1. German Tax Risks

Malta-based iGaming operators are subject to German VAT and sports betting tax if the German market is targeted. Not reporting these taxes to the German fiscal authorities may incur criminal liability for the directors and serious fines for companies due to tax evasion. German tax prosecutors have recently started to investigate Maltese iGaming companies. Find out about the VAT changes affecting Maltese iGaming businesses from the beginning of 2015, risk mitigation in relation to gambling taxation, reporting procedures for avoiding criminal liability and tax obligations, including tax declaration using the MOSS-portal.

2. The Tax Base For VAT – Update On The Current Discussion

The German VAT Act does not provide a clear answer whether gross gaming revenue or stakes are the correct tax base for VAT – although the latter would be an economic disaster. This panel will provide background information and an update on the current legal discussion.

3. Regulatory Update

Recent developments have given the call for reform of German gambling regulation a fresh impetus. Court decisions stopping the sports betting licensing process due to non-transparency and the European Commission’s decision to initiate a “pilot process” (i.e. a pre-stage to infringement procee-dings) have prompted German policy-makers to demand a reform of the existing regime. This panel will provide an overview of the most recent trends.

Dr. Joerg Hofmann Dr. Joerg Hofmann is President of the International Masters of Gaming Law (IMGL) and the group leader of the gaming law practice group of MELCHERS law firm in Germany. Joerg has been practicing gaming law since the mid-90s. MELCHERS’ legal advice is highly valued by global market leaders in all sectors of the gaming industry. Joerg has been consistently ranked as a “Leading Individual” in Gaming & Gambling by Cham-bers Global since 2011 and is the only German Lawyer listed among “Germany’s Best Lawyers” in the category “Gaming Law” by “Best Lawyers” and “Handelsblatt” in 2014 and 2015. This year, he received the award “Gaming Law - Lawyer of the Year in Germany – 2015” by Global Law Experts.

Dr. Norbert StegemannA specialist in criminal law. Norbert frequently advises clients in gambling-related matters with regard to criminal law, criminal procedure and the law of tax offences. He is a highly recognized expert in the field and has been repeatedly identified as a recom-mended individual for “white collar crime and tax criminal law” by JUVE, German handbook of commercial law firms, most recently in the 2014/2015 edition.

Matthias SpitzA regulation expert in gaming and betting law, with a focus on EU and administrative law and taxation of gambling. Matthias advises clients on regulatory developments in the online gaming and sports betting sector and assists with the implementation of new gambling products in the German market, including social gaming. He has conducted a number of licensing procedures for sports betting and online casino operators. Matthias is a member of the IMGL and frequently contributes articles on gaming and betting law to leading journals of the industry. Together with Joerg, he is the co-author of the “Germany” section of “Gaming Law: Jurisdictional Comparisons” and of “The International Comparative Legal Guide to: Gambling 2015”.

Dr. Gregor FuehrichGregor was appointed a Certified Tax Consultant in 2010, after completing his Doctoral Thesis on European Law and German Tax Law in 2009. His areas of expertise cover capital income and self-denunciations, international taxation and inheritance/gift tax as well as taxation of online gambling. Gregor advises clients on a national and international level at the Heidelberg head offices of German tax consultancy and auditing firm FALK & Co. For more than 75 years FALK & Co has been in existence as an independent audit, accounting and tax advisory firm with some 350 employees throughout 9 national offices.

Jessica Maier, LL.M.A gaming attorney with experience in IP and competition law. Jessica advises English and German speaking clients on all aspects of gaming and betting regulation, licensing requirements and legal developments in the field. She plays a part in due diligence reviews and regularly contributes to gaming and betting law publications. Jessica further coauthored MELCHERS‘ contribution to the EGR Compliance Database, which provides an overview on the current gaming regulation in Germany and is updated quarterly.
