Dy. CME / Plant / ICF, for and on behalf of the President of India, invites sealed tenders from eligible tenderers for the said work up to 14.30 hours on 05.10.2017, which will be opened at 15.00 hours on the same day i.e. 05.10.2017. If the date of tender opening is declared as a holiday, tender will be opened at the same time on the next full working day. 3. A sum of ` 2,76,000/- (Rupees Two Lakh and Seventy-Six Thousand only) towards Earnest Money Deposit (EMD) is to be deposited in cash with Assistant Chief Cashier of ICF or in the form of FDR (Fixed Deposit Receipt) with auto renewal facility / Banker’s cheque/Demand Drafts in favour of FA & CAO, ICF, executed by State Bank of India or any of the Nationalized Banks or by a Scheduled Bank. TENDER INTRODUCTION

Sub:

Hiring the services of Material Handling Equipment (MHE) such as diesel

operated forklift trucks (FLT) and road mobile crane (RMC) for Shell Division

through outside agencies for a period of one year.

Ref: Open Tender No.: M/M&P/WC/04/03/FLT HIRE/17-18

1. It is proposed to carry out “Hiring the services of Material Handling Equipment (MHE)

such as diesel operated forklift trucks and road mobile crane for Shell Division

through outside agencies for a period of one year”.

2. Dy. CME / Plant / ICF, for and on behalf of the President of India, invites sealed tenders

from eligible tenderers for the said work up to 14.30 hours on 05.10.2017, which will be

opened at 15.00 hours on the same day i.e. 05.10.2017. If the date of tender opening is

declared as a holiday, tender will be opened at the same time on the next full working day.

3. A sum of ̀ 2,76,000/- (Rupees Two Lakh and Seventy-Six Thousand only) towards Earnest

Money Deposit (EMD) is to be deposited in cash with Assistant Chief Cashier of ICF or in

the form of FDR (Fixed Deposit Receipt) with auto renewal facility / Banker’s cheque/Demand Drafts in favour of FA & CAO, ICF, executed by State Bank of India or

any of the Nationalized Banks or by a Scheduled Bank. This EMD which is to be submitted

along with the bid, shall be given by the Tenderer against any loss in the event of the

successful tenderer failing to undertake the contract or to furnish the required Security

Deposit within the appropriate time after the acceptance of the tender. Any other form of EMD viz., Cheques or Bank Guarantees will be summarily rejected.

SPECIAL CONDITIONS OF CONTRACT

1. TENDER NO:

1.1. M/M&P/WC/04/03/FLT HIRE/17-18

2. NAME OF THE WORK:

2.1. Hiring the services of Material Handling Equipment (MHE) such as diesel

operated forklift trucks and road mobile crane for Shell Division through

outside agencies for a period of one year.

3. BRIEF DESCRIPTION OF WORK:

3.1. Hiring the services of

13 Nos. of 3000 kg capacity diesel operated forklift trucks with driver,

One No. 12000 kg capacity Road mobile crane (Pick and Carry Type) with driver and

28 Nos. of male helpers to work along with the above vehicles for material handling works in Shell Division through outside agencies for a period of one year as per the schedule given by ICF and as per the details of the

works to be carried out given in the scope of work in Para 9.1 to 9.11.

5. For quoting the rates the prescribed Schedule of Rates Format at Annexure–B shall only

be used by the tenderer without fail.

6. The Validity of the offer shall be minimum 90 days (Ninety days) from the date of

opening of the Tender.

7. The checklist at Annexure – F shall be ticked and submitted along with the quotation as

a proof of coverage of all aspects in the quotation.

8. IT IS EMPHASIZED THAT THE TENDERER SHALL GIVE PARA-WISE COMMENTS FOR ALL THE FOLLOWING PARAGRAPHS, IN THE SAME SEQUENCE TO

FACILITATE EARLY FINALISATION OF TENDER.

9. SCOPE OF WORK FOR THE SUCCESSFUL TENDERER:

9.1. The successful tenderer shall provide 13 Nos. of 3000 kg capacity Diesel operated

forklift trucks with driver every day on daily basis to carry out the material

handling works as directed by the Senior Section Engineer in-charge nominated

for the subject work by Engineer (Office in-charge) of the work area.

9.2. The successful tenderer shall provide One No. of 12000 kg capacity diesel

operated Road mobile crane (Pick and Carry Type) with driver every day on daily

basis to carry out the material handling works as directed by Senior Section

Engineer in-charge nominated for the subject work by Engineer (Office in-charge)

of the work area.

9.3. The successful tenderer shall provide 28 Nos. of Male Helpers (i.e. two male

helpers per vehicle per day) every day on daily basis to work with the material

handling equipment as directed by the Senior Section Engineer in-charge

nominated for the subject work by Engineer (Office in-charge) of the work area.

9.4. These material handling equipment provided by the contractor for the subject

work shall be in good condition and shall not be more than five years old as on

the date of opening of the tender.

9.5. These material handling equipment shall have valid safety certification by the

competent authority as per Rule No. 55 A, “Lifting machines, chains, ropes and

lifting tackles” of Tamil Nadu Factories Rules, 1950.

9.6. The drivers of these material handling equipment shall possess valid Light Motor

Vehicle driving license issued by the Regional Transport Authority, Government

of Tamil Nadu.

9.7. As per Rule 61-K of Tamil Nadu Factories Rules, 1950, the drivers of these

material handling equipment shall not be colour blind and should have passed

the eye examination by a qualified ophthalmologist.

9.8. The drivers of the material handling equipment and the helpers engaged by the

contractor for the subject work shall be below 50 years of age and medically and

physically fit for work.

9.9. Fuel and consumables required for the subject work will be under the scope of

successful tenderers.

9.10. Successful tenderer’s vehicles will not be permitted to be parked inside the factory

premises. Hence, it will be the responsibility of the successful tenderer to take

out the vehicles and after working hours and bring them back next day.

10. SCOPE OF ICF:

10.1. All essential items such as Electricity, Water and Air required for the work will be

supplied by ICF at free of cost.

11. WORKING HOURS:

11.1. 08.30 Hours to 17.30 Hours (One hour lunch break from 12.00 hours to 13.00

hours)

12. TENDERER MUST VISIT THE SITE, TAKE NOTE OF THE SITE CONDITIONS AND ANALYSE

THE CONSTRAINTS BEFORE SUBMITTING THE TENDER. THE WORK SHOULD BE CARRIED OUT IN STRICT ADHERENCE TO THE SCHEDULE AND SHOULD NOT IN ANY WAY DISTURB THE NORMAL PRODUCTION PROCESS OF THE FACTORY.

13. FOLLOWING DETAILS SHALL BE FURNISHED (IRRESPECTIVE OF THE MONETARY

VALUE):

13.1. List of Personnel, Organization available on hand and proposed to be engaged for

the subject work.

13.2. List of Plant & Machinery available on hand (own) and proposed to be inducted

(own and hired to be given separately) for the subject work.

13.3. List of works completed in the last three financial years giving description of work,

organization for whom executed, approximate values of contract at the time of award, date of award, and date of scheduled completion of work. Date of actual

start, actual completion and final value of contract etc., should also be given in a

separate sheet in the format given below.

Note:

In case of items 13.3 and 13.4 above, separate documents / certificates from the Organizations with whom they worked / are working should be enclosed. All the certificates, agreements etc. should be got attested.

Certificates from private individuals for whom such works are executed / being executed shall not be accepted.

14. OTHER IMPORTANT CONDITIONS:

14.1. The Forklift Trucks and Road mobile crane engaged by the successful tender for

the subject work during the currency of the contract shall have valid Safety Certifications issued by the Competent Authorities authorised by the Inspector of

Factories, Tamil Nadu and the competency certificate issued by the Inspector of

Factories, Tamil Nadu should be furnished along with the Safety certification.

The copy of the certificates shall be furnished when obtaining work permits,

failing which permits will not be issued for the vehicles.

14.2. In cases of, Forklift Trucks and Road mobile crane engaged by the successful

tender for the subject work during the currency of the contract registered with

the Regional Transport Authority, Tamil Nadu, then the Copy of the Registration

Certificate and the valid Certificate of Fitness issued by the Regional Transport

Authority, Tamil Nadu should be submitted. The copies of the certificates shall be furnished when obtaining work permits, failing which permits will not be

issued for the vehicles

14.3. The drivers of the Forklift Trucks and Road mobile crane engaged by the

successful tender for the subject work during the currency of the contract shall

possess valid Light Motor Vehicle driving license issued by the Regional Transport

Authority, Government of Tamil Nadu. The copy of the driving license shall be

furnished when obtaining work permits, failing which permits will not be issued to the drivers.

14.4. The drivers nominated for the Forklift Trucks and Road mobile crane engaged by

the successful tender for the subject work shall be having good eyesight as

required by the rules and regulations covered under the Factories Act. The copy

of the certificate from qualified ophthalmologist shall be furnished when

obtaining work permits, failing which permits will not be issued for them.

14.5. The Forklift trucks and Road mobile crane engaged by the successful tender shall have valid emission under control certificates issued as per TNPCB norms.

14.6. The drivers of Forklift trucks and road mobile crane shall be below 50 years of

age and medically and physically fit for work.

14.7. The successful tenderer shall ensure the Helpers engaged by them are in good

health without any physical disabilities and capable of doing the works without

any problem.

14.8. On being awarded with the work and when working with ICF, the successful

tenderer shall strictly follow all Rules and Regulations including Factories Act,

Labour Rules, Minimum Wages Act, Safety Regulation, Tamil Nadu Pollution Control Board regulations, etc., which are in force.

14.9. The successful tenderer shall ensure the drivers nominated for the Forklift Trucks

and Road mobile crane and helpers engaged for the subject work follow discipline

during their working hours and shall not under in the influence of alcohol or any

other drugs.

14.10. The successful tenderer shall take all precautionary measures in order to ensure

the protection of his own personnel moving about or working on the railway premises, and shall follow the rules and regulations of the Railway.

14.11. The successful tenderers shall provide adequate insurance coverage (i.e.

employees compensation insurance) to their labour and equipment.

14.12. For the labour engaged, the successful tenderer shall provide a photo identity

card, and also shall provide all the requisite Personal Protective Equipment and

the stipulated minimum wages applicable for the work.

14.13. The successful tenderer shall be responsible to take necessary precautionary

measures in order to ensure the safety against injury, etc., of his personnel when working at the Railway premises and should confirm to the rules and regulations

of the Railway.

14.14. The successful tenderer shall see that no unauthorised person works for him

inside ICF premises.

14.15. The successful tenderer shall be responsible for the discipline of the men &

women engaged by him/her inside the ICF area and ensure that the labourers

employed by him are confined to their places of working and shall not go around

the workshop.

14.16. The successful tenderer shall ensure that the labour employed by him/her inside

the factory comply with all instructions given by the security staff on duty.

14.17. The successful tenderer shall maintain close co-ordination with the Senior Section Engineer in-charge of the work nominated by the Engineer (Office in-

charge) so as to ensure the work is in progress according to the contract schedule,

failing which, the administration shall take necessary action as per general

conditions of contract.

14.18. All the materials i.e. PPE’s (such as nose mask, gloves, safety shoes, helmets etc.),

required for the works to be carried out vide Para 9 and its sub-paras of SCC,

shall be arranged and maintained by the successful tenderer.

14.19. The helpers and drivers for the Forklift Trucks and Road mobile crane engaged by the successful tenderer for the subject work shall wear company uniform with

Logo.

14.20. Tenderer shall employ efficient and competent supervisors to supervise the

works.

15. CONTRACT PERIOD:

15.1. Validity of Contract: One year from the date of LOA (300 working days)

16. MAINTAINING OF LOG BOOK AND ATTENDANCE:

16.1. The Driver nominated for the Forklift Trucks and Road mobile crane engaged by

the successful tender for the subject work shall maintain logbook on daily basis on all days and the log book is to be endorsed by Senior Section Engineer in-

charge for the subject work nominated by Engineer (Office in-charge) duly

recording the time of arrival and the time of leaving the work. These log book shall

be presented for verification whenever the same are called for verification by

Labour Enforcement officer or by any official. The format for Log book will be given to the successful tenderer at the time of awarding of contract.

16.2. The drivers nominated for the Forklift Trucks and Road mobile crane and helpers

engaged by the successful tender for the subject work has to report to the Senior

Section Engineer in-charge nominated for the subject work by Engineer (Office

in-charge) on daily basis and their attendance will be recorded in an Attendance

Register maintained by Senior Section Engineer in-charge nominated by Engineer

(Office in-charge) for the subject work. This attendance register shall be presented for verification whenever the same are called for verification by Labour

Enforcement officer or by any official.

17. MEASUREMENT, INSPECTION AND CERTIFICATION OF WORK:

17.1. The Senior Section Engineer in-charge, nominated by Engineer (Office in-charge)

for the subject work shall record, (based on the log books and attendance

registers maintained vide Clause 16.1 and 16.2 and the total number of vehicles

with drivers and helpers engaged daily for the subject work), in the measurement book and the successful tenderer or his representative should sign monthly in

the Measurement Book to acknowledge the above measurements.

17.2. It shall be the duty of the successful tenderer to get the bills certified by the Senior

Section Engineer in-charge for the work

18. PENALTY CLAUSE:

18.1. In case the breakdown of Forklift Trucks and Road mobile crane engaged by the

successful tender for the subject work during the course of movement, alternative

vehicle should be arranged immediately (Within in one hour from the time of

breakdown). Otherwise, if ICF administration spends on an alternative transport,

the expenditure will be debited from the successful tenderer’s bill amount.

18.2. If the driver or helper engaged by the successful tender daily for the subject work found to be in inebriated condition during the hours of work or under the

influence of alcohol or any other drugs, he will be sent for medical examination

at ICF Hospital and if found guilty, a sum of `10,000/- (Rupees Ten Thousand

only) will be imposed on the successful tenderer for every such incident and the

driver or helper found positive for drunk while duty will not be allowed to perform

duties in ICF thereafter during the remaining period of currency of the contract.

18.3. In case of any accident or mishap resulting in loss damage to property or life, the

sole responsibility for any legal or financial implication shall rest with the

successful tenderer.

18.4. If the successful tenderer fails to arrange for the full daily requirement of Forklift Trucks for the subject work on any working day (i.e., if the successful tenderer

arranges less than the minimum requirement of 13 Nos. Forklift Trucks with

Driver), such case will be dealt severely and a sum of ` 2,000/- (Rupees Two

Thousand only), per day per vehicle in short, will imposed as penalty on the

successful tenderer on each case. It is the responsibility of the successful tenderer

to provide a stand by Forklift Truck with driver in place of the regular Forklift

Truck, whenever it is taken for attending any other maintenance works.

18.5. If the successful tenderer fails to arrange for the Road mobile crane with driver

for the subject work on any working day, such case will be dealt severely and a sum of ` 3,000/- (Rupees Three Thousand only) per day will imposed as penalty

on the successful tenderer on each case. It is the responsibility of the successful tenderer to provide a stand by Road mobile crane with driver in place of the

regular Road mobile crane, whenever it is taken for attending any other

maintenance works.

18.6. If the successful tenderer fails to engage the minimum requirement of Helpers (

i.e. 28 Helpers per day), a fine of ` 500/- (Rupees Five Hundred only) per day per

helper in short than the minimum requirement will be levied.

18.7. Exemption of penalty can be considered on following cases

18.7.1. On special cases such as natural calamity, bad weather or on any other

valid grounds etc. the successful tenderer shall claim for exemption from

paying penalty for the above reasons and Senior Section Engineer in-charge of the work shall certify it & get the approval of the Engineer (officer

in-charge).

18.7.2. In the above case, the decision of Dy. CME/Plant is final.

19. EARNEST MONEY DEPOSIT (EMD:

19.1. A sum of ` 2,76,000/- (Rupees Two Lakh and Seventy-Six Thousand only)

towards EMD is to be deposited in cash with Assistant Chief Cashier of ICF or in

the form of FDR (Fixed Deposit Receipt) with auto renewal facility / Banker’s

cheque/Demand Draft in favour of FA & CAO, ICF, executed by State Bank of

India or any of the Nationalized Banks or by a Scheduled Bank.

19.2. Any other form of EMD viz., Cheques or Bank Guarantees etc. will be summarily

rejected along with the tender.

19.3. No interest will be payable upon EMD, SD or on any amount payable to the

successful tenderer under the contract.

19.4. Tender without requisite EMD will be summarily rejected.

19.5. No interest will be payable upon EMD, SD or on any amount payable to the

successful tenderer under the contract.

19.6. Tender without requisite EMD will be summarily rejected. However, for Service

contracts, MSEs registered with District Industries Centers, Khadi & Village Industries commission, Khadi & Village Industries Board, Coir Board, National

small Industries Corporation, Directorate of handicraft & Handlooms, Any other

body specified by Ministry of MSME, shall be exempted from payment of

minimum EMD detailed above.

20. SECURITY DEPOSIT:

20.1. The Security Deposit amount will be 5% of the total contract value. The rate of

recovery shall be at the rate of 10% of the bill amount till the full security deposit

is recovered. Security deposit will be recovered only from the running bills of the contract and no other mode of collecting SD such as BG, FD etc. shall be accepted

towards SD.

20.2. The Security Deposit shall, however be released only after expiry of the

maintenance period and after passing the final bill based on “No Claim Certificate”

from the successful tenderer.

21. PERFORMANCE GUARANTEE:

21.1. The successful bidder shall have to submit a Performance Guarantee (PG)

amounting to 5% of the total contract value within 30 (Thirty) days from the date of issue of Letter of Acceptance (LOA). Extension of time for submission of PG

beyond 30 (thirty) days and up to 60 (sixty) days from the date of issue of LOA

may be given by the Authority, who is competent to sign the contract agreement.

However, a penal interest of 15% per annum shall be charged for the delay beyond

30 (thirty) days, i.e. from 31st day after the date of issue of LOA. In case the successful tenderer fails to submit the requisite PG even after 60 days from the

date of issue of LOA, the contract shall be terminated duly forfeiting EMD and

other dues, if any payable against that contract. The failed successful tenderer

shall be debarred from participating in re-tender for that work.

21.2. The successful bidder shall give a Performance Guarantee in the form of an

irrevocable bank guarantee amounting to 5% of the total contract value in any of

the following forms.

21.2.1. A deposit or cash;

21.2.2. Irrevocable bank guarantee;

21.2.3. Government securities including State Loan Bonds at 5%below the market value;

21.2.4. Deposit Receipts, Pay Orders, Demand Drafts and Guarantee Bonds.

These forms of Performance Guarantee could be either of the State Bank

of India or of any Nationalised Banks;

21.2.5. Guarantee Bonds executed or deposit receipts tendered by all scheduled

banks;

21.2.6. A Deposit in the Post Office Savings Bank;.

21.2.7. A Deposit in the National Savings Certificates;.

21.2.8. Twelve year National Defence Certificates;:

21.2.9. Ten Year Defence Deposits;

21.2.10. National Defence Bonds; and

21.2.11. Unit Trust Certificates at 5 percent below market value or at the face value

whichever is less.

(FDR in favour of FA&CAO/ICF (free from any encumbrance) may also be

accepted.) In case, the tenderer is submitting FDR towards PG, then the FDR

shall be submitted with Auto Renewal Facility.

NOTE: The instrument as listed above will also be acceptable for Guarantee in case of Mobilization Advance.

21.3. Performance Guarantee should be furnished by the successful tenderer after the letter of acceptance has been issued, but before signing of the agreement and this

guarantee shall be initially valid up to the stipulated date of completion plus 60

days beyond that. In case the time for completion of the work gets extended, the

successful tenderer shall get the validity of Performance Guarantee extended to

cover such extended time for completion of work plus 60 days.

21.4. The value of the PG to be submitted by the successful tenderer will not change

for variation up to 25 % (either decrease or increase). In case during the course of contract execution, value of the contract increases by more than 25 % of the

original contract value, an additional Performance Guarantee amounting to 5%

(five percent) for the excess value over the original contract value shall be

deposited by the successful tenderer.

21.5. Performance Guarantee shall be released after physical completion of the work

based on completion certificate issued by the competent authority stating that the successful tenderer has completed the work in all respects satisfactorily. The

Security Deposit shall, however be released only after expiry of the maintenance

period and after passing the final bill based on “No Claim Certificate” from the

successful tenderer.

21.6. Whenever the contracts are rescinded, the security deposit will be forfeited and

the performance guarantee will be encashed. The balance work shall be got done

independently without risk & cost of the failed successful tenderer. The failed successful tenderer shall be debarred from participating in the tender for

executing the balance work. If the failed successful tenderer is a JV or a

Partnership firm, then every member / partner of such a firm shall be debarred

from participating in the tender for the balance work in his/her individual

capacity or as a partner of any other JV / partnership firm.

21.7. The Engineer (Officer in-charge) shall not make a claim under the Performance

Guarantee except for amounts to which the President of India is entitled under

the contract (not withstanding and/or without prejudice to any other provisions

in the contract agreement) in the event of :

21.7.1. Failure by the successful tenderer to extend the validity of the

Performance Guarantee as described herein above, in which event the

Engineer (Officer in-charge) may claim the full amount of the Performance

Guarantee.

21.7.2. Failure by the successful tenderer to pay President of India any amount

due, either as agreed by the successful tenderer or determined under any

of the Clauses/Conditions of the Agreement, within 30 days of the service

notice to this effect by Engineer (Officer in-charge).

21.7.3. The contract being determined or rescinded under provision of the GCC,

the Performance Guarantee shall be forfeited in full and shall be absolutely at the disposal of President of India.

22. PAYMENT TERMS AND CONDITIONS:

22.1. No advance payment shall be paid to the successful tenderer

22.2. All the payments will be made through NEFT only. NEFT Form enclosed vide

Annexure – E shall be submitted duly filling and submitting all the required

details.

22.3. Payment will be made on monthly basis against the bills duly scrutinised as per

the measurements recorded in “Measurement Book” by the Senior Section

Engineer in-charge of the work, vide para 17.1 and 17.2 of SCC.

22.4. Penalties imposed during the month shall be deducted from the monthly payment

due to the successful Tenderer.

22.5. The rates of the contract shall remain constant throughout the currency of the

contract and shall not be subject to any variation.

22.6. The Security Deposit shall be released as mentioned in para 20.2 above. The

Performance Guarantee shall be released as mentioned in para 21.5 above.

23. INCOME TAX AND GOODS & SERVICE TAX

23.1. Income tax and Service tax will be applicable for this contract as per the

applicable rules and regulations prevailing at the time of making the payment.

23.2. Income tax will be deducted at source at appropriate rates and a certificate to

that effect will be issued by the Railway to enable to submit the same for Income

Tax returns.

23.3. The successful tenderer shall ensure that all the essential details given below are furnished in their Cash Bill / Invoice / Pro-forma Invoice at the time of raising

their request for payments:

23.3.1. Name, Address and GST Identification No. (GSTIN) of the successful

tenderer for each state.

23.3.2. Date of issue of Cash Bill / Invoice / Pro-forma Invoice.

23.3.3. Name, Address and GSTIN of the recipient (ICF)

23.3.4. Address of delivery.

23.3.5. HSN Code (for goods) or Accounting code of Service.

23.3.6. Description of goods and or services along with contract reference no., and

or Bill No.

23.3.7. Quantity and unit.

23.3.8. Total value of supply of goods and or services.

23.3.10. Rate of Tax (Central GST, State GST, Inter State GST, Union Territory GST

or Cess).

23.3.11. Amount of tax charges in respect of taxable goods or services (CGST,

SGST, IGST, UTGST or Cess).

23.3.12. Place of supply along with name of State (in case of a supply in the course

of inter-State trade or commerce).

23.3.13. Whether the tax is payable on reverse charge basis? This field must

separately be identified as the recipient of services / goods supplied is liable to pay taxes without adjustments.

23.3.14. Signature or digital signature of the supplier or his authorised

representative.

24. VARIATION IN QUANTITIES:

24.1. The procedure detailed below shall be adopted for dealing with variations in

quantities during execution of works contracts:

24.1.1. Individual NS items in contract shall be operated with variation of plus or

minus 25 % and payment would be made as per the agreement rate. For this, no finance concurrence would be required.

24.1.2. In case an increase in quantity of an individual item by more than 25 %

of the agreement quantity is considered unavoidable, the same shall be

got executed by floating a fresh tender. If floating a fresh tender for

operating that item is considered not practicable, quantity of that item

may be operated in excess of 125 % of the agreement quantity subject to the following conditions:

24.1.3. Operation of an item by more than 125 % of the agreement

quantity needs the approval of an officer of rank not less than

S.A. Grade.

24.1.4. Quantities operated in excess of 125 % but up to 140 % of the

agreement quantity of the concerned item, shall be paid at 98%

of the rate awarded for that item in that particular tender.

24.1.5. Quantities operated in excess of 140 % but up to 150 % of the

agreement quantity of the concerned item shall be paid at 96 % of the rate awarded for that item in that particular tender.

24.1.6. Variation in quantities of individual items beyond 150 % will be

prohibited and would be permitted only in exceptional unavoidable circumstances with the concurrence of associate

finance and shall be paid at 96 % of the rate awarded for that

item in that particular tender.

24.1.7. The variation in quantities as per the above formula will apply

only to the Individual items of the contract and not on the overall

contract value.

24.1.8. Execution of quantities beyond 150 % of the overall agreement

value should not be permitted and, if found necessary, should

be only through fresh tenders or by negotiating with existing

successful tenderer, with the prior personal concurrence of FA

& CAO and approval of General Manager.

24.1.9. In cases where decrease is involved during execution of contract:

24.1.10. The contract signing authority can decrease the items up to 25

% of individual item without finance concurrence.

24.1.11. For decrease beyond 25 % for individual items or 25 % of

contract agreement value, the approval of an officer not less than

rank of S.A. Grade may be taken, after obtaining “No Claim

Certificate” from the successful tenderer and with finance concurrence, giving detailed reasons for each such decrease in

the quantities.

24.1.12. It should be certified that the work proposed to be reduced will

not be required in the same work.

24.2. The limit for varying quantities for minor value items shall be 100 % (as against

25 % prescribed for other items). A minor value item for this purpose is defined

as an item whose original agreement value is less than 1 % of the total original

agreement value.

24.3. No such quantity variation limit shall apply for foundation items.

24.4. As for as SOR items are concerned, the limit of 25 % would apply to the values of SOR schedule as a whole and not on individual SOR items. However, in case of

NS items, the limit of 25 % would apply on the individual items irrespective of the

manner of quoting the rate (single percentage rate or individual item rate).

24.5. For the tenders accepted at Zonal Railways level, variations in the quantities will

be approved by the authority in whose powers revised value of the agreement lies.

24.6. For tenders accepted by General Manager, variations up to 125 % of the original

agreement value may be accepted by General Manager.

24.7. For tenders accepted by Board Members and Railway Ministers, variation up to 110 % of the original agreement value may be accepted by General Manager.

24.8. The aspect of vitiation of tender with respect to variation in quantities should be

checked and avoided. In case of vitiation of the tender (both for increase as well

as decrease of value of contract agreement), sanction of the competent authority

as per single tender should be obtained.

25. WORK PERMIT

25.1. Once the Letter of Acceptance is issued to the successful tenderer, the tenderer

shall apply in a prescribed format to obtain proper work permit for the period of

contract from ICF authorities.

25.2. The successful tenderer shall submit the copies of the Safety Certification for the

FLTs and Crane / Registration Certificate and Certificate of Fitness, Valid driving

licences and eye test certificates for drivers of FLTs and Cranes and certificates

as mentioned vide Para 14.1 to 14.5

26. SAFETY:

26.1. The successful tenderer shall be responsible to take necessary precautionary

measures in order to ensure the safety against injury etc., of his personal when

working at the railway premises and should confirm to the rules and regulations

of the railway.

27. ARBITRATION:

27.1. In the event of any dispute or difference arising in connection with this contract,

the same shall be referred to the sole arbitration of any arbitrator to be appointed

by the General Manager/Integral Coach Factory. The award of the sole Arbitrator

is final and binding on both the parties of the contract. The courts in Chennai

alone shall have the exclusive jurisdiction in all matters arising out of this

agreement. The place of Arbitration shall be in Chennai only.

28. INDEMNITY:

28.1. The successful tenderer should ensure that, there is no unauthorised, careless

or inadvertent operation of the vehicle and equipment, which may result in

accident to his staff or ICF personnel. The tenderer shall indemnify and keep

ICF administration indemnified and harmless against all actions, suits, claims,

demands, charges or expenses arising in connection with any accident, death

or injury sustained by any person/ persons within the Railway premises due

to the act or omissions of contract irrespective of whether such liability arises

under the workmen’s compensation act or the fatal accident act or any other

statue in force from time to time. If any compensation is paid by the ICF

Administration towards injury sustained or death caused, the equivalent amount

will be adjusted against the pending bills of the tenderer.

29. GENERAL TERMS & CONDITIONS:

29.1. This special condition of contract shall be read in conjunction with General

Conditions of Contract and specifications of Indian Railways as amended from

29.2. The successful Tenderer shall be required to execute an agreement with the

President of India acting through the Senior Mechanical Engineer/ Machinery &

Plant for carrying out the work according to General Conditions of Contract and

specifications of Indian Railways.

29.3. If there is any variation between description in the tender schedules and actual

site work, Dy. CME / Plant will review and authorize correct description in writing

and his decision is final and binding on the successful Tenderer.

29.4. The unit rates quoted in item wise break-up estimate shall be unaltered

and there shall not be any variation of the rates during the currency of the

contract.

29.5. The successful tenderer may inspect the site on any working day between 8.00

Hrs. to 16.30 Hrs. from Monday to Friday before submission of quotation and

contact the undersigned for any technical clarifications.

29.6. No freight charge is admissible.

30. PROVISIONS OF EMPLOYEES PROVIDENT FUND AND MISCELLANEOUS PROVISIONS ACT

1952:

30.1. The successful Tenderer shall comply with the provisions of Para 30 & 36-B of

the Employees Provident Fund Scheme, 1952; Para 3 & 4 of Employees’ Pension

Scheme, 1995; and Para 7 & 8 of Employees Deposit Linked Insurance Scheme,

1976; as modified from time to time through enactment of “Employees Provident

Fund & Miscellaneous Provisions Act, 1952”, wherever applicable and shall also

indemnify the Railway from and against any claims under the aforesaid Act and

the Rules.

30.2. The successful Tenderer is required to comply with the provisions of EPF & M&P

Act,1952 and obtain code number from the concerned authorities whenever

workmen employed by him are 20 or more. He shall also indemnify Railways from

and against any claim, penalties, recoveries under the above Act and Rules.

Successful Tenderer should get the code number under the EPF so as to enable

the PF Commissioners to extend the social security benefits to the workmen

engaged by the Railway contractors.

31. TENDER DOCUMENT CHARGES:

31.1. The Tender document charges will be ` 5,000/- (Rupees Five Thousand Only) if

collected in person (or) downloaded from ICF website. Tenderer shall submit a

Demand draft for an amount of ` 5,000/- (Rupees Five Thousand Only), drawn

in favour of FA & CAO / ICF or a cash receipt for an amount of ` 5,000/- (Rupees

Five Thousand Only) from Asst. Chief Cashier / ICF towards the above mentioned

document charges.

31.2. However, for Service contracts, MSEs registered with District Industries Centres,

Khadi & Village Industries commission, Khadi & Village Industries Board, Coir

Board, National small Industries Corporation, Directorate of handicraft &

Handlooms, Any other body specified by Ministry of MSME, shall be supplied

such Tender document free of cost on confirmation (Xerox copy) of their evidence

to this effect.

32. MINIMUM ELIGIBILITY CRITERIA FOR PARTICIPATING IN THE TENDER:

32.1. Tenderer should have physically completed at least one single similar nature

of work as defined in Para 32.5 below, for a minimum value of 35% of the

advertised tender value of work either in the current year or during three

previous financial years.

32.2. Tenderer should have completed cumulative minimum of 150 % of the advertised tender value of the work during the current year and three

previous financial years.

32.3. Tenderer shall produce an attested certificate from the employer/client, audited

balance sheet duly certified by the Chartered Accountant [and / or attested

certificates from the Central / State govt. / public sectors undertakings

organization/department from where the tenderer received the payment for the work done.]

32.4. The tenderer shall positively meet the requirements mentioned at para 31.5.

Otherwise, the tenderers will become ineligible for the Tender and their offers will

not be considered for the subject work.

32.5. Definition for similar nature works: Done the works of “Providing the services of Forklift Trucks / Road Mobile Cranes with driver, in any Municipal (or) Township (or) Corporation (or) State / Central Government owned industries or workshops (or) other State / Central Government undertakings”.

32.6. Documents to be submitted to prove Eligibility Criteria:

32.6.1. For the purpose of similar single work, the Experience certificate shall be

attached to the tender document. The certified copies of the relevant

Experience Certificates are also to be enclosed.

32.6.2. For Turn over with respect to Railways, the experience certificate should

have been issued by at least a JA grade officer. With respect to other

Government Departments and PSU’s the certificate issued at the level of

Executive Engineer and above only can be taken as valid. Certificates

issued by private individuals for the completion of the work will not be

considered

32.6.3. Documentary evidence duly certified by a Chartered

Accountant/Company Auditor, audited balance sheet duly attested by

Notary Public, or certificate issued by Railway Officers not below the rank

of JA Grade shall be submitted along with the offer for the total contract

amount received.

32.6.4. All documents to support fulfillment of eligibility criteria should be

furnished along with the tender and should be available at the time of

tender opening. Tenders not accompanied by documentary evidence in

support of eligibility criteria will be rejected. No post tender

communication, in any form will be made or entertained, after opening of

tenders, in this regard.

32.6.5. Tender Committee may at their discretion call for the originals of the

credentials for verification from the tenderers or any

clarifications/confirmations on the contents of the documents submitted.

32.6.6. In case the Certificates/Documents produced are proved to be

false/fabricated, the entire amount of earnest money is liable to be

forfeited in addition to banning their business with the organisation for a

specific period of not less than six months at the discretion of the

Railways.

32.6.7. The tenderer should avoid over writings and erasures. If there are any

alterations, they should be attested. The tenderer should sign at the foot

of each page of the tender documents. Should a tenderer find

discrepancies in, or omissions in the tender form, or should be in doubt

as to their meaning, he should at once notify the authority inviting tender.

It shall be understood that every endeavour has been made to avoid any

error which can materially affect the basis of the tender and the tenderer

shall take upon himself and provide for the risk of any error which may

subsequently be discovered and shall make no subsequent claim on

account thereof.

32.6.8. Before submitting a tender, the tenderer will be deemed to have satisfied

himself by actual inspection of the site and locality of the works, that all

conditions liable to be encountered during the execution of the works are

taken into account and that the rates he enters in the tender forms are

adequate and all-inclusive to accordance with the provisions in clause 37 of the General Conditions of Contract for the completion of works to the

entire satisfaction of the General Manager/ICF.

32.6.9. No post tender communication, in any form will be made or entertained,

after opening of tenders, in this regard.

32.7. It is requested that Firm’s Authorised Representative / Competent Person should

sign in all pages of the tender documents i.e. Special condition of the contract-

Annexure A, Schedule of Rate – Annexure B, Regulation for tenders/contracts

and conditions of Tender- Annexure C, Safety, Health & Environmental instructions-Annexure D, NEFT Form-Annexure E and Check List Annexure F

and all the above documents shall be submitted to ICF after signing in all pages.

33. LAST DATE FOR SUBMISSION OF TENDER:

33.1. The Tenderer shall send the sealed tender to reach the undersigned on or before

14.30 Hours on 05.10.2017 or deposit the quotation before 14.30 Hours on

same day (i.e. 05.10.2017) in the Tender box provided in the office of the Deputy

Chief Mechanical Engineer/Plant/Shell/ICF. The Tender will be opened on the same day at 15.00 Hrs. Late quotations will not be accepted.

33.2. If the date of tender opening is declared as a holiday, tenders will be opened

at the same time on the next full working day.

33.3. The quotations should be sealed and the cover to be super-scribed as “Hiring

the services of Material Handling Equipment (MHE) such as diesel operated

forklift trucks and road mobile crane for Shell Division through outside

agencies for a period of one year”, duly specifying the Tender Number

REGULATIONS FOR TENDERS AND CONTRACTS AND CONDITIONS OF TENDER

(For the guidance of successful tenderers for Mechanical Engineering Works.)

MEANING OF TERMS.

1. DEFINITIONS

1.1. In these Regulations for Tenders and Contracts and conditions of Tender the following terms shall have the meanings assigned hereunder except where the

context otherwise requires:- 1.1.1. "Railway” shall mean the President of the Republic of India or the

administrative Officers of the Integral Coach Factory or of the Successor

Railway authorized to deal with any matters, which these presents are

concerned on his behalf.

1.1.2. "General Manager" shall mean the officer in administrative charge of the

whole of the Integral Coach Factory, Chennai-38 and shall mean and include the General Manager of the successor Railway.

1.1.3. "Chief Mechanical Engineer" shall mean the Officer in charge of the

Mechanical Engineering Department of the Integral Coach Factory.

1.1.4. "Engineer” shall mean Senior Mechanical Engineer, Assistant

Mechanical Engineer in executive charge of the works and shall

include the superior officers of the Mechanical Engineering

Department of the Integral Coach Factory, (i.e.) Deputy Chief

Mechanical Engineer / Chief Workshop Engineer / Chief Mechanical Engineer and shall mean and include the Engineers of the successor

Railway.

1.1.5. "Successor Railway" shall mean and include such other Railway to

which for Administrative or other reasons this contract may during its

pendency be transferred.

1.1.6. "Tenderer" shall mean the person, the firm or company who tenders for

the works with a view to execute the works on the contract with

the Railway and shall include their personal representatives,

successors and permitted assigns.

1.1.7. "Limited Tenders" shall mean Tenders invited from all or some

successful tenderers on the approved list of successful tenderers with

Railway.

1.1.8. "Open Tenders" shall mean Tenders invited in open and public manner

and with adequate notice.

1.1.9. "Works" shall mean the works contemplated in the drawings and

schedules set forth in the tender forms and required to be executed

according to specifications.

1.1.10. "Specifications" shall mean specifications for materials and works,

current on the Integral Coach Factory or as amplified, added to or

superseded by special specifications if any appended to the Tender forms.

1.1.11. "Drawings" shall mean the drawings, plans and tracing or prints there

of annexed to the Tender Forms.

1.1.12. "General Conditions of Contract" shall mean the General Conditions of

contract for works in the Integral Coach Factory Mechanical

Engineering Department, issued under the authority of the Chief

Mechanical Engineer.

1.2. Words importing the singular number shall also include the plural and vice

versa where the context requires.

2. REGULATIONS FOR TENDERS AND CONTRACTS

2.1. Regulations for Tenders and Contracts subject to Modifications: These

regulations for tenders and contracts shall be read in conjunction with General

Conditions of the Contract and shall be subject to modifications, additions

or super session by special conditions of contract and/ or special

specifications, if any, annexed to the Tender forms.

2.2. Issue of Tender Forms: Tender forms shall be issued to the tenderers on

payment of the prescribed fees. At the time of submission of Tender, the Tenderer shall submit evidence regarding their financial status, previous

experience and ability to execute the works and authorized copy of the

Income Tax Clearance Certificate without which their Tenders shall not be

considered.

2.3. Tender forms not transferable: The transfer of Tender forms purchased by

one Tenderer to another Tenderer is not permissible.

2.4. Use of official Tender Form: No Tender shall be considered which is not submitted in the official tender form attached here to along with the tender

documents issued to the tenderer.

2.5. Omissions and discrepancies: Should a tenderer find discrepancies in or

omissions from the drawings or any of the tender forms or should be he in

doubt as to their meaning, he should at once notify the authority inviting

tenders who may send a written instruction to all tenderers. It shall be

understood that every endeavour has been made to avoid any error which can materially affect the basis of the tender and the successful tenderer shall take

upon himself and provide for the risk of any error which may subsequently

be discovered and shall make no subsequent claim on account thereof.

2.6. Prohibition of separate communication: No separate communication

bearing on the tender shall be addressed by the tenderer to the General

Manager, Integral Coach Factory, Chennai - 600 038 or any other persons, but all explanatory qualifying remarks which the tenderer may desire to

make must be recorded on page and hereof or submitted in a covering

letter along with the tender.

2.7. Signature of Tenderers on Tender: The tenderer should sign on each and

every page of the tender documents and at the end of each specification and

schedule at places provided for the purpose.

2.8. Amount and Method of deposit of Earnest Money:

2.8.1. The tender should be accompanied by a cash receipt for a sum as

mentioned in Special Conditions of Contract as Earnest Money deposited

in cash with Assistant Chief Cashier of the Integral Coach Factory or in

the form of Deposit receipts, Pay order, Demand Drafts, in favour of Financial Advisor and Chief Accounts Officer, Integral Coach Factory,

provided-The tenderer shall hold the offer open for a period of 90 days

from the date of fixed for opening the same, it being understood that the

Tender documents have been sold/issued to the Tenderer and the

tenderer is been permitted to tender in consideration of stipulation on

his part that after submission his tender he will not resile from his offer or modify the terms and conditions thereof in a manner not acceptable to

the Engineer (Officer in-charge) of the Integral Coach factory. Should

the tenderer withdraw his offer within validity date of the offer or fails to

undertake the contract after acceptance of his tender the full earnest

money should be forfeited.

2.8.2. The Earnest Money of the unsuccessful tenderers shall, save as, herein

before provided, be returned to them only through NEFT System, but the Railway shall not be responsible for any loss or depreciation that

may happen thereto while in their possession, nor be liable to pay

interest thereon.

2.8.3. Tender unaccompanied by the requisite Earnest Money in the prescribed form under no circumstances will be entertained and will

be summarily rejected.

2.9. Security Deposit and Performance Guarantee bond: Please refer relevant

para of the special condition of contract.

2.10. Care in submission of Tenders:

2.10.1. Before submitting a tender, The Tenderer will be deemed to have

satisfied himself by actual inspection of the site and locality of the

works that all conditions liable to be encountered during the execution of the works are taken into account and that the rates he

enters in the tender forms are adequate and all-inclusive to accord

with the provisions in Clause-37 of the Standard General Conditions of

the contract for the completion of works to the entire satisfaction of the

Engineer (Officer in-charge).

2.10.2. Tenderers will examine the various provisions of The Central Goods and Service Tax Act, 2017(CGST)/ Integrated Goods and Service Tax Act,

2017 (IGST) / Union Territory Goods and Service Act, 2017 (UTGST) /

respective state’s State Goods and Service Act (SGST) also, as notified

by Central/State Govt. & as amended from time to time and applicable

taxes before bidding. Tenderers will ensure that full benefit of Input Tax

Credit (ITC) likely to be availed by them is duly considered while quoting rates.

2.10.3. The successful tenderer who is liable to be registered under

CGST/IGST/UTGST/SGST Act shall submit GSTIN along with other

details required under CGST/IGST/UTGST/SGST Act to railway

immediately after the award of contract, without which no payment

shall be released to the contractor. The contractor shall be responsible for deputation of applicable GST to the concerned authority.

2.10.4. In case the successful tenderer is not liable to be registered under

CGST/IGST/UTGST/SGST Act, the railway shall deduct the applicable

GST from his their bills under reverse charge mechanism (RCM) and

deposit the same to the concerned authority.

2.10.5. When work is tendered for by a firm or Company of Successful tenderers, the tender shall be signed by the individual legally authorised

to enter into commitments on their behalf. The Railway will not be

bound by any power of attorney granted by the tenderer or by changes in the composition of the firm made subsequent to the execution of the

contract. It may, however, recognize such power of attorney and

changes after obtaining proper legal advice, the cost of which will be chargeable to the successful tenderer.

2.11. Opening of Tenders:

2.11.1. At the advertised time and place, tenders received for a contract shall

be opened by the Tender Committee and where practicable, the names

of tenders and the rates tendered by them read out in the presence of

such of the intending successful tenderers or their agents as may

attend.

2.12. Right of Railway to deal with Tenders:

2.12.1. The Railway reserves the right of not to invite tenders for any work

or works or invite open or limited tenders and when tenders are called to accept a tender in whole or in part or reject any tender or

all tenders without assigning reasons for any such action.

2.12.2. Ordinarily the lowest tender may be accepted by ICF/ Railway unless

such acceptance would not be to the public interest. The acceptance or rejection of any tender is left entirely to the discretion of the

authority empowered to deal with the matter and no explanation

can be demanded of the cause of rejection of his tender by any

tenderer.

3. EXECUTION OF CONTRACT DOCUMENTS:

3.1. The tenderer whose tender is accepted shall be required to appeared at the Office of the General Manager, Chief Mechanical Engineer, Chief Workshop Engineer, Deputy Chief Mechanical Engineer, Senior Mechanical Engineer as the case may be in person or if a firm or a corporation, a duly authorised representative shall so appear and to execute the contract documents within prescribed time after notice that the contract has been awarded to him. Failure to do so shall constitute a breach of the agreement effected by the acceptance of the tender in which case the full value of the Earnest Money accompanying the tender shall stand forfeited without prejudice to any other rights or remedies In the event of any tenderer whose tender is accepted shall refuse to execute the contract documents as herein before provided, the ICF/Railway may determine that such tenderer has abandoned the contract and there upon his tender and the acceptance thereof shall be treated as cancelled and the ICF/ Railway shall be entitled to forfeit the full amount of Earnest Money and to recover the liquidated damages for such default.

4. CONDITIONS OF TENDER

4.1. Tender / Drawings: The drawings for the works and relevant specifications can be seen in the Office of Deputy Chief Mechanical Engineer/Plant, Integral Coach Factory, Chennai 600 038 at any time during office hours.

4.2. Filling up of Schedule of Rates: The tenderer/tenderers shall quote

his/their rates with reference to each item and must tender for all the items shown in attached schedule. Both rate and amount columns of the schedule

should be filled in by the tenderer/tenderers both in figures and words. The

quantities shown in the attached schedule are given as a guide and are

approximate only and are subject to variation according to the needs of the

Railway. The Railway accepts no responsibility for their accuracy. The Railway

does not guarantee work under each item of the schedule.

4.3. Erasure and alterations: Tenders containing erasures and alterations of the tender documents are liable to be rejected any corrections made by the

tenderers in his/ her entries must be attested him/them.

4.4. Completion Time: The works are required to be completed within a period as

mentioned in the Special Conditions of Contract from the date of award of

contract.

4.5. Right of Railway to reject tender: It shall not be obligatory on the Railway

to accept the lowest tender and no tender/ tenderers shall demand any explanation for the cause of rejection of his/their tender.

4.6. Furnishing wrong information: If the tenderer/tenderers deliberately

gives/ give wrong information in his/their tender or creates/create

circumstances for the acceptance of his/their tender, the Railway reserves the

right to reject such tender at any stage.

4.7. If a tenderer expires after submission of his tender or the acceptance of his

tender, the Railway shall deem such tender as cancelled. If a partner of a firm expires after submission of their tender or after the acceptance of their tender,

the Railway shall deem such tender as cancelled unless the firm retains its

character.

4.8. Income Tax Clearance Certificate: The tenderer/tenderers is /are required

to produce along with his/their tender an authorised copy the Income Tax

Clearance Certificate or a sworn affidavit duly countersigned by the Income Tax

Officer to the effect that he/ they has/have no taxable income. Documents

testifying to the tenderer’s previous experience and financial status should be produced when desired by the Railway.

4.9. List of Credentials in support of the tenderer’s successful and timely completion

of similar works shall be submitted without fail.

4.10. The tenderer/successful tenderer shall ensure all safety measures.

4.11. No freight is admissible.

4.12. The successful tenderer/ successful tenderer shall be responsible to take

necessary precautionary measures in order to ensure the safety against injury

etc. of his personnel when working in the Railway premises and should confirm to the Rules and Regulations of the Railway.

4.13. If there is any variation between description in the Tender Schedules and actual

site work, Engineer (Officer in-charge) will review and authorise correct description in working and his decision is final and binding on the successful

tenderer.

4.14. The successful tenderer should ensure that no unauthorised careless or

inadvertent operation shall be carried out in Railway premises when which may result in damage of Railway property.

4.15. The successful Tenderer/Successful tenderer shall indemnify ICF against

accidents, suits, claims, demands, cost charges, expenses arising in

connection with any accidents causing injury or death to person/persons within ICF premises or damage sustained due to act of omissions of the

contract and this is liable under Workmen Compensation Act or any other

statute in force from time to time.

4.16. The authority for the acceptance of this tender will rest with the Engineer

(Officer in-charge), Integral Coach Factory, Chennai 600038, who does not

bind himself to accept the lowest or any other tender nor does he undertaken to assign reasons for declining to consider any particular tender or tenders.

4.17. Non-compliance with any of the conditions set forth herein above is liable to

result in tender being rejected.

4.18. The successful tenderer/tenderers shall be required to execute an Agreement

in the form annexed hereto (Page) duly stamped with the President of India

acting through the Engineer (Officer in-charge), Integral Coach Factory,

Chennai 600 038 of the Railway for carrying out the work according to the

General Conditions of Contract and Specifications. The cost of the stamps will be borne by the Successful tenderer.

4.19. The tenderer shall keep the offer open for a minimum period of 90 days from

the date of opening of the tender, within which period the tenderer cannot

withdraw his offer, subject to the period being extended further if required, by

mutual agreement from time to time. Any contravention of the above

condition will make the tenderer liable for forfeiture of his "Earnest Money".

4.20. The successful tenderer shall comply with the provisions of the Factories

Act, 1948 or the modifications thereof or any other laws relating thereto and

rules made there under from time to time.

4.21. Should a tenderer be a retired engineer or the gazetted rank or any other

gazetted officer working before his retirement, whether in the executive or

administrative capacity or whether holding a pensionable post or not, in

the Mechanical Department of any of the Railways owned and administered

by the President of India for the time being, or should a tenderer being

partnership firm have as one of its partners a retired engineer or a retired

gazetted office as aforesaid, or should a tenderer being an incorporated

company have any such retired engineer or retired officer as one of its

directors, or should a tenderer have in his employment any retired

engineer or retired gazetted officer as aforesaid the full information as

to the date of retirement of such engineer or retired gazetted officer from the

said service and in cases where such engineer or officer had not retired from

government service at least ONE year prior to the date of submission of

the tender as to whether permission for taking such contract or if the contract

be a partnership firm or an incorporated company to become a partner or

director as the case may be or to take employment under the successful

tenderer has been obtained by the tenderer or the engineer or the officer as

the case may be from the President of India or any officer duly authorised by

him, in this behalf, shall be clearly stated in writing at the time of

submitting the tender. Tenders without the information above referred to or

a statement to the effect that no such retired engineer or retired gazetted officer

is so associated with the tenderer, as the case may be shall be rejected.

4.22. Should a tenderer or successful tenderer being an individual on the list of

approved Successful tenderers, have a relative employed in gazetted capacity

in the Integral Coach Factory Chennai 600 038, or in the case of a

Partnership firm or Company incorporated under the Indian Company Law

should a Partner or a relative of the Partner or a Shareholder or relative of a Shareholder be employed in gazetted capacity in the Integral Coach

Factory, Chennai - 600 038, the authority inviting tenders shall be informed

of the fact at the time of submission of tenders, failing which the tender may

be rejected or if such subsequently comes to light, the contract may be

rescinded in accordance with the provisions in Clause 62 of the General

Conditions of Contract.

4.23. In the event of any dispute or difference arising in connection with contract after finalization the same shall be referred to the sole arbitration of any

arbitrator to be appointed by the General Manager/ Integral Coach Factory,

the award of the arbitrator shall be final and binding on the parties to the

contract.

4.24. Tenders must be enclosed in sealed covers, must be sent by registered

post to address of Deputy Chief Mechanical Engineer/ Plant, Integral Coach Factory, Chennai 600 038, so as to reach this office, or drop in a Special Box

exclusively kept for the said purpose in the Office of the Deputy Chief

Mechanical Engineer / Plant as mentioned in the Special Conditions of

Contract.

Annexure – D

SAFETY, HEALTH AND ENVIRONMENTAL INSTRUCTIONS

1. SAFETY & HEALTH

1.1. The Factories Act – 1948 and Tamil Nadu Factories Rules - 1950 & Contract

Labour (Regulation & Abolition) Act, 1970 are to be followed.

1.2. Adequate and appropriate tools shall be issued.

1.3. All instrument used for the work is to be complied with Indian Electricity rules.

1.4. The instruments are used to be conformed to Indian Standards.

1.5. Staffs under your control should wear the personal protective equipment as per

working condition to prevent injuries.

1.6. Suitable ladders/scaffoldings are to be used for climb up and working at height.

1.7. Ensure adequate lighting at work place.

1.8. Successful tenderer should follow the terms and conditions/instructions of ICF

from time to time.

1.9. Activities other than the specified activities as per the contract clauses, which are assigned to you, are not permitted at our premises.

1.10. Ensure the Suitable guards are provided to the hand operating machine.

1.11. Suitable lifting machineries and tackles are to be used to handle the materials.

1.12. Any loss incurred to ICF because of your activities shall be charged on your

account.

1.13. The equipment & materials stored at our premises are on your own risk.

1.14. Before start of work, proper shut down (if necessary) is to be undertaken for

safety.

1.15. Before start of any work, appropriate Work Permits shall be obtained.

1.16. Off cuts and wastes generated during the course of your work, must be suitably

disposed identified areas.

1.17. The renewal of permit will be issued only on the basis of performance of

compliance of the said rules, regulations, conditions and safety norms.

1.18. The successful tenderer shall engage qualified supervisors at the work site whenever men are engaged for work.

1.19. First aid box with adequate medicine are to be provided in the work area.

1.20. In case of any accident to the contract staff, the successful tenderer should

inform to the CSO/Shell & CSO/Fur., through department concerned within

one hour.

1.21. Disobeying or not following the conditions / precautions / procedures shall

result in penalty. In serious cases, stoppage of work or cancellation of permits

may be done. Stopping of the work are empowered by the Safety Officer, Chief Safety Officer, Factory manager and Occupier.

1.22. For accidents involving to your staff inside Shell factory, necessary

compensation to the dependents of the staff and legal expenditure cost shall be

borne on your account.

1.23. The display board containing the details of nature of work, maximum number

of staff working per shift, period of work, site in charge name and phone number

and main office phone numbers is to be placed at prominent place.

1.24. If total staff engaged by you on any day of the contract period is 20 or more, you have to register with Central Labour Commissioner at Shastri Bhavan and

obtain license.

1.25. Staffs under your control are to be insured during the work period.

1.26. Registers in Form XIII, XVI, XVII, XIX, XX, XXI, XXII and XXIII as per contract

labour act shall be maintained.

1.27. Employment card in Form XIV should be issued to all work men by the

successful tenderer.

1.28. Form XXIV - Half-yearly returns and Form VI B - Notice of commencement

/completion of work shall be sent to Labour office, Shastri Bhavan

1.29. The payment of wages shall be made as per Minimum wages Act, and shall be

witnessed by ICF nominated Supervisors.

1.30. Usage of LPG cylinder in the factories (both Shell & Fur) is prohibited for

industrial activities. Industrial LPG cylinders shall only be allowed if

accompanied by a certificate from gas companies about the end use for which it is issued.

2. ENVIRONMENT

2.1. ICF is an ISO 14001/2004 certified Factory. All activities shall be carried out

as per the Environment Protection Act & Rules.

2.2. Handling, storage & use of any chemicals and Hazardous waste shall be carried

out as per conditions laid down by TNPCB (Tamil Nadu Pollution Control

Board). Any clarification shall be made with contract executing officer & Safety

Cell.

2.3. Spillage of Hazardous materials, chemicals and oil shall be strictly avoided; in

2.4. Any waste materials should not be burnt inside the Factory.

2.5. Any open fire or smoke noticed by the successful tenderer or his men, should

be informed immediately to the Fire Fighting crew through telephone numbers

3. PENALTY

3.1. In case any unsafe conditions noticed that could have led to grievous injury to

the contract labour, a minimum penalty of ` 5,000/- per person shall be

imposed by ICF administration to the successful tenderer. However if multiple

violation of Safety instructions are noticed, the amount could be higher.

3.2. Recurrence on third occasion for the same contract would result in penalty of

` 50,000/-(Rupees Fifty thousand only) and termination of contract.
