house, waiting to see if Mutrie would come out.At approximately 1 :20 am on April 13, 2012, the police breached the door to Mutrie's house and placed a robot inside.The robot eventually located Mutrie and Tibbetts dead in the basement. 10.Based on the facts and circumstances described above, a search warrant was issued on April13th 2012 by Justice Mark F.Weaver, a Justice of the10th Circuit Court, for the premises located at 517 Post Road, Greenland New Hampshire.While executing the search warrant, crime scene investigators located a vehicle parked approximately 15feet from and facing the front porch of the residence.The area of the front porch, front yard and driveway where the vehicle is located is known to be the area where gunfire was. exchanged . 11.Upon a visual inspection of the vehicle,a small hole was located in the front license plate which is attached to the front bumper of the vehicle.This hole is consistent in size and shape of that being made by a bullet. 12.Based on this additional information, there is probable cause to believe that evidence of the crime of homicide will be found in the vehicle.The vehicle is a 2008 Volkswagon Jetta, 4 door sedan, color blue, BODY OVERVIEW The bodies of Cullen MUTRIE and Brittany TIBBETTS were located inside the basement of the residence located at 517 Post Road. As you walk down the basement stairs from the first floor kitchen, the bodies were located on the right side of the basement in front of laundry washer and dryer set that was placed against the east side basement wall. As you facedthe front of the laundry washer and dryer set, TIBBETTS' body was located on theleft and to her right was the body of MUTRIE. MUTRIE was lying in between the washer and the dryer and it appeared as if he had fallen backwards at a slight angle to that final position, slightly on his left side and back.I observed that he was wearing black flanneltype sweatpants, black socks, and a gray short sleeved tee shirt. I observed that he was wearing a silver wristwatch on his left wrist.I observed that there was a black semi-automatic pistol lying on top of his crotch area and partially lying between his legs.I observed that there was a partially burnt cigarette lying on the floor by his left arm.I observed that his head and his facewere both clean shaven. I observed that his head and facewere covered in a dried reddish brown substance and that heappeared tohave sustained an injury tohis head. TIBBETTS was located sitting Indian style but slumped forward onto her own lap on the basement floor in front of the dryer.Her head had come tofinal rest upon MUTRIE'S right thigh and her left knee was propped up on MUTRIE'S right thigh also. I observed that she was wearing blue jeans, a white sweatshirt with a dark grey lining.I observed that she had dyed blonde hair with dark roots showing through. Driveway Notes: Located in the driveway and on the property of the scene were a total of nine parked vehicles. These vehicles were identified as1 through 9 by Trooper Plamandon when he completed his exterior diagram of the scene; therefore I used the same identifiers for consistency.(See his diagram forfurther specifics). Vehicle #1was identified as a Dodge Durango sports utility vehicle, color black. It had a NH temporary registration of attached to it.This vehicle was facing south and was parked near the detached garage.I observed that all of the windows in this vehicle were closed at that time. Vehicle #2was identified asbeing a Volkswagen Toureg sports utility vehicle, color black.It had a NH registration of attached to it.This vehicle was facingsouth and wasparked near the detached garage.I observed that allof the windows in this vehicle were closed at that time . Vehicle #3was identified as a Ford Crown Victoria Police Interceptor. It is a fullymarked police cruiser for the Town of Greenland.It was further marked by the cruiser number100 and a NH registration of It has a fulllight bar on the roof the cruiser as well.This vehicle was facing southwest in the driveway of the scene. I observed that this vehicle had its driver's window down, and the remaining windows all were closed at that time. Driveway Notes: Located in the driveway and on the property of the scene were a total of nine parked vehicles. These vehicles were identified as1 through 9 by Trooper Plamandon when he completed his exterior diagram of the scene; therefore I used the same identifiers for consistency.(See his diagram forfurther specifics). Vehicle #1was identified as a Dodge Durango sports utility vehicle, color black. It had a NH temporary registration of attached to it.This vehicle was facing south and was parked near the detached garage.I observed that all of the windows in this vehicle were closed at that time. Vehicle #7 was identified as aBMW M6 sedan, color silver.This vehicle had a NH registration of attached to it.This vehicle was facing east and was currently parked on thelawn adjacent to the driveway. Notable ofthis particular vehicle was that it had sustained impact damage from being moved out of the way by the NH State Police SWAT team's armored Bear Cat vehicle during the initial response to this incident. IT was noted that this vehicle had been originally parked in the driveway of the scene facing east and that it had been pushed sideways off of the driveway onto the front lawn, so that the SWAT team could breach the front door withthe armored Bear Cat vehicle. Vehicle #8was identified as a Ford Crown Victoria Police Interceptor.It is a fully marked police cruiser for the Town of Greenland. It was further marked by the cruiser numberand a NH registration of t was alow profile model where the police lights were on the front and rear decks.This vehicle was facing west and parked horizontally in front of the driveway of the scene, at I the edge of the roadway. I observed that the driver's door was open at that time. Notable of this vehicle were the following items: a police rifle, a damaged pair of eyeglasses and a small black nylon medical kit were all observed lying on the ground on the passenger side of this vehicle. To the right of the front door was a single window.There was notable damage to this window frame and glass as well as suspected firearm projectile defects in it. To the far left of the front door was another single window.The glass appeared to be intact andclosed at that time. The inner shades of this window were closed. There isa covered farmer style front wooden porch leading up to the frontdoor. It has wooden stairs and wooden railings.The wood isstained.There are two front vertical posts on either side of the stairs that was holding up the roof of the porch.These posts were notably damaged by the NH State Police SWAT team's armored Bear Cat vehicle when it subsequently breached the front door of the residence. Also on the front porch, tothe right of the frontdoor isanother vertical roof support post.On this post was observed to be an infrared digital surveillance camera aimed at the front door area. Acord was leadingfrom the camera to the window to the right ofthefront door and then leading into the residence via the window.There also was a plastic baggie covering the camera protecting it from the outside weather. On the porch were several patio chairs, 3 yellow plastic pails and a propane barbeque grill. Underneath the barbeque grill a second spent shot gun shell was located. On the ground and on either side of thefront porch's stairs were two wooden planters containing plants.Underneaththe front porch stairs a spent blue plastic shot gun shell was located. Above the front porch is a single attic window that was closed and intact. They are further identified as being the main living room windows of this residence. Directly below this windows are two basement windows that facenorth towards theroadway in front of this residence.One was intact and the second had damage to its glass.The one that had damage toit was closest to the front porch area.The damage appeared to possibly be defectsfrom two suspectedfirearm projectiles. One the west side of the residence there are two single windows side by side that facewest. One of them hadan air conditioner in it.Both of these windows were further indentified as being from the living room area.Both windows appeared tobe intact. Directly above these side windows are two more windows that are alsoside by side and appeared to be attic windows.They both were the louver style windows and both were intact and closed. Also on this same west facing side of the residence were two basement windows that face west.Both were closed and intact. On therear exterior of the residence which facessouth are the following features. There is a rear porch entrance into the residence on the main floor living area that leads into the back of the kitchen.This porch is enclosed and has stairs leading up to the door from the back yard. Directly beneath this rear porch is a wooden door that leads into the basement of the residence.There are two cement barrier walls on either side of this basement door entranceway. To the left of the back porch is another exterior door that leads into the living roomarea of the residence.
