I. INTRODUCTION

The Productive Rural Infrastructure Development Project in the Central Highlands (the Project) is funded by an ADB loan, and Ministry of Agriculture and Rural Development (MARD) is the project owner. This project will be implemented within 05 years (2014 – 2019) and taken place in the 05 provinces (Lam Dong, Dak Nong, Dak Lak, Gia Lai and Kon Tum) of the Central Highlands.

The long-term purpose of Project is contributing to hungry alleviation and poverty reduction programs of the Government through sustainable development of the society, ecology and environment at community levels by developing infrastructures for production, improving socio-economic conditions and living standards of people in the area.

The short-term objectives of the project are (i) to rehabilitate and upgrade deteriorated or damaged irrigation systems and rural infrastructures, which are serving for production in 05 provinces of Highlands; (ii) to strengthen management capacity and implementation of ODA projects; strengthen infrastructure management at community, province, district and commune levels to gradually improve living standards and conditions of the poor in the project area in the Central Highlands; and (iii) to build models, institutional policies on "water saving irrigation technology for strategic and economic valuable plants" and "management and exploitation of irrigation schemes sustainably with the participation of all economic sectors ".

One sub-project of the Project is “Repairing, upgrading productive rural infrastructure in Lac Xuan and Tu Tra communes, Don Duong district, Lam Dong province” that will be implemented in Lac Xuan and Tu Tra communes. Don Duong district, Lam Dong province. The objectives of this sub-project are to provide irrigation water for 127 ha of 3-crops vegetables, 30 ha of 2-crops vegetables (it is equivalent with 441 ha of cultivated land) and aquaculture and to upgrade 9.4km operational road and rural road around the productive area at Cong Doan and Tan Hien reservoirs.

The objectives and scope of this IEE are to (i) assess the existing environmental conditions along and in the vicinity of the subproject; (ii) identify potential environmental impacts from the proposed components; (iii) evaluate and determine the significance of the impacts; (iv) develop an environmental management plan (EMP) detailing mitigation measures, monitoring activities, reporting requirements, institutional responsibilities and cost estimates to address adverse environmental impacts; and (v) carry-out public consultations to documentary issues/concerns that stakeholders may have on the sub-project and to ensure that such concerns are addressed in the sub-project design and mitigation measures.

This Initial Environmental Examination (IEE) of the sub-project is prepared to meet the requirements of environmental safety of ADB and the environmental regulations of Government of Vietnam. Its structure includes 11 parts as following:

II. POLICY FRAMEWORK, LEGISLATION AND MANAGEMENT

2.1 ADB policy

The ADB’s Safeguard Policy Statement (SPS) 2009 governs the environmental and social safeguards of ADB's operations. The SPS 2009 emphasizes on environmental and social sustainability in progress of economic growth and poverty reduction in Asia and the Pacific. The SPS environment safeguards aims to:

i. Avoid adverse impacts of projects on the environment and affected people, where possible;

ii. Minimize/mitigate and/or compensate for adverse impacts on environment and affected people when avoidance is not possible; and

iii. Help borrowers/clients to strengthen their safeguard systems and develop the capacity to manage environmental and social risks.

Environmental Safeguard Requirements of the SPS outlines the requirements that borrowers/clients are required to meet when delivering environmental safeguards for projects supported by ADB. These requirements include assessing impacts, planning and managing impact mitigations, preparing environmental assessment reports, disclosing information and undertaking consultation, establishing a grievance redress mechanism (GRM), and monitoring and reporting.

Moreover, all subprojects under the loan 3032-VIE need to follow the specific guidance on environmental assessment as stated in the Environmental Assessment Review Framework (EARF) of the project, prepared by the project owner and approved by ADB. The subprojects under loan 3032-VIE only categorized as Category B or C will be included in the list of eligible sub-projects for possible funding under the proposed Project. It is anticipated that all eligible sub-projects will fall into Category B, whereby some adverse environmental impacts are expected, but of a lesser extent.

Subproject “Repairing, upgrading productive rural infrastructure in Lac Xuan and Tu Tra communes, Don Duong district, Lam Dong province” is selected based on the project’s EARF that may cause the insignificant environmental impacts to the environment and ranked as Category B. Therefore, an IEE needs to be prepared with an EMP enclosed.

2.2 Environmental regulations of Vietnam government

The project must also comply with the environmental regulations of Vietnam comprising of following items:

- Law on Environmental Protection adopted by the National Assembly of the Socialist Republic of Vietnam dated January 01, 2015. The law regulates general environmental protection requirements, policies and resources for protecting the environment;

- Law on Labor adopted by the National Assembly of the Socialist Republic of Vietnam dated June 18, 2012 that regulates general requirement on safety and occupational health;

- Decree No. 18/2015/ND-CP on April 01, 2015 of the Government that regulates on environmental protection planning, strategic environmental assessment, environmental impact assessment (EIA) and environmental protection plan (EPPs);

- Decree No. 38/2015/ND-CP on June 15, 2015 of the Government that stipulates on waste and disposal management;

- Decree No. 201/2013/ND-CP on November 27, 2013 of the Government that details the Law on water resources;

- Circular No. 27/2015/TT-BTNMT on May 29, 2015 of the Ministry of Natural Resources and Environment (MONRE) that guides details on strategic environmental assessment, environmental impact assessment and environmental management plans;

2. Components of the subproject

02 main components of the subproject:

(i) Irrigation component: Repairing and upgrading headwork of Tan Hien reservoir in Lac Xuan commune and Cong Doan reservoir in Tu Tra commune.

(ii) Road component: Upgrading about 9.309 km rural road surrounding productive area of the subproject in these 02 communes.

2.1. Irrigation component

1- Repairing, upgrading grade IV Tan Hien reservoir headwork:

a) Existing Tan Hien Reservoir Headwork : (i) Tan Hien reservoir was built in 2005 to supply irrigation water for 8 ha of

paddy and 4 ha of vegetables around the reservoir. The reservoir’s capacity was about 110.36x103 m3 with its water surface area by 4.5ha. However, the current irrigation demand is 78ha of 3-crop vegetables and 30ha of 2-crop vegetables while there is no other reservoir in the area. Therefore, it is needed to upgrade Tan Hien reservoir to increase its capacity. (ii) The earth dam’s upstream slope is reinforced by concrete slabs with a layer of filter sand/gravel. In general, the slope is rather good, although it has some cavities causing seepage process in the future. (iii) The toedrain was built by masonry and currently in damaged condition causing subsidence. (iv) Downstream slope of the dam is uneven and eroded; and the grass layer has been destroyed due to cattle grazing. (v) The dam top was made of soil and gravel with a lot of sagged positions. (vi) The flood spillway is reinforced by concrete; (vii) Downstream valve gate of 300mm diameter intake is damaged.

b) Intervention actions will be done by subproject

- Level IV headwork work includes:

(i) Upgrading reservoirs

It will raise the normal water level of the reservoir dam +0.53m from +1,019.57m to + 1,020.10 m and dredges 130x103 m3 of sediment in the reservoir bed to increase the capacity of the reservoir. A new weir at 2.43km in upstream of the reservoir will be built to supplement water of the reservoir. Water from the weir will be flown to the reservoir by a D300mm pipeline with a total length of 2.43 km.

(ii) Soil dam

A homogeneous soil dam has the designed dam crest elevation is +1,020.9 m, length is L = 245 m dam width is B = 5m (combined as traffic road), the dam height is H = 6.6 m. It builds a wave wall on the crest by M200 reinforced concrete, the wall crest elevation is equal the dam crest one is +1,021.60, the wall height is 70cm. The dam has a subsidence split in each 10m. The dam crest width is 5m combined as a road. The dam surface consists of two layers. The bed layer is 20cm thick gravel, the dam surface is made of a 20cm concrete layer. The dam also has a downstream drainage. It needs to level and plant grass from the dam crest to the drainage.

(iii) Flooding spillway

It reinforces and raises the overflow threshold 0.53m, extends width of the spillway from 2m to 3m by M200 concrete

(iv) Water Intake

Pressure underground culverts are made of D300mm steel pipe culverts, steel thickness is 8mm. The pipes are covered by M200 reinforced concrete. The culverts are open and close by two downstream valves. The culvert slope i = 0.005, body length L= 28m.

(v) Main canal

It builds a new 629.35 m canal

(vi) Water pipeline from the dam to the reservoir

From water intake of the dam towards the end of the pipe is 2430m long. The steel pipe has D300mm with 5mm thick.

(vii) Items on the pipeline

On the pipeline, it installs sediment/air discharge valves. In addition, along the pipeline there will be 4 water intake valves.

(viii) Dredge the reservoir bed

The subproject will dredge the reservoir bed to the designed elevation as 1,013m. When dredging to the reservoir banks, pay attention to slope coefficient, at least, it is 1.5. The dredged length is 558m.

2- Repairing and upgrading Cong Doan reservoir headwork:

a) Existing Cong Doan Reservoir Headwork

- Cong Doan reservoir was built by local people since 1978 including an earth dam and an earth flood discharge culvert. The reservoir cannot store water any more.

- Earth dam: The top is subsided and sagged. The upstream slope is not reinforced and it is significantly eroded with some negative slope (like a frog's jaw). The downstream slope is eroded unevenly. The dam crest is made of hill gravel and used as traffic road.

- Spillway: constructed on the cut foundation and not reinforced yet;

- Water intake: unavailable

b) Intervention actions will be done by subproject

- Level IV work includes:

(i) Upgrading reservoirs

It will raise the normal water level of the reservoir dam from +1,018m to +1,018.67m, dredge 108 x103m3 of sediment of the reservoir bed so that the reservoir can store 166,930m3 instead of its impossible current status,

(ii) Soil dam

It retains the old dam and fills the dam in its upstream from the foot up to designed altitude. The two- dam blocks (the new dam block and the old block is reused) with the designed dam crest altitude is +1,020.50 m. Width of the dam surface is B = 6m (combined as a road), the dam height H is 5.9 m and length L is 330m.

(iii) Flooding spillway

It's free spillway, as a thin reinforced concrete spillway M200, on the spillway, there is a bridge used to open/close bottom discharge valves. The bridge is made of reinforced concrete.

(iv) Water Intake

The culverts combine with spillway.

(v) Dredge the reservoir bed

It will dredge the reservoir bed to the designed altitude equal 1,014.5m, while dredging nearly the reservoir banks, pay attention the minimum roof coefficient m=2; dredged length is 293m.

2.2 Rural road component

a) Existing rural road around Tan Hien reservoir

- Roads around Tan Hien reservoir are earthen, 4,742.66 m long 3-5m wide without drainage. In the rainy season, these are divided by water flow from the mountain causing it slippery and muddy.

- The road connecting to productive area of Cong Doan reservoir in Tu Tra commune is 4,566.48 m long, 3-6m wide. The surface is eroded; the slope is not appropriate; there is no drainage ditch; it is muddy and difficult to travel in the rainy season.

b) Intervention actions will be done by subproject

Repair and upgrade 9,309.14 m of road to Class IV road (TCN210-92), including about 4,742.66 m around Tan Hien reservoir in Lac Xuan commune and 4,566.48 m around Cong Doan reservoir in Tu Tra commune.

Roads in the Cong Doan reservoir area:

The main road from the district road DH413 to the dam is 472.94m. Other roads are 4,093.54m long. The roadbed is about 5.0 m wide. The road surfaces are 3.5m wide. Cross slopes are about 2%. Sidewalks are not reinforced as 2x0.75m made of soil. their cross slopes are about 4%. The road surface consists of a 5cm thick sand layer. Its M250 concrete surface layer is 18cm thick. Sidewalks is a soil-compressed layer K95.

Roads in the Tan Hien reservoir area:

The main road from the district road DH 412 to the dam is 1,268.36 m. Other roads are 3,474.3m long. The roadbed is about 5.0m wide. The road surfaces are 3.5m wide. Cross slopes are about 2%. Sidewalks are not reinforced as 2x0.75m made of soil. their cross slopes are about 4%. The road surface consists of a 5cm thick sand layer. Its M250 concrete surface layer is 18cm thick. Sidewalks is a soil-compressed layer K95.

Quantity and size of drainage culverts

- Road around Cong Doan reservoir in Tu Tra commune: 04 new culverts to be installed, including (i) 01 culvert D100 at the milestone C48 of the 3rd branch of route 2 length 8m; (ii) 01 culverts D100 at the mile stone C52A of the 3rd branch of route 2 length 8m; (iii) 03 box culvert D60x80 between the milestones C15 and C27 of branch 1st of route 1 length 8m and at the milestone C22 of the 2nd branch of route 1;

- Road around Tan Hien reservoir in Lac Xuan commune: 02 new culverts to be installed, including (i) 01 culvert D80 at the milestone C0 of branch 1 length 8m; (ii) 02 culvert D60x80 between the milestone TD9 of branch 1 and TD4 of branch 2.

Quantity of bridges There is neither existing nor being built bridge.

Irrigation and drainage system

Irrigation system:

- Tan Hien reservoir was built in 2005 to provide irrigation water

for about 8 ha 2-crop paddy and 4ha of vegetables. Due to the

reservoir was newly built, most of its items are still operational.

structures, culverts, inlets and pumps installed by local people.

- Cong Doan reservoir was manually dammed by local people since 1978. At the reservoir, people use pumps to directly take water. Over the long-term use without regular maintenance, it cannot store water by now.

- Subproject outputs (irrigation components of both reservoirs): repairing and upgrading works such as reservoirs, dam, spillway, intake gate, control valve, etc and build new canal in Tan Hien reservoir. It is estimated that the Tan Hien reservoir will provide adequate irrigation water for around 78ha of 3-crop vegetables and 30ha of 2-crop vegetables. Cong Doan reservoir will supply sufficient irrigation for about 49ha of 3-crop vegetables.

Drainage system:

- Only Tan Hien reservoir has an open drainage system but it has not been maintained regularly while it’s been obstructed due to cattle’s visiting.

The project will build culverts, flooding spillways to discharge water from both reservoirs. Water is discharged through the drainage system in the two sides of the dams and along roads connected with the reservoirs. The drainages are made of stone, reinforced concrete with reinforced concrete plates at intersections with the existing soil roads to ensure stable drainage systems. The culverts also have drainage function. The road-cross drainage system is the pipes with diameters of D80mm and D100mm.

Site clearance1

According to the land acquisition completion report of this subproject, the SP will affect 32 APs in total, in which 08 APs will be permanently acquired 620 m2 of agricultural land (for constructing downstream irrigation canal of Tan Hien reservoir) and 24 APs will be temporarily acquired 1,770 m2 agricultural land (for installing pipeline). The acquired land area will be rather small when it only accounts for 0.8% - 2.5% of their total land. The acquired land is located at the border of household’s land to minimize the affected asset. Neither structure, nor plant is affected.

Traffic roads that intersect with subproject’s roads

Currently, the roads in the sub-project area mostly are soil roads so it is very polluted by dust in the dry season and muddy in the rainy season.

The subproject road in Lac Xuan commune connects with National Highway No. 27, No. 20 and district road DH 412. The subproject area is about 3.5km from the national highway 27 to the southeast, 15km from the national highway 20 to the southeast and the DT 412 is 1,42km to the south.

The subproject road in Tu Tra commune connects with National Highway No. 27, National Highway No. 20, district road DH. 413, inter-communal roads and inter-village roads. The subproject is 5.84km to the highway 27 in the east, 8.33km to Highway 20 in the Southeast

The main river/ streams/ reservoir in the subproject area.

The subproject area has some small basins as the ones of rivers in upstream with low terrain to create reservoirs. River/stream morphology is indistinct. streams only appear in the rainy season.

• River:

Da Nhim river runs along the south of highway 27. It originates from the northern of the district to the south then flows into Da Dang river. This is the district's largest river where water is abundant throughout the year and mainly supplies water to crops.

- Lac Xuan commune is 3.62km far away from Da Nhim river to the eastward.

- Tu Tra commune is 3.05km far away from Da Nhim river to the southward.

• Reservoir:

Beside 02 upgraded reservoirs of the subproject that are Tan Hien reservoir in Lac Xuan commune and Cong Doan reservoir in Tu Tra commune, there are also Da Nhim hydropower reservoir in the east and Proh, Da Ron, Proh, Ka Zam, Rlom, Ka Bang, Ma Danh reservoirs.

• Stream:

Along Da Nhim river and surrounding Tan Hien and Cong Doan reservoirs there are many unnamed small creeks/ streams

Number of hills and mountains

- Areas in the east of Lac Xuan and Tu Tra are characterized by hilly and mountainous terrain. The areas have potentials to develop agriculture and surrounded by high mountains, along the national road 27 and inter-commune roads, communes' main road, therefore agricultural activities also have advantages. The terrain in the areas also creates favorable locations to construct reservoirs and small irrigation works and Tan Hien and Cong Doan reservoirs are surrounded by hills

Construction methods

Upgrading the reservoirs

Flow diversion when upgrading the reservoirs: Two reservoirs that will be upgraded, repaired have relatively small basins. In the dry season, their discharge are only 2-3l/s, so the flow diversion for construction is negligible.

- Tan Hien reservoir: Flow will be diverted through the old culverts under the dam;

- Cong Doan reservoir: Before constructing spillway, flow will be diverted through the old pipe. After completing the spillway, flow will be diverted in to the spillway to construct other components.

Constructing the irrigation component

- Soil dam: The construction is mainly done by machines and combined with hand;

- Spillway: After removing a soft soil layer on surface, use excavators and trucks to transport soil to embank the dam downstream.

- Water intake: The construction is mainly done by machines and combined with manual;

Dredging the reservoirs: In the dry season, the reservoir beds are almost dry. So, it just needs to dig and divert flow from upstream through the old culverts under the dam to collect water and make the bed dry. Embanking the construction roads by soil taken at the reservoir bed. Dredge the reservoir bed to the designed elevation. When dredging to the reservoir shore, pay attention side slope coefficient. It must meet a minimum standard and avoid too steep to make easy landslide.

Constructing traffic road component:

The construction is mainly by machine to ensure the quality, but the construction should be combined with manual labor. Each road, it can arrange two construction groups. One from the beginning to the middle-road. Another is from the middle point to the end point. It is best if the construction is applied the section separate method that will not occupy much road surface and not cause traffic jams.

Material sources and disposal area.

Source of materials:

- Soil: use of dredged soil from Tan Hien and Cong Doan reservoirs to fill an embankment (see Annex 3 the agreement on borrow pit).

- Freestone, crushed stone and sand will be bought in Don Duong and surrounding area of the subproject within 15-20km far away.

- Cement, steel, formwork will be bought from Thanh My town.

- Asphalt will be purchased from Da Lat City;

- Electric Power: From the national grid. Besides, 03 standby generators will be also mobilized.

dispose construction wastes and dredged materials, including 5 locations on local people’s land and 5 managed by Lac Xuan and Tu Tra CPCs. All these disposal areas were accepted by the local people or authorities. The size of each disposal area is as bellow:

The excavated soil and materials from reservoirs and traffic roads will be utilized for constructing embankments. The redundancy (238,393.3 m3) will be dumped in 10 disposal areas in Lac Xuan and Tu Tra communes as mentioned above.

Such vehicles and equipment should be in good conditions and subjected to periodical verifications.

+ Manage water for irrigation: collect data of irrigating area, type of plants, water distribution plan, signing contract etc.,

+ Repair damages such as sinking and landslide, land erosion on irrigation works and roads, especially before and after rainy season.

− For regular maintenance

+ Repair and maintain dam slopes, canal slopes.

+ Dredging water intakes and outlets, canals, drains.

+ Remove animal caves and termites’ nest on dam slopes.

+ Repairing stone and concrete of dams, dam slopes, culverts.

Frequency: once/seven year or ad hoc when emergency occur. Operation and maintenance in case of emergency: carry out repair for broken and downgraded items. Check damages and propose technical method and estimate cost for necessary repairs, based on current regulation of State.

IV. DESCRIPTION OF EXISTING ENVIRONMENT

Results of survey and baseline environment data of the subproject area collected by the safeguard policy consultant (EPC) in April 2015 are summarized as following:

4.2 NATURAL ENVIRONMENTAL CONDITIONS

Air quality

The subproject is located in the mountainous area in which there are neither industrial nor mining activities. Local roads are low traffic density. Therefore, there is no sign of high dust concentration or problems related to environmental pollution of air quality.

Phuong Nam Center for Environmental Analysis and Measurements measured, collected and analyzed 4 samples of the air in the sub-project area on January 16, 2016. These 4 samples were 01 at Cong Doan reservoir, 01 at Tan Hien reservoir, 01 at the starting point of upgraded road in Lac Xuan commune and 01 sample in Tu Tra commune. 7 parameters including humidity, wind speed, suspended dust, SO2, NO2, CO, temperature of each sample was analyzed. Results of the analysis showed that the ambient air quality of the subproject was pretty good. All parameters are within limits of QCVN 05: 2013 / BNTMT (see Annex 4 for detailed analysis of air quality of the ambient environment).

Noise and vibration

The subproject is located in the mountainous area without industrial, mining activity and traffic density is low. According to the measurement results of noise and vibration by Phuong Nam Center of environmental analysis and measurements for 04 samples (02 in Lac Xuan commune and 02 in Tu Tra commune) on January 16, 2016, the noise level ranged from 50.3 - 63.8 dBA, lower than the threshold (70 dBA) per QCVN 26/2010 / BNTMT about noise. (See details in Annex 4).

Climate and natural disasters

The subproject area is influenced by the tropical monsoon and plateau tropical monsoon climate. The climate is divided into two distinct seasons:

- The rainy season is from May to November (accounting for approximately 80-90% of annual rainfall) with the rainfall from 1,280 mm – 1,827 mm.

- The dry season is from December to April (accounting for approximately 10% to 20% of annual rainfall).

Temperature:

� Average annual temperature: 21.850C.

� The highest temperature: 22.8 – 23.40C (April, May)

� The lowest temperature: 18.2 – 21.10C (December, January)

Air humidity:

� Humidity average /year: 81.7%

� The highest humidity month: 88 - 91% (July – September)

� The lowest humidity month: 73 - 78% (February, March)

Sunshine hours:

� Annual average number of sunshine hours is 2,330 hours and mostly in the dry season.

� The highest number of sunshine hours per month is 260 hours.

� The lowest number of sunshine hours per month is 132 hours.

Wind:

Wind in the area depends on season and has two types of wind, one directed Northeast and the other South-west.

� Average wind speed is 7.5 - 8m /s in Lac Duong;

� The maximum speed is 28 m/s;

Natural Disasters:

Main natural hazards in the Central Highlands and in Lam Dong province consist of (i) drought in the dry season and (ii) flood in the rainy season. (iii) There are also other risks that happened in history, such as landslides, cyclones, hail, heavy rain, hot and stuffy.

- Storms in 1994, 1999, 2000.

- Extreme heavy rains with high rainfall caused landslides to the mountainous area (for example, landslides occurred in Don Duong district in 2010 after a heavy rain).

- Drought: A prolonged drought in 2002 left negative impacts on Bao Loc, Bao Lam, Da Huoai, Da Teh, Cat Tien and a drought in a large extent in 2015 affected 217 reservoirs in Lam Dong province badly (including Cong Doan and Tan Hien reservoirs), causing water shortages for irrigation (Source: Hydrometeorology Center of Lam Dong)

Topography and soil

Per the subproject Investment report (SIR):

- The subproject area is dominated by plateaus and mountains. Beside mountainous area, the plain area locates along the main roads of the center of Lac Xuan and Tu Tra communes.

- Geology of subproject area includes: (i) the outermost layer is yellow,

dark brown humus containing plant remnants with 0.4m thick; (ii) the second layer is gray black, dark brown clay containing sand and grit; (iii) and the third layer is dark yellow, blue gray clay containing macadam, weathered grit and sand.

Surface water resource

- The main surface water resource in the subproject area is from Da Nhim river originating from the northern of Don Duong district and flows to the southern into Da Dang river. This is the district's largest river with abundant water throughout the year and it is the major irrigation water for the crops.

- The subproject area has some small basins that are actually upstream valley rivers with low and hollow terrain developed as reservoirs with unclear shape of a river/ stream. Streams only flow in the rainy season. Reservoirs nearby the subproject are as table below:

Surface water quality

The Phuong Nam Center took 02 samples of surface water at Cong Doan and Tan Hien reservoirs in December 2015 and analyzed 09 parameters of these. Analysis results showed that surface water quality in the subproject within the limits of QCVN 08: 2015 / BTNMT such as PH: 7.1 to 7.3; turbidity: 8.3 to 12.1(NTU); BOD5 9-17 (mg / l); COD: 14.6 to 24 (mg / l); TDS: 26-32 (mg / l); TSS: 12.3 to 19.8 (mg / l); Total Nitrogen: 1.2 to 1.5 (mg / l); Total P: 0.3 to 0.4 (mg / l); Coliform: 1400 - 3200 (MPN / 100ml). (See details analytical results in annex 4);

Underground water resource

- Regional groundwater reserve is low or medium, without pressure;

- Chemical compositions of water are super light, potassium-sodium carbonate, weak corrosive with alkaline indicator HCO3 of concrete;

- Underground water level varies in season. In the rainy season, the underground water level is 0.2 - 2.0m below the ground surface while in dry season it is 3.0 - 5.0m;

Underground water quality

Although there is no analyzed data of underground water quality, through surveying and interviewing local people, it showed that the groundwater has been used by local people for domestic activities. Per observation, groundwater has no sign of contamination.

Flooding - Flooding only occurs in cultivated area around the valleys or adjacent to streams which are often lower than residential areas and roads. Flood is prone when there is heavy rain with tropical storm from June to September annually;

- Previously, tropical storms did not directly affect Don Duong district but indirectly caused prolonged heavy rain such as the hurricanes in 1987, 1994, 1999 and 2000.

Terrestrial fauna and flora

Lac Xuan and Tu Tra are agricultural areas, therefore, flora in this area is characterized by crops such as tomatoes, cabbage, cauliflower, etc. While major fauna is cattle such as buffalo, cows, pigs, chickens, etc. In addition, the green coverage area is quite large. The subproject area also

has some natural fauna and flora of the tropical & subtropical. The subproject area is far from the nature reserve and does not have any species in the Red Book of Vietnam.

Aquatic fauna and flora

Aquatic fauna and flora of the subproject area are mostly common species present in Da Nhim river, its tributaries, small streams, Cong Doan, Tan Hien, Ka Zam, Da Ron reservoirs, as well as canal system of these reservoirs.

There are no specific data available about the aquatic flora and fauna of these water bodies. Through field visits, aquatic fauna species in rivers, streams, reservoirs, canals had been found including freshwater fishes, shrimp and others, while aquatic flora include algae and various other grass.

No specially protected aquatic fauna & flora species are listed in the Red Data Book of Vietnam.

Protected areas There is no ecological / protected area in the subproject region. There are 02 protected areas of biodiversity recorded but located far away from subproject: (i) Nui Chua National Park (in Ninh Thuan province) about 50km away from the center of Lac Xuan commune to the East and (ii) Natural Reserve Mao river (Binh Thuan province) about 17km away from the center of Tu Tra commune to the southwest.

4.3 ENVIRONMENTAL AND SOCIAL CONDITIONS

Unexploded ordnance (UXO)

Clearance of UXO was conducted by the Company No. 319 under Ministry of National Defence in November 2015.

Land use

The adjacent land of the subproject includes (i) agricultural and forestry land; (ii) non-agricultural land is distributed in the following communes:

- Lac Xuan commune: The total area is 10,243.5 hectares of natural land where; (i) agricultural land is 9,848.7 hectares (96.14%); (ii) non-agricultural land is 366.8 ha (3.58%) and; (iii) 28.0 hectares of unused land (0.28%).

- Tu Tra commune: The total area is 7,699.0 hectares of natural land where; (i) agricultural land is 6652.4 hectares (86.74%); (ii) non-agricultural land 551.4 ha (7.17%) and; (iii) unused land is 195.2 ha (6.09%).

Residential areas near the subproject

The rural / residential areas locate near the subproject area are:

- Tu Tra commune: Lac Thanh Hamlet, Lac Thạnh village, New Economy village, R'Lam village; Ma Danh village;

- Lac Xuan commune: Tan Hien village, B'Kan village, Don Duong afforestation yards;

Rural infrastructures

- There are approximately 25,480 ethnic people in Don Duong District in 2015 (4,246 households), accounting for 28% of the district population. The district has 12 ethnic groups, such as K'Ho, Churu, Chil and some minorities like Muong, Thai (migrants from the north), etc. distributing in 8 communes and towns with around 6 persons / household.

- EM in Lac Xuan commune (where the Tan Hien reservoir locates): 3,395 people (585 households) accounts for 36% of the commune population household size is 5.8 persons/ households (K'Ho, Churu, Chil, Cham, Chinese, etc.).

Cultural and natural heritages

In the subproject area, no cultural and natural heritage has been recorded.

Public health Each commune has one communal health center, which can diagnose and treat simple and most common diseases such as diarrhea, red eye, respiration and skin diseases.

Traffic and transportation

- In the subproject area, road network is the unique traffic system with very low traffic volume because it only serves local people’s travel;

- The major vehicles engaged in the traffic are bicycles and motorcycles;

- The region with the highest traffic density is at Highway No. 27, No. 20, district roads DH.412, DH.413.

V. ENVIRONMENTAL IMPACT SCREENING

5.1 Positive impacts

Implementing the subproject "Repairing, upgrading productive rural infrastructure in Lac Xuan and Tu Tra communes, Don Duong district, Lam Dong province” will bring positive impacts on environment and society as follows:

- Increase water surface and stabilization of reservoirs will create positive impacts on local climate, especially increasing humidity in dry season of the subproject area;

- It will ensure water to irrigate initiatively for 127 ha of 3-crop vegetables, 30 ha of 2-crop vegetables, especially in the dry season. Thus, the subproject will improve agricultural productivity as well as income of local people;

- It will also contribute to stabilizing groundwater resources around reservoirs; - The traffic from residential areas to production areas will be improved, hence

transportation of materials and fertilizers as well as agricultural products will be more convenient. In addition, improvement in transportation creates favorable conditions for mechanizing agricultural production, bringing scientific advances into production, intensive cultivation to increase crop yields. The sub-project also reduces cultivation and labor costs and improves income of local peoples in the subproject area.

- It contributes to early completion of criterion No.2 - on transport, criterion No.3 - on irrigation, criterion No.10 - on incomes, criterion No.11 - on poverty rate of the new rural criterion in construction plan of new rural areas, which have been approved and are deployed at the locality.

- The sub-project will also contribute to improving living conditions, livelihoods and environment in sub-project areas and contribute to reducing poverty.

5.2 Negative impacts

The sub-project could also create negative impacts, especially during construction phase, which need to be managed through appropriate mitigation measures. The negative impacts from the subproject could be summarized in the following table:

Permanent land acquisition: constructing downstream irrigation canal of Tan Hien reservoirs will submerge 620 m2 of land. This area is agricultural land, belonging to 08 households in Lac Xuan commune and share about 0.8 – 2% of their total holding land, the acquired land is mostly fence, which will not cause any impacts on cultivation activities of these household.

Temporary land acquisition: Temporary land acquisition of the sub-project is 1770 m2 for installing pipeline in Tan Hien reservoir This area is agricultural land, belonging to 24 households in Lac Xuan commune and occupy about 0.8 – 2.5% of their total holding land. The household have voluntarily agreed to donate their land for sub-project, the temporarily acquired land will be returned to its original status after construction.

Affected object(s): 32 HHs in commune of Lac Xuan, Don Duong district.

Affected level: Social impact due to land acquisition is minor due to i) acquired land area is fence; ii) not create any impacts on cultivation of these household; iii) those household agreed to donated their land and vi) many local HHs will get long-term benefits from the sub-project.

Description: The upgraded road of the subproject will be constructed on the existing road. Therefore, the construction will temporarily occupy the road. The operation of vehicles/ construction machinery in the narrow space of the upgraded road may cause (i) traffic accidents, especially involving the elderly, children and loose cattle and (ii) difficulties in transporting goods.

However, the upgraded road connecting to residential area and reservoirs (road connecting from district road DH 413 to the dam of Cong Doan reservoir and the road connecting district road DH412 to the dam of Tan Hien reservoir) is low traffic density. The left side of Tan Hien reservoir dam (garden and structure of village culture house), left side of Cong Doan dam (garden and house of teacher dormitory) near the road will be used to construct worker camps, material yards, etc. One sub-warehouse will be built at the dam upstream and near the culvert to store materials for constructing culvert and to gather vehicles/ construction machinery for embanking the dam. A sub-camp and a yard will also be built on the right side of downstream dam to construct right shoulder of the dam. Description: According to field surveys in 4/2015, the inter-commune roads include both concrete (intersection connecting with the National Highway no. 27) and earthen roads. Along the road has no water supply network, drainage pipe while the electrical lines are rather far from the roads. PPMU Lam Dong need to specify in the bidding document that contractor is bound to repair or compensate for any damages to public infrastructures that they may cause.

6.3 Capacity Building for EMP implementation

The relevant stakeholders need to ensure the EMP implementation as their responsibilities. All CPMU, Lam Dong PPMU, CSC and CC need to appoint officers/staffs to be in charge of environmental management. However, most of these officers/ staffs are also assigned for other works and they are not specialized in environmental management. Thus, to ensure EMP is implemented in compliance with sponsor policies and Vietnamese legislation, these officers/ staffs must be guided/ trained on EMP implementation capacity building. Training on EMP implementation must be held for different groups with different requirements.

- Lam Dong PPMU and CSCs: The staffs that are in charge of environment will be trained (at least once in the first 3 months of the project) on monitoring and preparing environmental reports.

- Construction contractor: Will be trained (immediately after contract signing) on implementing mitigation measures and preparing reports.

VII. IMPLEMENTATION RESPONSIBILITY AND REPORTING

7.1 Implementation responsibility

Agencies directly related to EMP implementation are Lam Dong PPMU, CSC and CC. The responsibilities of relevant stakeholders in EMP implementation are presented as table below:

Public consultation and information disclosure of the subproject should be implemented continuously from the design phase to the construction phase. It consists of collecting community ideas/as well as encouraging local people’s participation in preparing and implementing the sub-project’s EMP. IX. GRIEVANCE REDRESS MECHANISM

9.1 Purpose of the mechanism

During the deployment of the subproject, local people are informed about environmental protection activities such as EMP. Negative impacts on the environment may occur during the construction and operational phases. Any comments/ suggestions of local people will be solved quickly, transparently in compliance of laws, particularly for affected people by the sub-project. Complaint handling mechanism will be classified by level and responsibilities of involved parties.

9.2 Grievance redress mechanism

Per the environmental management frame, there are 03 steps to redress complaint as below:

Stage 1: If a person has any complaint, he/she can submit a complaint to the CPC-community monitoring board. CPC will work with CSC and CC to solve complaints.

Stage 2: If his/her complaint is not resolved, the complainant may submit an application to the Don Duong DPC to resolve the complaint.

Stage 3: If more than 15 days passed without response from Don Duong DPC, the complainant may submit a complaint to the Lam Dong PPC (through Lam Dong DONRE). Lam Dong PPC will require Don Duong DPC to solve the complaint. In case the complaint is still not resolved, Lam Dong PPC will require environmental police to investigate and requested stakeholders to resolve the complaint. See the mechanism in Figure 1 below:

X. CONCLUSION, COMMITMENT AND RECOMMENDATION

10.1 Conclusion

The results of environmental screening and environmental impact assessment show that the sub-project may cause some adverse environmental impacts, but that most of these impacts are site specific. The appropriate mitigation measures in EMP are proposed to manage the negative impacts and maximize the benefit of the subproject. The responsibilities of implementation and monitoring of the stakeholders have also been identified to ensure environmental compliance.

10.2 Commitment

Lam Dong PPMU of the sub-project “Repairing, upgrading productive rural infrastructure in Lac Xuan and Tu Tra communes, Don Duong district, Lam Dong province” commits to:

- Implement requirements of environmental safety as stated in IEE via information dissemination, integrating environmental requirements as stated in this IEE into bidding documents, construction contracts with contractors and the construction supervisor contracts with construction supervision consultants; mobilize human resources and monitor internally the IEE compliance;

- Report environmental safety implementation to DONRE and CPMU periodically as specified in the IEE;

- Compensate and take measures against environmental pollution if there are any problem during operation of the sub-project;

- Handle complaints if any.

10.3 Recommendations

Based on the IEE report, the PPMU of Lam Dong would recommend that:

- No further environmental assessment is needed because the impacts on environment is insignificant;

- Based on IEE, PRI CHP of Lam Dong would like to request functional authorities to give their approval of the IEE for “Repairing, upgrading productive rural infrastructure in Lac Xuan and Tu Tra communes, Don Duong district, Lam Dong province” sub-project, to create the basis for next implementation steps, ensuring the implementation progress, effectiveness and benefits of the project.

- Contractors must prepare a place to clean /wash tools /vehicles. Washing trucks /vehicles next to the water bodies, existing rivers, streams, Cong Doan and Tan Hien irrigation system as well as other surface water bodies nearby will not be permitted;

- Locations of 03 worker camps need to be apart from the left side of Cong Doan reservoir and the right side of Tan Hien reservoir to avoid water contaminations from domestic waste;

- Cover material storage areas if it rains. Temporary storage of construction and domestic waste on the sites should not last more than 24 hours.

3 Noise/ vibration

To ensure the noise/ vibration must follow

- Construction machinery and equipment need to meet the standards related to noise and vibration as regulated by the Government. Contractors need to submit official documentation proving that all construction vehicles, equipment, and machinery are checked and meet current Vietnam standards concerning noise and vibration generated;

- Ensure that all construction vehicles and equipment are well maintained. Turn off machinery and/or equipment when possible to avoid continuous noise and vibration from disturbing workers;

- All noise and vibration generating activities shall be avoided during resting time of local people (12-1pm and 8pm to 6am) along the upgraded roads, new canal and reservoirs in Lac Xuan, Tu Tra communes;

- Provide ears’ protective equipment for workers working in high noise conditions generated by machinery and/or equipment, and allow for reasonable time-off from work when they are exposed to excessively long periods to noise and vibrations, as regulated in Decision 3733/2002 of Ministry of Heath

- Detailed construction schedule needs to be publicly announced by the contractor to local people so that they can arrange their activities and stay away from working sites and noise and vibrations.

Air pollution

It ensures air pollution complies with QCVN:05-2013/BTNMT

areas such as Lac Thanh Hamlet, Lac Thạnh village, New Economy village, R'Lam village; Ma Danh village in Tu Tra commune; Tan Hien village, B'Kan village in Lac Xuan commune. Watering activities should be carried out at least once/ day in rainy season (in non-rainy days) and twice/day during dry season in the working areas;

- Equipment and machinery must be licenced and periodically maintained to ensure the exhaust within allowable limits. Specifically, transporting vehicles need to meet the standards related of exhaust emissions as regulated by Government and according to Decision 249/2005 of the Prime Minister about emission of transportation vehicles in the territory;

- Equipment and machines will not be allowed to move outside of construction sites to ensure control of emission sources;

- Material or soil are falling from on the paved road and public road shall be cleaned immediately;

- All material/waste storages should be away from households and sensitive areas.

5 Soil contamination

To minimize soil contamination

- Covering material, chemicals, wastes storage areas to ensure that they could not fall into agricultural land in the subproject areas;

- Discarded lubricants and chemicals must be kept in dry areas or covered if raining;

- Toxic wastes, if any, need to be collected, transported and treated according to Circular No. 36.2015/BTNMT of MONRE;

- Regularly collecting solid wastes and transporting them to local disposal areas agreed with 5 households and CPCs of Lac Xuan and Tu Tra;

- Providing dustbins and mobile septic tanks in all construction sites and worker camps;

- Wastewater from worker camps needs to be collected and treated before being discarded into the environment.

Unsafe conditions of travelling and business during the road construction (traffic safety)

To ensure traffic safety and minimize disturbances to local people

- Installing traffic signs at construction sites to regulate and minimize of vehicles speed or installing construction warning signs, especially at the roads’ intersections;

- Installing lamps at night at construction sites;

- Informing communities about construction schedule through informal public consultation or at any meetings with local people and display related information on notice boards of Lac Xuan, Tu Tra communes;

- Construction activities need to be done by section sequences to minimize temporary occupation of areas along the upgraded roads

- Training for drivers of the sub-project as well as workers in safety rules and warning people passing nearby the sites

- Assigning at least 1 worker to monitor the inflow and outflow of vehicles to and from construction sites during peak hours to assure traffic safety.

9 Impact by solid wastes

To minimize impacts of solid wastes on environment.

- Construction wastes such as soil, stone or debris should be regularly removed to 10 disposal sites in Lac Xuan and Tu Tra with distance about 2km;

- At the public consultation in April 2015, local people suggested being used disposal residual soil. However, an agreement of each household with contractor and local authorities must be done before people can take soil from construction sites.

- Equip dustbins and mobile septic tanks to work-sites for waste collection and treatment; (it is proposed that there will be 06 dustbins and 03 mobile septic tanks provided at each camp and construction site);

- Construction contractors need to sign contract to weekly collect solid waste from 03 worker camps with a local solid waste collection agency. The agency will dispose the waste at disposal sites in Lac Xuan and Tu Tra

- Disposal of solid wastes into reservoirs, canals, stream, other water sources as well as in agricultural field and public areas shall be prohibited;

- Burning of construction and domestic wastes shall be prohibited;

10 Impacts on existing infrastructure

- Load of trucks should not exceed local bridges/roads’ design load (weight of loaded truck utilized to be lower than 5 or 10 tons depending on the designed load of the bridge /road),

- After construction completion, all public facilities must be checked to ensure their functions have not been affected by sub-project activities; if any damage has been identified besides normal wear and tear, contractor will be responsible for repairing the damaged structures to their original

- Temporary residence must be registered with local authorities for workers living in the 03 camps;

- Contractor needs to regulate camp sanitation system;

- Carrying out a program of HIV/AIDS and Sexually Transmitted Infections prevention. All workers should attend the training organized by the Project

- Communicating and raising awareness of the construction workers to maintain disciplines, habits and customs and create good relationships with local people, reduce social evils;

- Encouraging contractors to cook for all workers at each site to ensure hygiene and adequate food safety;

- Spray insecticides in the 03 workers’ camps;

- Train and guide labor safety measures and infection disease prevention for workers;

- A first aid kit will be provided at each construction site to ensure that patients can receive first aid timely before transporting them to the medical station/ hospital. Collaborate with commune clinic center to receive additional support;

- Installing power network at site in accordance with official safety regulations to ensure that the power lines and outlets are located at dry and safe places;

- Construct temporary drainage ditches to drain water from sites, prevent any possible water logging;

To minimize environmental impacts caused by mining raw materials for construction

- Embanked soil is exploited from beds of Tan Hien and Cong Doan reservoirs under Lam Dong Irrigation exploration and management company;

- Sand is purchased at Don Duong mine. Crushed stone is bought a licensed rock mine in Duc Trong district (40-50km). Environmental impacts from the exploitation were mitigated by the mine owner and monitored by competent agency of the locality.

- Materials will be transported continuously to construction sites.

- The materials are easy to evaporate and generate dusts, so it needs to cover carefully.

Impact on existing irrigation systems

Avoiding and minimizing situation of lacking water for irrigation

- Plan of construction the irrigation system must be considered to water availability for agriculture fields. Those plans need to be agreed with DARDs (Lam Dong and Don Duong) and Lac Xuan and Tu Tra communes and announced to local residents;

- Construction contractor needs to apply appropriate measures that ensure water enough for fields downstream.

- Construction need to be implemented in subsequent sections to minimize impacts

- Contractor must compensate for damages due to shortage of irrigation if this is from the construction;

Impact on surrounding agricultural land and cultivation activities

Avoiding, minimizing impacts on surrounding agricultural activities

- The construction plans need to be reviewed and agreed among Lam Dong DARD, Don Duong district and communes (Lac Xuan, Tu Tra) and displayed on notice boards of such communes;

- For road component: Contractor may arrange two contruction group, One contructs from the beginning point to middle point of the route. Another is from the middle point to the end. Apply the mat rolling method, section by section to minimize traffic jams.

during construction period, the traffic distribution method should be established and having traffic guides to local people who traveling on the routes nearby.

- For Cong Doan, Tan Hien reservoirs and headworks: construction plans need to be such that water supply to irrigated fields will not be discontinued.

Flow diversion when upgrading the reservoirs: Two reservoirs tol be upgraded, repaired have relatively small basins. In the dry season, their flow volumes are only 2-3l/s, so the flow diversion for construction is negligible. In Tan Hien reservoir, flow will be diverted through the old culverts under dam. For Cong Doan reservoir, before constructing spillway in combination with bottom discharged flow is diverted through the old culverts. After completing the construction, flow will be diverted through the spillway to construct other components.

- Any negative impact to irrigated fields (mainly insufficient or interrupted water supply causing losses to crops) occurring during construction period need to be adequately compensated;

16 Cultural objects or graves found

Avoiding and minimizing impacts on cultural objects or graves

- If any cultural objects and/or graves are found during construction phase, the construction activities at those places need to be temporarily stopped and immediately informed local authorities to deal with the issue;

- Appropriate assistances need to be implemented after consultation with households suffering from any impact on their graves, and the construction contractor should provide necessary support to these HHs to resettle graves elsewhere or to communes for cultural objects found;

17 Environmental recovery activities

To ensure damaged environment and related infrastructures will be recovered after completing construction

- During construction, any damage to local infrastructure will be repaired and recovered to its original condition or compensated by construction contractor if they cannot be recovered as mentioned above;

- The environmental issues emerged during recovery activities such as noise, dust, gases, solid waste, hazardous waste, water pollution etc. will be handled with similar measures indicated in related section above;

- Re-planting cuter plants/trees after completing construction activities;

- Repairing damaged infrastructures as soon as possible;
