Greetings Members,

The District has been extremely busy through May of this year. In February we had our District Officer nominations. The Delegates at our 2018 District Convention lowered the criteria to become a qualified can-didate to run for a District Lodge 19 position, and as a result, an election will be part of our process this year. We welcome the spirit of an open and honest election to enhance the process of democracy. I encour-age all our members to take part in this election and highly recommend you cast your vote on Friday June 14, 2019.

In April of this year District 19 Delegates had the honor to represent the membership of District 19 at the bi-annual Transportation Conference. The number of delegates at the 2019 Conference was more than double of any other Transportation Conference in the past. District 19 was well represented. Railroaders were giv-en special recognition in a Railroad exclusive video, followed by the State of the Railroad and District Lodge 19 report outlining the work your staff of District 19 has done over last two years. Below is a sum-mary of what I reported to the Delegates at the Transportation Conference.

District Lodge 19 Transportation Conference Report

Agreements: District Lodge 19 Arbitrated the National Freight Agreement. Successfully Negotiated and Ratified 20 Agreements and presently have 4 in Negotiations.

Claims and Grievances: 200 Claims / Grievances filed and won for a total of $524,609.30. Several Claims / Grievances won protecting Machinist work, improve safety, brought back out-sourced work in house and established additional full time Machinist positions.

Discipline Investigations: Represented Members at 65 Discipline Formal Investigations 5 of these Members were found not guilty after the Investigation resulting in $22,801.33 back pay.

Arbitration - Public Law Boards / 2nd Division Cases

Presented 42 Cases to PBL and/or 2nd Division – Majority were Discipline Cases Back pay awarded $409,031.34 (includes $26,756.30 job protection insurance claim denied

appealed and won) .

Nine terminated members was returned to work without back pay. These Nine members were terminated with just cause but GC’s were able to convince Arbitrator to give a 2nd chance.

One case was a Jurisdictional of work Dispute with another Union trying to claim Machinist

work which was won by DL 19 at Arbitration. Tremendous amount of Machinist work and Machinists were protected.

Insurance Claims:

In the last two years we have helped approximately 253 members with different insurance issues.

Thirty-five members insurance was canceled that we got reinstated.

We filed at least 20 denied claim appeals that were overturned, and all claims paid. (We Cannot determine the dollar amount because we did not know the value of the denied claims).

We filed an appeal for one member who was denied Medicare until July 2019, got that over turned and his Medicare was backdated to December 2018 to show no gap in coverage.

We filed an appeal for one member on an Aetna Supplemental Sickness case where all claims were denied. On the final appeal we filed, the member was awarded all back-pay and re- ceived a check for more than $8,000.00

Just a few months ago we successfully filed for Supplemental Plan E for a member that had just retired, had an accident and was in a coma and could not speak for herself. This gave her an addition $500,000.00 in medical coverage.

As you can see your District Staff has been extremely busy working for you.

Several DL 19 General Chairmen and Local Lodge members attended the May 2019 Legislative Confer-

ence. In this conference we learned that the IAMAW membership will have a voice in who the IAMAW

will be endorsing for the upcoming 2020 Presidential Race. What will be coming is an electronic voting pro-

cess in which all members will be able to cast a vote for who they want the IAMAW to endorse for the next

President of the United States. More information is forth coming on this.

We also heard from several Senators, Congressman and others that are seeking our support for their

bid for the President of the US. All Senators and Congressmen and others seeking the Presidential Office

pledged their full support and committed to be fighting with everything they have to protect not only us, but

every hardworking person in this country. On Wednesday an invitation was sent out to many Senators and

Congressmen to join the Legislative Delegates in a Congressional Reception. I must say their response was

overwhelming. Over 50 Senators and Congressman joined us at this reception. They are seeking our sup-

port because they know that the Machinists are very powerful in the political arena.

On a lighter note, our 5th annual Guide Dogs of America, Charity Golf Tournament was another great suc-cess. We overflowed the golf course with golfers. We had 82 golfers that participated in this year’s golf

tournament. Our Golf Tournament came very close to raising enough funds to sponsor one guide dog for a vision impaired person.

Greetings,

In February I completed another on-site training at Local Lodge 754, Long Island New York. Local Lodge President, Dave Negus contacted me with a request to have specific claim/grievance training. We spent a full day training Local Lodge 754 representatives how to improve their chances of winning a claim/grievance. Next up will be similar training for representatives at Local 165 later on in May.

The first week in June will be our annual Local Chairman Class, this will be the largest class yet with over 30 participants. After this class we will be sending out the enrollment forms for the Advanced Local Chairman Class.

Please forward any requests for on-site training to me so that we can discuss how to schedule a class at your Local. Please contact me with any questions.

I would like to thank each and every Donor, Local Lodge and Member that participated and all the golfers who came out to support this most worthy cause. It is only because of you that we can do this.

On the communications of the District, Brother General Chairman John Denny gracefully volunteered to be-come District Lodge 19 Communicator. He has already started a District 19 Facebook page. (District 19 IAMAW). You can find the happenings around the District on this Facebook page. We will be transitioning

the Communicators duties to Brother John over the next couple of months.

National Agreement Section Six notice: We are presently working on an Electronic National Agreement sur-vey to be sent to the members who fall under the National Agreement in July of this year. You will be able

to access this survey from Computers, iPad and Smart Phones. For those who do not have smart phones or use computers or iPads, there will be a process in which you can submit a hard copy of your survey. The re-sults of these surveys will play an important role in developing our section six notice and will be used in up-

coming National Agreement negotiations.

All the staff of District 19, including your Secretaries are working very hard each and everyday for you. We are working very hard in restructuring the District, improving communications and the way we communi-

cate. I personally thank all of you for your support and your patience as we implement many changes to make District Lodge 19 more efficient in all aspects.

Vacation season is quickly approaching. I wish each of you a great and relaxing vacation, wherever your va-cation may take you.

Kenny Krause, Heath Jacobs and I have docketed 13 cases to PLB 6701. The cases will be heard on July 30, 2019 in Louisville, KY. Letters will be going out to the Claimants informing them of the details soon. BNSF was severely impacted due to the Midwest flooding which was jeopardizing coal stockpiles at some power plants. We continue to work with BNSF Mechanical Trainers and Man-agement to develop an industry leading training program. Our focus for this year will be to develop training for Journeyman to assure that they remain qualified for any job bulletined. We successfully negotiated an agreement to keep the Havelock shops from being offered to a subcontractor. This agreement potentially saved up to 400 jobs at the facility. The Havelock Wheel Plant which employs approximately 130 Machinists recently produced the 3rd millionth wheel set. Congratulations to this group for an amazing accomplishment. Investment in Shop and track improvements continue. Cur-rently BNSF is the only class 1 Carrier not partici-pating in Precision Scheduled Railroading.

A system LAT meeting will be held in Houston, TX in May in which we will be attending.

CP continues to hire at the St. Paul, MN Locomo-tive Shop. At the time of my recent visit the Mis-sissippi River was encroaching into the yard mak-ing it difficult for our members to get to the facili-ty. Work for the Traveling Mechanics remain high as they continue to battle flooding and equipment maintenance.

LS&I

The Railroad is transitioning from the winter to the shipping season. The Ore shipments remain steady.

The Carrier has recalled all members from fur-lough and possibly looking at reopening the Na-hant Locomotive Shop. The members recently re-ceived a 1% additional raise due to the Railroad achieving a benchmark based on Rail Ton Miles. This is the first work group on that Railroad to qualify.

Workloads and expectations continue to remain high. I recently settled a subcontracting claim that pays every Machinist 4 hour’s pay.

As all are aware, the Union Pacific Railroad started implementing their brand of Precision Railroading, Uni-fied Plan 2020, in December of 2018. They have stored over 1300 locomotives, to date, and counting, which has directly led to the furlough of over 400 of our brothers and sisters. We are currently progressing several Art 1 protection claims under the September 25, 1964 Washington Job Protection Agreement and are also progressing several Sub-contracting claims, as we find and get information of locomotives being worked at vendor locations. We must be vigilant and could use your help. We need everyone to collect and forward any information they can gather, relative to locomotives being worked on vendor properties and we also need information of vendors coming onto our properties and preforming work generally recognized as Ma-chinists work and covered under the Machinist Classification Rule. Thank you in advance.

We have been constantly in contact with the Mechanical Department and Labor Relations trying to get an answer as to when all this madness will end, to no avail. We will keep you informed, when we are.

As was shared on UP On-Line, CMO John Estes is retiring July 4, 2019 and they have went outside the company and hired Gerry Weber to replace John. Mr. Weber is from the CN, as was Jim Vena. There has been a lot of movement in the upper echelon of the Mechanical Department and Labor Relations and as the dust settles we will do our best to sort it out for everyone.

We currently have nine (9) cases docketed for PLB 7604, to be heard by Neutral member Edwin Benn, five (5) dismissal cases, two (2) discipline cases and two (2) rules cases. We have been docketed and are waiting on funding. These cases should be adjudicated, this year.

Looking forward, EVP Tom Lischer is meeting with the General Chairmen of all organizations on May 29, 2019 in Omaha, NE., which Derrick, Heath and I will be attending. This will entail a State of the Railroad, by Lischer, with breakout sessions with the Mechanical Department after that. Hopefully we can get some answers and will keep everyone informed. Also, CMO John Estes has tentatively scheduled a Local Chair-man’s meeting for July 23, 2019 in Omaha.

During these unprecedented and uncertain times at the Union Pacific Railroad, first and foremost, be safe. Go home to your loved ones and families the same way you reported to work, each and every day. It is im-perative that we remain vigilant. Remember Rule # 1 of the agreement clearly states; eight (8) hours of ser-vice constitutes a day’s work.

Several years of hard negotiating has finally come to an end and the Coalition had Meetings to roll out what was in the final proposal in Missoula, Helena, Livingston, and Billings. These meetings were informative and well attended.

The following Monday the Machinist overwhelm-ingly voted to accept the contract with a 13.5 % overall wage increase and medical frozen for the life of this contract. There were quite a few other improvements that went in to making this a con-tract our members were willing to approve. Spe-cial thanks to Justin Fievet the Local Chairman for this property for all of his help in getting the word out to our members and his invaluable help in get-ting the vote done as quickly as possible.

In other news we have won an Arbitration, with conditions, for an employee and secured his return to work without back-pay.

BNSF Shops

Visited Seattle for a shop visit in February to dis-cuss possible changes in the area.

A shop visit and union meeting was scheduled in Alliance for March 19 but due to the severe weath-er it had to be rescheduled for May 2, 2019 where President Directing General Chairman Mike Perry and Grand Lodge Representative Richie Johnsen as well as District Secretary Treasurer Rich Nadeau and myself will be present.

BNSF Traveling Mechanics

In January I went to Albuquerque to meet with the sys-tem Traveling Mechanics for their startup meetings. We met for an informal meeting to discuss things that were going on with their groups and to answer ques-tions about some of their grievances. This was a very informative meeting that was well attended and a good discussion of some of the problems they are facing.

Labor Relations had agreed with us that Traveling Me-chanics were able to be paid double time for anything worked over (16) hours. When push came to shove, and they had to fix the problem with Work force Manage-ment, they decided that this was not how they were go-ing to handle it. So as of now I have a minimum of 4 grievances in the process now one for (30) hours of continuous service and one for over (60) hours on con-tinuous service. Not only did the Carrier deny them the double time they were owed but they restarted their time over at midnight to straight time. This is a fight we are actively pursuing and ask you to please contact me if this happens to you.

In all of the Meetings I have held with the Traveling Mechanics we have discussed getting Local Chairman for each of the Districts and possibly another for the Systems Gangs. I believe this was well received by everyone I talked to. I am actively looking for anyone who may be interested in doing this to contact me so we can move forward.

Meet Sister Virginia Waters, Recording Secretary of Local Lodge 1450 in Chattanooga TN. She gave DL 19 Staff members a great informative tour of her Chattanooga Diesel Shop facility. She filled us in on all the doings of LL 1450. The next day she volunteered her time to the DL 19 GDA Golf Tournament. She worked registra-tion and as a course monitor. She is with Venus, a Guide Dog who will very soon be giving independence to a vision impaired person. Sister Waters, We can’t thank you enough for your hospitality and your service to your Local Lodge, the Guide Dogs of America and District Lodge 19.

Report of GC J. Hartford

Negotiations continue with minimal to no progress. Our last meeting was in late February, we had an-other meeting date set for the last week of March and METRA cancelled at the last minute. Current-ly we are working on setting up another date. Due to good communication among all the crafts on property we are hearing that METRA is proposing a 1-year agreement, with a minimal GWI and leav-ing an uncertain healthcare benefit package. This offer has not been given to us yet but quite certain we will see it the near future. Our members under-stand this is going to be a long tough round of ne-gotiations and I appreciate all their hard work and patience. District 19 and their bargaining commit-tee remain committed to providing them the best agreement possible.

Greetings District Lodge 19 Members, I hope everyone had a great New Year and winter and ready to enjoy warmer weather. We have had a tremendously productive winter and spring and will continue to keep the momentum moving forward into the summer.

Terminal Railway Alabama State Docks (TR-ASD) In January our members ratified a 5-year agreement with 12% GWI over the life of the agreement and their healthcare benefits remain frozen at the cur-rent rates for the life of the agreement. I want to thank Tommy Wilkinson, Hayes Anderson, and Mike Sims for all their hard work and patients dur-ing these negotiations. They truly keep TR-ASD up and running.

This increase in the workforce is partly due to the effects of the late Hunter Harrison and his Precision Schedule Railroading he brought to CN in 2003. This winter hit CN Machinists unusually hard, nu-merous locations saw temperatures dip below -35 degrees (without the wind chill) for several days and more snow than they could handle. Even with these winter conditions our members continued to work and keep CN on the rails. Overtime was abundant and at times they were forced to work 12 hour shifts but they understood the situation continued to work safely and prevailed.

In January our members at Bombardier’s outlying points in Brunswick, MD and Martinsburg, WV transferred from LL 212 to LL 486. LL 486 members work at Bombardier’s Riverside facility in Baltimore, MD and deal directly with Bom-bardier management. This transfer brings better representation to our members and better commu-nication between all Machinists working at Bom-bardier. Local Chairman Greg Rawlings and I visited Brunswick and Martinsburg in February to meet with the new members of LL 486.

We had our first meeting in January since serving section 6 in October 2018. We made progress and are looking forward to our next meeting. Due to unexpected situations, NCVA and our bargaining committee have had to postpone our scheduled meetings and we are currently working on setting another date. Our members are committed to working hard and remaining patient in order to get the best agreement possible. I remain in good communication with my other properties and continue to ensure our members are treated fairly and have a voice on the job. This task can not be done alone and all of us need to do our fair share to preserve our right to dignity and respect on the job.

Keep working safely. Be a diligent union member, abide by the agreement and help in the enforcement of the agreement by informing your Local Chair-man of problems. Protect your job and your fami-ly’s livelihood by following all the established rules and procedures of the Carrier. They can’t disci-pline you for following the rules.

I am currently progressing a grievance to be heard in Arbitration on this property.

Norfolk southern has started its Precision Sched-uled Railroading (PSR). As I am sure you’re all aware this will affect us all. The Carrier fur-loughed 25 machinists last month. Continue to educate yourselves with the Work Rule Agree-ment to help police management and pass any vio-lations to your Local Chairman.

In March we had a claims conference where I con-ferenced 12 discipline and grievance claims. Also in March we had a shop craft coalition meeting. During this meeting the Carrier discussed their PSR plan which included the same information they presented at their shareholders meeting. Dur-ing the meeting the Carrier discussed force reduc-tions in which their basis of these reductions is the statistic that they only need half a craft person per locomotive to maintain the locomotive. As the Carrier stores more of their locomotive fleet we can expect more force reductions. I was also ap-proached about Training Gang Leaders and again will be working to have them reinstated again. During the meeting the efficiency of Supervisory Gang Leaders was brought up by myself and the IBEW. The Carrier will be reviewing the use and number of SGL’s. Currently at some locations management have completely removed them from their shop.

In April I had a PLB hearing and argued 13 cases before an arbitrator. We are awaiting to receive the official decisions. There are still an addition-al 6 cases waiting for funding through the NMB to be heard and 12 more open cases in various stages of the appeal process.

District 19 is currently working with the IAMAW Grand Lodge Legislative Department to combat PSR on Capitol Hill. Please pass on any infor-mation to your Local Chairman and/or myself per-taining to lessened safety, maintenance, forced overtime due furloughs/insufficient manpower and any other possible safety deficiencies.

Local Lodge 409 received an award at the 2019 Ma-chinists Non-partisan Political League (MNPL) annual conference for being the highest contributing local with a membership size of under 100 members. LL 409 is an active local in the Maine State Council of Machinists and understands the value of having our voice heard in State and Federal politics. When Dis-trict Lodge 19 started the DL 19 Club, LL 409 signed up over 75% of the membership through voluntary payroll deductions to MNPL. Members realize how important contributing to MNPL is and gives more than the minimum requirement to be a part of the DL 19 Club. LL 409’s leadership is continually encourag-ing members to contribute to MNPL and is constantly educating everyone on working family’s issues and the politicians and candidates who support our values. CSX continues to have no idea to what their plan is to how they are going to structure their machinist work force across their system. On April 7, 2019, 46 machinists were furloughed from the Russell, KY Shop. CSX will continue to keep the Service Center open and have some of our members work-ing at that location. Those machinist at that loca-tion will be covered by the WARN Act for 60 days after the furlough which at that time they will be able to draw EPA if they are eligible depending on their years of service. On that day, CSX also fur-loughed 11 machinists at Waycross Heavy Repair. On April 25, 2019, they did call 2 of our brothers back to work 18 days after they were furloughed. Those members at Waycross will also be available for EPA depending on their years of service. On April 29, 2019, 2 of our brothers were furloughed in Birmingham, AL. They both are eligible for EPA so they will have that option in the future. I would like for us to think about these members and their families in our thoughts and prayers. Preci-sion Railroad is tough but these members have a lot of uncertainty in their life.

There have been 8-10 machinist jobs that have been added on at the Cincinnati Locomotive Shop. This is a positive for some of our brothers that are will-ing to transfer to that location. The Cumberland Locomotive Shop has also added machinist jobs back in mid-April. CSX furloughed 38 machinists on May 11, 2018, at Cumberland but now has called 16 of those back to service.

In March PLB 7539 cases were heard and the arbi-trator brought one of our members back to work. The arbitrator also reduced the suspension of a member by 15 days answer the questions that are asked.

Thank you to the members that take the time to be the Local Chairman and Union Leaders at CSX lo-cations with me. I know that during these times of Precision Railroad there are a lot of questions and they are tough. With good communication we will answer the questions that are asked.

South Central Florida Express was served their Section 6 notice in the month of April. There have been 2 meetings of negotiations with SCFE and more scheduled for May and June. The ne-gotiations are ongoing at the current time. The District has received the surveys that were taken at SCFE and are being processed at this time. There is a member that was discharged due to discipline at SCFE. His case was heard by an arbitrator and he is in the process of being put back to work by the arbitrator. I would like to start off by thanking the members of LL 1352 and LL 591 for sending representatives to the IAM Transportation Conference. I believe this was the best and most informative Transporta-tion Conference to date. We had over 800 IAM delegates from both the Rail and Airline Industries. The next conference in 2021 promises to be even larger.

Greetings District Lodge 19 Members,

CSX has started to furlough our Members again. Last month one Machinist was furloughed at the Flint Michigan location and returned to service after three weeks. Our members at the Russell KY and Waycross GA shops have not yet been so lucky. On April 5, 2019 I received a call and email from labor relations at 5:09 AM to inform us of furloughs at both locations. The Russell KY shop and Waycross Back Shop were closed that day. A total of 57 Machinists were sent home, 46 at Rus-sell received full pay for the next 60 days.

Most everyone will be protected by the negotiated EPA (Employee Protection Agreement) for at least one year. The timing of the Russell closure al-lowed me to travel up to Russel that Friday and meet with any Machinist that was willing to come out. A Furloughed Member secured the Fellowship Hall at his Church for this meeting on very short notice. Thank You Mark Daniels for making this meeting possible for our Members in need.

Since these furloughs, two members have been reinstated at Waycross and four Russell Members have transferred to the Cincinnati OH shop. As usual CSX appears to be shooting from the hip when making decisions, there have already been rumors of the reopening of the Russell Shop after less than one month being closed.

Members at CSX are not alone as Precision Sched-uled Railroading (PSR) has fully infected most other railroads. District 19 is currently collecting information about the effects of PSR in an effort to possibly use current laws and proposed legislation to protect our Members and the Public. Pleas for-ward any information regarding these effects to me at any time via Email.

Amtrak continues to go through management changes at the top levels of the Mechanical De-partment. So far the new leadership has been open to our members concerns and we are working to-gether to overcome a long history of mistrust.

We are still awaiting the Arbitrators decision on the “Me Too” claim we filed with the Carrier con-cerning our monthly contribution.

Amtrak is currently taking applications for multi-ple Machinists positions in Seattle WA where they just opened their new state of the art Loco-motive Repair Facility.
