14Clear-Up Notification

Madigan Gill operate a Waste Clear-Up Notification for sub-contractors who do not carry out theirhouse keeping duties or through their acts and omissions block fire escapes and pedestrian accessroutes. This system is flexible in its approach as occurrences which are deemed a health and safety issueare dealt with immediately with photo records taken with the contra charge being issuedretrospectively.

The project Waste Management Strategy will be based on agreement of the desired Site WasteManagement Plan. The results of which contribute to the target BREEAM score of;

■ The nature of waste materials to be managed within the Package Scope of Works■ Volume of waste materials to be managed within the Package Scope of Works■ Desire to segregate waste materials on site and to maximise recycling statistics■ Availability and locality of space for waste management operations■ Commercial viability of different waste management techniques

We have assumed that responsibility for the management of the following waste streamswould remain with the relevant Sub-contractors, should this not be the case we would behappy to discuss broadening the proposed waste strategy to include these wastes:

■ Substructure and Superstructure trades■ Groundwork’s, External Works, Paving■ Concrete / reinforcement / formwork■ Structural steelwork■ Concrete Frame & Floors■ Scaffolding tubes, fittings & boards■ Edge protection■ Hard & Soft Landscaping■ Utilities / Stats works■ Over-ordered, damaged or condemned materials■ Temporary works materials - weatherproofing, hoarding, step-overs, kelly-blocks,

protection■ Returnable packaging – Pallets, stillages, skids, blocks

Counter Charge Management

It is the policy (and philosophy) of MadiganGill to takeresponsibility for the housekeeping and cleanliness of eachproject we work on.

As such, we continually encourage other contractors to ‘invest’ inthe same policy, to enable the logistics contractor to work withthe other contractors to maintain a clean, safe & tidy site.

Through education, stringent management & constantmonitoring, our logistics management work (on behalf ofManagement) would assist to create a site culture that allows theproject to progress without hindrance, whilst maintaining theexpected project housekeeping standards.

In conjunction with this philosophy, our logistics personnel alwaysendeavour to take all reasonable steps to ensure thatsub-contractors comply with the site requirements for wastedisposal.

Unfortunately, through experience, we know that fit-outcontractors may fail on occasions to place waste into the wheeliebinsprovided.

Continued failure, irrespective of the actions of the logisticscontractor by fit-out contractors to comply with the siterequirements is unacceptable and would normally result in thelogistics company being requested to carry out this task on thebehalf of the management contractor. This subsequently incurstimely and contractual correspondence.

To manage this aspect of the project on behalf of , MadiganGillwould normally employ the use of our bespoke Contra-ChargeManagement System

This completely computerised system allows for quick and efficientissue of Clearance Notifications to offending fit-out contractors,including photographic evidence, tracking of responses to ClearanceNotifications, Secondary Notification of failure to action by the fit-out contractor and the resources deployed by MadiganGill to rectify.

This system allows for easy exporting of reports into spreadsheetformat for use in management reports, Directors meetings, andcommercial processing.

MadiganGill have drafted (with the assistance of legal professionals)contractual wording which can be inserted into Sub-contracts and isintended to offer protection to both Construction and MadiganGill.

This Clause reinforces the contra-charge process to the contractorsand makes them fully aware of theconsequences of failing to comply with Clearance Notices issued byMadiganGill on behalf of Construction. A copy of this wording isavailable upon request.
