating House use to be calculated at 1 bay for every 3 square metres of public area.
8 All car parking, maneuvering areas and access driveways shall be constructed, as a minimum, to compacted gravel, drained and delineated standard to the Local Government’s specifications.
9 The clearing of remnant vegetation on the property other than for fire management and /or driveway access purposes is not permitted, unless otherwise determined by the Council.

10 All storm water resulting from impervious surfaces and buildings shall be retained on the site. Storm water shall not be disposed of into natural drainage lines resulting in erosion or cause environmental harm (contamination).
11 A Landscaping Plan shall be submitted as part of a development application clearly showing the planting of native trees and shrubs around all proposed buildings on the property, to the satisfaction of the Local Government.
12 Vegetation buffers shall be established on the property where, in the opinion of the Council, a potential conflict issue may arise with an adjoining land use.
13 The specific siting of buildings on the property shall be determined by the Council at the development application stage taking into account visual amenity, conflict issues between neighbouring uses, vehicular access, provision of adequate servicing, and removal of vegetation and extent of site works involved.
14 Management of the property (including all development/uses) shall be provided and maintained on site, unless otherwise determined by the Local Government.
15 The crossover to Chapman Valley Road from Lot 2 shall be designed and constructed in accordance with Local Government/Main Roads WA standards.
16 Prior to the commencement of development of an Additional Use permitted within this Zone, the developer may be required at the request of the Local Government to provide and implement a fire management plan to the satisfaction of the Fire and Emergency Services Authority of Western Australia and the Local Government. The fire management plan shall address—
(i) water supplies for fire fighting; (ii) egress for residents/patrons and access for
firefighting units; (iii) strategic and alternative fire breaks; (iv) adequacy of firefighting equipment. The fire management plan is to be prepared in
accordance with the document “Planning for Bush Fire Protection”.
