USDOL’s Role in the IB Program

•Oversight *

Provide technical assistance to the IB SubcommitteePublish and maintain procedures, handbooks, training

materials, etc. as agreed to by the Subcommittee Promote State’s adherence to the proceduresProvide guidance to the StatesKeep the Subcommittee informed of Federal law or

policies that affect the operation of IB program and of States that do not adhere to IB procedures

Interstate Benefits Subcommittee

The mission of the Interstate Benefits System is to provide methods for the exchange of information among states and Canada to support Unemployment Compensation benefit determinations and workforce security objectives.

•The NASWA consultant to USDOL on the Combined Wage Claim process.

•Acts as the state voice for Federal Programs

•Works with USDOL on IB, CWC, and Federal Program issues and concerns

•Maintains the Interstate Benefit 5 year plan

•Each state is represented by a member from its region. •Canada, USDOL and the UI ICON contractor, Xerox have liaison seats on the Sub-committee

IB Subcommittee ResponsibilitiesThe IB Sub-committee:•Is charged with the responsibilities set forth in Part II of the Interstate Benefit Payment Plan

•Is responsible for issuing rules, regulations, instructions, procedural forms/record formats, and interpretative decisions relating to the IB Plan to be used by the State Agencies.

•Provides guidance and assistance in resolving differences between the State Agencies.

Each State’s Responsibility in the IB Program

Each State agreed to adopt and put into force and effect each rule, regulation, instruction, procedural form (record format) and interpretative decision relating to the IB program issued by the NASWA IB Subcommittee, except those the State finds to be clearly inconsistent with the STATUTORY provisions of the State law.

•States’ Participation is not voluntary.

• All States, DC, PR and VI are required to have provisions for CWC program participation in State law as a condition of State law approval. (Required by Section 3304(a)(9)(B) of the Internal Revenue Code.)

•Canada is not signatory to this agreement

•“Paying State” definition as of January 6, 2009; See UIPL 01-09

Role of IB Subcommittee in the CWC Program

Represents the States in requesting changes to the program.

Represents the States in consultations with the DOL concerning any automation or other changes the DOL may want to make to the program.

USDOL’s Role in the CWC Program

•Oversight

•Develop and issue rules, regulations and procedures in consultation with States (IB Subcommittee).

•Provide guidance to the States.

•Keep the Subcommittee informed of Federal law or policies that affect the operation of CWC program.

Responsibilities of the IPC

◦ Provide oversight of state’s IB Program◦ Promote prompt implementation of ICON applications◦ Respond to IB Subcommittee Regional Rep member’s

requests◦ Keep ICON on-line handbooks updated◦ Review reports (i.e. LADT)◦ Expedite the handling of difficult claims◦ Ensure UNIFORM interpretation of the IB requirements within

the State agency

◦ Serve as point of contact for States and Federal Regional or National office concerning IB, CWC, ICON activities.

◦ Provide leadership and assistance, and monitor the State’s administration of the interstate and combined wage programs.

◦ Ensure that IB/CWC procedures and guidelines are followed by the State (including telephone and internet procedures).

◦ Conduct or assist in conducting IB/CWC training for appropriate state staff.

◦ Review the consolidated contact list for accuracy and send updates as changes occur

◦ Promote prompt implementation of ICON applications by the State.

◦ Work with ICON programmer to design the interface of the ICON Model Code (or State equivalent) to the State’s wage and benefit systems

◦ Create administrative reports for use in monitoring the States activities and performance.

◦ Represent State’s position on IB/CWC/ICON issues being reviewed by the IB Subcommittee through communication with Regional IB Subcommittee representative.
