ISPA IN ROMANIA

PROGRAMME TITLE Ispa

From 2007 onwards, the Ispa support for will be automatically converted in Cohesion Funds and the entire envelope will increase substantially (7-8 times bigger than the Ispa package at the time of accession) challenging the Romanian authorities to set up and strengthen appropriate coordination and administrative structures to increase the absorption capacity.

SECTORS RECEIVING ASSISTANCE • Environment: bringing the applicants to the EU environmental standards Candidate countries will need to undertake significant investments, in order to be able to fully implement the EU environmental legislation and meet the EU environmental standards. Ispa will concentrate on the most "investment heavy" environmental directives, i.e. directives that are very costly to implement in the following areas: drinking water supply, treatment of waste water, management of solid waste and hazardous waste, air pollution. The implementation of these directives is closely related to the improvement of the health and quality of life of citizens and has a direct positive impact on the economic and social cohesion of the beneficiary countries.

• Transport: extending the Trans-European Transport Networks to the candidate countries There is an urgent need to build and rehabilitate transport infrastructure in the candidate countries and to link it to the Union's transport networks. For the countries concerned, improving their transport infrastructure is a crucial part of their economic development strategies and thus an essential component for the success of the EU accession process. Assistance should go to transport infrastructure projects which encourage sustainable forms of moving people and goods, in particular projects which are of EU interests (identified at the Helsinki and Crete conferences), and also projects which enable the countries concerned to meet the objectives of the Accession Partnerships. This will include expanding the Trans-European Transport Networks to provide good connections between the EU and the applicant countries and interconnections between national networks and links from them to the Trans-European Transport Networks. Ispa is therefore contributing to funding the development of railways, roads, and waterways aiming to bring transport infrastructure in the applicant countries up to the standards of the Union to meet the expected sustainable growth of traffic with direct impact on economic development.

• Technical Assistance: support for the preparation of the projects to be funded The Ispa budget may also be used to fund preparatory studies and technical assistance. A clear link must be shown between these measures and the investments funded by Ispa. Technical assistance will be very important in ensuring a high level of project quality, in terms of preparation, management and impact.

ISPA STRATEGIES AND PIPELINE OF PROJECTS The Romanian authorities have been asked to prepare strategies for Ispa, which identify key priorities in transport and environment and provide a systematic basis for project selection. According to these strategies the Romanian Authorities have to identify the portfolio of projects to cover the whole allocation for the seven years when Ispa will be in force, both in the field of transport and in the field of environment. These strategies have to be periodically updated so that they can reflect the latest priorities of the sectors, conjugated with the National Development Plan as included in the Government Strategy. The European Commission approves the Ispa strategies.

BENEFICIARIES Beneficiaries of the Ispa programme can be local and central authorities (Ministries in line, County Councils, Mayors Offices) and Regies Autonomes, Romanian National Company for Motorways and National Roads and National Company for Railways.

HOW DOES ISPA FUNCTION In order to obtain Ispa funds, the following steps are to be followed:

a. Beneficiaries must submit project proposals to the two Line Ministries (Ministry of Environment and Waters Management and Ministry of Transports, Constructions and Tourism) for evaluation.

b. Line ministries check the projects and their consistency with the strategic papers and fill in an Ispa Application.

c. Ispa applications are then submitted via the Ministry of Public Finance (National Ispa Coordinator (NIC) as central co-ordinating body in the Romanian Government and main contact point for the European Commission) to the European Commission, DG Regio F. The role of the NIC is to submit applications for assistance, organise monitoring committees, and arbitrate between Ministries.

d. The applications are examined by Commission services and (when necessary) discussed with the applicant country. DG Regio submits the acceptable projects for opinion to the Ispa Management Committee, composed of representatives of the Member States.

e. After having received the positive opinion of the Management Committee, the European Commission adopts the project and submits a Financing Memorandum for signature to the beneficiary country

FINANCIAL REQUIREMENTS Projects submitted for approval under Ispa must have a minimum budget of 5 MEURO, out of which a maximum of 75% of public expenditure can be covered by Ispa funds. The rest is to be provided by the beneficiary from central or local budgets, loans, grants from other donors, etc. As the minimum 25% of co-financing from the beneficiary is a pre-requisite for any Ispa project in order to be accepted by the Management Committee, in parallel with the preparation of the Applications, important steps have also been undertaken in order to involve International Financial Institutions (IFIs) in the Ispa projects for Romania. So far, two IFIs were responded: ▪ European Bank for Reconstruction and Development (EBRD) – The EBRD board has approved a

Municipal Environmental Loan Facility (MELF) of 80M€ for Romania, designed to provide co-financing to Ispa Grants in selected municipalities on a non-sovereign basis.

▪ European Investment Bank (EIB), has set up the “Municipal Water Infrastructure Scheme”, a horizontal loan facility to co-finance the environmental projects with sovereign guarantee.

ADMINISTRATIVE STRUCTURES [see Annex I – Ispa Implementing Scheme] • Implementing Authority – is represented by the line ministries for each sector. Ministry of Transports,

Constructions and Tourism and Ministry of Environment and Waters Management are the Implementing Authorities for the Ispa programme. In each of these ministries there are Ispa Co-ordination Units established.

• Implementing Agency – Is nominated with the responsibility to launch call for tenders, to sign contracts

and to follow up the implementation. Commission is having at present ex-ante control, which means that for each step in the tendering process the Implementing Agencies have to get the prior approval from of EC Delegation before moving forward. For the ongoing projects there are four Implementing Agencies: one for environment CFCU (Central Financing and Contracting Unit) and three for transport RNCMNR SA (Romanian National Company for Motorways and National Roads) and CFR (National Railway Company) and the newly established Implementing Agency for Danube Projects (Danube Implementing Agency). For the environment sector the Implementing Agency (CFCU) is working closely with the Final Beneficiaries (i.e. operators for Municipal services or local authorities) where Ispa Programme Implementing Units are also established.

CURRENT STATUS

a) Ispa projects submitted and approved by the EC Management Committee. Over the past the last five years, Romania has committed the total yearly allocated budget for 2000 to 2004, increasing from 238M€ to 317M€, and fairly balanced between environment and transport sectors. The total amount of the 46 Ispa Financing Memoranda signed (34 Environment, 11 Transport and 1 Institution Building for both sectors) is 2.4 Billion € out of which, 74% is the Ispa Grant of € 1.7 Billion €. A complete table with signed and approved Ispa measures to date is hereby attached in the Annex II. b) Current state of implementation The implementation of the Ispa projects started in mid 2000. A total of 102 contracts (72 for environment, 25 for Transport and 5 for Institution Building) amounting at 736.9 M€ being concluded to date by the Implementing Agencies under the ex-ante control of the EC Delegation. The contracting rate versus the total amount committed is now 30.9%. See attached the table with all Ispa contracts signed to date in the Annex III.
