GovernmentCode,section6253(c),requiresthat:
Eachagency,uponarequestforacopyofrecords,shall,within10daysfrom
receiptoftherequest,determinewhethertherequest,inwholeorinpart,seeks
copiesofdisclosablepublicrecordsinthepossessionoftheagencyandshallpromptlynotifythepersonmakingtherequestofthedeterminationandthe
reasonstherefor.
GovernmentCode,section6253(b)requiresthattheserecordsbeprovidedtomepromptlyand
specificallystatesthat:
Exceptwithrespecttopublicrecordsexemptfromdisclosurebyexpress
provisionsoflaw,eachstateorlocalagency,uponarequestforacopyof
recordsthatreasonablydescribesanidentifiablerecordorrecords,shallmake
therecordspromptlyavailabletoanypersonuponpaymentoffeescovering
directcostsofduplication,orastatutoryfeeifapplicable.Uponrequest,anexactcopyshallbeprovidedunlessimpracticabletodoso.
Additionally,IwouldliketodirectyourattentiontoGovernmentCode,section6253.1,which
provides:
Whenamemberofthepublicrequeststoobtainacopyofapublicrecord,
thepublicagency,inordertoassistthememberofthepublicmakeafocused
andeffectiverequestthatreasonablydescribesanidentifiablerecordorrecords,
shalldoallofthefollowing,totheextentreasonableunderthecircumstances:
1. Assistthememberofthepublictoidentifyrecordsandinformationthatareresponsivetotherequestortothepurposeoftherequest,if
ifstated.

2. Describetheinformationtechnologyandphysicallocationinwhichthetherecordsexist.
3. Providesuggestionsforovercominganypracticalbasisfordenyingaccesstotherecordsorinformationsought.
IfyouclaimthatanyoftherecordsIhaverequestedarenotdisclosable,pleaseprovidemewitha
writtenresponseincludingthelegaljustificationforyourdecision,asrequiredbyGovernmentCode
section6255(a)-(b),whichstates:
Theagencyshalljustifywithholdinganyrecordbydemonstratingthattherecord
inquestionisexemptunderexpressprovisionsofthischapterorthatonthe
factsoftheparticularcasethepublicinterestservedbynotdisclosingtherecord
clearlyoutweighsthepublicinterestservedbydisclosureoftherecord.
Aresponsetoawrittenrequestforinspectionorcopiesofpublicrecordsthatincludesadeterminationthattherequestisdenied,inwholeorinpart,shallbe
inwriting.
Finally,ifyouclaimthatanyoftherecordsrequestedcontainexemptinformation,yourdutywouldbe
toredactthoseexemptportionsandprovidetheremainderoftherecordforinspection.
Oncetherequestedrecordsarereadyforviewing,pleasenotifymesothatwecanarrangeatimefor
viewingwhichisconvenientforstaff.
Asprovidedforunderthelaw,IwillexpecttheCityresponsebynolaterthanJuly19,2012.IfIdonot
receivetheCityresponsewithintherequiredtimeframe,orifanyoftherequestedrecordsareunlawfullywithheld,Iwillhavelittlechoicebuttoconsiderallavailablelegalremediesavailableto
enforcemyrightsundertheCaliforniaPublicRecordsActandotheravailablelaws.
