Keith Anderson, electrical program chief, said that the 2017 code committee

completed its work with the review of the 2017 Oregon Electrical Specialty Code.

He thanked all committee members for their hard work and said the board will be

making a recommendation to the Administrator later in the agenda. All code

proposals, agendas, minutes and videos are posted on the division website.

Keith thanked Shawn Haggin, assistant electrical chief, for his service and let the

board know that Shawn will be leaving the division April 4, 2017.

B. Elevator program update

Warren Hartung, elevator program chief, Statewide Services, gave a report on the

January and February 2017 overdues and accidents.

Chief Hartung introduced new inspector Brett Kelly who will be inspecting in

Area 10.

C. Summary of enforcement actions previously taken by the division outlined

on the enforcement board report. (No board action required)

VII. New business

A. Board review and provide a recommendation to the Administrator on the

2017 Oregon Electrical Specialty Code

Nathan Phillips, NECA, chair of the 2017 OESC committee, discussed the work

of the committee. Mr. Phillips said the committee met six times beginning

November 29, 2016, and finalizing its recommendations for the board on

February 28, 2017. He said that the committee recommended adopting the 2017

addition of NFPA 70 as the base model code with Oregon amendments included

in Table 1-E.

Michael Weaver, chair, thanked committee members as well as staff for their

expertise, which allowed for a smooth process.

Motion by Heather Miller, vice-chair, to approve the committee’s

recommendation to adopt the proposed language and forward to the Administrator

for rulemaking and subsequent adoption, with the finding that the added cost, if

any, is necessary to the health and safety of the occupants or the public or

necessary to conserve scarce resources. In addition, recommend that the

Residential and Manufactured Structures Board approve the proposed language

where it relates to low-rise residential provisions.

Motion carried unanimously.

Mr. Phillips discussed code proposal OESC 17-13, Electrical Vehicle-Ready

Parking Facilities submitted by Representative Phil Barnhart. Mr. Phillips

explained that the committee approved the technical requirements and agreed with

the policy. The committee suggested that the proposal be housed in a more

compatible code. The committee suggested forwarding this proposal to the

Administrator for placement in the correct code.

Motion by Ms. Miller, vice-chair, to approve the technical requirements of

OESC 17-13 to the Administrator for rulemaking and subsequent adoption with

the finding that the added cost, if any, is necessary to the health and safety of the

occupants or the public or necessary to conserve scarce resources and forward the

remaining requirements of the proposal back to the Administrator. In addition,

recommend that the Residential and Manufactured Structural Board approve the

proposed language where it relates to low-rise residential provisions.

Motion carried unanimously.

Mr. Phillips further discussed egress lighting controls in reference to 700.23 of the

model code and the energy provisions that allow the use of occupancy sensors to

control egress lighting. He said the committee could not agree on a

recommendation and voted to forward to the Administrator for a decision to send

to the appropriate board and back to the Electrical and Elevator Board if needed.

Motion by Ms. Miller, vice-chair, to approve the committee recommendation to

forward egress lighting controls in reference to 700.23 of the model code and the

energy provisions that allow the use of occupancy sensors to control egress

lighting to the Administrator to forward to the appropriate board for a

recommendation.

B. Request to grant continuing education credit hours to 2017 Oregon Electrical

Specialty Code Review Committee members and staff

Nathan Phillips, chair of the code committee, said that staff and committee

members spent over 36 hours reviewing code proposals, model code, and

amendments. The committee asked the board to approve four hours of Oregon

Rule and Law, and 20 hours of Code Change Credit for the licensed members of

the code review committee.

Motion by Tim Frew to approve the code change committee’s request for

continuing education hours.

Motion carried unanimously

C. Review and approve committee’s recommendations for new continuing

education courses and instructors applications

Motion by Heather Miller, vice-chair, to approve committee recommendations

for approval or denial of course or instructor applications.

Motion carried unanimously.

Richard Baumann, policy analyst, Policy and Technical Services, said that the

action taken by the board today regarding the 2017 Oregon Electrical Specialty

Code (OESC) did not yet trigger the requirement in administrative rule for 2017

OESC code change and Oregon rule and law continuing education courses. These

courses may be submitted for consideration after the division files the notice for

public hearing.

D. Board decide on committee recommendations for criteria used when

evaluating Class B Limited Energy Technician 32-hour training programs

Mr. Baumann said the board’s continuing education sub-committee recently

reviewed an application for a 32-hour training program. This raised questions

with the sub-committee, which is seeking clarification from the board to

standardize criteria when evaluating 32-hour training programs.

Chair Weaver said that Oregon Rule and Law should be part of the syllabus.

Members concluded that two hours of Oregon Rule and Law specific to the

license was sufficient for the training course.

Also, members discussed establishing a deadline date for submitting training

programs for review. Chair Weaver suggested a January 1, 2018, date for the

2017 code, and an October 1, 2017 deadline for the current training programs

being taught. All members agreed and directed the division to notify the two

instructors currently teaching the 32-hour training course to resubmit their

courses for review by the sub-committee and subsequent action by the board.

These courses must be approved by October 1, 2017, if the provider intends to

continue offering them.

Motion by Heather Miller, vice-chair, to amend and approve committee’s

criteria for evaluating 32-hour training programs to include notifying instructors

currently teaching the program to submit courses for review for an approval date

of October 1, 2017, and to include two hours of Oregon Rule and Law directly

related to the license.

State of Oregon Board memo Building Codes Division May 25, 2017 To: The Electrical and Elevator Board From: Anthony Estrada, contested case representative, Enforcement Services Subject: Final Order for Case No. C2016-0047, In the Matter of Grigoriy Bogoslavets1 Action requested: To consider the adoption of a Proposed Order and issue a Final Order. Background: On July 28, 2016, the Building Codes Division (division), acting on behalf of the Electrical and Elevator Board (board), issued a Notice of Proposed Refusal to Renew Limited Residential Electrician License No. 543LR, Notice of Proposed Disqualification from Licensure and Final Order on Default (Notice) to Grigoriy Bogoslavets (Respondent) in Case No. C2016-0047. The Notice alleged that Respondent had been ordered to pay damages under judgments that related to construction and had become final by operation of law2 and that the conduct supporting those judgments demonstrated that Respondent was unfit to hold a limited residential electrician license. The Notice proposed to deny Respondent’s limited residential electrician license application (ORS 455.129(2) and ORS 670.280(2)) and disqualify him from obtaining a limited residential electrician license for five years (ORS 455.127(2)). Respondent requested a hearing, which was scheduled for April 18, 2017. Administrative Law Judge (ALJ) Marni Davis was assigned to preside over the hearing. On February 24, 2017, the division filed a Motion for Summary Determination. Respondent did not file a response to the division’s motion. On April 5, 2017, ALJ Davis issued a Ruling on Motion for Summary Determination and Proposed Order finding that there were no genuine issues as to any material facts and that the division was entitled to a favorable ruling as a matter of law. 1 Grigoriy Bogoslavets is also known as Grigory Bogoslavets, Grigoriy G. Bogoslavets, Grigory G. Bogoslavets, Gregory Bogoslavets, and Gregoriy Bogoslavets. 2 On approximately October 28, 2008, a 36 count indictment was entered against Respondent in the State of Oregon vs. Grigory G. Bogoslavets, Clackamas County Circuit Court case number CR0801406. The charges against Respondent included four counts of Aggravated Theft in the First Degree (ORS 164.057), a Class B felony. Each count alleged that Respondent unlawfully and knowingly committed theft of electrical supplies of Platt Electric valued at $10,000 or more. On approximately September 22, 2009, Respondent was convicted of Counts 1 through 4 in case CR0801406. The judgment entered against Respondent in CR0801406 included a criminal sentence and an order for Respondent to pay $274,891 in restitution to Platt Electric.

ALJ Davis found that the division may refuse to renew Respondent’s limited residential electrician license, pursuant to ORS 455.129(2)(q) and (3)(b) and ORS 670.280(3), because Respondent was ordered to pay damages in criminal case CR0801406 and because the conduct leading to Respondent’s conviction in criminal case CR0801406 was substantially related to the work for which his license was required, and Respondent’s fitness to hold an electrical license. Finally, ALJ Davis found that the division may disqualify Respondent from obtaining or renewing his limited residential electrician license for five years. ALJ Davis proposed that Respondent’s application to renew his limited residential electrician license number 543LR be denied and that Respondent be disqualified from obtaining a limited residential electrician license for a period of five years. No exceptions to the Proposed Order were filed. Options: After considering the Proposed Order, the board may:

Issue a Final Order and adopt the Proposed Order. Amend the Proposed Order and indicate to the division what it would like the division to

alter in the order. Disapprove the Proposed Order, and direct the division to approve of Respondent’s

application for a limited residential electrician license.

HISTORY OF THE CASE On July 28, 2016, the Electrical and Elevator Board (Board) of the Building Codes Division (Division) issued a Notice of Proposed Refusal to Renew Limited Residential Electrician License Number 543LR, Notice of Proposed Disqualification from Licensure and Final Order on Default to Grigoriy Bogoslavets (Respondent). On August 15, 2016, Respondent requested a hearing. On December 16, 2016, the Division referred the hearing request to the Office of Administrative Hearings (OAH). Administrative Law Judge (ALJ) Davis was assigned to preside at hearing. A prehearing conference convened on January 27, 2017. Respondent did not appear. Assistant Attorney General Tyler Anderson appeared on behalf of the Division. Anthony Estrada also appeared on behalf of the Division. During the hearing, ALJ Davis established filing dates for motions and responses, as well as scheduled a hearing for April 18, 2017. On February 24, 2017, the Division filed a Motion for Summary Determination a supporting exhibits. Respondent had until March 10, 2017 to file a response. Respondent did not file a response by the established deadline. ALJ Davis closed the record on March 14, 2017 and took the matter under advisement.

ISSUES

1. Whether there are any genuine issues as to any material facts and, if not, whether the Division is entitled to a favorable ruling as a matter of law. OAR 137-003-0580.

2. Whether the Division may refuse to renew Respondent’s license because:

a. Respondent was required to pay damages under a judgment that relates to construction. ORS 455.129.

DOCUMENTS CONSIDERED

The Division’s Motion and its supporting Exhibits A through M were considered.

FINDINGS OF FACT

1. On April 30, 1999, Respondent was issued limited residential electrician license #543LR in Oregon. (Ex. A.)

2. Platt Electric, Inc. (Platt Electric) is a wholesale distributor of electrical products.

Between January 1, 2007 and April 30, 2007, Platt Electric extended short term credit to electrical contractors, including Respondent, to purchase electrical products and supplies at wholesale prices. In order to receive this credit, the contractor was required to submit an application creating a separate account for each contracting job. This short term credit and discounted merchandise was not available to the general public. (Exs. C, D, E, and F.)

3. Platt Electric extended short term credit to Respondent, doing business under the

name Skylight Electric. Under this credit policy, Platt Electric requires that the customer complete an application creating a separate account for each job for which they intend to receive material on credit. Between August 4, 2006 and April 12, 2007, Respondent created 18 fictitious jobs and he and his employee/brother-in-law ordered and picked up $444,886.94 worth of merchandise from Platt Electric. On March 25, 2007, Respondent presented a check for $17,159.89 for payment on his accounts, but the check bounced. Upon investigating the matter, Platt Electric discovered that Respondent never had the means or intention to pay for the material he received and told them that he sold the material to pay off a debt. (Ex. C at 2.)

3. On approximately October 28, 2008, a 36 count indictment was entered against Respondent in the State of Oregon vs. Grigory G. Bogoslavets, Clackamas County Circuit Court case number CR0801406. The charges against Respondent included the following:

a. Count 1 - Aggravated Theft in the First Degree (ORS 164.057), a Class B felony. The indictment alleged that Respondent, between approximately January 1, 2007 and April 30, 2007, in Clackamas, Oregon, did unlawfully and knowingly commit theft of electrical supplies for Job #MICH5, of the total value of $10,000 or more, the property of Platt Electric. b. Count 2 - Aggravated Theft in the First Degree (ORS 164.057), a Class B felony. The indictment alleged that Respondent, between approximately

d. Count 4 – Aggravated Theft in the First Degree (ORS 164.057), a Class B felony. The indictment alleged the Respondent, between approximately January 1, 2007 and April 30, 2007, in Clackamas County, Oregon, did unlawfully and knowingly commit theft of electrical supplies for Job #MICH139, of the total value of $10,000 or more, the property of Platt Electric.

4. On approximately July 23, 2009, Respondent pled no contest to Counts 1 through 4 in

case CR0801406. (Ex. I.) 5. On approximately September 22, 2009, Respondent was convicted of Counts 1 through

4 in case CR0801406. The judgment entered against Respondent in CR0801406 included a criminal sentence and an order for Respondent to pay $274,891 in restitution to Platt Electric. (Exs. G at 20-22, H at 2-3, 30-31.)

6. On approximately August 31, 2011, an Amended Judgment was entered in case

CR0801406. The amendment was related to the length of Respondent’s criminal sentence. (Ex. H at 2, 30-31.)

7. On October 1, 2015, Respondent’s limited residential electrician license #543LR

expired. (Ex. A.) 8. On approximately December 30, 2015, Respondent applied to renew his limited

residential electrician license with the Division. (Ex. L.)

CONCLUSIONS OF LAW 1. There are no genuine issues as to any material facts and the Division is entitled to a favorable ruling as a matter of law.

2. The Division may refuse to renew Respondent’s limited residential electrician license because Respondent was ordered to pay damages in criminal case CR0801406 and the conduct leading to Respondent’s conviction in criminal case CR0801406 was substantially related to the work for which his license was required and Respondent’s fitness to hold a license.

3. The Division may disqualify Respondent from obtaining or renewing his limited

residential electrician license for five years.

OPINION 1. Standard of Review for Motion for Summary Determination OAR 137-003-0580 addresses motions for summary determination. It provides, in relevant part:

(6) The administrative law judge shall grant the motion for a summary determination if: (a) The pleadings, affidavits, supporting documents (including any interrogatories and admissions) and the record in the contested case show that there is no genuine issue as to any material fact that is relevant to resolution of the legal issue as to which a decision is sought; and (b) The agency or party filing the motion is entitled to a favorable ruling as a matter of law. (7) The administrative law judge shall consider all evidence in a manner most favorable to the non-moving party or non-moving agency.

(8) Each party or the agency has the burden of producing evidence on any issue relevant to the motion as to which that party or the agency would have the burden of persuasion at the contested case hearing.

* * * * * (12) If the administrative law judge’s ruling on the motion resolves all issues in the contested case, the administrative law judge shall issue a proposed order in accordance with OAR 137-003-0645 incorporating that ruling * * *.

Pursuant to OAR 137-003-0580(6)(a), in making my ruling, I considered the Division’s Motion for Summary Determination and its supporting Exhibits A through M. After considering the facts of the case in a light most favorable to Respondent, the non-moving party, I conclude, for the reasons discussed below, that there are no genuine issues as to material facts and that the Division is entitled to a favorable ruling as a matter of law, which resolves all the issues. Therefore, the Division’s Motion is granted and this Ruling and Proposed Order is issued.

2. Refusal to Renew Limited Residential Electrician’s License #543LR The Division contends that Respondent’s application for renewal of his license is subject to denial because Respondent was required to pay damages under a judgment that relates to construction and Respondent’s conviction in criminal case CR0801406 was substantially related to the work for which his license was required and Respondent’s fitness to hold the license.

The Division bears the burden of proving its allegations by a preponderance of the evidence. ORS 183.450(2) and (5); Reguero v. Teachers Standards and Practices Commission, 312 Or 402, 418 (1991) (burden is on Commission in disciplinary action); Cook v. Employment Div., 47 Or App 437 (1980) (in the absence of legislation adopting a different standard, the standard of proof in administrative hearings is preponderance of the evidence). Proof by a preponderance of the evidence means that the fact finder is convinced that the facts asserted are more likely true than false. Riley Hill General Contractor v. Tandy Corp., 303 Or 390, 402 (1987).

ORS 455.129(2)(q) and (3)(b) provide that:

(2) Subject to ORS chapter 183, a regulatory body listed in subsection (3) of this section may deny a license, certificate, registration or application or may suspend, revoke, condition or refuse to renew a license, certificate or registration if the regulatory body finds that the licensee, certificate holder, registrant or applicant:

In determining whether the conduct is substantially related to the fitness and ability of the applicant or licensee to engage in the activity for which the license is required, the licensing board, commission or agency shall consider the relationship of the facts with respect to the conduct and all intervening circumstances to the specific occupational or professional standards.

Between January 1, 2007 and April 30, 2007, Respondent engaged in theft of property of Platt Electric, property his status as a limited residential electrician allowed him to access. By stealing electrical supplies from a wholesale distributer, Respondent abused the authorization given to him by Platt Electric and engaged in conduct related and detrimental to the electrical profession. Respondent stole electrical products from Platt Electric over a four month period, demonstrating the he is unfit to hold a limited residential electrician license. The Division has established that Respondent’s conviction in criminal case CR0801406 was substantially related to the work for which his license was required and Respondent’s fitness to hold that license. Additionally, the judgment entered against Respondent in criminal case CR0801406 included an order for Respondent to pay $274,891 in restitution damages. The award for damages imposed against Respondent related directly to Respondent’s engagement in the construction industry.

Respondent’s application for renewal of his License is subject to denial pursuant to ORS 455.129(2)(q) and (3)(b) and ORS 670.280(3). 3. Disqualifying Respondent from Renewing or Obtaining a License for Five Years

ORS 455.127(2)(a) and (3) provide that:

(2) The Director of the Department of Consumer and Business Services, the Department of Consumer and Business Services or an appropriate advisory board may disqualify a person from obtaining or renewing a license, registration, certificate or certification if the person: (a) Is or has been subject to civil penalties, revocation, cancellation or suspension of a license, registration, certificate, or certification or other sanction by the director, department or an advisory board

* * * * * (3) A disqualification under subsection (2) of this section shall be for a period determined by the director, department or appropriate advisory board by rule, not to exceed five years. If a person applies for reinstatement of a revoked license, registration, certificate or certification after the period of disqualification, the person must meet the disqualifications for initial issuance of license, registration, certificate or certification.

The Division proposes disqualifying Respondent from obtaining or renewing his limited

residential electrician license for five years pursuant to ORS 455.127(2)(a) and (3). Because the Division has established that Respondent’s application to renew his license should be denied pursuant to ORS 455.129(2)(q) and (3)(b) and ORS 670.280(3), and considering the nature of Respondent’s conduct, it is appropriate to disqualify him from obtaining or renewing his limited residential electrician license for five years.

RULING AND ORDER

The Division's Motion for Summary Determination is GRANTED. The hearing

scheduled for April 18, 2017 is canceled. I propose the Division issue the following order:

(1) Respondent Grigoriy Bogoslavets’s application to renew his limited residential electrician license #543LR is denied. (2) Respondent Grigoriy Bogoslavets is disqualified from obtaining or renewing a limited residential electrician license for a period of five years.

After that board meeting, the review committee found that a proposed change discussed during the code committee process regarding multiple feeders in one- or two-family dwellings was not included in the 2017 National Electrical Code. The 2017 OESC Review Committee finds that the 2017 OESC should include the attached language regarding multiple feeders in one- or two-family dwellings. Discussion: The committee recommends that the board adopt the proposed amendment in addition to the base code and amendments adopted at the March 23, 2017, meeting, and forward to the Administrator for adoption and subsequent rulemaking. The committee also requests that the board recommend adoption of the low-rise residential provisions of the code to the Residential and Manufactured Structures Board. OESC 225.30 Number of Supplies. A building or other structure that is served by a branch circuit or feeder on the load side of a service disconnecting means shall be supplied by only one feeder or branch circuit unless permitted in 225.30(A) through (E) (F). For the purpose of this section, a multiwire branch circuit shall be considered a single circuit.

Where a branch circuit or feeder originates in these additional buildings or other structures, only one feeder or branch circuit shall be permitted to supply power back to the original building or structure, unless permitted in 225.30(A) through (E) (F).

(F) One- or Two-Family Dwelling Unit(s). For a one- or two-family dwelling unit(s) with multiple feeders, it shall be permissible to install not more than six disconnects grouped at one location where the feeders enter the building, provided the feeder conductors originate at the same switchboard, panelboard, or overcurrent protection device location.

EWEB is asking Board for ruling to allow electric utilities to install UL-approved meterbase equipment between meter and customer-owned meterbase on overhead (OH) electric services. Based on utility service conductor ownership, EWEB already has right to install such devices on underground (UG) electric services. In both OH and UG cases, these devices typically use the neutral conductor as a ground connection. Transfer Switches and Surge Protection are available in UL-approved residential meter socket configurations. These devices are installed into existing meterbase clips and then the utility meter is re-installed into the “Meter socket” of the new device. Once everything is installed, the utility seals all devices to the original meterbase and responds to service problems; like any other utility service disconnect. There has been a question about licensure required to make the ground connection inside the meterbase for OH services. Given that EWEB owns UG service wire, if connection is made on line-side of meter EWEB owns the conductor and installation is covered under utility licensure. OH services are different, however EWEB believes this ground connection is similar to any approved use and attachment to the customer’s grounding system; including communication companies who sometimes use the meterbase as ground. Also, due to the metering integrity, reliability, safety, and service call-out potential, EWEB is concerned about the integrity of this connection and wishes to also make this connection on OH services. The meter is removed and re-installed by utility journey line technicians; along with the neutral/ground termination. These devices can be owned by the utility or customer; however due to the utility seal, meter space, and installation coordination, these devices are typically installed by the electric utility. Most of these devices need access to ground inside the meterbase, which is the neutral conductor is the most accessible and reliable grounding conductor inside the meterbase. For UG services, and in the case of EWEB, all the wires are owned by EWEB to the line-side of the meterbase termination. Of course, this is different for overhead (OH) configurations, whereby the utility wire ends at drip-loop just outside weatherhead. Alan Fraser P.E. Background: The Electrical and Elevator Board establishes continuing education requirements for all electrical licensees in order to ensure licensees possess up-to-date knowledge of the code and administrative requirements. They set standards for approval of courses and instructors in order to have a sufficient number and variety of continuing education courses available to licensees. The board’s continuing education committee has been meeting to evaluate courses and instructors on the board’s behalf. The committee met on April 11, 2017, to review continuing education course and instructor applications. The committee reviewed 176 applications from 31 organizations: 76 courses were recommended for approval. 9 courses were recommended for denial. 64 instructors were recommended for approval. 5 instructors were recommended for denial. 22 applications are pending waiting for additional information from the provider.

See attached summary for more information. In addition to the Oregon Rule and Law criteria, the committee is using the following when reviewing applications: NFPA 70E courses are eligible for a maximum of eight hours code-related credits. OSHA 10 courses are eligible for a maximum of four hours code-related credits. OSHA 30 courses are eligible for a maximum of sixteen hours code-related credits. First Aid/CPR courses are eligible for a maximum of four hours code-related credits (two

hours for each course).

Subject: Upgrade of lighting fixtures by limited maintenance specialty contractors

Question:

1) Are licensed limited maintenance specialty contractors (LMS) performing lighting retrofits

allowed to replace a magnetic ballast with an electronic ballast, or install a certified LED retrofit

within the existing shell, without additional licensure?

1)2) Is an LMS contractor authorized to perform work involving signs?

Answer:

1) LMS contractors can are allowed to upgrade lighting fixtures by changing from magnetic to

electronic type ballasts or installing a certified LED retrofit within the existing shell. They may

also perform maintenance within the shell of the fixture but may not permanently change fixtures

from incandescent to fluorescent. LMS contractors maycan not relocate any existing fixtures or

add new lighting fixtures. Maintenance of the fixture is restricted to inside the shell of the fixture

and is limited to ballasts, lamp-holders and equipment that is part of the lighting fixture.

1)2) An LMS contractor cannot perform maintenance, repair or replace ballasts or transformers

in an electric sign.

Analysis:

The issue of retrofitting or upgrading lighting fixtures has been raised frequently due to the incentives

offered by Utility companies and the energy savings generated by moving away from the old style

magnetic ballasts and fluorescent fixtures. ORS 479.630(12) grants authority to an LMS contractor to

change repair or replace existing ballasts with similar equipment.

Additional clarification is provided in OAR 918-282-0050(1)(b) allowing ballast change-out by

replacement with similar products and also maintenance inside the shell of the lighting fixture.
