Executive Order #4 (2008)
• Established a state green procurement and
sustainability program;
• Directs state agencies, public authorities and other affected entities to incorporate sustainability into their operations;
• As of April 2016, forty (43) specifications have been
created for products and services

Who is required to use the EO4 specifications?
Anyone can use the specifications, but ‘Affected
Entities’ are required to.
Affected entities are:

• Public benefit corporations

Required Versus Recommended Guidelines
• Specifications typically contain both ‘Required’ and
‘Recommended’ Guidelines– Required guidelines must be met for the product or service to meet the
specification
– Recommended guidelines should be met, but are not required.
However, purchasers are strongly encouraged to buy products that
meet the recommended guidelines listed in the specification.

Example: EO4 Specification for Desktop and Laptop Computers
All desktop, notebook (includes laptops) and tablet PCs must:
• Be registered with the Environmental Product Environmental Assessment Tool (EPEAT) Silver or better, and,
• Must meet or exceed all of the following six optional EPEAT criteria:
– 4.1.2.1 Elimination of intentionally added cadmium
– 4.1.5.1 Elimination of intentionally added hexavalent chromium
– 4.1.6.2 Large plastic parts free of certain flame retardants classified under European Council Directive 67/548/EEC
– 4.1.7.1 Batteries free of lead, cadmium and mercury (not applicable for Monitors)
– 4.1.8.1 Large plastic parts free of PVC
– 4.8.2.2 Packaging 90% recyclable and plastics labeled

In addition, affected entities are encouraged to:
• Purchase PC’s that meet the EPEAT Gold standard, the six criteria listed
above, and EPEAT 4.8.3.2 ‘Minimum post-consumer content guidelines.
• Work with Contractors to evaluate available trade-in options (when not
using the state’s surplus program)

Also, Contractors are:
• Required to offer programs that include take-back or trade-in programs
• Encouraged to disclose all flame retardants used in the products offered
• Encouraged to meet flame retardancy standards and flammability
requirements without the use of added flame retardants

• The specifications include requirements and recommendations covering
important environmental areas such as:
– Energy Efficiency (Energy Star, Design Consortium)
– Water Conservation (Water Sense)
– Material Restrictions (restrictions on PVC, Mercury, PBDE’s, etc.)
– Recyclable Material Requirements
– Recycling Requirements
• By buying products that meet the specifications, you create a healthier
environment, reduce environmental impacts and encourage companies to
offer additional environmentally friendly products and services.

Beware of GreenwashingMany companies “greenwash” to make their products appear to be environmentally friendly when they’re not, for example a product that claims it is “all natural” – some naturally occurring ingredients are poisonous (arsenic, uranium, mercury, formaldehyde, etc)
To protect yourself against greenwashing:
• Be skeptical and educate yourself
• Know the EO4 specifications
• Know which certification labels are meaningful
• Avoid products where claims are vague or cannot be verified

• IFB for various motor oil viscosity grades (5W-30, 10W-30, 5W-20, 15W-40)
• Re-refined content was not required by the Solicitation, however a 10% pricing
preference was given to products containing re-refined content
• To qualify for the pricing preference, the product needed to contain at least 50% post-
consumer material by weight
• The bidder needed file a manufacturer’s affidavit of recycled content or must have
been authorized as recycled by the DEC

IFB for Oil Lubricating, High Detergent (Motor Oil, Group 05700, Award 22300)

• Products which met both of these requirements qualified for the pricing preference
• The Preference for Recycled Products’ clause stated:
“If a proposed recycled product complies with the above and is priced not more than 10% above
a low bid on products manufactured from virgin materials meeting specifications, the award will
be made on the recycled product. An additional preference, not exceeding a total preference of
15%, will be allowed if at least fifty percent of the recycled content materials utilized in the
manufacture of the product is generated from the waste stream in New York State.”
• The result was that award was made to products with re-refined content for all oil
viscosities and zones except for bulk delivery of 15W-40 in Regions 8, 10 and 11.

• The materials used to make the biodiesel were specified
• Physical and chemical requirements were specified (flash point, viscosity,
cetane numbers, etc)
• Award was made by county and item based on lowest cost
• Either B5, B10 or B20 was awarded in almost all counties, with B5 the most
common
• Contract users can choose which type of fuel to purchase (regular, premium
or biodiesel)
