Be It Enacted by the Legislature of the State of Idaho:10

SECTION 1. That Section 54-1704, Idaho Code, be, and the same is hereby11amended to read as follows:12

54-1704. PRACTICE OF PHARMACY. "Practice of pharmacy" means:13(1) The interpretation, evaluation and dispensing of prescription drug14

orders;15(2) Participation in drug and device selection, drug administration,16

prospective and retrospective drug reviews and drug or drug-related re-17search;18

(3) The provision of patient counseling and the provision of those acts19or services necessary to provide pharmaceutical care;20

(4) The responsibility for:21(a) Compounding and labeling of drugs and devices, except labeling by22a manufacturer, repackager or distributor of nonprescription drugs and23commercially packaged legend drugs and devices;24(b) Proper and safe storage of drugs and devices, and maintenance of25proper records for them; and26(c) The offering or performing of those acts, services, operations or27transactions necessary to the conduct, operation, management and con-28trol of pharmacy;29(5) The prescribing of:30(a) Agents for active immunization when prescribed for susceptible31persons six (6) years of age or older for the protection from communica-32ble disease; and33(b) Ddrugs, drug categories, or devices that are prescribed in accor-34

dance with the product's federal food and drug administration-approved la-35beling and that are limited to conditions that:36

(ia) Do not require a new diagnosis;37(iib) Are minor and generally self-limiting;38(iiic) Have a test that is used to guide diagnosis or clinical decision-39making and are waived under the federal clinical laboratory improvement40amendments of 1988; or41(ivd) In the professional judgment of the pharmacist, threaten the42health or safety of the patient should the prescription not be imme-43diately dispensed. In such cases, only sufficient quantity may be44provided until the patient is able to be seen by another provider.45

The board shall not adopt any rules authorizing a pharmacist to prescribe a46controlled drug, compounded drug or biological product.47

SECTION 2. That Section 54-1705, Idaho Code, be, and the same is hereby1amended to read as follows:2

54-1705. DEFINITIONS. In this chapter:3(1) "Board of pharmacy" or "board" means the Idaho state board of phar-4

macy.5(2) "Central drug outlet" means a resident or nonresident pharmacy,6

drug outlet or business entity employing or contracting pharmacists to per-7form off-site pharmacy services.8

(3) "Certificate" means a license or registration issued by the board9unless specifically stated.10

(4) "Chain pharmacy warehouse" means a physical location for prescrip-11tion drugs that acts as a central warehouse and performs intracompany sales12or transfers of such drugs to a group of chain pharmacies that have the same13common ownership and control.14

(5) "Colicensed partner or product" means an instance where two (2) or15more parties have the right to engage in the manufacturing or marketing of16a prescription drug, consistent with the federal food and drug administra-17tion's implementation of the prescription drug marketing act.18

(6) "Compounding" means the practice in which a pharmacist, a pre-19scriber, or, in the case of an outsourcing facility, a person under the20supervision of a pharmacist combines, mixes or alters ingredients of a drug21to create a medication tailored to the needs of an individual patient.22

(47) "Counseling" or "counsel" means the effective communication by23the pharmacist of information, as set out in this chapter, to the patient or24caregiver in order to improve therapeutic outcomes by maximizing proper use25of prescription drugs and devices.26

(58) "Deliver" or "delivery" means the actual, constructive or at-27tempted transfer of a drug or device from one person to another, whether or28not for a consideration.29

(69) "Device" means an instrument, apparatus, implement, machine, con-30trivance, implant, in vitro reagent or other similar related article, in-31cluding any component part or accessory which that is:32

(a) Recognized in the official United States Pharmacopoeia or official33National Formulary, other drug compendia or any supplement to them;34(b) Intended for use in the diagnosis of disease or other conditions, or35the cure, mitigation, treatment or prevention of disease in man or other36animal;37(c) Intended to affect the structure or any function of the body of man38or other animal, and which does not achieve any of its principal in-39tended purposes through chemical action within or on the body of man or40other animal, and which is not dependent upon being metabolized for the41achievement of any of its principal intended purposes.42(710) "Dispense" or "dispensing" means the preparation and delivery of43

a drug pursuant to a lawful prescription drug order of a practitioner in a44suitable container appropriately labeled for subsequent administration to45or use by a patient or other individual entitled to receive the prescription.46

(811) "Distribute" means the delivery of a drug other than by adminis-47tering or dispensing.48

(912) "Drug" means:49

(a) Articles recognized as drugs in the official United States Phar-1macopoeia, official National Formulary, official Homeopathic Pharma-2copoeia, other drug compendia or any supplement to any of them;3(b) Articles intended for use in the diagnosis, cure, mitigation,4treatment or prevention of disease in man or other animal;5(c) Articles, other than food, intended to affect the structure or any6function of the body of man or other animal; and7(d) Articles intended for use as a component of any articles specified8in paragraph (a), (b) or (c) of this subsection.9(103) "Drug outlet" means a resident or nonresident pharmacy, business10

entity or other facility where employees or personnel are engaged in the11practice of pharmacy, in the provision of pharmaceutical care, or in the12dispensing, delivering, distributing or manufacturing of drugs or devices13in or into Idaho.14

(114) "Institutional drug order" means a prescription drug order issued15in the unique form and manner permitted for a patient or resident of an in-16stitutional facility or as permitted for other purposes as defined in rule.17Unless specifically differentiated, state law applicable to a prescription18drug order is also applicable to an institutional drug order.19

(125) "Institutional facility" means a facility for which its primary20purpose is to provide a physical environment for patients to obtain health21care services and in which patients spend a majority of their time, as may be22further defined by board rule.23

(136) "Internship" means a practical experience program under the su-24pervision of a preceptor.25

(147) "Investigational or new drug" means any drug which is limited by26state or federal law to use under professional supervision of a practitioner27authorized by law to prescribe or administer such drug.28

(158) "Labeling" means the process of preparing and affixing of a la-29bel to any drug container, exclusive however of the labeling by a manufac-30turer, packer or distributor of a nonprescription drug or commercially pack-31aged legend drug or device. Any such label shall include all information re-32quired by federal and state law.33

(169) "Limited service outlet" means a resident or nonresident phar-34macy, facility or business entity that is subject to registration by the35board, pursuant to section 54-1729, Idaho Code, and has employees or person-36nel engaged in the practice of pharmacy, in the provision of pharmaceutical37care, or in the dispensing, delivering, distributing or manufacturing of38drugs or devices as may be further defined by board rule but is not a retail39community pharmacy, institutional facility, manufacturer, wholesaler,40nonresident central drug outlet or mail service pharmacy.41

(1720) "Mail service pharmacy" means a nonresident pharmacy that ships,42mails or delivers by any lawful means a dispensed legend drug to residents43in this state pursuant to a legally issued prescription drug order and en-44sures the provision of corresponding related pharmaceutical care services45required by law.46

(1821) "Manufacture" means the production, preparation, propagation,47compounding, conversion or processing of a device or a drug, either directly48or indirectly by extraction from substances of natural origin or indepen-49dently by means of chemical synthesis or by a combination of extraction and50

chemical synthesis, and includes any packaging or repackaging of the sub-1stance or labeling or relabeling of its container, except that this term does2not include the preparation or compounding of a drug by an individual for his3own use or the preparation, compounding, packaging or labeling of a drug:4

(a) By a pharmacist or practitioner as an incident to his administer-5ing, dispensing or, as authorized by board rule, distributing of a drug6in the course of his professional practice; or7(b) By a practitioner or by his authorization under his supervision for8the purpose of or as an incident to research, teaching or chemical anal-9ysis and not for sale.10(1922) "Manufacturer" means a person who by compounding, cultivating,11

harvesting, mixing or is licensed or approved by the federal food and drug12administration to engage in the manufacture of drugs, including a colicensed13partner or affiliate of that person, who compounds, cultivates, derives,14harvests, mixes, or by other process produces or prepares legend drugs,15and includes persons who prepare such drugs in dosage forms by mixing, com-16pounding, encapsulating, entableting, or other process, or who packages or17repackages such drugs, but does not include pharmacists or practitioners in18the practice of their profession.19

(203) "Nonprescription drugs" means medicines or drugs which that may20be sold without a prescription drug order and which that are prepackaged for21use by the consumer and labeled in accordance with state and federal law.22

(214) "Nonresident" means a person or business entity located in the23District of Columbia or a state or territory other than Idaho that practices24pharmacy including, but not limited to, pharmaceutical care services into25Idaho.26

(225) "Off-site pharmacy services" means services provided by a central27drug outlet or an off-site pharmacist or technician. Services may include,28but are not limited to: processing a request from another pharmacy to fill,29refill or dispense a prescription drug order; performance of processing30functions; or providing cognitive or pharmaceutical case care services.31Each function may be performed by the same or different persons and at the32same or different locations.33

(236) "Outsourcing facility" means a pharmacy or facility that is reg-34istered by the United States food and drug administration pursuant to 2135U.S.C. 353b and either registered or endorsed by the board.36

(247) "Person" means an individual, corporation, partnership, associa-37tion or any other legal entity.38

(258) "Person in charge" or "PIC" means a person whose qualifications,39responsibilities, and reporting requirements are defined in rule.40

(269) "Pharmaceutical care" means drug therapy and other pharmaceuti-41cal patient care services intended to achieve outcomes related to the cure or42prevention of a disease, elimination or reduction of a patient's symptoms,43or arresting or slowing of a disease process as defined in the rules of the44board.45

(2730) "Pharmacist" means an individual licensed by this state to en-46gage in the practice of pharmacy or a pharmacist registered by this state who47is located in another state, territory or the District of Columbia and is en-48gaged in the practice of pharmacy into Idaho, unless exempted.49

(2831) "Pharmacist intern" means a person who is enrolled in or who has1completed a course of study at an accredited school or college of pharmacy2and is registered with the board as a pharmacist intern prior to commencement3of an internship program.4

(2932) "Pharmacy" means any drug outlet, facility, department or other5place where prescription drug orders are filled or compounded and prescrip-6tions are sold, dispensed, offered or displayed for sale, which has, as its7principal purpose, the dispensing of drug and health supplies intended for8the general health, welfare and safety of the public.9

(303) "Practitioner" means a person licensed in this state and permit-10ted by such license to dispense, conduct research with respect to or adminis-11ter drugs in the course of professional practice or research in this state.12

(314) "Preceptor" means a pharmacist or other health professional li-13censed and in good standing who supervises the internship training of a reg-14istered pharmacist intern.15

(325) "Precursor" means a substance, other than a legend drug, which16that is an immediate chemical intermediate that can be processed or synthe-17sized into a legend drug, and is used or produced primarily for use in the18manufacture of a legend drug by persons other than persons licensed to manu-19facture such legend drugs by the Idaho board of pharmacy, registered by the20state board of health and welfare, or licensed to practice pharmacy by the21Idaho board of pharmacy.22

(336) "Prescriber" means an individual currently licensed, registered23or otherwise authorized to prescribe and administer drugs in the course of24professional practice.25

(347) "Prescriber drug outlet" means a drug outlet in which prescrip-26tion drugs or devices are dispensed directly to patients under the super-27vision of a prescriber, except where delivery is accomplished only through28on-site administration or the provision of drug samples, patient assistance29program drugs, or investigational drugs as permitted in chapter 94, title3039, Idaho Code.31

(358) "Prescription drug or legend drug" means a drug that under federal32law is required, prior to being dispensed or delivered, to be labeled with33one (1) of the following statements:34

(a) "Caution: Federal law prohibits dispensing without a prescrip-35tion"; or36(b) "Rx Only"; or37(c) "Caution: Federal law restricts this drug to use by or on the order38of a licensed veterinarian";39

or a drug which that is required by any applicable federal or state law or40regulation rule to be dispensed on prescription drug order only or is re-41stricted to use by practitioners only.42

(369) "Prescription drug order" means a valid order of a prescriber for43a drug or device for an ultimate user of the drug or device.44

(3740) "Prospective drug review" includes, but is not limited to, the45following activities:46

(a) Evaluation of the prescription drug order for known allergies, ra-47tional therapy contraindications, reasonable dose and route of admin-48istration, and reasonable directions for use.;49

(b) Evaluation of the prescription drug order for duplication of ther-1apy.;2(c) Evaluation of the prescription drug order for drug, food, or dis-3ease interactions.; and4(d) Evaluation of the prescription drug order for proper utilization,5over- or under-utilization, and abuse/misuse.6(3841) "Record" means all papers, letters, memoranda, notes, prescrip-7

tions, drug orders, invoices, statements, patient medication charts or8files, computerized records or other written indicia, documents or objects9that are used in any way in connection with the purchase, sale or handling of10any drug or device.11

(42) "Repackage" means repackaging or otherwise changing the con-12tainer, wrapper, or labeling to further the distribution of a prescription13drug, excluding such actions when completed by the pharmacist responsible14for dispensing product to the patient.15

(43) "Reverse distributor" means a drug outlet that receives nonsalable16prescription drugs from persons or their agents, who may lawfully possess17prescription drugs without being issued a valid prescription drug order, and18that processes for credit or disposes of such prescription drugs.19

(3944) "Sale" means every sale and includes:20(a) Manufacturing, processing, transporting, handling, packaging or21any other production, preparation or repackaging;22(b) Exposure, offer, or any other proffer;23(c) Holding, storing or any other possession;24(d) Dispensing, giving, delivering or any other supplying; and25(e) Applying, administering or any other usage.26(405) "Ultimate user" means a person who lawfully possesses a drug for27

his own use or for the use of a member of his household or for administering to28an animal owned by him or by a member of his household.29

(416) "Veterinary drug outlet" means a prescriber drug outlet that dis-30penses drugs or devices intended for animal patients.31

(47) "Wholesale distribution" means distribution of prescription drugs32to persons other than a consumer or patient, but does not include:33

(a) Drug returns, when conducted by a hospital, health care entity, or34charitable institution in accordance with 21 CFR 203.23;35(b) The sale, purchase, or trade of a drug, an offer to sell, purchase,36or trade a drug, or the dispensing of a drug pursuant to a prescription;37(c) The delivery of, or offer to deliver, a prescription drug by a38common carrier solely in the common carrier's usual course of business39of transporting prescription drugs when such common carrier does not40store, warehouse, or take legal ownership of the prescription drug; or41(d) The sale or transfer from a community pharmacy or chain pharmacy42warehouse of expired, damaged, mispicked, returned, or recalled pre-43scription drugs to the original manufacturer, original wholesaler, or44third-party returns processor, including a reverse distributor.45(428) "Wholesaler" means a person, who in the usual course of business,46

lawfully distributes drugs or devices in or into Idaho to persons other than47the ultimate user.48

SECTION 3. That Section 54-1707, Idaho Code, be, and the same is hereby49amended to read as follows:50

54-1707. MEMBERSHIP. The board of pharmacy shall consist of five (5)1members. One (1) member shall be a representative of the public, and four (4)2members shall be licensed pharmacists who possess the qualifications spec-3ified in section 54-1708, Idaho Code. The board of pharmacy shall have di-4verse pharmacy practice experience, with at least one (1) member having sub-5stantial experience in retail community pharmacy and at least one (1) member6having substantial experience in hospital pharmacy.7

SECTION 4. That Section 54-1710, Idaho Code, be, and the same is hereby8amended to read as follows:9

54-1710. TERMS OF OFFICE. (1) Except as provided in subsection (2) of10this section, members of the board of pharmacy shall be appointed for a term11of five (5) years, except that members of the board who are appointed to fill12vacancies which that occur prior to the expiration of a former member's full13term shall serve the unexpired portion of such term.14

(2) The terms of the members of the board shall be staggered, so that the15terms of no more than one (1) member shall expire in any year.16

(3) No member of the board shall serve more than two (2) consecutive17full terms. The completion of the unexpired portion of a full term shall not18constitute a full term for purposes of this section.19

(4) An appointee to a full term on the board shall be appointed by the20governor as provided in section 54-1709, Idaho Code, and be effective on July211 of the year of appointment. Appointees to unexpired portions of full terms22shall become members of the board upon appointment.23

SECTION 5. That Section 54-1715, Idaho Code, be, and the same is hereby24amended to read as follows:25

54-1715. MEETINGS OF THE BOARD. (1) The board of pharmacy shall meet at26least once every six (6) months to transact its business. One (1) such meet-27ing held during each fiscal year of the state shall be designated as the an-28nual meeting and shall be for the purpose of electing officers and for the re-29organization of the board. The board shall meet at such additional times as30it may determine. Such additional meetings may be called by the chairman of31the board or by three (3) of the members of the board.32

(2) The board shall meet at such place as it may from time to time deter-33mine. The place for each meeting shall be determined prior to giving notice34of such meeting and shall not be changed after such notice is given without35adequate subsequent notice.36

(3) Notice of all meetings of the board shall be given in the manner and37pursuant to requirements prescribed by the state's applicable statutes, and38rules and regulations.39

(4) A majority of the members of the board shall constitute a quorum for40the conduct of a board meeting and, except where a greater number is required41by the act, or by any rule or regulation of the board, all actions of the board42shall be by a majority of a quorum.43

(5) All meetings and hearings of the board shall be conducted in compli-44ance with the provisions of chapter 2, title 74, Idaho Code.45

SECTION 6. That Section 54-1718, Idaho Code, be, and the same is hereby1amended to read as follows:2

54-1718. LICENSURE AND DISCIPLINE. (1) The board of pharmacy shall be3responsible for the control and regulation of the practice of pharmacy in4this state including, but not limited to, the following:5

(a) The licensing by examination or by reciprocity of applicants who6are qualified to engage in the practice of pharmacy under the provisions7of this chapter;8(b) The renewal of licenses to engage in the practice of pharmacy;9(c) The determination and issuance of standards for recognition and ap-10proval of schools and colleges of pharmacy whose graduates shall be el-11igible for licensure in this state, and the specification and enforce-12ment of requirements for practical training, including internship;13(d) The enforcement of the provisions of this chapter relating to the14conduct or competence of pharmacists practicing in this state, and the15suspension, revocation or restriction of licenses to practice phar-16macy;17(e) The regulation of the training, qualifications and employment of18pharmacist interns.19(2) The board of pharmacy shall require the following applicants to20

submit to a fingerprint-based criminal history check of the Idaho central21criminal history database and the federal bureau of investigation criminal22history database:23

(a) Original applicants for licensure or registration a certificate,24unless exempted by board rule; and25(b) Applicants for reinstatement of a license or registration26certificate.27

Each applicant shall submit a completed ten (10) finger fingerprint card or28scan to the board of pharmacy at the time of application and shall pay the29cost of the criminal history check.30

SECTION 7. That Section 54-1719, Idaho Code, be, and the same is hereby31amended to read as follows:32

54-1719. MEDICATIONS -- DRUGS -- DEVICES -- OTHER MATERIALS. The board33of pharmacy shall also have the following responsibilities in regard to med-34ications, drugs, devices and other materials used in this state in the di-35agnosis, mitigation and treatment or prevention of injury, illness and dis-36ease:37

(1) The regulation of the sale at retail and the dispensing of med-38ications, drugs, devices and other materials, including the method of39dispensing in institutional facilities, and including the right to seize40such drugs, devices and other materials found to be detrimental to the public41health and welfare by the board after appropriate hearing as required under42the administrative procedure act;43

(2) The specifications of minimum professional and technical equip-44ment, environment, supplies and procedures for the compounding, dispensing45and distribution of such medications, drugs, devices and other materials46within the practice of pharmacy;47

(3) The control of the purity and quality of such medications, drugs,1devices and other materials within the practice of pharmacy; and2

(4) The issuance and renewal of certificates of registration of drug3outlets for purposes of ascertaining those persons engaged in the manufac-4ture and distribution of drugs.5

SECTION 8. That Section 54-1720, Idaho Code, be, and the same is hereby6amended to read as follows:7

54-1720. OTHER DUTIES -- POWERS -- AUTHORITY. The board of pharmacy8shall have such other duties, powers, and authority as may be necessary to9the enforcement of this chapter and to the enforcement of board rules made10pursuant thereto, which shall include, but are not limited to, the follow-11ing:12

(1) The board may join such professional organizations and associa-13tions organized exclusively to promote the improvement of the standards of14the practice of pharmacy for the protection of the health and welfare of the15public and whose activities assist and facilitate the work of the board.16

(2) In addition to any statutory requirements, the board may require17such surety bonds as it deems necessary to guarantee the performance and18discharge of the duties of any officer or employee receiving and disbursing19funds.20

(3) The executive director of the board shall keep the seal of the board21and shall affix it only in such manner as may be prescribed by the board.22

(4) (a) The board shall determine by rule the fees to be collected for23the issuance and renewal of licenses and registrations certificates.24(b) All fees or fines that shall be paid under the provisions of this25chapter shall be paid over by the board to the treasurer of the state of26Idaho and shall be held by the state treasurer in the pharmacy account,27which shall be paid out by the state treasurer upon warrant drawn by the28state controller against said account. The state controller is hereby29authorized, upon presentation of the proper vouchers of claims against30the state, approved by the said board and the state board of examiners,31as provided by law, to draw his warrant upon said account.32(5) In addition to its annual appropriations, the board may solicit and33

receive, from parties other than the state, grants, moneys, donations and34gifts of tangible and intangible property for any purpose consistent with35this act, which may be specified as a condition of any grants, donations or36gifts. Such moneys may be solicited or received provided:37

(a) Such moneys are awarded for the pursuit of a specific objective38which the board is authorized to accomplish by this chapter, or which39the board is qualified to accomplish by reason of its jurisdiction or40professional expertise;41(b) Such moneys are expended for the pursuit of the objective for which42they are awarded;43(c) Activities connected with or occasioned by the expenditures of such44moneys do not interfere with or impair the performance of the board's45duties and responsibilities and do not conflict with the exercise of the46board's powers as specified by this chapter;47(d) Such moneys are kept in a separate, special state account; and48

(e) Periodic reports are made to the administrator, division of finan-1cial management, concerning the board's receipt and expenditure of such2moneys.3(6) The board shall assign to each drug outlet under its jurisdiction a4

uniform state number.5(7) The board or its authorized representatives shall also have power6

to investigate and gather evidence concerning alleged violations of the pro-7visions of this chapter or of the rules of the board.8

(8) Except as otherwise provided to the contrary, the board shall exer-9cise all of its duties, powers and authority in accordance with the adminis-10trative procedure act.11

(9) (a) For the purpose of any proceedings held before the board as12authorized by law, including the refusal, nonrenewal, revocation or13suspension of licenses, registrations or certifications a certificate14authorized by this chapter, or the imposition of fines or reprimands15on persons holding such licenses, certifications or registrations16certificates, the board may subpoena witnesses and compel their at-17tendance, and may also at such time require the production of books,18papers, documents or other memoranda. In any such proceeding before the19board, any member of the board, or its designee, may administer oaths or20affirmations to witnesses so appearing.21(b) If any person shall refuse to obey a subpoena so issued, or refuse22to testify or produce any books, papers or documents called for by23said subpoena, the board may make application to the district court24of the county in which the proceeding is held for an order of the court25requiring the person to appear before the court and to show cause why26the person should not be compelled to testify, to produce such books,27papers, memoranda or other documents required by the subpoena, or28otherwise comply with its terms. The application shall set forth the29action theretofore taken by the board to compel the attendance of the30witness, and the circumstances surrounding the failure of the witness31to attend or otherwise comply with the subpoena, together with a brief32statement of the reasons why compliance with the subpoena is necessary33to the proceeding before the board.34(c) Upon the failure of a person to appear before the court at the time35and place designated by it, the court may enter an order without further36proceedings requiring the person to comply with the subpoena. Any per-37son failing or refusing to obey such order of the court shall be punished38for contempt of court as in other cases provided.39(10) The board may sponsor, participate in or conduct education, re-40

search or public service programs or initiatives to carry out the purposes41of this chapter.42

SECTION 9. That Section 54-1721, Idaho Code, be, and the same is hereby43amended to read as follows:44

54-1721. UNLAWFUL PRACTICE. (1) It shall be unlawful for any person or45business entity to engage in the practice of pharmacy including, but not lim-46ited to, pharmaceutical care services in or into Idaho unless licensed or47registered to so practice under the provisions of this chapter, except as48provided in this subsection:49

(a) Practitioners who are licensed under the laws of this state and1their agents or employees may deliver and administer prescription drugs2to their patients in the practice of their respective professions where3specifically authorized to do so by statute of this state;4(b) Nonresident pharmacists who are actively licensed in their state5of residence may practice pharmacy into Idaho if employed by or affili-6ated with and practicing for an Idaho-registered nonresident drug out-7let. Only the PIC of a registered nonresident facility must be regis-8tered to practice into Idaho;9(c) Multistate licensees permitted to engage in the multistate prac-10tice of pharmacy in or into Idaho pursuant to section 54-1723B, Idaho11Code;12(d) A veterinary drug outlet, as defined in section 54-1705, Idaho13Code, does not need to register with the board if the outlet does not14dispense for outpatient use any controlled substances listed in chapter1527, title 37, Idaho Code, euthanasia drugs, tranquilizer drugs, neuro-16muscular paralyzing drugs or general anesthesia drugs;17(e) Employees of the public health districts established under section1839-408, Idaho Code, shall be permitted to engage in the labeling and de-19livery of prepackaged items pursuant to a valid prescription drug order20and in accordance with a formulary established by the district health21director; and22(f) Researchers may possess legend drugs for use in their usual and law-23ful research projects.24(2) It shall be unlawful for any person, not legally licensed or regis-25

tered as a pharmacist, to take, use or exhibit the title of pharmacist or any26other title or description of like import.27

(3) Any person who shall be found to have unlawfully engaged in the28practice of pharmacy shall be subject to a fine not to exceed three thousand29dollars ($3,000) for each offense. Each such violation of this chapter or30the rules promulgated hereunder pertaining to unlawfully engaging in the31practice of pharmacy shall also constitute a misdemeanor punishable upon32conviction as provided in the criminal code of this state.33

SECTION 10. That Section 54-1722, Idaho Code, be, and the same is hereby34amended to read as follows:35

54-1722. QUALIFICATIONS FOR LICENSURE BY EXAMINATION. (1) To obtain a36license to engage in the practice of pharmacy, an applicant for licensure by37examination shall:38

(a) Have submitted a written application in the form prescribed by the39board of pharmacy;40(b) Have attained the age of majority;41(c) Have graduated and received the first professional undergraduate42degree from a school or college of pharmacy approved by the board of43pharmacy;44(d) Have completed an internship or other program approved by the board45of pharmacy, or demonstrated to the board's satisfaction experience in46the practice of pharmacy that meets or exceeds the minimum internship47requirements of the board;48

(e) Have successfully passed an examination given by the board of phar-1macy; and2(f) Paid the fees specified by the board of pharmacy for examination and3issuance of license.4(2) Examinations. The examination shall be prepared to measure the5

competence of the applicant to engage in the practice of pharmacy. The board6may employ and cooperate with any organization or consultant in the prepa-7ration and grading of an appropriate examination, but shall retain the sole8discretion and responsibility of determining which applicants have success-9fully passed such an examination.10

(3) Internship and other training programs. All applicants for licen-11sure by examination shall obtain practical experience in the practice of12pharmacy concurrent with or after college attendance, or both, under such13terms and conditions as the board shall determine.14

(4) Any applicant who is a graduate of a school or college of pharmacy15located outside the United States, the degree program of which has not been16approved by the board, but who is otherwise qualified to apply for a license17to practice pharmacy in this state, may be considered to have satisfied the18degree requirements of subsection (1)(d) of this section by verification to19the board of his academic record and his graduation and by meeting any other20requirements as the board may establish from time to time. The board may re-21quire that the applicant successfully pass an examination given or approved22by the board to establish proficiency in English and an equivalency of edu-23cation with qualified graduates of a degree program specified in subsection24(1)(d) of this section as a prerequisite of taking the licensure examination25as provided in subsection (1)(f) of this section.26

SECTION 11. That Section 54-1723, Idaho Code, be, and the same is hereby27amended to read as follows:28

54-1723. QUALIFICATIONS FOR LICENSURE BY RECIPROCITY. (1) To obtain a29license as a pharmacist by reciprocity, an applicant for licensure shall:30

(a) Have submitted a written application in the form prescribed by the31board of pharmacy;32(b) Have attained the age of majority;33(c) Have good moral character and temperate habits;34(d) Have possessed at the time of initial licensure as a pharmacist such35other qualifications necessary to have been eligible for licensure at36that time in this state;37(ed) Have presented to the board proof of initial licensure by exam-38ination and proof that such license and any other license or licenses39certificate granted to the applicant by any other state or states is not40at the time of application suspended, revoked, canceled or otherwise41restricted in a manner preventing the applicant from practicing as a42pharmacist for any reason except nonrenewal or the failure to obtain43required continuing education credits in any state where the applicant44is licensed but not engaged in the practice of pharmacy; and45(fe) Have paid the fees specified by the board of pharmacy for issuance46of a license.47(2) Eligibility. No applicant shall be eligible for licensure by reci-48

procity unless the state in which the applicant was initially licensed as a49

pharmacist also grants reciprocal licensure to pharmacists duly licensed by1examination in this state, under like circumstances and conditions.2

SECTION 12. That Section 54-1723A, Idaho Code, be, and the same is3hereby amended to read as follows:4

54-1723A. REGISTRATION CERTIFICATE TO ENGAGE IN THE PRACTICE OF PHAR-5MACY INTO IDAHO. (1) To obtain a registration certificate to practice as a6pharmacist into the state of Idaho, the applicant shall:7

(a) Be licensed and in good standing in the state from which the appli-8cant practices pharmacy;9(b) Submit a written application in the form prescribed by the board;10(c) Pay the fee(s) specified by the board for the issuance of the11registration certificate; and12(d) Comply with all other requirements of the board.13(2) A successful applicant for registration a certificate under this14

section shall be subject to the disciplinary provisions of section 54-1726,15Idaho Code, the penalty provisions of section 54-1728, Idaho Code, and the16rules of the board.17

(3) A successful applicant for registration a certificate under this18section shall comply with the board's laws and rules of this state un-19less compliance would violate the laws or rules in the state in which the20registrant applicant is located.21

(4) Renewal shall be required annually and submitted to the board no22later than the last day of the registrant's applicant's birth month. The23board shall specify by rule the procedures to be followed and the fees to be24paid for renewal of registration the certificate.25

SECTION 13. That Section 54-1723B, Idaho Code, be, and the same is26hereby amended to read as follows:27

54-1723B. MULTISTATE PRACTICE OF PHARMACY. Notwithstanding any pro-28vision of law to the contrary:29

(1) As used in this section:30(a) "License" means a license, registration, or other credential for31the practice of pharmacy issued by the pharmacy licensing agency of a32state.33(b) "Multistate licensee" means a multistate pharmacist, multistate34pharmacist intern, or multistate technician.35(c) "Multistate pharmacist" means a nonresident pharmacist, licensed36by a party state, who is not otherwise licensed by the board.37(d) "Multistate pharmacist intern" means a nonresident pharmacist38intern, registered by a party state, who is not otherwise registered39licensed by the board.40(e) "Multistate practice of pharmacy" means the practice of pharmacy in41or into Idaho, for a patient located in Idaho, by a multistate licensee,42pursuant to the requirements of this section and the terms of a mutual43recognition agreement.44(f) "Multistate technician" means a nonresident certified technician,45licensed by a party state, who is not otherwise registered by the board.46

(g) "Mutual recognition agreement" means a written agreement entered1into between the board and a party state allowing for the multistate2practice of pharmacy, subject to the requirements of this section and3any other reasonable and supplemental contract terms negotiated by the4board and the party state.5(h) "Party state" means any pharmacy licensing agency of a state that6has entered a mutual recognition agreement with the board.7(i) "Primary state of residence" means the multistate licensee's de-8clared primary state of residence, as evidenced by a valid state or fed-9eral identification card with a home address or another form of identi-10fication as accepted by the board.11(j) "State" means a state, a territory or possession of the United12States, or the District of Columbia.13(2) The board may enter into mutual recognition agreements with one (1)14

or more party states provided that each party state:15(a) Has substantially similar requirements for pharmacist licensure,16as required in section 54-1722, Idaho Code, or pharmacist intern and17certified technician registration, as required by board rule, or both;18(b) Requires a fingerprint-based criminal history check prior to li-19censure that is substantially similar to the requirement in section2054-1718, Idaho Code; and21(c) Grants the same multistate practice privileges to Idaho phar-22macists, registered pharmacist interns, or certified technicians as23Idaho grants to the party state's pharmacists, registered pharmacist24interns, or certified technicians under like circumstances and condi-25tions.26(3) A pharmacist license, pharmacist intern registration, or certified27

technician license issued by a party state will be recognized by the board as28permitting the multistate practice of pharmacy in or into Idaho without a li-29cense or registration issued by the board provided the following conditions30are met:31

(a) The party state is the primary state of residence for the multistate32licensee;33(b) The multistate licensee holds an active license issued by a party34state that is not currently suspended, revoked, canceled, or otherwise35restricted or conditioned in any manner; and36(c) The requirements specified in paragraph (a) or (b) of this subsec-37tion must be met at all times by any multistate licensee engaged in the38multistate practice of pharmacy in or into Idaho.39

(i) If such a multistate licensee no longer meets the require-40ments in paragraph (a) of this subsection, the multistate licensee41must apply for licensure in the new primary state of residence42prior to relocating to the new primary state of residence. If the43pharmacist, pharmacist intern, or technician's new primary state44of residence is either Idaho or another party state, the pharma-45cist, pharmacist intern, or technician may continue to practice46until a new license is issued in the new primary state of resi-47dence.48(ii) If a multistate licensee no longer meets the requirements in49paragraph (b) of this subsection, the multistate licensee must im-50

mediately cease engaging in the multistate practice of pharmacy in1or into Idaho, unless the multistate licensee obtains a license or2registration issued by the board.3

(4) A multistate licensee engaged in the multistate practice of phar-4macy in or into Idaho must comply with all laws governing the practice of5pharmacy in the state of Idaho.6

(5) If the board finds grounds for discipline exist, as set forth in7section 54-1726 or 37-2718, Idaho Code, the board may impose upon the mul-8tistate practice privileges of a multistate licensee any of the penalties9set forth in section 54-1728 or 37-2718, Idaho Code. The board's imposition10of any penalties shall be limited to the multistate practice privileges of11a multistate licensee. Only the party state shall have the power to revoke,12suspend, or otherwise discipline a license issued by the party state.13

(6) The board shall promptly notify a party state of any board action14taken against the multistate practice privileges of a multistate licensee15licensed by the party state. The party state shall give the same priority and16effect to reported conduct received from the board as it would if such con-17duct had occurred within the party state.18

SECTION 14. That Section 54-1724, Idaho Code, be, and the same is hereby19repealed.20

SECTION 15. That Section 54-1726, Idaho Code, be, and the same is hereby21amended to read as follows:22

54-1726. GROUNDS FOR DISCIPLINE. (1) The board of pharmacy may refuse23to issue or renew, or may suspend, revoke or restrict the license or regis-24tration penalize as set forth in section 54-1728, Idaho Code, a certificate25of any person, pursuant to the procedures set forth in chapter 52, title 67,26Idaho Code, upon one (1) or more of the following grounds:27

(a) Unprofessional conduct as that term is defined by the rules of the28board;29(b) Incapacity of a nature that prevents a pharmacist person from en-30gaging in the practice of pharmacy with reasonable skill, competence31and safety to the public;32(c) Being found guilty, convicted or having received a withheld judg-33ment or suspended sentence by a court of competent jurisdiction in this34state or any other state of one (1) or more of the following:35

(i) Any crime that is deemed relevant in accordance with section3667-9411(1), Idaho Code;37(ii) Any act that is related to the qualifications, functions or38duties of a licensee or registrant; or39(iii) Violations of the pharmacy or drug laws of this state or40rules pertaining thereto, or of statutes, rules or regulations of41any other state, or of the federal government;42

(d) Fraud or intentional misrepresentation by a licensee or registrant43in securing the issuance or renewal of a license certificate;44(e) Engaging or aiding and abetting an individual to engage in the prac-45tice of pharmacy without a license, certificate or falsely using the ti-46tle of pharmacist; and47

(f) Being found by the board to be in violation of any of the provisions1of this chapter, chapter 27, title 37, Idaho Code, or rules adopted pur-2suant to either chapter.3(2) Nonresident licensees and registrants shall be held accountable to4

the board for violations by its agents and employees and subject to the same5grounds for discipline and penalties for their actions as set forth herein.6

SECTION 16. That Section 54-1727, Idaho Code, be, and the same is hereby7amended to read as follows:8

54-1727. CONFIDENTIALITY OF PRESCRIPTIONS AND PATIENT INFORMA-9TION. (1) In addition to the requirements of the health insurance porta-10bility and accountability act of 1996, aAll prescriptions, drug orders,11records or any other prescription information that specifically identifies12an individual patient shall be held in the strictest confidence. No person13in possession of such information shall release the information, unless re-14quested as follows:15

(a) By the board, or its representatives, acting in their official ca-16pacity;17(b) By the patient, or the patient's designee, regarding the patient's18own records;19(c) By the practitioner, or the practitioner's designee, who issued the20prescription;21(d) By other licensed health care professionals who are responsible for22the direct and acute care of the patient;23(e) By agents of the department of health and welfare when acting in24their official capacity with reference to issues related to the prac-25tice of pharmacy (written requests by authorized agents of the depart-26ment requesting such information are required);27(fd) By agents of any board whose practitioners have prescriptive au-28thority, when the board is enforcing laws governing that practitioner;29(ge) By an agency of government charged with the responsibility for30providing medical care for the patient (written requests by authorized31agents of the agency requesting such information are required);32(h) By the federal food and drug administration (FDA), for purposes re-33lating to monitoring of adverse drug events in compliance with the re-34quirements of federal law, rules or regulations adopted by the federal35food and drug administration;36(i) By the patient's authorized insurance benefit provider or health37plan providing health care coverage or pharmacy benefits to the pa-38tient.39(j) Nothing in this section shall be construed to prohibit consulta-40tions between health care professionals who are involved in the diagno-41sis, care and treatment of the patient.42(kf) Nothing in this section shall prohibit insurance companies and43health plans from sharing patient-specific information with law en-44forcement authorities or any of the entities identified in subsections45(1)(a) through (i) of this section, paragraphs (a) through (e) of this46subsection in cases of suspected fraud and substance abuse.; or47

(lg) Nothing in this section shall prohibit disclosure of patient-spe-1cific information to law enforcement authorities pursuant to a search2warrant, subpoena, or other court order.3(2) Nothing in this section shall prevent the pharmacist or others from4

providing aggregate or other data, which does not identify the patient to5qualified researchers, including pharmaceutical manufacturers, for pur-6poses of clinical, pharmacoepidemiological, or pharmacoeconomic research.7

(3) Any person who has knowledge by virtue of his office or occupation8of any prescription drug order, record, or pharmacy-related information9that specifically identifies an individual patient shall not divulge such10information except as authorized in subsections (1) and (2) of this section.11Any person or entity to whom information is divulged pursuant to subsection12(1) of this section shall not divulge such information except in compliance13with this section.14

(43) Nothing in this section shall limit the authority of the board15or its representatives from inspecting the records of pharmacies or phar-16macists licensees and registrants or the authority of any other board with17licensees or registrants who have prescriptive authority from performing18any other duty or authority of that board, nor shall this section limit a19court of competent jurisdiction from ordering the release or disclosure of20such records upon a showing of just cause after such review or hearing as the21court deems necessary and proper. This section shall not limit the author-22ity of any other board or agency to inspect records of persons it regulates,23notwithstanding that the records may contain information protected by the24provisions of this section.25

(54) In addition to all other penalties as provided by law, any person26or entity found by the board to be in violation of the provisions of this sec-27tion shall be subject to an administrative penalty not to exceed three thou-28sand dollars ($3,000) for each violation.29

(65) No person shall be liable, nor shall a cause of action exist, for30any loss or damage based upon on the proper good faith release of records pur-31suant to the provisions of subsection (1) or (2) of this section.32

SECTION 17. That Section 54-1728, Idaho Code, be, and the same is hereby33amended to read as follows:34

54-1728. PENALTIES AND REINSTATEMENT INTERVALS. (1) Upon the finding35of the existence of grounds for discipline of any person or business entity36holding a license or registration, seeking a license or registration, or a37renewal license or registration renewing a certificate under the provisions38of this chapter, the board of pharmacy may impose one (1) or more any of the39following penalties:40

(a) Suspension of the offender's license or registration certificate41for a term to be determined by the board;42(b) Revocation of the offender's license or registration certificate;43(c) Restriction of the offender's license or registration certificate44to prohibit the offender from performing certain acts or from engaging45in the practice of pharmacy in a particular manner for a term to be de-46termined by the board;47(d) Refusal to issue or renew the offender's license or registration48certificate;49

(e) Placement of the offender on probation and supervision by the board1for a period to be determined by the board;2(f) Imposition of an administrative fine not to exceed two thousand3dollars ($2,000) for each occurrence providing a basis for discipline.4(2) Whenever it appears that grounds for discipline exist under this5

chapter and the board finds that there is an immediate danger to the pub-6lic health, safety, or welfare, the board is authorized to commence emer-7gency proceedings to suspend, revoke, or restrict the license or registra-8tion certificate. Such proceedings shall be promptly instituted and pro-9cessed. Any person whose license or registration certificate has been dis-10ciplined pursuant to this subsection can contest the emergency proceedings11and appeal under the applicable provisions of chapter 52, title 67, Idaho12Code.13

(3) The board may take any action against a nonresident licensee or reg-14istrant that the board can take against a resident licensee or registrant for15violation of the laws of this state or the state in which it resides.16

(4) The board may report any violation by a nonresident licensee or reg-17istrant, or its agent or employee, of the laws and rules of this state, the18state in which it resides or the United States to any appropriate state or19federal regulatory or licensing agency including, but not limited to, the20regulatory agency of the state in which the nonresident licensee or regis-21trant is a resident.22

(5) The board may elect to not initiate an administrative action under23Idaho law against a nonresident licensee or registrant upon report of a vi-24olation of law or rule of this state if the licensee's or registrant's home25state commences an action for the violation complained of; provided however,26that the board may elect to initiate an administrative action if the home27state action is unreasonably delayed or the home state otherwise fails to28take appropriate action for the reported violation.29

(6) The suspension, revocation, restriction or other action taken30against a licensee or registrant by a state licensing board with authority31over a licensee's or registrant's professional license or registration32certificate or by the drug enforcement administration may result in the33board's issuance of an order likewise suspending, revoking, restricting or34otherwise affecting the license or registration certificate in this state,35without further proceeding, but subject to the effect of any modification or36reversal by the issuing state or the drug enforcement administration.37

(76) The assessment of costs and fees incurred in the investigation38and prosecution or defense of a person holding a license or registration,39seeking a license or registration, or renewing a license or registration40certificate under this chapter shall be governed by the provisions of sec-41tion 12-117(5), Idaho Code.42

(87) Any person or business entity whose license certificate to prac-43tice pharmacy in this state has been suspended, revoked, or restricted44pursuant to this chapter, or any drug outlet whose certificate of registra-45tion has been suspended, revoked or restricted pursuant to this chapter,46whether voluntarily or by action of the board, shall have the right, at rea-47sonable intervals, to petition the board for reinstatement of such license48certificate. Such petition shall be made in writing and in the form pre-49scribed by the board. Upon investigation and hearing, the board may in its50

discretion grant or deny such petition, or it may modify its original finding1to reflect any circumstances which have changed sufficiently to warrant such2modifications.3

(98) Nothing herein shall be construed as barring criminal prosecu-4tions for violations of the act where such violations are deemed as criminal5offenses in other statutes of this state or of the United States.6

(109) All final decisions by the board shall be subject to judicial re-7view pursuant to the procedures of the administrative procedure act.8

SECTION 18. That Section 54-1729, Idaho Code, be, and the same is hereby9amended to read as follows:10

54-1729. REGISTRATION AND LICENSURE OF FACILITIES. (1) All drug or de-11vice outlets doing business in or into Idaho shall:12

(a) If a nonresident, be licensed or registered and in good standing in13the applicant's state of residence and, if a pharmacy, have a PIC who is14registered by the board;15(b) Submit a written application in the form prescribed by the board;16and17(c) Pay the fee or fees specified by the board for the issuance of the18registration or license certificate.19(2) Each drug or device outlet shall apply for a certificate of regis-20

tration or a license in one (1) of the following classifications:21(a) Retail Community pharmacy;22(b) Institutional facility;23(c) Manufacturer;24(d) Wholesaler;25(e) Prescriber drug outlet;26(f) Central drug outlet;27(g) Mail service pharmacy;28(h) Limited service outlet.29(3) The board shall establish by rule under the powers granted to it un-30

der sections 54-1718 and 54-1719, Idaho Code, the criteria that each outlet31with employees or personnel engaged in the practice of pharmacy must meet to32qualify for registration or licensure in each classification designated in33subsection (2) of this section. The board may issue various types of cer-34tificates with varying restrictions to such outlets designated in subsec-35tion (2) of this section where the board deems it necessary by reason of the36type of outlet requesting a certificate.37

(4) It shall be lawful for any outlet or facility to sell and distrib-38ute nonprescription drugs. Outlets engaging in the sale and distribution of39such items shall not be deemed to be improperly engaged in the practice of40pharmacy. No rule will be adopted by the board under this chapter that re-41quires the sale of nonprescription drugs by a pharmacist or under the super-42vision of a pharmacist or otherwise applies to or interferes with the sale43and distribution of such medicines.44

(5) If the regulatory board or licensing authority of the state in which45a nonresident outlet is located fails or refuses to conduct an inspection or46fails to obtain records or reports required by the board, upon reasonable no-47tice to the nonresident outlet, the board may conduct an inspection. Nonres-48ident outlets shall also pay the actual costs of the out-of-state inspection49

of the outlet, including the transportation, lodging and related expenses of1the board's inspector.2

(6) A successful applicant for registration a certificate under the3provisions of this section shall be subject to the disciplinary provisions4of section 54-1726, Idaho Code, the penalty provisions of section 54-1728,5Idaho Code, and the rules of the board.6

(7) A successful applicant for registration a certificate under the7provisions of this section shall comply with the board's laws and rules of8this state unless compliance would violate the laws, regulations, or rules9in the state in which the licensee or registrant is located.10

(8) Renewal shall be required annually and submitted to the board no11later than December 31. The board shall specify by rule the procedures to be12followed and the fees to be paid for renewal of registration or licensure a13certificate.14

SECTION 19. That Chapter 17, Title 54, Idaho Code, be, and the same is15hereby amended by the addition thereto of a NEW SECTION, to be known and des-16ignated as Section 54-1729A, Idaho Code, and to read as follows:17

54-1729A. WHOLESALE DRUG DISTRIBUTOR -- LICENSURE. (1) In addition18to meeting federal requirements, every business entity that engages in the19wholesale distribution of prescription drugs in or into Idaho must be li-20censed by the board as a wholesale distributor except:21

(a) Manufacturers distributing their own federal food and drug admin-22istration-approved drugs and devices, including distribution of pre-23scription drug samples by manufacturers' representatives and intracom-24pany sales, meaning any transaction or transfer between any division,25subsidiary, parent, or affiliated or related company under common own-26ership and control of a corporate entity or any transfer between col-27icensees of a colicensed product, unless particular requirements are28deemed necessary and appropriate following rulemaking;29(b) An entity that donates prescription drugs, when conducted in accor-30dance with sections 54-1760 through 54-1765, Idaho Code;31(c) A pharmacy distributing in accordance with section 54-1732, Idaho32Code; and33(d) Persons selling, purchasing, distributing, trading, or transfer-34ring a prescription drug for emergency medical reasons.35(2) The board shall not issue a wholesale distributor license to an36

applicant unless the board determines that the designated representative37meets the following qualifications:38

(a) Is actively involved in and aware of the actual daily operation of39the wholesale distributor; and40(b) Is physically present at the facility of the applicant during regu-41lar business hours, except when the absence of the designated represen-42tative is authorized, including but not limited to sick leave and vaca-43tion leave.44(3) All applicant-designated representatives shall submit to a fin-45

gerprint-based criminal history check of the Idaho central criminal history46database and the federal bureau of investigation criminal history database.47Each applicant shall submit a completed ten (10) finger fingerprint card or48

scan to the board of pharmacy at the time of application and shall pay the1cost of the criminal history check.2

(4) A wholesale distributor shall have adequate processes in place for3monitoring purchase activity of customers and identifying suspicious order-4ing patterns that indicate potential diversion or criminal activity related5to controlled substances such as orders of unusual size, orders deviating6substantially from a normal pattern, orders for drugs that are outside of the7prescriber's scope of practice, or orders of unusual frequency.8

(5) The board may adopt rules to approve an accreditation body to eval-9uate a wholesaler's operations to determine compliance with professional10standards and any other applicable laws and to perform inspections of each11facility and location where wholesale distribution operations are conducted12by the wholesaler.13

SECTION 20. That Section 54-1730, Idaho Code, be, and the same is hereby14amended to read as follows:15

54-1730. DRUG OUTLET APPLICATION PROCEDURES. (1) The board shall16specify by rule the registration procedures to be followed, including,17but not limited to, specification of forms for use in applying for such18certificates of registration and times, places and fees for filing such ap-19plication.20

(2) Applications for certificates of registration shall include the21following information about the proposed outlet:22

(a) Ownership; and23(b) Location.24(3) Certificates of registration issued by the board pursuant to this25

chapter shall not be are not transferable or assignable.26(4) The board shall specify by rule minimum standards for the profes-27

sional responsibility in the conduct of any outlet that has employees or per-28sonnel engaged in the practice of pharmacy. The board is specifically au-29thorized to require that the portion of the facility pharmacy to which such30certificate of registration applies be operated only under the direct super-31vision of no less than one (1) pharmacist licensed to practice in this state,32and not otherwise, and to provide such other special requirements as deemed33necessary.34

SECTION 21. That Section 54-1731, Idaho Code, be, and the same is hereby35amended to read as follows:36

54-1731. NOTIFICATIONS. All registered drug outlets shall report to37the board of pharmacy the occurrence of any of the following changes:38

(1) Permanent closing;39(2) Change of ownership, management, or location;40(3) Disasters, accidents, and emergencies that affect the safe and con-41

tinued operation of a drug outlet; and42(4) Any and all other matters and occurrences as the board may require43

by rules.44

SECTION 22. That Section 54-1732, Idaho Code, be, and the same is hereby45amended to read as follows:46

54-1732. VIOLATIONS AND PENALTIES. (1) No drug outlet designated in1section 54-1729, Idaho Code, shall be operated until a certificate of reg-2istration has been issued to said facility by the board. Upon the finding of3a violation of this subsection, the board may impose one (1) or more of the4penalties enumerated in section 54-1728, Idaho Code.5

(2) Reinstatement of a certificate that has been suspended, revoked6or restricted by the board may be granted in accordance with the procedures7specified in section 54-1728(87), Idaho Code.8

(3) The following acts, or the failure to act, and the causing of any9such act or failure are unlawful:10

(a) The sale, delivery or administration of any prescription drug or11legend drug, except an opioid antagonist pursuant to section 54-1733B,12Idaho Code, or an epinephrine auto-injector pursuant to section1354-1733D, Idaho Code, unless:14

(i) Such legend drug is dispensed or delivered by a pharmacist or15prescriber upon an original prescription, drug order or prescrip-16tion drug order by a practitioner in good faith in the course of his17practice. Any person violating the provisions of this subpara-18graph shall be guilty of a felony and on conviction thereof shall19be imprisoned in the state penitentiary for a term not to exceed20three (3) years, or punished by a fine of not more than five thou-21sand dollars ($5,000), or by both such fine and imprisonment.; or22(ii) In the case of a legend drug dispensed to a person, there is23a label affixed to the immediate container in which such drug is24dispensed. Any person violating this subparagraph shall be guilty25of a misdemeanor and upon conviction thereof shall be fined not26more than five hundred dollars ($500). Nothing in this subpara-27graph prohibits a practitioner from delivering professional sam-28ples of legend drugs in their original containers in the course of29his practice when oral directions for use are given at the time of30such delivery.31

(b) The refilling of any prescription or drug order for a legend drug,32except as designated on the prescription or drug order or by the autho-33rization of the practitioner, or in accordance with board rule. Any34person guilty of violating the provisions of this paragraph shall be35guilty of a misdemeanor and upon conviction thereof shall be incarcer-36ated in the county jail for a term not to exceed one (1) year or punished37by a fine of not more than one thousand dollars ($1,000), or by both such38fine and incarceration.39(c) The possession or use of a legend drug or a precursor, except an40opioid antagonist pursuant to section 54-1733B, Idaho Code, or an epi-41nephrine auto-injector pursuant to section 54-1733D, Idaho Code, by any42person unless such person obtains such drug on the prescription or drug43order of a practitioner. Any person guilty of violating the provisions44of this paragraph shall be guilty of a misdemeanor and upon conviction45thereof shall be incarcerated in the county jail for a term not to exceed46one (1) year or punished by a fine of not more than one thousand dollars47($1,000), or by both such fine and incarceration.48(d) The wholesale distribution of drugs or devices by a pharmacy except49for:50

(i) The sale, transfer, merger or consolidation of all or part of1the business of a pharmacy or pharmacies from or with another phar-2macy or pharmacies, whether accomplished as a purchase and sale of3stock or business assets;4(ii) The sale of minimal quantities of prescription drugs to prac-5titioners for office use or to dispensing drug outlets for a spe-6cific patient need;7(iii) The sale of a prescription drug for emergency medical rea-8sons, but never to a wholesale distributor;9(iv) Intracompany sales of prescription drugs, meaning any trans-10action or transfer between any division, subsidiary, parent or af-11filiated or related company under common ownership and control of12a corporate entity, or any transaction or transfer between coli-13censees or a colicensed product, but never to a wholesale distrib-14utor; or15(v) Other exemptions as permitted by federal law.16

(e) The failure to keep records as required by the board. Any person17guilty of violating the provisions of this paragraph shall be guilty of18a misdemeanor and upon conviction thereof shall be incarcerated in the19county jail for a term not to exceed one (1) year or punished by a fine20of not more than one thousand dollars ($1,000), or by both such fine and21incarceration.22(f) The refusal to make available and to accord full opportunity to23check any record, as required by the board. Any person guilty of vio-24lating the provisions of this paragraph shall be guilty of a misdemeanor25and upon conviction thereof shall be incarcerated in the county jail for26a term not to exceed one (1) year or punished by a fine of not more than27one thousand dollars ($1,000), or by both such fine and incarceration.28(g) It is unlawful to:29

(i) Obtain or attempt to obtain a legend drug or procure or at-30tempt to procure the administration of a legend drug: by fraud,31deceit, misrepresentation or subterfuge; by the forgery or alter-32ation of a prescription, drug order, or of any written order; by33the concealment of a material fact; or by the use of a false name or34the giving of a false address.;35(ii) Communicate information to a practitioner in an effort un-36lawfully to procure a legend drug, or unlawfully to procure the ad-37ministration of any such drug. Any such communication shall not be38deemed a privileged communication.;39(iii) Intentionally make a false statement in any prescription,40drug order, order, report or record required by this chapter.;41(iv) For the purpose of obtaining a legend drug to falsely assume42the title of, or represent himself to be, a manufacturer, whole-43saler, pharmacist, physician, dentist, veterinarian dispenser,44prescriber, or other person.;45(v) Make or utter any false or forged prescription or false drug46order or forged written order.;47(vi) Affix any false or forged label to a package or receptacle48containing legend drugs. This subparagraph does not apply to law49

enforcement agencies or their representatives while engaged in1enforcing state and federal drug laws.; or2(vii) Wholesale or retail any prescription or legend drug to any3person in this state not entitled by law to deliver such drug to4another.5

Every violation of paragraph (g)(i) through (vi) of this subsection shall6be a misdemeanor, and any person convicted thereof shall be incarcerated in7the county jail for a term not to exceed one (1) year or fined not more than8one thousand dollars ($1,000), or punished by both such fine and imprison-9ment. Any person violating paragraph (g)(vii) of this subsection is guilty10of a felony and on conviction thereof shall be imprisoned in the state peni-11tentiary for a term not to exceed three (3) years or punished by a fine of not12more than five thousand dollars ($5,000), or by both such fine and imprison-13ment.14

(4) The ultimate user of a legend drug who has lawfully obtained such15legend drug may deliver, without being registered, the legend drug to an-16other person for the purpose of disposal of the legend drug if the person re-17ceiving the legend drug for purposes of disposal is authorized under a state18or federal law or regulation to engage in such activity.19

SECTION 23. That Section 54-1733A, Idaho Code, be, and the same is20hereby amended to read as follows:21

54-1733A. TRANSMISSION OF PRESCRIPTION DRUG ORDERS. A valid pre-22scription drug order may be transmitted to a licensed registered pharmacy in23accordance with federal law by the following means:24

(1) By delivery of the original signed written prescription drug order25or a digital image of the order; or26

(2) By a prescriber, prescriber's agent, or representative of a state-27licensed or federally certified provider community:28

(a) Electronically in compliance with the uniform electronic transac-29tions act, chapter 50, title 28, Idaho Code, or via a secure, interoper-30able information technology system that exchanges data accurately and31in compliance with applicable laws;32(b) Verbally; or33(c) Via facsimile.34

SECTION 24. That Section 54-1733B, Idaho Code, be, and the same is35hereby amended to read as follows:36

54-1733B. OPIOID ANTAGONISTS. (1) Notwithstanding any other pro-37vision of law, any health professional licensed or registered under this38title, acting in good faith and exercising reasonable care, may prescribe39and dispense an opioid antagonist to: any person or entity.40

(a) A person at risk of experiencing an opiate-related overdose;41(b) A person in a position to assist a person at risk of experiencing an42opiate-related overdose;43(c) A person who, in the course of his official duties or business, may44encounter a person experiencing an opiate-related overdose; or45

(d) A person who, in the opinion of the health professional licensed or1registered under this title, has valid reason to be in the possession of2an opioid antagonist.3(2) Notwithstanding any other provision of law, any person acting in4

good faith and exercising reasonable care may administer an opioid antag-5onist to another person who appears to be experiencing an opiate-related6overdose. As soon as possible, the administering person shall contact emer-7gency medical services.8

(3) Any person who prescribes, dispenses, or administers an opioid an-9tagonist pursuant to subsection (1) or (2) of this section shall not be li-10able in a civil or administrative action or subject to criminal prosecution11for such acts.12

(4) As used in this section, "opioid antagonist" means naloxone hy-13drochloride or any other similarly acting and equally safe drug approved by14the federal food and drug administration for the treatment of drug overdose.15

SECTION 25. That Section 54-1733D, Idaho Code, be, and the same is16hereby amended to read as follows:17

54-1733D. EPINEPHRINE AUTO-INJECTORS -- PRESCRIPTION AND ADMINIS-18TRATION. (1) Notwithstanding any other provision of law, any prescriber or19pharmacist acting in good faith and exercising reasonable care may prescribe20an epinephrine auto-injector to: any person or entity.21

(a) A person at risk of experiencing anaphylaxis;22(b) A person in a position to assist a person at risk of experiencing23anaphylaxis;24(c) A person who, in the course of the person's official duties or busi-25ness, may encounter a person experiencing anaphylaxis; and26(d) A person who, in the opinion of the prescriber or pharmacist, has a27valid reason to be in possession of an epinephrine auto-injector.28(2) Notwithstanding any other provision of law, any person acting in29

good faith and exercising reasonable care may administer an epinephrine30auto-injector to another person who appears to be experiencing anaphylaxis.31As soon as possible, the administering person shall contact emergency medi-32cal services.33

(3) Any person who prescribes, dispenses, or administers an epineph-34rine auto-injector pursuant to subsection (1) or (2) of this section shall35not be liable in a civil or an administrative action or subject to criminal36prosecution for such acts.37

(4) As used in this section, "epinephrine auto-injector" means a sin-38gle-use device used for the automatic injection of a premeasured dose of epi-39nephrine into the human body.40

SECTION 26. That Section 54-1736, Idaho Code, be, and the same is hereby41amended to read as follows:42

54-1736. DECLARATION OF COMMON NUISANCE. Any store, shop, warehouse,43dwelling house, apartment, building, vehicle, boat, aircraft, or any place44whatever, which is whatsoever used by any person for the purpose of unlaw-45fully using any legend drug, or which is used for the unlawful keeping or46selling of the same, is a common nuisance. No person shall keep, or maintain47

such a common nuisance, nor or frequent or visit such place, knowing it to be1used for any said purposes.2

SECTION 27. That Chapter 17, Title 54, Idaho Code, be, and the same is3hereby amended by the addition thereto of a NEW SECTION, to be known and des-4ignated as Section 54-1737A, Idaho Code, and to read as follows:5

54-1737A. RESTRICTIONS ON TRANSACTIONS. (1) A wholesale distributor6shall not engage in the wholesale distribution of prescription drugs pur-7chased from pharmacies or practitioners or from wholesale distributors that8purchase them from pharmacies or practitioners.9

(2) A manufacturer or wholesale distributor shall furnish prescription10drugs only to a person licensed by the appropriate state licensing agency to11manufacture, distribute, dispense, conduct research on, or independently12administer such prescription drugs, unless exempted by law. A manufacturer13or wholesale distributor shall furnish a scheduled controlled substance14listed in section 37-2705, 37-2707, 37-2709, 37-2711, or 37-2713, Idaho15Code, only to a person who has been issued a valid controlled substance reg-16istration by the United States drug enforcement administration and the Idaho17board of pharmacy, unless exempted by state or federal law.18

(3) Prescription drugs furnished by a manufacturer or wholesale dis-19tributor shall be delivered only to a principal place of business or a pro-20fessional practice.21

SECTION 28. That Section 54-1739, Idaho Code, be, and the same is hereby22amended to read as follows:23

54-1739. PROSPECTIVE DRUG REVIEW AND COUNSELING. (1) Before dispens-24ing any new prescription, a pharmacist shall complete a prospective drug re-25view.26

(2) Before dispensing a prescription for a new medication, or when oth-27erwise deemed necessary or appropriate, a pharmacist shall counsel the pa-28tient or caregiver. Counseling shall include such supplemental written ma-29terials as required by law or as are customary in that practice setting. For30refills or renewed prescriptions, a pharmacist or a technician shall extend31an offer to counsel the patient or caregiver. If such offer is accepted, a32pharmacist shall provide such counseling as necessary or appropriate in the33professional judgment of the pharmacist. All counseling and offers to coun-34sel shall be face-to-face with the patient or caregiver when possible, but if35not possible, then a reasonable effort shall be made to contact the patient36or caregiver. Nothing in this section shall require a pharmacist to provide37counseling when a patient or caregiver refuses such counseling or when coun-38seling is otherwise impossible. Patient counseling shall not be required39for inpatients of a hospital or institutional facility when licensed health40care professionals administer the medication.41

(3) This section shall apply to all registered and licensed outlets.42

SECTION 29. That Section 54-1751, Idaho Code, be, and the same is hereby43repealed.44

SECTION 36. That Section 54-1761, Idaho Code, be, and the same is hereby13amended to read as follows:14

54-1761. DEFINITIONS. As used in sections 54-1760 through 54-1765,15Idaho Code:16

(1) "Donation repository" means:17(a) A community health center as defined in section 39-3203, Idaho18Code;19(b) A free medical clinic as defined in section 39-7702, Idaho Code;20(c) A designated regional behavioral health center as identified in21chapter 31, title 39, Idaho Code;22(d) A state charitable institution as defined in chapter 1, title 66,23Idaho Code; or24(e) A drug outlet as defined in section 54-1705, Idaho Code.25(2) "Legend drug" has the same meaning as provided in section26

54-1705(358), Idaho Code.27(3) "Medically indigent patient" means any person who is a resident of28

Idaho and who meets one (1) of the following conditions:29(a) The person is not eligible for medicaid or medicare;30(b) The person cannot afford private prescription drug insurance; or31(c) The person does not have income and other resources available suf-32ficient to pay for a legend drug.33(4) "Qualified donor" means:34(a) Any entity that meets the definition of "donation repository" as35provided in this section; or36(b) Any member of the public in accordance with section 54-1762, Idaho37Code.38

SECTION 37. That Section 54-1762A, Idaho Code, be, and the same is39hereby amended to read as follows:40

54-1762A. DRUG DONATION FOR ANIMALS. Notwithstanding any other pro-41vision of law:42

(1) An owner or a legal caretaker of an animal may donate a drug that is1dispensed for the animal, but will not be used by that animal, to a licensed2veterinarian of a veterinary medical facility, as that term is defined in3section 54-2103, Idaho Code, if the veterinarian or facility chooses to ac-4cept the drug.5

(2) A licensed veterinarian or a veterinary medical facility may accept6and reissue drugs donated pursuant to this section and from qualified donors7listed in section 54-17621(4), Idaho Code, if:8

(a) The drug is not expired;9(b) There is no reason to believe the drug has been adulterated;10(c) The drug is not a controlled substance; and11(d) The drug is not a compounded drug; and12(e) If a liquid, the drug is packaged in a single dose in an ampule or13vial.14(3) A licensed veterinarian or a veterinary medical facility may not15

resell the donated drug.16(4) A licensed veterinarian or a veterinary medical facility may, how-17

ever, reissue the donated drug, without charge, for proper administration to18an animal by:19

(a) Another client of the veterinarian or facility who appears to be fi-20nancially unable to pay for the drug;21(b) A nonprofit animal shelter; or22(c) A pound, as that term is defined in section 25-3502, Idaho Code.23

SECTION 38. That Section 54-1764, Idaho Code, be, and the same is hereby24amended to read as follows:25

54-1764. IMMUNITY FROM LIABILITY. Any entity that lawfully and volun-26tarily participates by donating, accepting, distributing or dispensing leg-27end drugs under the Idaho legend drug donation act shall be immune from lia-28bility for any civil action arising out of the provision of such action. This29section shall not extend immunity to the participating entity for any acts30constituting intentional, willful or grossly negligent conduct or to acts by31a participating entity that are outside the scope of practice authorized by32the entity's licensure, certification or registration certificate.33

SECTION 39. That Section 54-1765, Idaho Code, be, and the same is hereby34repealed.35

SECTION 40. That Section 54-4702, Idaho Code, be, and the same is hereby36amended to read as follows:37

54-4702. DEFINITIONS. As used in this chapter:38(1) "Acupuncture" means that theory of health care developed from tra-39

ditional and modern Oriental medical philosophies that employs diagnosis40and treatment of conditions of the human body based upon stimulation of spe-41cific acupuncture points on meridians of the human body for the promotion,42maintenance, and restoration of health and for the prevention of disease.43Therapies within the scope of acupuncture include manual, mechanical, ther-44mal, electrical and electromagnetic treatment of such specific indicated45points. Adjunctive therapies included in, but not exclusive to, acupuncture46

include herbal and nutritional treatments, therapeutic exercise and other1therapies based on traditional and modern Oriental medical theory.2

(2) "Board" means the Idaho state board of acupuncture.3(3) "NCCAOM" means "National Certification Commission for Acupuncture4

and Oriental Medicine."5(4) "Practice of acupuncture" means the insertion of acupuncture nee-6

dles and use of similar devices and therapies, including application of mox-7ibustion, to specific indicated points on the skin of the human body as indi-8cated pursuant to traditional and modern theories of Oriental medicine. The9"practice of acupuncture" does not include:10

(a) Surgery; or11(b) Prescribing, dispensing or administering any prescription drug or12legend drug as defined in section 54-1705(358), Idaho Code.13
