2. HOW MUCH DOES AN iBEX HOME WARRANTY COST?

3 . WHEN DOES MY CONTRACT BECOME EFFECTIVE?

Contracts become effective when full payment of your selected warranty coverage is processed.

6. WHAT HAPPENS AFTER I FILE A CLAIM WITH iBEX?

• You will be contacted by an incredible iBex contractor. • Every attempt will be made to complete your service request within 2 business

days of receiving your claim. • If parts are not readily available, iBex is at the mercy of the part supplier and will

do everything possible to complete the repair as soon as possible. With unique systems or appliances, acquiring a part could take longer.

7. WHAT IS THE SERVICE CALL FEE?

• $60.00 • The service call fee covers the diagnosis of your repair request. • You may pay the service call fee directly to the contractor upon arrival to perform

diagnosis. Or, you may pay your service call fee online at www.ibexhw.com. • If you require service after-hours, during the weekend or holidays, the service

call fee is $120. This does not apply to emergency service (please see next question below).

8. WHAT IS CONSIDERED AN EMERGENCY?

• Iftheoutsidetemperatureisabove95degreesorbelow40degreesandyouhave a full loss of air conditioner or furnace.

• An interior pipe leak that cannot be shut off. • Complete loss of power. This does not include a local or widespread

power outage. • In the event of an emergency, iBex will make every effort to schedule an

appointment as quickly as possible.

9. WHAT IF MY SYSTEM OR APPLIANCE HAS AN ACTIVE MANUFACTURER WARRANTY?

• The contractor will work with the manufacturer to repair the system or appliance. • If the manufacturer does not pay for labor, iBex will cover the labor costs

of the repair.

10. WHAT IS A PREEXISTING CONDITION AND HOW IS IT HANDLED?

• This is a condition that is determined to have existed before the warranty contract has become effective.

• We reserve the right to deny preexisting conditions.

11. CAN I USE MY OWN SERVICE PROVIDER?

• No.

12. DO I NEED TO OBTAIN APPROVAL FROM iBEX FOR REPAIRS?

• Yes.PleasecontactiBexfirsttoinsureyourrepairiscovered.

13. CAN I BE REIMBURSED FOR SERVICES PERFORMED WITHOUT iBEX’S CONSENT?

• No, iBex does not offer reimbursement. Please make sure to contact iBex for all service requests.

14. WHAT IF A REPAIR IS NEEDED BEHIND CABINETS OR THROUGH TILE, MARBLE, GRANITE, CONCRETE, SHEET ROCK OR OTHER SURFACES?

• iBex will access repairs behind concrete and/or drywall. Upon completion of the repair,iBexwillreturnconcretetoafinishcondition,anddrywalltoapaintablecondition. (Concrete countertops excluded)

• If a repair is required behind any other obstacle, the homeowner is responsible to provide access.

15. WHAT HAPPENS IF SECONDARY DAMAGE IS CAUSED BY WATER FROM A LEAKING PIPE, FIRE DAMAGE, OR OTHER FAILURE?

• iBex does not cover secondary damage. • iBex’s responsibility is to cover the items mentioned as included (see included

items) and not the damage caused by failure of a covered item.

16. DOES iBEX MATCH SYSTEMS OR APPLIANCES THAT NEED TO BE REPLACED?

• When replacement is necessary, iBex will attempt to match the item being replaced with an item similar in features, but is not obligated to match for color, dimensions, or manufacturer name brand.

17. CAN I UPGRADE IF REPLACEMENT IS NECESSARY?

• Yes, and you would pay the difference between the cost of a matched replacement and the upgrade.

18. DOES THE CONTRACTOR PROVIDE A WARRANTY FOR THEIR WORK?

• Yes, for 60 days. This includes all costs: labor, material, and service call fee.

19. WHAT HAPPENS IF MY SYSTEM OR APPLIANCE WAS PREVIOUSLY INSTALLED IMPROPERLY?

• If a system or appliance has been previously installed improperly or is mismatched for its capacity to perform its function properly, iBex reserves the right to deny coverage.

20. CAN I GET A CASH OUT TO DO MY OWN REPAIR(S) OR BUY A REPLACEMENT SYSTEM OR APPLIANCE?

• iBex reserves the right to determine when a cash out is available. A full diagnosis is required by an iBex related contractor.

• A cash out payment may be granted in cases where parts are no longer available, the homeowner chooses to use a non-iBex contractor, or a homeowner chooses to repair the item themselves.

• In the case of a cash out, iBex is no longer responsible to warranty the repair or the related appliance or system.

21. DOES iBEX USE GENERIC PARTS?

• iBexwillalwaysusemanufacturerpartsifpossible. Ifnotavailable,genericpartswill then be used.

22. CAN I CANCEL MY WARRANTY?

• Yes. The refunded amount will be based upon the following: • A cancellation fee of $200.00 • Any amount iBex has spent toward repairs or replacement will be deducted from

the refund amount. • Each month the warranty has been in effect will reduce the refund amount 1/12th

of the original cost of the warranty.

23. IS MY WARRANTY TRANSFERABLE?

• Yes. The iBex Home Warranty is transferable to a new owner, and the warranty must stay with the current property for the remainder of the contract term.

• iBex must be contacted to transfer and/or extend coverage.

24. CAN I PURCHASE A MULTIPLE YEAR WARRANTY?

• Yes. iBex allows for one or two-year warranty contracts.

25. CAN I RENEW MY CONTRACT?

• Yes.PleasecontactiBex,orfilloutanewapplicationonline.

26. ARE THERE ANY FINANCIAL CAPS (PAYMENT LIMITS) UNDER THE TERMS OF MY WARRANTY CONTRACT?

• Yes. iBex limits are as follows per contract year: Air conditioning - $2500, Furnace - $2500, Plumbing - $2000, Electrical - $2000, Appliances - $4000 (cumulative total for all covered appliances), Garage Door - $1000

27. DOES MY CONTRACT COVER HAZARDOUS MATERIALS?

• No. iBex reserves the right to determine what is a hazardous material.

28. IF I HAVE A CREDIT, HOW CAN I USE IT?

• Once you’ve created an account online at www.ibexhw.com, any credit amount can be viewed in your customer account. The credit can be used for any of the following:

In the event the parties are not able to resolve any dispute between them arising out of or concerning these Terms and Conditions, or any provisions hereof, whether in contract, tort, or otherwise at law or in equity for damages or any other relief, then such disputeshallberesolvedonlybyfinalandbindingarbitrationpursuanttotheFederalArbitrationAct,conductedbyasingleneutralarbitrator and administered by the American Arbitration Association, or a similar arbitration service selected by the parties, in a locationmutuallyagreeduponbytheparties.Thearbitrator’sawardshallbefinal,andjudgmentmaybeentereduponitinanycourt having jurisdiction. In the event that any legal or equitable action, proceeding or arbitration arises out of, or concerns, these Terms and Conditions, the prevailing party shall be entitled to recover its costs and reasonable attorney’s fees. The parties agree to arbitrate all disputes and claims in regard to these Terms and Conditions or any disputes arising as a result of these Terms and Conditions, whether directly or indirectly, including tort claims, that are a result of these Terms and Conditions. The parties agree that the Federal Arbitration Act governs the interpretation and enforcement of this provision. The entire dispute, including the scope and enforceability of this arbitration provision, shall be determined by the Arbitrator. This arbitration provision shall survive the termination of these Terms and Conditions.

CLASS ACTIONWAIVER

Any arbitration under these Terms and Conditions will take place on an individual basis; class arbitrations and class/representative/collective actions are not permitted. THE PARTIES AGREE THAT A PARTY MAY BRING CLAIM AGAINST THE OTHER ONLY IN EACH PARTY’S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PUNITIVE CLASS, COLLECTIVE AND/ OR REPRESENTATIVE PROCEEDING, SUCH AS IN THE FORM OF A PRIVATE ATTORNEY GENERAL ACTION AGAINST THE OTHER. Further, unless both parties agree otherwise, the arbitrator may not consolidate more than one party’s claims, and may not otherwise preside over any form of a representative or class proceeding.

• Coverage afforded under this contract is not guaranteed by the Property and Casualty Guaranty Association.
