The National Waste Management Strategy and
Action Plans (NWMS) outlines specific short,
medium and long-term objectives and initiatives,
which are to be achieved by all spheres of govern-
ment, in order to translate the Policy on Integrat-
ed Pollution and Waste Management (IPWM) into
practice.
The implementation of the NWMS will contribute
to the progressive realisation of the environmental
right in terms of Section 24 of the Constitution that
provides for a cleaner, safer environment that is not
harmful to the health and well being of people.
The NWMS outlines the priority initiatives that are
to be developed by the three spheres of govern-
ment that includes: integrated waste management
planning; waste information system; waste mini-
misation; recycling; waste collection and trans-
portation; waste treatment and waste disposal.
The strategy also defines short-term objectives as
those waste management activities planned within
current resource constraints. One of the short-term
priority objectives that must be achieved by pro-
vincial governments is the drafting of a Provincial
Hazardous Waste Management Plan (HWMP).
To meet this short term obligation, the Western
Cape Department of Environmental Affairs and De-
velopment Planning (D: EA&DP) has conducted:
• A Baseline-Situational Analysis on Hazar-
dous Waste Management in the Western
Cape (2002).
• Consultative workshops with various stake-
holders, interested and affected parties
(I&AP’s) and the general public (2004).
The needs and objectives that were identified
through the consultative workshops and the Base-
line-Situational Analysis Report have been collated
and have contributed to the development of this,
the first Hazardous Waste Management Plan for
the Western Cape (HWMP).

Hazardous waste is defined as
1. “Waste that has the potential, even in low concentrations, to have a significant adverse effect on
public health and the environment because of its inherent toxicological, chemical and physical
characteristics.”
2. “Waste that may, by circumstances of use, quantity, concentration or inherent physical, chemical
or infectious characteristics, cause ill-health or increase mortality in humans, fauna and flora, or
adversely affect the environment when improperly treated, stored, transported or disposed of.”

Waste identified as hazardous requires strin-
gent control and management to prevent
harm or damage and can only be disposed of at
a permitted hazardous waste landfill facility.
The aim of integrated hazardous waste manage-
ment planning is to ensure the protection and safety
of the environment through efficient and effective
hazardous waste management. Thus HWMP shall
subscribe to the environmental management
principals as described in Section 2, of the
National Environmental Management Act, Act. 107
of 1998 (NEMA), while ensuring the attainment of
acceptable standards of management, practice and
technology in relation to the generation, handling,
storage, transportation, treatment, disposal and
record keeping of hazardous waste.
These aims must be achieved within the framework
of cost effective, efficient and sustainable environ-
mental management systems and practices. This
can only be achieved by involving all stakeholders,
business, industry and interested and affected
parties in the development of a hazardous waste
management plan for the province.
The key factor underpinning this participative
approach is the common desire for sustainable
waste management which will ultimately contri-
bute towards sustainable development and the
attainment of sustainable and healthy communities
in the province.
The generation of waste is an inevitable conse-
quence of development and therefore it will not
be possible to eliminate its generation altogether,
however concerted effort must be made to move
towards “zero waste” in the long term. Efforts must
thus be concentrated on cleaner production and
the waste management hierarchy which favours, in
the following order of preference, waste avoidance,
minimisation, reuse, recycling, treatment and dis-
posal being the last resort.
All parties advocate a proactive approach, which
seeks to put in place environmental management
systems, which will anticipate, prevent or eliminate
adverse impacts on human health and safety, and
the environment, while subscribing to the governing
principals of NEMA, such as, duty of care and
polluter pays.
In implementing the Waste Management Strategy,
Provincial governments are tasked to develop
Integrated Hazardous Waste Management Plans.
Business and Industry are required to develop
waste management plans and submit these to
municipalities to inform their Integrated Waste
Management Plans (IWMPs).
The development of the hazardous waste manage-
ment plan at provincial level must also be seen
as an integral link with the IWMP which must
be developed by each municipality. The IWMP
should be seen as an integral part of the Integrated
Development Plan (IDP) that is manifested as a
sectoral plan to the IDP.
IDP’s need to be developed by municipalities as
stipulated in the Municipal Systems Act, Act No.
32 of 2000. This Act and its regulations defines
municipal functions and powers as they are
stipulated in Schedule 4 and 5 of the Constitution
and outlines the IDP planning process and its
requirements which must therefore be considered
and complied with.
The current restructuring of local government in
the Western Cape and the delegation of waste
management functions to certain categories of
municipalities are likely to have a major impact
on the standard of waste management practices
in the Western Cape. Integrated Waste Manage-

4.SCOPEOFTHEPLAN
ment Planning can be regarded as a catalyst for
more effective waste management because it
can inform the desired institutional structure,
systems and practices.
The Western Cape consists of 30 municipalities,
which are divided into the following categories:
• 1 metropolitan municipality
• 5 district municipalities and
• 24 local municipalities
The hazardous waste types generated vary in the
various municipalities. Consultative workshops
were therefore conducted within the West Coast,
Overberg, Eden, Central Karoo, Cape Winelands
district areas and the City of Cape Town metro-
politan area.
This Hazardous Waste Management Plan
includes the following information:
• The types of hazardous waste that is
generated;
• The existing hazardous waste man-
agement systems and practices;
• Hazardous waste statistics;
• The organizational structure and func-
tions of the various municipalities;
• The existing policy and legislation;
• The objectives and targets that have
been set by the attendees during the
workshops for the Western Cape with
regard to the future management of
hazardous waste;
• The proposed projects / activities that
have been identified to ensure that
the objectives and targets that have
been set are achieved within the set
time frames;
• The responsibilities of the various role
players in the implementation of this
plan.
4.1 PriorityHazardousWasteStreams
Table 2, lists the hazardous waste
streams requiring urgent attention which
have been identified through baseline
information studies and the HWMP public
participation workshops.

5.1 StrategicGoal
To ensure the safe and integrated management of hazardous waste in the Western Cape through
integrated sustainable hazardous waste management planning.
5.2 Objectives
The following objectives have been identified through consultation with Stakeholders and
Interested and Affected Parties:
i. Safe Handling, Storage, Transportation and Disposal of Hazardous Waste
ii. Accurate and Reliable Information Management
iii. Effective Compliance Monitoring and Enforcement
iv. Reduction of the Generation of Hazardous Waste
v. Provision of Sufficient / Adequate Financial Resources
The above listed objectives are clarified as follows:
i. Safe Handling, Storage, Transportation and Disposal of Hazardous Waste
a) Identify the need for and initiate planning of suitable hazardous waste treatment and
disposal facilities for the Western Cape.
b) Continuously educate and appropriately train all personnel on the safe handling of
and the relevant emergency procedures with regard to the accidental exposure, spillage
etc. of hazardous waste.
c) Continuously educate and inform the general public, business and industry as well as
municipal officials who are exposed to hazardous waste as to the:
• Number of permitted and non-permitted hazardous waste disposal / treatment
facilities being operated within the Western Cape.
• Progress with regard to the rehabilitation of previously operated hazardous
waste disposal or management/treatment facilities.
• Dangers related to the handling, storage, transportation and disposal of
hazardous waste.
• Identification and classification of hazardous waste.
• Methods recommended for the safe handling, storage, transportation and
disposal of hazardous waste.

• Approved identification/labelling methods for all containers and vehicles used
to store and transport hazardous waste.
• Safe treatment and disposal of the seven-priority (7) hazardous waste streams i.e.
special hazardous wastes, pesticides, sewage sludges, health care waste,
abattoir waste, industrial hazardous waste and household hazardous waste.
ii. Accurate and reliable Information Management
a) Develop, operate and maintain information management services and systems that
will support effective compliance monitoring, and the enforcement of regulatory
measures with respect to hazardous waste in the Western Cape.
b) Develop data collection and reporting procedures for all hazardous waste produced
in the Western Cape, so as to obtain more comprehensive dataset and accurate
information.
c) Strengthen and build the infrastructure and capacity at municipal level to collect,
analyse and use relevant information and knowledge to ensure informed decision-
making, which would support integrated hazardous waste management.
d) Ensure that all organs of state, facilities, industries and individuals producing,
handling, storing, transporting, treating and disposing of hazardous waste within the
boundaries of the Western Cape maintain records pertaining to their activities with
regard to hazardous waste management and report on their activities as determined
by D: EA&DP.
iii. Effective Compliance Monitoring and Enforcement
a) Ensure strict enforcement of legislation by adopting a “zero tolerance” approach to
those who show disregard for or violate the laws governing the generation, handling,
transport, storage, treatment and disposal of hazardous waste within the Western
Cape.
b) Ensure the efficient prosecution of environmental offenders.
c) Raise awareness of the significance and value of the environment within the judiciary.
d) Assist municipalities with compliance monitoring and enforcement.
e) Ensure co-ordinated and uniform compliance monitoring and enforcement.

f) Lobby that fines and sentences imposed for offences with regard to hazardous waste
management are commensurate with the crime committed i.e. fines or sentences
should be equal to or greater than the economic benefit so that the penalty is not seen
as “the cost of doing business”.
iv. Reduction of the Generation of Hazardous Waste
Achieve a minimum 25% reduction of the total tonnage of priority hazardous waste to landfill
over the next six years by promoting cleaner production methods i.e. avoidance, minimization,
recycling and, re-use of hazardous waste and treatment so as to ensure 0% hazardous waste
to landfill by 2022 (POLOKWANE DECLARATION).
v. Ensure the Provision of Sufficient Financial Resources
a) Ensure that sufficient funds are available to implement the activites and / projects
identified in this plan.
b) Ensure the alignment of activities and programmes between all tiers of government.
c) Promote public-private partnerships, private sector ownership and operation, and cost
shared provincial, district and municipal agreements with regard to sharing equipment,
facilities and the development of educational materials and programmes.
d) Explore the use of economic instruments which support the “Polluter Pays Principal”
i.e. taxes, fees, charges etc.
5.3 Short,MediumandLongTermTargetsandActivities
The following objectives and targets have been proposed with regard to the above:
5.3.1 Short – Term Targets (attainable in 1 to 3 years)
The following targets objectives are relatively simple, low cost and a limited amount of time
and planning are required:
i. All priority hazardous waste will be appropriately treated before disposal at licensed
facilities.
ii. All high-risk sites should be identified and managed immediately.

iii. All organs of state, facilities, industries and individuals producing, handling, storing,
transporting, treating and disposing of hazardous waste within the boundaries of
the Western Cape will have to be identified within (1) year of the implementation of
this plan.
iv. To ensure co-ordinated and effective enforcement.
v. To reduce the generation of hazardous wastes by 15% by 2009.
vi. To increase the recovery and recycling rates for priority hazardous wastes identified
by 5% by 2009.
vii. Ensure adequate funds for the implementation of this plan.
viii. Engage and inform the general public, business and industry and municipal officials
who are exposed to hazardous waste, as to the dangers, options and methods for
safe handling, storage treatment etc.
ix. Strengthen and build the capacity at municipal level to collect, analyse and use
relevant information and knowledge to ensure informed decision-making, which would
support integrated hazardous waste management.
x. All organs of state, facilities, industries and individuals producing, handling, storing,
transporting, treating and disposing of hazardous waste have to register and report
on their operations as determined by D: EA&DP within 2 years of implementation of
this plan.
5.3.2 Medium - Term Targets (attainable in 4 to 7 years)
These objectives are more costly and more difficult to implement than short term objectives:
i. Establish an improved collection infrastructure for household, agricultural, small and
medium enterprise hazardous wastes.
ii. Identify and initiate planning of suitable hazardous waste treatment and disposal
facilities.
iii. Strengthen and build the capacity at municipal level to collect, analyse and use
relevant information and knowledge to ensure informed decision-making, which
would support integrated hazardous waste management.

iv. Reduce the amount of household hazardous waste being disposed at landfill facilities.
v. To ensure that all organs of state, facilities, industries and individuals producing,
handling, storing, transporting, treating and disposing of hazardous waste maintain
records pertaining to their activities with regard to hazardous waste management.
vi. Timeous and effective prosecution of offenders / transgressors.
vii. Explore the establishment of a Hazardous Waste Cleanup and Remediation financial
mechanism.
viii. To reduce the generation of hazardous wastes by 30% by 2014.
ix. To increase the recovery and recycling rates for priority hazardous wastes identified
by 15 % by 2014 .
5.3.3 Long –Term Targets (longer than 7 years)
These objectives usually require larger budgets and longer term planning, they are also
reliant on the outcomes of the medium term objectives:
i) To ensure the availability of information to I&AP’s in order to support effective inte-
grated pollution and waste management decisions.
ii) 100% compliance with relevant legislative requirements with regard to hazardous
waste.
iii) Increase the recovery and recycling rates for priority hazardous wastes identified by
25% by 2016.
iv) Reduce the generation of hazardous waste by 50% by 2016.
v) A sustainable Hazardous Waste Cleanup and Remediation financial mechanism.
(eg. Hazardous Waste Cleanup and Remediation fund).

The successful implementation of this plan is dependant on the commitment of all responsible entities
(as detailed in Section 6.) and the provision of adequate funding. Municipalities are advised to make suffi-
cient provision to execute their obligations through the normal budgeting process. Additional funding can
also be sourced from donors. Municipalities should note that their obligations in terms of this plan should
be included and costed as part of the development of their IDP’s and IWMP’s.
D: EA&DP will investigate additional sources of funding and will assist municipalities where possible with
the implementation of this plan.

Monitoring is a critical process, the results of which informs strategic planning, financial and technical
performance etc. Thus monitoring and reporting on the implementation of the HWMP will contribute towards
the achievement of its objectives.
The activities linked to the following objectives:
• Safe Handling and Disposal of Hazardous Waste
• Information Management
• Improved Compliance Monitoring and Enforcement
• Reduction of the Generation of Hazardous Waste
• Ensure the Provision of Adequate Financial Resources
which, are defined in section 6 “Implementation Programme” will be monitored by provincial government
together with municipalities on an ongoing basis, so as to ensure that the above objectives are achieved.
Municipalities should establish a performance management system that is commensurate with their re-
sources and which facilitates regular reporting and the evaluation of progress with regard to waste manage-
ment targets and activities. The performance management system envisaged must ensure that the views
of communities are considered in assessing performance.
A formal reporting mechanism will have to be developed which will be aligned with the reporting provisions
of the National Environmental Management: Waste Management Act (NEM:WM). It is envisaged that such
provisions will ensure that the results of monitoring activities will be compiled into a monitoring report on
an annual basis. The outcomes of the monitoring reports should alert municipalities to initiate the required
interventions to ensure delivery of the HWMP objectives.

The reviewing of the HWMP and its implementation will entail the critical assessment of delivery with regard
to its objectives. This process will evaluate the appropriateness of the strategic goal and its objectives and
should provide an indication of whether they need to be amended or adjusted.
The review of the HWMP will be informed by:
• The evaluation of monitoring reports.
• The evaluation of performance levels related to the implementation of the plan.
• An evaluation of improvements from status quo conditions.
• Public perceptions and opinions regarding hazardous waste management and its associated
services.
• An evaluation of the effectiveness of prescribed objectives and activities.
The Western Cape Hazardous Waste Management Plan will be reviewed by D: EA&DP in consultation with
stakeholders at least every 5 years.
