Jockey Tommy Berry, who also rode the Michael, Wayne and John Hawkes-trained Chautauqua at Randwick last start, told ANZ Bloodstock News yesterday the six-year-old was a more mature and relaxed horse now compared to when he was a four-year-old.

“As a three-year-old he won the Hawkesbury Guineas over 1400 metres and he won well that day,” Berry said.

“We tried to step him up once more in the All Aged Stakes and he almost brought himself down he pulled that hard, so he obviously went back the sprints.”

Berry said it was possible Chautauqua ($8) could even track Winx, the early $1.15 favourite, into the race turning for home on Saturday despite drawing opposite sides of the field.

“He’s a lot more relaxed now and I could see him in front of a few on the fence or, if he is back last, from that gate (eight) Hughie will have to go forward or back and if he does go back I might find myself on the back of Winx,” he said.

In the Canterbury Stakes, Berry settled Chautauqua in last position and was forced to cut the corner on the heavy track at Randwick before angling towards the outside to the better going when runner up to Le Romain.

“We knew he was looking for a little bit further and he showed that last start by proving it was the right way to go (in the Canterbury Stakes),” he said.

“He was strong to the line even though he had a few things against him on the day. As long as I can get him to switch off early on Saturday I’ll be happy.”

Bowman admitted yesterday that Winx, who won last year’s Cox Plate (Gr 1, 2040m) by a comprehensive eight lengths, was facing her toughest test for some time in the George Ryder Stakes on Saturday.

Winx won the Chipping Norton Stakes (Gr 1, 1600m) at Randwick comfortably by two lengths on a Heavy 9 surface on 25 February and was likely to confront another heavy track on Saturday.

“She’s starting to get to a level that she was when she won the Cox Plate last year. So that to me is very exciting,” Bowman said.

“In saying that though I think the George Ryder will probably be the most competitive event for her in some time.

“The fact is it’s 1500 metres so it’s probably short of her best distance and she’s going to take on some serious competition in Chautauqua, Le Romain and others.

“I think those two horses put the writing on the wall in the Canterbury Stakes the other day that they’re up for the challenge.

“We’re going to know where we’re at anyway.”Trainer John O’Shea, who also has Hartnell (Authorized) in the

Ranvet Stakes (registered as Rawson Stakes) (Gr 1, 2000m) at Rosehill on Saturday, has accepted with Epsom Handicap (Gr 1, 1600m) winner Hauraki (Reset) in the George Ryder Stakes.

Hauraki, who resumed with a closing third behind Le Romain and Chautauqua in the Canterbury Stakes, has drawn barrier two for his second up run.

“The Ryder is as good a weight-for-age race as we’ve seen in Australia

for some time,” O’Shea said.“The number of Group Ones between all the participants would be

quite significant. You’ve got the best horse in the world, the former best sprinter in the world, the quality of the Melbourne horses who are multiple Group One winners and our own horse Hauraki who’s in great form.”

O’Shea said Hauraki, who won the Epsom Handicap third up from a spell last preparation, was on target for the Doncaster Mile (Gr 1, 1600m) at Randwick on 1 April.

“I think the Doncaster winner will probably run in the (George Ryder Stakes) and if Hauraki can run top three it gives him a wonderful opportunity to go on because he’s so adept at Randwick at a mile,” he said.

Jockey William Buick, who is based in Sydney while fellow Godolphin retained rider James Doyle recovers from injury, said Hauraki was capable of mixing it with the elite field.

“He’s thriving, a very exciting horse. He’s in the deep end, but he’s a very classy horse in a good race. A lot can happen on the day,” Buick said.

Victorian trainer Darren Weir decided against sending Black Heart Bart (Blackfriars) to Sydney for the George Ryder Stakes, but did accept with Australian Bloodstock-owned Japanese import Tosen Stardom (Deep Impact).

Tosen Stardom, who had just one run in the spring, resumed with a narrow second to Black Heart Bart in the Futurity Stakes (Gr 1, 1400m) at Caulfield on 25 February and has Craig Williams booked to take the ride on Saturday from the outside barrier.

The six-year-old entire, however, is also in the Blamey Stakes (Gr 2, 1600m) at Flemington alongside Group One-winning stablemates Black Heart Bart and Palentino (Teofilo). If Tosen Stardom races in Melbourne on Saturday, apprentice Ben Melham will take the ride.

Chautauqua’s stablemate Leebaz (Zabeel) will be ridden by Christian Reith, while Gold Coast trainer Toby Edmonds has three-year-old Sylpheed (Real Saga) in the George Ryder Stakes after finishing fourth first up against her own age at Eagle Farm on 18 February.

All American Colt Tops Book TwoA colt by the Strawberry Road-based All American (Red Ransom) topped the final session of the three day Magic Millions Adelaide Sale after Magic Millions agent Tim Brown, who was bidding on behalf of former leading

New Zealand trainer Jason Bridgman, went to $56,000 to secure the colt from the Tosca Farm draft. Catalogued as Lot 447 the colt is out of the winning mare Social Register (Hussonet), herself a half-sister the Group Three winner Essence (Gluch). Book Two ConcludesAfter the close of trade on the final day Magic Millions reported the average price for Book Two increased from $13,505 to $15,453 compared with the corresponding session last year, with a total aggregate of $1,347,000 at a clearance rate of 73 per cent. "There was some great trade done today," said Magic Millions managing director Vin Cox. "A number of vendors were delighted with their results - many horses sold above expectation and the demand for quality continued right through the day. "I think he's actually looking for a bit of wet ground," Melham told Racing.com. "He just peaked the other day and the back up will suit him on the wet ground."

Sofia Rosa Arrives In SydneyATC Australian Oaks (Gr 1, 2400m) winner Sofia Rosa (Makfi) arrived in Sydney yesterday ahead of her tilt at the Ranvet Stakes on Saturday. The Stephen Marsh-trained four-year-old drew barrier seven for the Group One race, with Blake Shinn taking the ride. Sofia Rosa, who campaigned in Melbourne during the spring, finished third in the Haunui Farm WFA Classic (Gr 1, 1600m) at Otaki last start on 25 February behind Kawi (Savabeel).

Melham Positive About She Will ReignGolden Slipper Stakes (Gr 1, 1200m) second favourite She Will Reign (Manhattan Rain) has retained the confidence of her jockey Ben Melham despite being beaten in the Reisling Stakes (Gr 2, 1200m) at Randwick on 4 March. The Gary Portelli-trained filly, who had won her first three starts decisively, was beaten by Frolic (Husson). Melham said She Will Reign did not handle the heavy track in the Reisling Stakes. "She lost no admirers - including

myself," Melham told Racing.com. "I was really happy with the run. I just had it in the back of my mind when riding her to run the 1200 out and obviously that horse (Frolic) that got out wider in the better lane had that momentum up on me.”

Vet Check For Single BulletTrainer Gary Portelli informed NSW Stewards yesterday that Single Bullet (Not A Single Doubt) had suffered injuries after being cast tn his box at the trainers Warwick Farm stables yesterday. Saturday’s Pago Pago Stakes (Gr 3, 1200m) winner, who is nominated to run in Saturday’s Golden Slipper Stakes at Rosehill, was found to have abrasions to both front legs and also had some swelling to his right eye. Portelli reported Single Bullet has been inspected by his stable veterinarian who detected no lameness after the incident. The colt will now have to be inspected by Racing NSW Senior Official Veterinarian Dr Craig Suann at 9:30am today, who will assess his suitability to line up in the $3,500,000 race on Saturday.

Williams Confident About CatchyJockey Craig Williams is confident that Catchy (Fastnet Rock) can keep her unbeaten record intact when she lines up in the Golden Slipper Stakes at Rosehill on Saturday. The Lindsay Park-trained two-year-old stretched her perfect record to four when she took out the Blue Diamond Stakes (Gr 1, 1200m) on her last start. While Williams did warned the heavy going would be unknown territory for the filly, but hopes she will have not problems handling it on Saturday. "It is a big question mark," he said. "But one thing I know about her is that she'll still try and still give her best. She doesn't know anything else but to stick her head out in front and win these fights and win these races. If you want to go to war with a horse, she's the horse you want to go to war with."

Wet A Worry For Emerald CityTrainer David Vandyke has warned that Emerald City (Bernardini) may not line up in the Gold Coast Stakes (1800m) on Saturday if the heavy rain arrives in Queensland. Kembla Grange Trials PostponedYesterday’s barrier trials scheduled for Kembla Grange were postponed after overnight rain left surface water on the track. Racing officials called off the barrier trials after declaring the track unsafe to conduct the program.

Cobalt Appeal Decision On FridayThe Victorian Civil and Administrative Tribunal is expected to hand down its decision in the appeals lodged by trainers Danny O’Brien and Mark Kavanagh relating to disqualifications over cobalt use. The Flemington trainers were in early 2016 disqualified for four years and three years respectively by the Racing Appeals and Disciplinary Board. Four horses trained by O’Brien returned cobalt positives above

the allowable threshold while one trained by Kavanagh was found to have returned a high reading. VCAT could hand down its verdict over Kavanagh and O’Brien’s appeals against the disqualifications at 9.30am tomorrow.

Gold Mount To Attempt Rare FeatThe Tony Cruz-trained Gold Mount (Excellent Art) will attempt to become the first horse since Oriental Express (Green Desert) in 1997 to win in the Hong Kong Derby (HK Gr 1, 2000m) off the back of only one start in Hong Kong. The four-year-old won the Citi Insurance Services Handicap (1600m) last month, his first start since being imported from Britain, where he was known as Primitivo. While in training with Alan King he won four races in a row, which culminated in him landing the King George V Stakes (1m4f) at Royal Ascot last June. “I like Gold Mount, he’s a lovely horse,” said Cruz. “He can really accelerate in the last quarter, as we saw when he raced in England. Horses that can run at Ascot, they love Sha Tin racecourse.”

Amazing Kids Trials Ahead Of DubaiAmazing Kids (Falkirk) tuned up for a tilt at the Al Quoz Sprint (Gr 1, 1200m) at Meydan on 25 March with a barrier trial over 1000 metres at Sha Tin on Tuesday. The five-year-old, who took out the Bauhinia Sprint Trophy Handicap (Gr 3, 1000m) and was most recently seen running fourth in the Centenary Sprint Cup (Gr 2, 1200m) in January, was given an easy time by Brett Prebble and eventually finished an easy second, a neck behind the John Size-trained Amazing Kids (Sebring). Strong Start For OBS March SaleThe first session of the Ocala Breeders' Sales March sale of two-year-olds in training on Tuesday ended with a significant gain in average, a median that was on even terms with last year’s corresponding, and a decline in gross because of fewer horses sold. At the close of trade on Tuesday, Ocala reported 137 lots sold for a total aggregate of US$26,320,500, compared with US$26,481,500 for the 169 sold at the corresponding session last year. The average soared 23 per cent to US$192,120 from US$156,322, while the median both years was US$110,000. The session topper was a colt from the first crop of Claiborne Farm stallion Orb (Malibu Moon), after he was purchased by Solis / Litt for US$1,250,000 from the Crupi’s New Castle Farm draft. Mastery Recovering From SurgeryUnbeaten colt Mastery (Candy Ride) is reportedly recovering well after undergoing surgery to repair a condylar fracture of his leg, an injury he sustained during his victory the San Felipe Stakes (Gr 2, 8.5f) at Santa Anita last Saturday. "The surgery went very well," trainer Bob Baffert told Bloodhorse.com. "He'll stay there for at least a month," Baffert said. "We'll just wait. It takes like 90 days for that to heal up, and then we'll decide (if he'll race again). Right now our main concern is to make sure he's comfortable and happy."

Being a firm that is acknowledged and respected for its property tax expertise as much as its bloodstock expertise, when we

come across a decision in a Land Tax case that focuses on whether a full primary production exemption is applicable for a rural property, it will obviously be of special interest to us.

It follows that if it’s of special interest to us, it will be of special interest to horse industry players running a business on rural property.

This case was decided in the Supreme Court of NSW on 30 January 2017 and is an extension of the immense scrutiny that NSW land owners have been subjected to in the past few years, especially those trying to claim a “primary production” land tax exemption.

Though, given the uniformity of land tax exemption laws across Australia, the principles in this case extend to land owners in other states who are trying to claim primary production land tax exemption where the land also has a competing purpose, e.g. part of the land is being developed for residential housing purposes.

The interesting aspect of this case as that in some of the years land tax exemption was not granted even though the primary production activity was still being carried on and the sale of the property had not even commenced. Expenditure incurred was the major consideration as to what activity was “dominant”.

Issue

The issue was whether a company called Leppington Pastoral Co Pty Ltd (“Leppington”), was exempt from NSW Land Tax in respect of land which was a dairy farm but also part of a major residential project whereby farmland was being progressively released for urban development. This case turned on the question of whether the ‘dominant use’ of land was ‘primary production’.

FactsLeppington owned and operated a dairy

farm on land in and around an area south-west of Sydney.

During the 2011 to 2014 land tax years, a significant portion of Leppington’s land (the ‘Farmland’) was progressively released to a developer (‘GDC’) for the purpose of building a new township with associated housing (the ‘development land’).

GDC and its contractors had a right to access the Farmland prior to it becoming development land under a licence granted to Leppington, under which GDC:· was required to notify Leppington prior to accessing the land; and· had an obligation to cause as little disruption as possible to farming operations being carried out on it.

GDC used the Farmland during this period

to carry out:· earthworks relating to adjacent Development Land; and· tests, either to obtain consents for future development on the Farmland, or to satisfy conditions of approval on either the Farmland or the Development Land.

The Land Tax Commissioner (‘LTC’)

assessed Leppington to land tax in respect of both the Development Land and Farmland for the 2011,2012, 2013 and 2014 land tax years. Leppington objected to the LTC’s assessments in respect of the Farmland portion.

the dominant use of which is for:(b) the maintenance of animals (including birds), whether wild or domesticated, for the purpose of selling them or their natural increase or bodily produce, or

Leppington’s ContentionsLeppington claimed that during the 2011-

2014 land tax years, the dominant use of the Farmland was primary production because that use was physically and economically dominant over the non-primary production use of the Farmland during those tax years.

Land Tax Commissioner Contentions

The LTC did not dispute that the Farmland was used for “primary production” as defined in the above section. He did however consider that the dominant use of the Farmland in the 2011-2014 land tax years was preparing the Farmland for imminent development, and carrying out development activities relating to adjacent land.

Court Decision

The Supreme Court decision was a “shared” victory for Leppington and the LTC.

The court held that Leppington had satisfied its onus of proving that the dominant use of the Farmland was primary production for the 2012 and 2013 land tax years, but not for the 2011 and 2014 years.

His Honour examined the ordinary meaning of the term “dominant” and concluded that based on dictionary definitions, the term “carries the notion of not just being the chief use or most influential use, but of being a ruling, governing or commanding use”.

“Dominant use” Factors His Honour noted that in determining the

‘dominant use’ of the Farmland in each land tax year, it is necessary to consider:

· the scale and intensity of the primary production use of the Farmland, and relevant to – but not determinative of that question – is the extent to which use of the subject lands makes a financial contribution to Leppington’s dairy operations;· whether activities conducted by GDC on the Farmland amounted to the commencement of use of the Farmland for residential development or whether residential development remained a contemplated future use; and· the nature, extent and intensity of the various uses of the Farmland, the extent of the Farmland used for different purposes and the time, labour and resources spent in using the Farmland for each purpose. Having regard to these considerations, the

Court held that for the 2012 and 2013 land tax years:

· the evidence showed that the only substantial competing use of the Farmland was by consultants for the purpose of carrying out tests in connection with existing and proposed residential development. There was also a small amount of earthworks. Together, this

development work was “episodic” and carried out only over a small area, such that overall, the primary production use of the Farmland in those years dominated.· therefore Leppington had established that the dominant use of Farmland was primary production, and that the LTC’s land tax assessment relating to the Farmland should be revoked for those years.However, for the 2011 and 2014 years,

the Court held that Leppington had failed to establish that the dominant use of the Farmland was primary production, and therefore the LTC’s land tax assessments for those years should be confirmed, i.e. no exemption.

His Honour found:· For the 2011 land tax year, there was imprecision in Leppington’s evidence as to the value to it of the primary production activities on the Farmland. Furthermore, the evidence clearly showed substantial expenditure by GDC on earthworks and on consultant’s activities which exceeded Leppington’s expenditure on cattle grazing and raising of pastures and crops. His Honour inferred that based on the expenditure on each competing use, the development activities were of greater

value to GDC in the 2011 year than the primary production activities were to Leppington.· For the 2014 land year, the evidence established the extensive earthworks were carried out on the Farmland, and the costs incurred by GDC for consultants were almost double the costs in 2012 and 2013 combined, while the primary production use was materially less than it had been for 2012 and 2013.

For the really curious, NSW Revenue Ruling No. LT 097 on the topic of “Land Used for Primary Production” is the best authority for this decision.

The Darren Weir-trained Humidor (Teofilo) [125+] was an impressive winner of Saturday’s Australian Cup (Gr 1, 2000m), achieving a

high Timeform rating, overcoming controversy about a severe track bias at Flemington, writes Adam Blencowe.

A new peak Timeform rating of 125+ (is accompanied by a plus) and it will be no surprise to see the former New Zealand-trained stayer, advance further in the Timeform rankings, where he now shares top billing on the season’s Four-Year-Old table.

A rating of 125+ was the best rating in the Australian Cup since Fiorente (Monsun) [125] in 2014 and is a figure at least as good as every other winner since Lonhro (Octagonal) [128] in 2004.

Northerly (Serheed) [127] won in 2001 and Intergaze (Integra) [126] in 2000 but clearly the Australian Cup's golden era was the early nineties when Better Loosen Up (Loosen Up) [131] won in 1991, Let's Elope (Nassipour) [127] in 1992 and Veandercross (Crossways) [129] in 1993 posted the three highest ratings in the race's recent history.

And while the 2017 Australian Cup was a good race it was a day where the Flemington track really dominated most conversations.

Views on the condition of the track varied, and, as is almost always the case in debates, where the two sides were are at the extremes.

But the betting markets did appear to react to perceived track bias that suggested the track was certainly away from perfect but far from a nightmare as some claimed.

The actions of riders on the day also pointed to the thought that the fairness of the Flemington track was a 50-50 situation. Jockeys made their way to the far side in straight races but they were mostly reluctant to be on speed.

Finishing speeds on the day were: 103.2 per cent; 105.5 per cent; 103.5 per cent; 102.6 per cent; 104.4 per cent; 102 per cent; 104.6 per cent; 102.3 per cent and 103.7 per cent with

not a single race was run faster early than late.The winner of the Australian Cup, Humidor,

a noted backmarker, was always going to race against the suggested bias but he was firm throughout betting and, ultimately, he was fast and good enough to still win the race.

After being back in ninth place in the 11-horse field at the 800 metre mark, Humidor finished too well to score by a long neck from Jameka (Myboycharlie) [119] with Exospheric (Beat Hollow) [121] a length and a quarter away third.

Time for the 2000 metre journey, in a solidly run race was 2:01.07.

A clogging of the racing calendar in more recent years has seen the Australian Cup slip from prominence but the 2017 edition should be considered a strong one.

Humidor ran the best closing sectional times for the final 800 metres, 600 metres, 400 metres and 200 metres while the third-placed Exospheric ran the fastest closing times for the last 1600 metres, 1400 metres, 1200 metres and 1000 metres.

Exospheric did something similar when third in last year’s Caulfield Cup (Gr 1, 2400m) and it is clear that sustained power is his asset. He ran to a rating of 121 in the Australian Cup but his peak of 124 looks almost a formality when stepped up to 2400 metres.

And the runner up Jameka was terrific again, looking soon set to at least repeat her Caulfield Cup-winning peak of 121 after returning a Timeform figure of 119 at her third run this preparation.

overseas targets, Jameka would need to have that 121 achieved again, when and if, she steps up to tackle the cream of the European middle distance stayers.

A more immediate goal is expected to be The BMW (registered as H E Tancred Stakes) (Gr 1, 2400m) at Rosehill on 25 March, with the first three home in the Australian Cup likely to head there with good credentials but Sydney's weather could have the final say.

The other feature at Flemington was the Newmarket Handicap (Gr 1, 1200m), which was won first-up for the first time in many years by the very much in-form stable of Lindsay Park, which produced the well-travelled Redkirk Warrior (Notnowcato) [120] as a surprise winner.

With a finishing speed of 104.6 per cent, the Newmarket Handicap was slower than optimal

for a Group One sprint down the Flemington straight and the winner was aided by a smart and positive ride from a talented young rider in Regan Bayliss.

After sharing the lead at a moderate early tempo, Redkirk Warrior sprinted clear and went on to score by two lengths from Voodoo Lad (I Am Invincible) [116) with the three-year-old Star Turn (Star Witness) [118] holding on for third, a short head further back in a time of 1:09.05.

A British import, who subsequently raced successfully in Hong Kong, Redkirk Warrior returned a Timeform rating of 120 while the runner-up Voodoo Lad [116] matched his previous peak, also putting up a promising first up performance.

Both first and second are clearly back in terrific order and look to have big campaigns in store but the Newmarket Handicap overall

hardly looks to have cleared what are fairly murky waters in the Victorian sprinting division at present.

By comparison, Le Romain (Hard Spun) [125] and Chautauqua (Encosta De Lago) [125] posted genuine Group One performances recently in the Canterbury Stakes (Gr 1, 1200m) at Randwick but Melbourne's big three autumn sprints have failed to deliver ratings at that level.

In fact the 2017 Newmarket Handicap was the first renewal without a horse returning a Timeform rating to 125 or better since 2003.

Despite that comment the race is still likely to be a pointer to some forthcoming winners.

The Mike Moroney-trained Tivaci (High Chaparral) [112] being one that really caught the eye running on strongly for fifth, matching his 112 peak figure and looks set to lift that rating quickly when stepped up in trip.
