I am pleased ' t o announce today t h a t an agreement has been reached

by r e p r e s e n t a t i v e s of the Department o f the I n t e r i o r and o f Westlands Water

District which f u l f i l l s the o b j e c t i v e s of the Department: t o c l o s e Kesterson

Reservoir e x p e d i t i o u s l y , t o cont inue planned d e l i v e r y o f i r r i g a t i o n water

on lands within Westlands, and t o t ake important s t e p s toward a long-term

s o l u t i o n t o the dra inage problems wi th in the San Joaquin Val ley.

Upon formal approval o f this agreement by the Westlands Board of D i r ec to r s ,

I am prepared t o s i g n i t immediately so t h a t C a l i f o r n i a ' s a g r i c u l t u r a l

economy wi l l not be jeopard ized , and environmental concerns a r e met.

This agreement w i l l a s s u r e the c l o s u r e of Kesterson Reservoi r i n a

much s h o r t e r per iod o f time than i f the Department had a t tempted t o use

i ts u n i l a t e r a l power and a u t h o r i t y under the law t o r e s o l v e the i s sue . I

have no doubt t h a t any a t tempt t o a c t u n i l a t e r a l l y would have r e s u l t e d

i n p ro t r ac t ed , d i v i s i v e and counter-product ive l i t i g a t i o n .

This consensus approach is the bes t way f o r the Department t o f u l f i l l

i t s miss ions both t o p r o t e c t the environment and t o provide i r r i g a t i o n

water which is so essential t o the agricultural co.munity.

"I particularly appreciate the efforts of the representatives of Westlands

and i t s farmers in reaching a consensus on this issue. T b concerted,

bipartisan work of Governor Deukmejian, the California congressional delegation,

Interior Solicitor Frank Richardson, Assistant Secretary Broadbent, Bureau

of Reclamation Regional Director Houston, Western Regional Representative

Carol Hallett, and various concerned parties such as the Oakland, California

Sierra Club was key t o achieving a consensus. Through their efforts, we

will be able t o bring the process begun on March 15 t o a successful conclusion,''

Hodel said.

I would like t o summarize briefly the essential points of this agreement.

Westlands will be required t o eliminate the flow of drain waters into the

San Luis Drain and Kesterson Reservoir. The reduction of drain water will

begin this summer and will be phased t o allow for development of alternative

facilities, and Westlands i s required t o complete preparation of i t s preliminary

plan for alternative means of disposal by June 1, 1985.

Most importantly, under the agreement there wi 11 be a .complete termination

of drain water from Westlands into Kesterson after June 30, 1986.

Westlands has agreed t o take all actions necessary t o achieve this

schedule. I have been assured t h a t the actions contemplated by the agreement

are technically sound and t h a t they will be effective. The Department

expressly has the right t o go t o court t o see t o i t t h a t Westlands' obligations

are enforced and has preserved i ts authority, i f all else fails, t o take

these steps itself t o assure compliance.

The Department o f Just ice, based i n p a r t on the in fo rmat ion and pro fess iona l

judgments prov ided by the F ish and W i l d l i f e Service and the Bureau o f

Reclamation, has concurred w i t h t h i s s o l u t i o n and has given assurances,

as s e t f o r t h i n i t s l e t t e r t o the S o l i c i t o r dated today, t h a t no enforcement

ac t i on under the Migra tory B i r d Treaty Act i s warranted against any person

who, i n compliance w i t h the agreement, d e l i v e r s water i n t o the San Lu is

Dra in o r manages and operates the San Lu i s Drain and Kesterson Reservoir.

I am pleased we are able t o reach an agreement which should p r o t e c t

both environmental and economic concerns i n the San Joaquin Val l ey . Nevertheless,

a b i p a r t i s a n e f f o r t i n Congress and i n t e n s i v e

consul t a t i o n w i t h environmental and a g r i c u l t u r a l i n t e r e s t s s t i 11 w i l l

be necessary t o achieve a long-term s o l u t i o n t o the complex problems associated

w i t h w i l d l i f e and a g r i c u l t u r a l drainage i n C a l i f o r n i a . I stand ready

t o he lp i n such an e f f o r t .

The Bureau of Reclamation (Bureau) of t h e Department f u r n i s h e s most of t h e i r r i g a t i o n water used i n Westlands. Both Resteraon Reservoir and t h e San L u i s Drain were planned o r i g i n a l l y as p a r t of a l a r g e r d r a inage oystem intended t o t r an s - port t h e d r a i n water 200 miles north f o r d iacharge i n t o t h e western Sacranunto-San Joaquin Delta. 4 drainage syatem war

However, as a r e s u l t of environmental concerns about d r a in water discharges i n t o t h e d e l t a and lack of a p p r o p r i a t i o n s , t h e l a r g e r system never was completed. The San Luis Drain p r e sen t l y temf n a t e s a t Kes t e r son Reservoir , which s i n c e 1970 has been ope ra t ed as p a r t of t h e I testerson Nat iona l w i l d l i f e Refuge. -. •

On March 14, 1985 t h e S e c r e t a r y of t h e I n t e r i o r was adv i sed by t h e Department 's S o l i c i t o r t h a t , because t h e hazing program was

n o t e n t i r e l y e f f e c t i v e , employees pe r fona ing their o f f i c i a l dut ies i n connect ion wi th t h e o p e r a t i o n of Kesterson Rese rvo i r c o u l d n o t be assured t h a t t h e i r a c t i o n s would not be found to v i o l a t e the n i g r a t o r y Bi rd T r e a t y A c t i f waterfowl d i e d from i n g e s t i n g selenium.

Based on that advice , t h e .Department understandably decided t o begin immediately t h e p roceas o f ' p lugging, t h e San Luis Drain and c l o a i n g Kosteraon Reservoir. Becauso of t h e time it would t a k e

to fabricate, procure and i n s t a l l p l u g s i n the dra inage p ipes
