Official Plan:

The subject lands are designated “Low-Rise Residential” by City of Vaughan Official Plan 2010 (VOP 2010), which was approved, in part, by the Ontario Municipal Board on September 30, 2014. The proposal conforms to the policies of the Official Plan.

Comments: Condition(s): Recommendation:

The Planning Department is of the opinion that the proposal is minor in nature, meets the intent of the Zoning By-law, and is desirable for the appropriate development of the land. Based on photos provided by the Agent, the Urban Design Division is satisfied that the existing Emerald Cedars planted between the pool cabana and the existing wrought iron fence, provides sufficient screening from abutting properties. None. The Planning Department supports Minor Variance Application A123/15.

Comments: 1. The Development Engineering and Infrastructure Planning Services

Department offers no comments or objections to proposal no. 1.

2. The existing air conditioning unit is located on the west side of the subject lot with a 0.3 m side yard setback. As per the lot grading criteria, no changes are to be made within 0.6 m of all lot boundaries. This is to allow adequate space for the drainage swale between houses. The owner should be aware that a 0.3 m side yard setback is not recommended, as water could pool behind the A/C and cause problems in the future. Although not mandatory, it is recommended that the A/C unit is raised and bolted to the wall to help prevent blockage to the existing drainage pattern. Despite these recommendations, the Development Engineering and Infrastructure Planning Services Department has no objections to proposal no. 2 at this time.

PowerStream has received and reviewed the proposed Variance Application. This review, however, does not imply any approval of the project or plan. All proposed billboards, signs, and other structures associated with the project or plan must maintain minimum clearances to the existing overhead or underground electrical distribution system as specified by the applicable standards, codes and acts referenced. In the event that construction commences, and the clearance between any component of the work/structure and the adjacent existing overhead and underground electrical distribution system violates the Occupational Health and Safety Act, the customer will be responsible for 100% of the costs associated with PowerStream making the work area safe. All construction work will be required to stop until the safe limits of approach can be established. In the event construction is completed, and the clearance between the constructed structure and the adjacent existing overhead and underground electrical distribution system violates the any of applicable standards, acts or codes referenced, the customer will be responsible for 100% of PowerStream’s cost for any relocation work.
