threshold limit of 25 for the Cargo Handling Service hence the regulated service is deemed as Not Material Since the service is Not Material the Assessment of Competition and reasonableness of the User Agreements have no relevance for the assessment of regulatory approach As per Clausegz (i) of the guidelines 2011 wherever the regulated service provided is Not Material the Authority shall determine tariff (s) for service provider (s) based on a Light Touch Approach for the duration of the Control Period

4 The Authority observed that MsAAicLAS had not conducted the Stakeholders Consultation meeting on the propo~edt~riffproposalat the time of submission of its MYTP ATP Therefore AERA i~it~99ps~1~ation Paper directed that AAICLAS to conduct a Stakeholder Consulta~i9Qi~eeting~Iid submit details to the Authority along with Stakeholders comments bef91~j~~JJ~pft~liffOrder on the above proposal

6 AAICLAS has requested to considerth~(itOlltrpLperiod as 7 years including the previously elapsed 2 years ie FY 2017-18 amp FY 2018-19 the Authority is of the view that as per AERA (CGF) guidelines 2011 Control period means a period of 5 years during which the Multi Year Tariff Order and Tariff (s) determined by the Authority pursuant to such order shall subsist Therefore Control Period cannot be considered for more than 5 years The FY 2017-18 and FY 2018-19 has lapse and AAICLAS has not submitted any proposal it is inappropriate to recover any-shortfall for the Pflstyear from the present user Hence the Authority considers ~J1eFirst~(gt~trolPelio~fronfpy 2q~9~~() to FY2023-24

7 Ms AAICLAS submitted the actual financial data for FY 2017-18 and FY 2018-19 and projections from FY2019-2gto ~22~__~40n tll~ basis of actual and projected data of Revenue Operating expeIl~twre~9fl~i~~l~Jpen~itJ1re etc submitted by the AAICLAS the Authority observed tll~ttne R~turn RnAVeni~eyenB was 4893 in FY 2017-18 and 1189 in FY 2018-19 (actual) and as per projections for FY 2019-20FY 2020-21 FY 2021-22 FY 2022-23 and FY 2023-24 Returns on Average RAE will be -1803 -956 -431 -309 and 016 respectively mainly due to projected Capital Expenditure Further the Authority observed that the Operating profitturnover ratio was 2910 in FY 2017-18 and 671 in FY 2018-19 (actual) and as per projections for FY 2019-20 FY 2020-21 FY 2021-22 FY 2022-23 and FY 2023-24 Operating profitturnover will be -916 -1990 -1394 -836 and 037 respectively AAICLAS have projected Capital Expenditure of Rs 1100 lakhs during the First Control Period for improving and expanding the available infrastructure at Lucknow Airport in which the major portion of Rs 879 la~s will be incurred on new C~r~~~~rm~~El~ Building and Rs 103 lakhs on Plant and Machmery~iA Iy~

8 The Authority considered the submissions made by AAICLAS and issued a Consultation Paper No 282020-21 dated 23062020 wherein the Authority observed that AAICLAS would require higher rate of increase in tariff rates at Lucknow Airport to achieve the sufficient Return on Average RAB amp Operating Profit Margin and due to low volume of Cargo at the Airport Considering the substantial change in the prevailing business scenario and higher tariff rate required to AAICLAS the Authority proposed in the CP to allow Ms AAICLAS to charge an increase of 1921 from existing tariff for FY 2020-21 and thereafter 1000 increase Y-O-Y from FY 2021-22 to FY 2023-24 as sought by AAICLAS

9 The Authority sought written evidenf~p(l~edfeedbackcomments and suggestions from Stakeholders on the above propo~l11lltesfbY14072020 The Authority vide e-mail dated 24062020 informed the same to~11~~ff5~1~~d stakeholders on their registered e-mail IDs Since no comments have beenr~ceiv~qfJj6m any stakeholders on Consultation Paper no 282020-21 dated 23062020th~Atltliority presumed that the stakeholders have no objection to the proposal

10 Ms AAICLAS has conducted stakeholder Consultation meeting on 17072020 and submitted the minutes of the meetitrgtollIeAuthority As per the Minutes of the meeting submitted by AAICLAS they hav~tnadesoJll~amendmentsin the tariff rates and notes of the tariff card on the request of the Stakeholders AAICLAS has proposed to keep the existing tariff rates for Regulated Agent Facilitation (for Export amp Domestic Outbound) and some others line items like Terminal Operator PackingRepacking charges Merchant over Time XBIS usage charges of Import Cargo etc The Authority has decided to allow Ms AAICLAS to increase 1921 from existing tariff for FY 2020-21 and thereafter 1000 increase Y--Y froIDRY 2021-22 toFY202324 except the amended charges proposed by AAIStySion theTequestoftheS0(lkeh01a~r~ Further the Authority has decided to implement theJariffftqIDQV102Q20 aspfppqscentdby the AAICLAS

Upon careful consideratiog~fm~ierial availablelt~Rr~cord as well as submissions made by the service provider the Authorityin exerpiseofpowers conferred upon it by Section 13(1) (a) of the AERAAct 2008 hereby orders that

(i) The Cargo services provided by Ms AAI Cargo Logistics and Company Limited (AAICLAS) at Chaudhary Charan Singh International Airport Lucknow are Non Material Hence the Authority decides to adopt Light Touch Approach for determination of tariff from 1st tariff year to 5th tariff year of the 1st Control Period ie FY 2019-20 to FY2023-24

n) The export TSP charges paid in advance through online by the shippers agents will be refunded in case the export cargo is not physically brought to the Air Cargo Terminal for processing on the same day subject to retention of minimum rate per consignment of General Special Valuable cargo respectively Proportionate Applicable GSTon minimum rate will also be retained

7 Ms AAICLAS submitted the actual financial data for FY 2017-18 and FY 2018-19 and projections from FY2019-2gto ~22~__~40n tll~ basis of actual and projected data of Revenue Operating expeIl~twre~9fl~i~~l~Jpen~itJ1re etc submitted by the AAICLAS the Authority observed tll~ttne R~turn RnAVeni~eyenB was 4893 in FY 2017-18 and 1189 in FY 2018-19 (actual) and as per projections for FY 2019-20FY 2020-21 FY 2021-22 FY 2022-23 and FY 2023-24 Returns on Average RAE will be -1803 -956 -431 -309 and 016 respectively mainly due to projected Capital Expenditure Further the Authority observed that the Operating profitturnover ratio was 2910 in FY 2017-18 and 671 in FY 2018-19 (actual) and as per projections for FY 2019-20 FY 2020-21 FY 2021-22 FY 2022-23 and FY 2023-24 Operating profitturnover will be -916 -1990 -1394 -836 and 037 respectively AAICLAS have projected Capital Expenditure of Rs 1100 lakhs during the First Control Period for improving and expanding the available infrastructure at Lucknow Airport in which the major portion of Rs 879 la~s will be incurred on new C~r~~~~rm~~El~ Building and Rs 103 lakhs on Plant and Machmery~iA Iy~
