Groundw ater Management Areas w ere created "in order to provide for th e conservation, preservation, protection,rech arging, and prevention of w aste of th e groundw ater, and of groundw ater reservoirs or th eir subdivisions, andto control subsidence caused by w ith draw al of w ater from th ose groundw ater reservoirs or th eir subdivisions,consistent w ith th e objectives of S ection 59, Article X V I, Texas Constitution, groundw ater management areas maybe created..." (Texas W ater Code §35.001) Added by Acts 1995, 74th Leg., ch . 933, §2, eff. S ept. 1, 1995.- Th e responsibility for Groundw ater Management Area delineation w as delegated to th e Texas W ater DevelopmentBoard. (S ection 35.004, Ch apter 35, Title 2, Texas W ater Code)- Th e initial Groundw ater Management Area delineations w ere adopted on December 15, 2002.(356.23, TW DB R ules)
In response to th e drough t of th e 1950s and in recognition of th e need to plan for th e future, th e legislature createdth e Texas W ater Development Board (TW DB) to develop w ater supplies and prepare plans to meet th e state’s future w ater needs. In 1997, th e legislature establish ed a new w ater planning process, based on a “bottom-up,” consensus-driven approach .Coordinating th is w ater planning process are 16 planning groups, one for each regional w ater planning area (see map). Th eplanning groups, each made up of about 20 members, represent a variety of interests, including agriculture, industry,environment, public, municipalities, business, w ater districts, river auth orities, w ater utilities, counties, and pow er generation.Each planning group approved bylaw s to govern its meth ods of conducting business and designated a political subdivision, suchas a river auth ority, groundw ater conservation district, or council of governments, to administer th e planning process and manageany contracts related to developing regional w ater plans.Th e planning groups conduct all functions at open meetings in an openand participatory manner. Th ey h old special public meetings w h en th ey develop th eir scopes of w ork and h old h earings beforeadopting th eir regional w ater plans. Th is public involvement h elps direct th e planning and determine w h ich w ater managementstrategies to recommend. Consensus building w ith in th e planning groups is crucial to ensure sufficient support for adopting th e plan. P lanning group members adopt plans by vote at open meetings in accordance w ith each group’s respective bylaw s.Once th e planning group adopts its regional w ater plan, th e plan is sent to th e TW DB for approval. Th e TW DB th en compilesinformation from th e approved regional w ater plans and oth er sources to develop th e state w ater plan.
Th e Texas W ater Development Board is ch arged w ith th e approvalof groundw ater management plans. All confirmed groundw aterconservation districts in Texas are required to develop and implement a management plan for th e effective management of th eir groundw aterresources. As of 2012, all confirmed districts h ave an approvedgroundw ater management plan or are in th e process of being approved.* Districts th at h ave, in w h ole or part, auth ority as assignedby Ch apter 36 of th e Texas W ater Code.
