Maximum Reserves
• The reserve price is the lowest price that the Vendoris prepared to accept for the property.
• If the bidding does not reach the reserve price, thenthe seller is not required to sell the property.
• The reserve price will be set at a figure which is eitherlower than, or the same as, the maximum reserve. Itwill not be higher.
• The reserve price itself will not be disclosed

Identification
If you are the successful bidder, you will be asked toprovide two forms of identification. Please bring to theAuction some form of photo identity such as yourpassport or driving licence and, in addition, bring proof ofyour address such as a utility bill or bank statement. Wewill take and retain photocopies of your identificationdocuments for our records.
Deposits
Please note that cash deposits cannot be accepted inany circumstances. However, personal cheques,company cheques and banker’s drafts are acceptablesubject to any relevant conditions of sale. Cheques mustbe made payable to Allsop Space Ltd.

This Glossary applies to the Auction Conduct Conditions wherever it
makes sense
• singular words can be read as plurals, and plurals as singular

contract date (as applicable); and

ACTUAL COMPLETION DATE The date when COMPLETION takes place or is treated as taking place
for the purposes of apportionment and calculating interest
ADDENDUM An amendment or addition to the CONDITIONS or to the
PARTICULARS or to both whether contained in a supplement to the
CATALOGUE, a written notice from the AUCTIONEERS or an oral
announcement at the AUCTION
AGREED COMPLETION DATE(a) the date specified in the CONTRACT FOR SALE, or
(b) if no date is specified, 28 DAYS after the CONTRACT DATE but if
that date is not a BUSINESS DAY the first subsequent BUSINESS

GENERAL CONDITIONS The part of the CONTRACT FOR SALE so headed
INTEREST RATE If not specified in the CONTRACT FOR SALE, 4% above the CourtRate obtaining pursuant to Section 22 Courts Act 1981 (the INTERESTRATE will also apply to judgment debts, if applicable)
LOT Each separate property described in the CATALOGUE or (as the casemay be) the property that the VENDOR has agreed to sell and thePURCHASER to buy (including CHATTELS if any)
MORTGAGEA charge to secure a loan or other financial indebtedness (notincluding a rent charge)
PARTICULARS The section of the CATALOGUE that contains descriptions of eachLOT (as varied by any ADDENDUM)
PURCHASER The person who agrees to buy the LOT or, if applicable, that person’spersonal representatives: if two or more are jointly the PURCHASER allobligations can be enforced against them jointly or against each ofthem separately
PURCHASE PRICE The price that the PURCHASER agrees to pay for the LOT
READY TO COMPLETE Ready, willing and able to complete: if COMPLETION would enable theVENDOR to discharge all MORTGAGES secured on the LOT that haveto be discharged by COMPLETION, then those outstandingMORTGAGES do not prevent the VENDOR from being READY TOCOMPLETE

Guidance for Prospective Purchasers and Auction Conduct Conditions
These notices are intended to assist you as aprospective purchaser. Legal matters in Irelandcan be complex and so these Guidance Notes,the Auction Conduct Conditions, the Auctioneer’sPre-Sale Announcements printed in thiscatalogue, together with any other conditions,documents or matters affecting the Lot you areinterested in should be read and consideredcarefully. Whilst the Vendors of the Lotsdescribed in this catalogue have used reasonableefforts to ensure that Lots are correctlydescribed, we strongly recommend that youappoint professional advisors includingindependent legal advisors and arrange for themto consider and advise you on all aspects of yourintended purchase.
1. RESERVE PRICES The Auctioneers have not carried out valuations ofany of the Lots in the Auction. Consequently, youshould not treat any reserve price that is publishedin respect of a Lot nor any estimate or suggestionas to the price for which a Lot may be sold or pricethat you might consider bidding for a Lot as being avaluation for that Lot. It is your responsibility todecide how much you should bid for any Lot.
2. CONDITIONS OF SALE2.1 If you are the successful Purchaser of any Lot, you
will, from the moment the Auctioneer’s gavel falls,become legally bound by the Conditions of Sale inrelation to that Lot.
2.2 It will be assumed that you have read andconsidered the Conditions of Sale and any otherrelevant documents for the Lot(s) you are interestedin before the day of the Auction, that you haveshown them to your professional advisors and takentheir professional advice before bidding.
2.3 The Conditions of Sale consist of the following:
• The Auction Conduct Conditions including theExtra Auction Conduct Conditions printed in PartTwo of these Auctioneers’ Notices
• The Law Society General Conditions of Sale (2009edition) and the Special Conditions of Sale for theLot (not printed in the catalogue but obtainablefrom the Vendor’s solicitors or the Auctioneers)
• Any addendum or addenda relating to the Lot
2.4 An addendum will be available before and will bedistributed at the Auction. This important documentwill detail any corrections, amendments and/oradditions to the particulars and conditions of salefor any of the Lots. It will be assumed that you haveread the addendum and have satisfied yourself asto the context and implications of any addendumitem relating to any Lot you are interested in beforebidding.
2.5 Please note that some or all of the conditions ofsale relating to certain Lots might be contained in aseparate catalogue or might be obtainableseparately from the Vendor’s solicitors or theAuctioneers.
3. PROCEDURES ON SALE OF THE LOT 3.1 After a Lot is knocked down to you, you will be
given a Purchaser’s Slip which you must completewith all the required information. You will be askedto produce a minimum of two forms of identificationboth of which should relate to you as bidder.Acceptable identification must consist of, firstly,some form of photo identity such as a driver’slicence or passport and secondly evidence of youraddress such as a recent utility bill or bankstatement. You acknowledge and agree that wemay take photocopies of your identificationdocuments and that we may retain them for ourrecords in order to comply with our bidderidentification procedures.
3.2 When completing the Purchaser’s Slip, you mustspecifically name the person or organisation that isto be the Purchaser of the Lot. Lots cannot betransferred to an unnamed Purchaser. References inthe Purchaser’s Slip to the Purchaser’s ‘nominees’,‘associates’ or similar terms are not acceptable.Unless you obtain the Vendors prior consent the Lotcan only be transferred to the Purchaser named inthe Purchaser’s Slip and Sale Memorandum.
3.3 When you have completed the Purchaser’s Slip andpaid the deposit, you will be given a card showingthe number of the Lot you have bought and the saleprice. It is imperative that you do not lose this card.
3.4 The Auctioneers will prepare the Contract for Sale induplicate. Before leaving the Auction room, youmust attend the contracts desk situated near theAuction room where you must produce the Lot cardreferred to above and your identification documentsand sign your part of the Contract for Sale. You willthen be given the duplicate copy of the contract,signed on behalf of the Vendor, in exchange.
4. DEPOSIT 4.1 The deposit is the sum you must pay to the Vendor
upon acceptance by the Auctioneer of your bid as aguarantee that you will proceed to completion of thepurchase. If completion takes place without dispute,the sum becomes part payment of the purchaseprice. DEPOSITS MUST BE PAID IN EUROS
4.2 A deposit taken as agent for the Vendor effectivelybelongs to the Vendor as soon as it is paid and willbe released to him after the auction without furtherreference to you. You may have a right to recover itfrom the Vendor if the Vendor fails to complete.
4.3 A deposit taken by the Auctioneers as stakeholderwill be held in the client account until completion.The Auctioneers are entitled to keep interest earnedon the deposit during the time it is held by them.

4.4 You are at risk of losing the deposit paid on a Lotand at risk of the Vendor taking legal action againstyou for breach of contract if you fail to completeyour purchase of the Lot.
4.5 The deposit must be given to the Auctioneers’ clerktogether with the completed Purchaser’s slip.
4.6 If you buy more than one Lot, you will need to pay aseparate deposit for each Lot.
4.7 Deposit cheques are accepted on the basis thatthere are adequate cleared funds in the accountupon which the cheque is drawn. Deposit Chequesmay be specially cleared immediately followingreceipt on the day of the Auction but otherwise willbe presented for clearance first thing on themorning after the auction. The Vendor may takeaction against you if your cheque is not honouredon first presentation. You are therefore stronglyadvised to ensure that there are adequate fundsavailable in the account to meet any depositcheque(s) that are drawn as a result of the Auction.
4.8 All deposit cheques should be made payable toAllsop Space Ltd unless the Special Conditions ofSale state otherwise.
4.9 For the purposes of the definition of ApprovedFinancial Institution contained in the Glossary to theCommon Auction Conditions deposit cheques orbankers drafts will also be acceptable where drawnon a bank or building society or branch of a bank orbuilding society that is situated in Ireland.
4.10 A full explanation of the Auctioneers deposit termsand procedures is available on request from theAuctioneers.
5. PROXY, TELEPHONE AND INTERNET BIDDING 5.1 If you are unable to attend the Auction but wish to
bid by proxy or telephone or over the internet youwill need to complete the Registration Form forRemote Bidders printed towards the back of thiscatalogue and send it to the Auctioneers with yourdeposit and proof of identity before the Auction. Ifyou contact the auction department, they willexplain the remote bidding procedures in detail toyou.
5.2 If you bid by proxy, telephone or over the internet,you will, in addition to the Conditions of Sale, belegally bound by the Terms and Conditions forRemote Bidders printed towards the back of thiscatalogue.
6. PLANS AND PHOTOGRAPHS 6.1 The plans and photographs shown in the catalogue
are included in order to assist you in locating theLot in question. They are not necessarily drawn toscale and any arrows on plans or photographs aremerely to assist you in finding the Lot, not for thepurpose of indicating legal boundaries. TheAuctioneers cannot guarantee that any plans orphotographs show the up to date position withregard to occupiers either for the Lot or for anyother properties shown in such plans orphotographs.
7. CONDITION, INSPECTION AND VACANTPOSSESSION
7.1 It is strongly recommended that, as a prudentpurchaser you make every effort to physicallyinspect the Lot and where possible, arrange to haveit professionally surveyed prior to the Auction.
7.2 If you want to inspect the Lot before the Auction,it may be possible to arrange this with theAuctioneers on prior notice and you shouldtherefore contact them in advance of the auction.
7.3 Keys to Lots that are offered for sale with vacantpossession will normally be made available to youon completion of the sale. However, access to theLot for the purpose of inspection and/or carryingout a survey might be available prior to completionsubject to obtaining the Vendor’s permission (youshould approach the Auctioneers about this).
8. RENTS AND INFORMATION RELATING TOTENANTS
8.1 Financial and other information given in thecatalogue particulars for any Lot relating to tenantsor other occupiers of the Lot is usually obtainedfrom a credit reference agency that has access tothe Companies Registration Office (whose files areopen to public inspection and verification) or frompublished reports and accounts of the tenant ortenant’s holding company, unless otherwise stated.
8.2 The Auctioneers obtain this information duringcompilation of the catalogue. Some of theinformation shown in the catalogue may be at leasttwo years out of date depending on when returnswere last filed at the Companies Registration Officeor on when the tenant’s corporate accounts andreport were last published. In addition, thecircumstances of any tenants or other occupiers ofthe Lot might have changed since compilation ofthe catalogue, for example as to ownership. Thereis no guarantee therefore that the information shownin the catalogue is accurate or up to date as at thedate of the Auction and it is your responsibility tocheck whether or not the catalogue particulars areaccurate in relation to such matters.
8.3 Estimates or suggestions given by the Auctioneersas to current or future rental values affecting any Lotor as to the current or future open market rentalvalue of the whole or any part of the Lot must notbe treated as valuations but only as estimates. Youshould consult your own professional advisors toestablish whether such estimates or suggestions areaccurate.
9. The Purchaser agrees and accepts that noinformation, statement, description, quantity ormeasurement contained in any advertisements orgiven orally or contained in any brochure, catalogue,letter, report, docket or hand out issued by or onbehalf of the Vendor or any agent acting on behalfof the Vendor in respect of the Subject Property(whether or not in the course of any representationor negotiations leading to the Sale) shall constitute arepresentation including the Purchaser to enter intothe Sale or a condition or warranty forming p[art ofthis Contract. Any information, statement,description, quantity or measurements so given orcontained in any such advertisement, brochure,catalogue, letter, report or hand out issued by or onbehalf of the Vendor or any agent on its behalf arefor illustration purposes only and are not to be takenas matters of fact and that any mistake, omission,inaccuracy or mis-description given orally or in theform of any advertisement, brochure, catalogue,letter, report or hand out issued by or on behalf ofthe Vendor or any of its agents (whether or not inthe course of any representation or negotiationsleading to the Sale) shall not give rise to any right ofaction, claim, entitlement or compensation againstor from the Vendor or any of its agents under thisagreement or otherwise or any right of residue oftermination. The within Contract comprises theentire of the Contract between the Vendor and thePurchaser and supersedes any other allegedcontract between the parties in relation to theSubject Property. For the avoidance of doubt, theparties hereby acknowledge that any previousagreement which may have been entered into bythe Vendor, Receiver and Purchaser relating to theSubject Property is hereby rescinded. Anystatement, representation or warranty whatsoevermade by the Vendor, agent or employees during thecourse of negotiations leading to the Sale which arenot herein contained and setforth are hereby treatedas having been withdrawn and will have no force oreffect at law whatsoever. General Condition No. 33shall be read subject to this condition.
A1 INTRODUCTIONA1.1 Words in CAPITALS have special meanings, which
are defined in the Glossary.A1.2 The CATALOGUE is issued only on the basis that
YOU accept these AUCTION CONDUCTCONDITIONS. They govern OUR relationship withYOU and cannot be disapplied or varied by theSPECIAL CONDITIONS (even by a CONDITIONpurporting to replace the whole of the Conditions).They can be varied only if WE agree.
A2 OUR ROLEA2.1 As agents for each VENDOR we have authority to:
(a) prepare the CATALOGUE from informationsupplied by or on behalf of each VENDOR;
(b) offer each LOT for sale;(c) sell each LOT;(d) receive and hold the deposit as stakeholder/
agent for the Vendor;(e) sign each CONTRACT FOR SALE; and(f) treat a CONTRACT as repudiated if the
PURCHASER fails to sign a CONTRACT FORSALE or pay a deposit as required by theseAUCTION CONDUCT CONDITIONS.
A2.2 OUR decision on the conduct of the AUCTION isfinal.
A2.3 WE may cancel the AUCTION, or alter the order inwhich LOTS are offered for sale. WE may alsocombine or divide LOTS. A LOT may be sold orwithdrawn from sale prior to the AUCTION.
A2.4 YOU acknowledge that to the extent permitted bylaw WE owe YOU no duty of care and YOU have noclaim against US for any loss.
A3 BIDDING AND RESERVE PRICESA3.1 All bids are to be made in euros exclusive of any
applicable VAT.
A3.2 WE may refuse to accept a bid. WE do not have toexplain why.
A3.3 If there is a dispute over bidding WE are entitled toresolve it, and OUR decision is final.
A3.4 Unless stated otherwise each LOT is subject to aminimum reserve price (which may be fixed justbefore the LOT is offered for sale). If no bid equalsor exceeds that minimum reserve price the LOT willbe withdrawn from the AUCTION.
A3.5 Where there is a minimum reserve price theVENDOR may bid (or ask US or another agent tobid on the VENDOR’S behalf) up to the minimumreserve price but may not make a bid equal to orexceeding the minimum reserve price. YOU acceptthat it is possible that all bids up to the minimumreserve price are bids made by or on behalf of theVENDOR.
A3.6 Where a maximum reserve price (or range of prices)is given that price is the minimum price at which, orrange of prices within which, the VENDOR might beprepared to sell at the date of the maximum reserveprice. A4 THE PARTICULARS AND OTHERINFORMATION

A5 THE CONTRACTA5.1 A successful bid is one WE accept as such

A5.2 YOU are obliged to buy the LOT on the terms of theCONTRACT FOR SALE at the PURCHASE PRICEYOU bid plus VAT (if applicable).
A5.3 YOU must before leaving the AUCTION:
(a) provide all information WE reasonably need fromYOU to enable us to complete the CONTRACTFOR SALE (including proof of your identity ifrequired by US);

A5.4 If YOU do not WE may either:(a) as agent for the VENDOR treat that failure as

(b) Sign the CONTRACT FOR SALE on your behalf
A5.5 The deposit:(a) is to be held as Agent unless the SPECIAL

(b) must be paid in euros by cheque or by bankers’draft made payable to US on an APPROVEDFINANCIAL INSTITUTION. The extra auctionconduct conditions may state if WE accept anyother form of payment.
A5.6 WE may retain the CONTRACT FOR SALE signedby or on behalf of the SELLER until the deposit hasbeen received in cleared funds.
A5.7 If the PURCHASER does not comply with itsobligations under the CONTRACT then:(a) YOU are personally liable to buy the LOT even if
YOU are acting as an agent unless the name ofthe PURCHASER has been clearly identified; and
(b) YOU must indemnify the VENDOR in respect ofany loss the VENDOR incurs as a result of thePURCHASER’S default.
A5.8 Where the PURCHASER is a company YOU warrantthat the PURCHASER is properly constituted andable to buy the LOT.

1 All Lots will be offered for sale in accordance with the
Order of Sale. The Order of Sale will be distributed at
the auction. It will provide details of all Lots which will
have been sold or withdrawn from the sale.
2 An Addendum (if applicable) to the Particulars and
Conditions of Sale will also be distributed.
This important document provides details of all
corrections to the catalogue and/or the conditions of
sale.
Prospective Purchasers are deemed to have read the
Addendum whether they have actually done so or not.
3 Special Conditions of Sale and General Conditions have
usually been available for inspection at the offices of the
Auctioneers or the Vendor’s Solicitors prior to auction.
These will be attached to the Contract for Sale. Any
amendments to the Special Conditions of Sale will be
referred to in the Addendum.
4 We sell on the basis that prospective Purchasers have
made all their enquiries and are satisfied or not, as the
case may be, as a result of such enquiries and that they
have read the Notices within the catalogue and the
conditions of sale at the back and fully understand their
content.

8 We only accept deposit cheques on the basis that thereare adequate funds in the account upon which thecheque is drawn. Our clients reserve their rights to takeany action they feel appropriate against a Purchaserwhose cheque is not honoured on the first presentation.Prospective Purchasers are strongly advised to ensurethat there are adequate funds to meet any depositcheques that are drawn as a result of the day’sproceedings.

We will photocopy your identification documentsand retain the copies for our records in order to complywith our bidder identification procedures. In return forthe completed Purchaser’s Slip and deposit, you will begiven a Purchaser’s Identification Card as proof of yourpurchase. These terms and conditions apply to You and You will be bound bythem if You bid by proxy, telephone or internet
Allsop means Allsop Property Consultants LImited. Allsopis, a limited liability company registered in Irelandwith registered number 485113, whose registeredoffice is at Fourth Floor, Ulysses House, FoleyStreet, Dublin 1
Allsop Space means Allsop and Space acting as JointAuctioneers.
Auctioneers means Allsop’s and Space’s auctioneer havingconduct of the Auction
Purchaser means the person, firm or company identified inSection Two of the Registration Form who agreesto buy the Lot and who is intended to be the ownerof the Lot
Space means Space Lettings Limited. Space is a limited liability company registered in Ireland withregistered number 464025, whose registered officeis at 7 Pembroke Street Lower, Dublin 2
Vendor means the person selling the Lot
You (and Your) means the person identified in Section One of theRegistration Form (whether or not the Purchaser),being someone who bids by remote means at theAuction, whether by proxy or by telephone or viathe internet
Auction means the Allsop Space residential auction to beheld at the time and place and on the dateadvertised in the Auction catalogue in which the Lotappears
Business Days has the same meaning as in the Law SocietyGeneral Conditions of Sale (2009 edition)
Conditions of Sale means the Auction Conduct Conditions containedin Part Two of the Auctioneers’ Notices printedtowards the front of the Auction catalogue togetherwith the General Conditions of Sale and anySpecial Conditions of Sale and any addenda thatare applicable and/or relevant to the Lot
Lot means the property for which You bid remotely atthe Auction (the Auction catalogue Lot number forwhich you have entered in Section One of theRegistration Form)
Maximum Bid Price means the maximum price that You wish to bid forthe Lot. This must be shown exclusive of any VATthat might be applicable
Registration Form means the registration form for proxy, telephoneand internet bidding printed overleaf and alsoavailable to download from the Auctioneers’website at www.allsopspace.ie
VAT means Value Added Tax or any other tax of asimilar nature
1. Registration Form
1.1 If You wish to bid at the Auction by proxy, telephone or internet, Youshould complete the Registration Form, entering Your full details inSection One and full details of the intended Purchaser in SectionTwo.
1.2 You should sign the Registration Form where indicated on behalf ofyourself and (if different) the intended Purchaser. We regret thatfailure to sign will be treated as a fundamental error in theRegistration Form that will entitle the Auctioneer to disregard yourbid.
1.3 In the event that Your bid is successful, the details appearing inSection Two of the Registration Form will be entered on theContract for Sale for the Lot. Changes to these details may not bemade without the Vendor’s prior consent for which the Vendormight make a charge. References to ‘nominee’ or ‘associates’ orsimilar are unacceptable.
1.4 The Registration Form may be used to bid remotely for one or moreLots but each Lot number and address must be clearly stated. A separate cheque or banker’s draft is required in respect of thedeposit for each Lot for which You wish to bid.
1.5 The completed Registration Form together with
(a) two copy forms of identification for You as bidder, consisting of firstly a form of photo identification such as Your passport orcurrent driving licence and secondly proof of Your address suchas a recent utility bill or bank statement
(b) a cheque or banker’s draft in respect of the appropriate depositshould be delivered to Allsop Space Limited, 7 Pembroke StreetLower, Dublin 2, for the attention of Robert Hoban by hand or bypost so that it is received not less than 48 hours prior to the date of the Auction. Please note that Your copy identification documents will be retained by the Auctioneers forthe Auctioneers’ records in order to comply with their bidderidentification procedures
1.6 If You wish to alter any of the details appearing on the RegistrationForm, You should notify the Auctioneer of this in writing (but not bye-mail) prior to the commencement of the Auction. Changes to theRegistration Form may only be made if the Auctioneer agrees tothem. Commencement times for the Auction are published on theAuctioneers’ website and are printed in the Auction catalogue.
1.7 In the event that there is any error or confusion in either theRegistration Form or the accompanying deposit or in Yourinstructions, the Auctioneers reserve the right not to accept Yourbid. Please note that the Auctioneer’s decision as to whatconstitutes error or confusion is final.
2. Deposit 2.1 The Registration Form should be returned together with a valid
cheque or banker’s draft drawn in euros on an Approved FinancialInstitution for a sum representing the greater of:
(a) the minimum deposit of €3500 (or the total of Your MaximumBid Price if this is less than that minimum), and
(b) 10% of Your Maximum Bid Price (as indicated in Section One ofthe Registration Form), exclusive of VAT.
2.2 If You bid by telephone or internet, You may instead provide asigned blank cheque which, if Your bid is successful, theAuctioneers will complete on Your behalf for the amount of thedeposit.
2.3 If You successfully bid for the Lot and the purchase price for the Lotis less than Your Maximum Bid Price, then any excess of thedeposit you have provided may be treated as additional deposit inrespect of the Lot to be held according to the Conditions of Salepending completion of the sale and purchase of the Lot and, in thisevent, You authorise the Auctioneer to retain the excess amount forthis purpose.
2.4 In the event that Your bid for the Lot is unsuccessful (includingwhere the Lot has been withdrawn or sold prior to the Auction), thenthe Auctioneers may destroy any cheque that You have provided byway of deposit and, for the avoidance of doubt, the Auctioneersshall not be obliged to return any such cheque to You. However,any banker’s draft that You provide by way of deposit will, in thesecircumstances, be returned to You.
2.5 The Auctioneers shall not be obliged to account to You for anyinterest accruing on any deposit that You provide in respect of anyremote bid.
3. Proxy Bids 3.1 If You bid at the Auction by proxy, You should enter Your Maximum
Bid Price in Section One of the Registration Form.
3.2 The Maximum Bid Price must be an exact figure (accordingly,wording such as ‘€100 over the highest bid in the room’ will not beacceptable). Failure to clearly indicate Your Maximum Bid Price willinvalidate Your bid.
3.3 If You bid by proxy, You appoint the Auctioneer as Your agent andYou authorise the Auctioneers to bid for the Lot on Your behalf upto (but not in excess of) Your Maximum Bid Price in whatevermanner the Auctioneers in their absolute discretion thinks fit.
3.4 You may, in writing only, withdraw Your proxy bid at any time up tothe commencement of the Auction. It is Your responsibility to ensurethat the Auctioneers receives Your instructions to this effect and Youare advised to check that such instructions have been received.
3.5 As soon as reasonably possible after the Auction, You will benotified of whether or not Your proxy bid for the Lot was successful.
4. Terms of Sale/Conduct of the Auction 4.1 If Your bid is successful, You will purchase subject to and will
become bound by the Conditions of Sale which You will beconsidered to have inspected and to be fully aware of prior to theAuction.
4.2 It is possible that, at any time up to the commencement of biddingat the Auction, corrections, amendments and/or additions may bemade to the Conditions of Sale for the Lot or any other mattersrelating to it. Such amendments are publicised by means of writtenaddenda and by verbal addenda announced from the rostrum. Youwill be deemed to have knowledge of such matters (including, forthe avoidance of doubt, any late addenda that are announcedverbally from the rostrum) and, if Your bid is successful, will buysubject to them in any event. Provided that Your Registration Formis received by the Auctioneers at least 48 hours prior to the Auctionand You have provided a fax number, the Auctioneers will usereasonable endeavours to fax to You any written addenda relating tothe Lot by the night prior to the Auction. In any event, You areadvised to refer to the Auctioneers’ website where an up-to-dateaddendum for all Lots is published up to the night before theAuction. In addition, You may telephone the Auctioneers’ residentialauction department (Tel: +353 (0) 1676 2033) between 8.30 am and9.30 am on the day of the Auction to establish whether there areany late addenda (including, where known at the time of your call,verbal addenda that are to be announced from the rostrum) that areapplicable to the Lot. The Auctioneers will not be responsible for anylosses, costs or damages that You may incur as a result of any ofthe matters referred to under this clause.
4.3 If Your bid is successful, the Auctioneer or any person authorised bythe Auctioneer, will sign the Contract for Sale or sale contractrelating to the Lot on Your behalf.
4.4 The amount of Your Maximum Bid Price for the Lot will not bedisclosed by the Auctioneer to the Vendor without Your priorconsent.
4.5 If, after registering Your remote bid, You wish to bid for the Lot inperson (including through an agent appointed by You who attendsthe Auction on Your behalf), You must notify such intention in writingto the Auctioneer prior to the Lot being offered for sale. In this event,You accept and agree that the Auctioneer will not then make anybids on your behalf.
5. Disclaimer 5.1 There is no substitute for being present in the room and the
Auctioneers strongly recommend that You attend the Auctionpersonally in order to bid. However, the Auctioneers will usereasonable endeavours to provide remote bidding facilities at theAuction in accordance with these Terms and Conditions and willmake no additional charge for such service.
5.2 The Auctioneers will have no liability or responsibility whatsoevertowards You in the event of Your remote bid not being made as aresult of:• unclear instructions • error, lack of clarity or confusion regarding the Registration Form
or the deposit • any change in the date, time and/or venue for the Auction• interruption or suspension of telephone or internet bidding services • You being unobtainable by telephone or becoming disconnected
during the course of bidding by telephone or via the internet • any other factor beyond the Auctioneers’ control.
In any such case, neither the Auctioneer nor any member or employee ofthe Auctioneers shall be held responsible or liable for any loss, cost, claim,demand or damage that You may incur as a result.
