As we begin the second month of the year hopefully we are all on pace with our New Years resolutions. Your resolution may be getting rid of an old bad habit and starting the year with a new one. Whether yours is related to your business or a personal goal for 2012, keep working toward your goal. In our ever-changing industry this year will include some code changes in the near future. In the first quarter of 2012 Indiana plans to adopt a new energy code. This will vastly impact many facets of how we construct our

homes today. The new energy code will bring about change and added expense to our homes. However, this new code will elevate the energy efficiency in our homes and give us a competitive advantage over the existing residential home market. How can this be? A newly constructed home will be more energy efficient than many of the existing homes on the market. If you were not able to attend the local energy code seminars there is one scheduled for Monday February 27th, 2012 in Indianapolis. El Maggos Retires from Maggos Builders, Inc.

El Maggos, Maggos Builders, Inc. has been in business since 1975 and has been a member of the HBA Fort Wayne since 1987. He has actively participated in the Town & Country New Home Tour and Parade of Homes. He was the developer of the Parade Site in 2002 at Mallard’s Lake. His time will be spent golfing, fishing and relaxing in Florida. El Maggos will continue to operate as Millennium Development. Congratulations El!

A new, free BizTools builder business guide on how to survive the downturn and prepare for a resurgent home building industry is now available to members and can be downloaded from NAHB’s Builder Business Guides Web page. The guide, “A Business Vision for the Future” — produced by NAHB’s Business Management and Information Technology Committee to help members manage their businesses more effectively and increase their profits—is a compilation of articles written by industry experts that focuses on how to prepare for when the industry and housing market regain their health. The guide provides human resources tips on hiring and retaining employees, sharpening leadership skills and survival tactics to stabilize a business until the industry recovers. OSHA Names Top 10 Most Frequently Cited Standards

Each year, the Occupational Safety and Health Administration compiles an annual list of the top 10 most frequently cited standards across all industries. The majority of standards that OSHA has now identified as the most frequently cited are directly applicable to the construction and residential home building industries. Employers who were cited for violations in 2011 may have noticed that the penalties were higher than in the past. The average serious violation penalty for 2011 was $2,132 — more than double the average of $1,053 for 2010. OSHA last year also issued 215 citations totaling at least $100,000 — up from 164 citations issued in 2010. OSHA’s top 10 most frequently cited standards across all industries in FY 2011 were: 1. Scaffolding, general requirements (29 CFR 1926.451) 2. Fall protection (29 CFR 1926.501) 3. Hazard communication standard (29 CFR 1910.1200) 4. Respiratory protection (29 CFR 1910.134) 5. Control of hazardous energy (lockout/tagout) (29 CFR 1910.147) 6. Electrical, wiring methods, components and equipment (29 CFR 1910.305) 7. Powered industrial trucks (29 CFR 1910.178) 8. Ladders (29 CFR 1926.1053) 9. Electrical systems design, general requirements (29 CFR 1910.303) 10. Machines, general requirements (29 CFR 1910.212) In a September 16, 2010 webinar on preparing for OSHA inspections, Brad Hammock of Jackson Lewis, LLP reminded builders that there are a few things they can do to reduce or eliminate the chances of being cited by OSHA. January 10, 2012 HBA Office – 7:30am Attendees: Craig Yoder, Jamie Lancia, Charlie Giese, Tamra Stier, Maurine Holle, Chad Delagrange, Brad Cayot, Jim Bushey, Sam Schenkel, Mike Christoffersen, Gregory Gerbers, Justin Berger, Matt Momper and Barclay Allen Absent: Rodney Robrock, Jay Shipley and James Morlan Call to Order: The meeting was called to order @ 7:31 a.m. by Jamie Lancia, President.

Guest Speaker: The Guest Speakers, John Pierce board member and Mark GiaQuinta president of the Ft. Wayne Community Schools were introduced. They spoke about the vision and 2012 budget being proposed including much needed building maintenance and renovation programs. The question was asked if we as HBA members would be looked at for these projects and the answer from Mark was yes. Concurrence Items: • Treasurer’s Report was accepted as presented. • Secretaries Report was accepted as presented.

New Member Report: • A new member was accepted pending BBB review. • Board Members committed to contacting past members and future members.

Parade of Homes: • For the 2012 Parade of Homes the developer needs 6 homes with at least 3 different builders committed. • Maurine and Tamra met at Diamond Lake Estates to discuss parade options and parking. • Group discussion on parking, distance between lots and placement of tent, etc…. • Group discussion on Honeysuckle, the other possible parade location, and Maurine was asked to see if Duane Kees could get us a plot layout of proposed site.

Town & Country New Home & Specialty Retail Tour Maurine will research best options for the book and who will print and whether we will try to sell in house this year. Habitat Home Blitz Update • Justin Berger explained that there are approximately 5 builders so far showing interest in the Home Blitz in June 2012, building 5 to 8 homes in a week here in Allen County. There are 2 sites being considered. Leaning towards site off Sand Pointe Road. The homes are built with donated materials and fund raisers are held to make up the difference. • Could be ready by first of June, but may move back to July to give builders more time. • After the Home Blitz is completed, Habitat for Humanity would like to team up with the HBA and hold a Parade of Homes to build awareness to the communities and local builders. ONE IN THREE BUILDERS REPORT LOSING SALES DUE TO POOR APPRAISALS

Findings of a recent NAHB survey confirm the severe degree to which problematic new-home appraisals are killing sales and slowing a housing and economic recovery. One out of every three builders in the nationwide poll reported losing a signed sales contract over the previous six months due to an appraisal coming in below the contract sales price. Moreover, of the 60% of builders reporting that they have had an appraisal come in below their contract sales price, more than half (53%) said the appraisal amount in question was actually less than what it cost to build the home. Of course, a major factor behind these absurdly low appraisal values is the inappropriate use of distressed and foreclosed sales as comparables in determining new home values. NAHB is using these survey results to help draw attention to the problem as part of our overall efforts on the appraisal issue. In a press release, NAHB Chairman Bob Nielsen said that the practice of using distressed properties as comparables for assessing the value of new homes was "not only unfair and unreasonable, but it perpetuates the cycle of declining home values, drives more home owners underwater, harms local economic activity and acts as an obstacle to the recovery of the housing market." Beyond this, such appraisal problems are a major contributing factor to the ongoing credit crunch for acquisition, development and construction financing of residential projects, because falling appraised values for land and subdivisions under development have led some financial institutions to stop lending to developers and builders, demand additional equity, and even call performing loans. As part of NAHB's widespread efforts to reach out to all the stakeholder groups on this issue, NAHB has now held four "appraisal summits" in Washington involving representatives of federal banking regulators, the appraisal industry, the housing finance industry, the real estate and housing sectors and others. At the latest such event in mid-October, Chairman Nielsen made it clear that major reforms in appraisal practices and oversight are needed to ensure that appraisals accurately reflect true market values and don't contribute to price volatility or harm aspiring home owners and move-up buyers.
