The Contractor,mall provide sufficient, safe and proper facilities at all times for theinspection of the work by the authorized representatives of the Owner and shall, after receiving writtennotice to. that effect, proceed to remove from the grounds or buildings all materials condemned by them.whether worked or unworked, and to take down all portions of the work which, by like written notice,condemn as unsound or improper, or as in any way failing to conform to the drawings and specifications,and shall make good all work damaged or destroy-ed thereby. .

ARTICLE VI. The Contractor shall complete the several portions, and the whole of the work comprehended in this agreement by and at the time or times hereinafter stated, to-wit:

Subject to the conditions of Article 8 of the General ConditionsARTICLE VII. I Should the Contractor be delayed in the prosecution or completion of the work by the
act, neglect or default of the Owner, or of any other Contractor employed by the Owner upon the work. orby any damage caused by fire or other casualty for which the Contractor is not responsible, or by combinedaction of workmen in no wise caused by or resulting from default or collusion on the part of the Contractor,then the time herein fixed for the completion of the work shall he extended for a period equivalent to thetime lost by reason of any or all the causes aforesaid, which extended period shall be determined and fixedby the authorized representatives of the Owner, but no such allowance shall be made unless a claim therefore is presented in writing to the authorized representatives of the Owner within the time specified of theoccurrence of such delay.
ARTICLE VIII. It is hereby mutually agreed between the parties hereto that the sum to be paid bythe Owner to the Contractor for said work and material shall be

subject to additions and deductions as herein provided, and that such sum shall be paid by the Owner tothe Contractor in current funds and only upon certificates of the authorized representatives of the Owneras follows:
Ninety (90) percent of the actual cash value of all labor performed and material furnished in placeeach calendar month shall be paid on proper vouchers during the next succeeding calendar month, and thebalance upon the full completion of the job. Except as otherwise specified in the contract documents.
If, at any time, there shall be evidence of any claim for which, if established, the Owner of the saidpremises might become liable, and which is an obligation chargeable to the Contractor, the Owner shallhave the right to retain out of any payment then due or thereafter to become due an amount sufficient tocompletely indemnify it against such claim. Should there prove to be any such claim after all payments aremade, the Contractor shall refund to the Owner all monies that the latter may be compelled to pay in dis·charging any claim in consequence of the Contractor's default.
It is further stipulated and agreed that out of any retained amounts, the Owner may at his option pay,in whole or in part, any just claim against the Contractor for labor or material furnished bini by persons notparties hereto, where such labor or material has been expended in the carrying out of work covered by thisagreement.
ARTICLE IX. It is further mutually agreed between the parties hereto that no certificate given orpayment made under this contract, shall be conclusive evidence of the performa.'1ce of this contract, eitherwholly or in part, and that no payment shall be construed to be an acceptance of defective work orimproper materials.
ARTICLE X. The Owner, through its authorized representatives, has the power and duty to decideall questions as to the due performance of this contract.
The said parties, for themselves, their heirs, successors, executors, administrators and assigns, do herebyagree to the full performance of the covenants herein contained.

Salvage Material from Powell Hall
We have investigated the possibility of salvaging wanteditems from Powell Hall. After discussing this rmtterwith several individuals and adding our own concernsregarding salvage costs, schedule and potential Universityliability, we have arrived at the following recomrendation.
If adequate justification and funds can be identified,a rmster salvage list should be incorporated in thePowell Hall demolition documents.
The contractor, as part of his bid submittal, shouldidentify items to be removed and establish the removalcost.
The items would then be delivered and turned over toUniversity Property Accounting's off site locationfor future sales.
This approach assigns total responsibility to thedemolition contractor for schedule, liability,delivery and establishing the cost burden foreach i tern salvaged.
The purchaser of these items would pay the salvagecost burden plus other identified costs and inturnwould reinburse the Hospital Renewal Project for thesalvage costs.
I should add that my past experience with this type ofoperation, indicates that salvage atterrpts of this natureare usually a losing proposition. If you need furtherhelp, please let us know.

I was extremely heartened by your call of 12-11-80 regarding ourdesire to relocate the Powell Hall wishing well on our property. Yoursensitivity about my feelings for preserving a very important part ofthe history of the School of Nursing is very satisfying.
I entered the School of Nursing in the Fall of 1943. These werewar years and there was a great demand to process nurses quickly, butthe University of minnesota School of Nursing held to their principlesof a very sound basic science background with extraordinary clinicaltraining. It gave me a solid background for my present career inpharmaceutical research in an effort to find a drug to combat seniledementia in the geriatric population.
I lived at Powell Hall for 4 years and look back with tremendousfondness on the building. The wishing well had particular significancein my training years.
my husband supports me in a commitment to offer the School of Nursinga gift of $500.00 and to assume all financial responsibility for movingthe wishing well to our property.

An offer from a donor to the School of Nursing has been accepted andforwarded to Clint Hewitt for further action on the removal of thewishing well from the yard of Powell Hall and the subsequent rebuildingof the wishing well in the yard of the donor as a memorial.
A Form 14 has been submitted to Dick Hendrick requesting an estimate forremoval of one (or both if necessary) fireplace mantel in the Powell Hallcafeteria and the refinishing of the mantel to natural wood color. It willbe used in a donor recognition area in unit F.
An informal offer has been made by Northwestern Title and Marble to remove,cut and polish marble from Powell Hall Lavatories (new wing) to make 5004" x 4" blocks which will be used as donor incentives in the future. Theremoval, cutting and polishing would be done without cost to the Universityif Northwestern is permitted to salvage any pieces of Mankato Stone orother marble in the building at their cost. This has been discussed withClint Hewitt. Permission to take both the fireplace mantel and the marblefor the 4" x 4" blocks was negotiated several months age in Clint Hewitt'soffice.
If convenient the School of Nursing would like to salvage approximately 500Powell Hall bricks. One problem yet to be solved is a storage space forthe bricks. Any help with this matter would be appreciated.
It is my understanding that arrangements to salvage the cupola from PowellHall are being written into the demolition contract. Saving the cupolais no longer a priority with the School of Nursing and was recommended byanother department.
To the best of my knowledge the School of Nursing has no other salvage requestsor plans at this time. Thank you.

Concerning the dismantling and removal of items that we had listed in myJanuary 13 memo to you, we are confident that any and all items that wouldbe given to us for re-use in other buildings we will have removed fromPowell Hall within 5 working days after some advance notice that we canproceed to dismantle and remove.
The light fixtures would be removed by Physical Plant electricians andmoved by Housing Office staff. The furniture items would be moved bycontracted-for furniture movers or by Housing Office Staff. Dismantlingof stair railing wood tops would be by Pioneer Hall staff. Items thatwould need heavy equipment type of personnel or equipment to move themwould be done by Physical Plant personnel.

As I understood your offer, you would be willing to remove, cut and polish,enough marble to provide me with 500 4" X 4" blocks in exchange for yourremoving any or all other marble or Mankato stone in Powell Hall foryour own use. This includes marble or stone in the lavatories, janitorclosets, etc. As we discussed, you would not be required to remove or clearup any broken or unusable marble, but we would expect that you would notleave any dangerous or hazardous conditions in tlle removal of certainpieces.
I appreciate your generous offer to do this work for the School of Nursing.The work on the project will not be able to begin until funding of the newhospital project has been secured, the dates could possibly range from midMarch to late fall. Coordinators of the removal of the marble and thedemolition of the building will be handled by Mr. Paul Maupin, Health SciencesPlanning Office, Room 4104 Powell Hall. Dear Mr. zaworski:
We are hereby confinuing Mr. Tierney's letter of February17, 1981, regardin,g the removal of the marble and stonein the toilet and shower rooms in the above building. Wewill remove all salvageable marble and fittings and inreturn would furnish you with 500 pieces of 4" x 4" polishedmarble blocks from the Napoleon Grey which we are removing.
I do not forsee that there would be any hazardous conditionsafter the removal of the marble and stone.
We would like a week's notice prior to the time you wouldlike us to do the removal work.
The length of time would of course depend upon the number ofmen we will be able to put on the job. I would guess thatthis work could be accomplished in approximately two weeks time.
We are asking our insurance carrier to send you insurancecertificates to covery any liability while on the job.

~. Stair Railings - wooden top pieces only -- all curved pieceson all stairways in old parts of building and some straightpieces. Pioneer Hall staff will remove these when told todo so.
~4. Exterior light fixtures at front entrance - I understandthese have already left the premises, but if ever retrieved,we can still use them at Pioneer Hall.

This will confirm our phone conversation on Thursday, June 18concerning the rounded (bay-type) window unit on Fifth Floor inPowell Hall. WE DEFINITELY WANT THIS UNIT WITH THE WINDOW SEATand I hope that you are reserving this item for me. It is aunit with three standard windows and two narrow windows in between,there's a window seat built into the bottom of the frame work. Thewindows are located on Fifth Floor (north wall of the building) bythe elevators.
We'd like an opportunity to purchase the following items (dependingon prices):
The rounded window unit on Fourth Floor (identical to the one aboveand located directly below it).
v/ One or two sets of french doors leading to balconies behind elevatorson Fifth and Sixth F1~rs.
