BACKGROUND In accordance with Council’s Code of Meeting Principles and Practices: 53.6 - The Minutes of Reference Group or Working Group meetings can only be confirmed and adopted by resolution of that Reference Group or Working Group, passed at a subsequent meeting of that Group. A motion or discussion in respect of the Minutes shall not be in order except as to their accuracy as a record of proceedings. Minutes may not be amended to reflect second thoughts on a resolution - changes may only be made if the accuracy of the resolution is found to be at fault; as per clause 19.2 of this Code. 53.7 - A report on the proceedings of Reference Group or Working Group meetings are to be submitted to the next available meeting of Council for endorsement, including all recommendations. Any Councillor may be mover or seconder of a motion to confirm the proceedings of a Reference Group or Working Group meetings. CONSULTATION REQUIREMENTS Community engagement is not required. SUSTAINABILITY STATEMENT The sustainability implications are of a minor nature and as such did not warrant a detailed assessment. DETAIL This report presents the recommendations of the last meeting of the Waverton Peninsula Working Group held on 9 May 2017 for Council endorsement. The Minutes are attached for information.

MINUTES: WAVERTON PENINSULA WORKING GROUP MEETING HELD IN

THE ROS CRICHTON PAVILION ON TUESDAY, 9 MAY 2017 AT 5.00PM.

At the commencement of business (5.00pm) Councillors present were: Councillor Baker in the Chair.

1. Minutes

The Minutes of the previous meeting held on 25 October 2016, copies of which had been previously circulated, were taken as read and confirmed.

The Motion was moved by Sid French and seconded by Councillor Baker. Voting was unanimous.

2. Matters Arising

Nil.

3. Berrys Bay

a) Status of Proposed New Development Application The RMS advised via email on 9 May 2017 that there was no update on this matter.

b) Report by Precinct on the visit by the Premier, local Federal Member and

newly elected local State Member Iain Bartholomew provided an update on this matter. The Premier of NSW visited Berrys Bay on Sunday, 26 March 2017 with the local Federal Member, the newly elected State Member, Felicity Wilson and members of the local Liberal Party branch. Waverton Precinct has written to the Greater Sydney Commission in relation to issues affecting the Precinct. Iain has spoken to the Head of the Premier’s Department to try to ascertain who is the current holder of the Berrys Bay lease. This information was not forthcoming. Iain spoke to the new member for North Shore, Felicity Wilson 8 May 2017. Ms Wilson was unable to attend tonight’s meeting as Parliament is sitting. Ms Wilson advised she would like to attend Waverton Peninsula Group meetings in future. The Working Group noted the report from Iain Bartholomew. c) Future of Dolphin Wharf It is noted the Dolphin Wharf has been leased to Sydney Super Yacht Company by Maritime Services. Three watercraft are currently moored at this location. Waverton Precinct members will continue to monitor any activity at this location. d) Noakes Dry Dock The Manager Development Services advised that the Noakes Dry Dock is currently being refurbished. It is unknown when it will be in use again.

4. Coal Loader Wharf / Maritime Precinct

a) Status of IHO / SHR Listing Council’s Manager Development Services provided an update on this matter. The Minister for Heritage has informed Council that the RMS has agreed not to proceed with the demolition of the Coal Loader Wharf, pending the resolution of Council Nomination for listing on the State Heritage Register (SHR). The Minister has therefore resolved not to proceed with Council’s request for an Interim Heritage Order. Further, the Heritage Division has advised Council that the assessment of the Nomination of the Coal Loader on the SHR is currently progressing and it anticipates that the nomination will progress to the State Heritage Register Committee in the second half of 2017, but has not given a specific timeframe in which this will occur. A detailed update is in preparation and will be reported to Council at the earliest opportunity. It was noted that the Wharf is crumbling and no maintenance has been undertaken by the RMS. Council will request that the RMS undertakes some sort of conservation work to prevent further deterioration of the Wharf.

Resolved to recommend: 1. THAT Council lobby the Local Member and renew talks with the State Government at all appropriate levels about the possible repair of the existing Heritage Wharf. 2. THAT Council consider committing matching funds to work with the Government to enable completion of the restoration of the Coal Loader Wharf. 3. THAT it be noted that it would be highly desirable for a ferry wharf for tourism purposes be included in the final design in conjunction with the development of the Coal Loader Platform. Moved by Ian Grey and seconded by Bruce Donald. Voting was unanimous. b) Adaptive Reuse Project - Western Gateway to Sydney Harbour Highline This matter was discussed in 5a) below. c) RMS Plans This matter was discussed in 4a) above.

5. Sydney Harbour High Line Project

a) Status – Proposed Committee Iain Bartholomew provided an update on this matter. The aim is for the Highline to be a foreshore link. An agreement has been reached with the Highline Team, the Precincts Union and Lavender Bay Precinct to proceed accordingly. Waverton Precinct is aiming to have a representative on any Working Group conducted by Infrastructure NSW. If Tourism NSW visits this site, Waverton Precinct wants to be included and has advised Tourism NSW accordingly. Resolved to recommend: 1. THAT the Waverton Peninsula Working Group take into account the future potential of this project. Moved by Sid French and seconded by Iain Bartholomew. Voting was unanimous. b) Foreshore Bypass of Noakes Along the Lower Railway Embankment This matter was discussed in 5a) above.

6. Balls Head Road, Balls Head Drive, Waterhen Drive – Streetscape Upgrades

a) Timing of Future Stages Iain Bartholomew advised that completion of the work at the intersection of Balls Head Road and Wood Street is still required. Outstanding issues include extra drainage, redesign of the corner and installation of pedestrian lights. David Banbury provided an update from Jim Moore who is in charge of the project. Works are scheduled to begin on 15 May 2017.

b) Street Lighting Waterhen Drive Footpath Side The lighting works are currently being priced by Council’s Contractors. The installation will be programmed once the installation quotations have been received. c) Gateway Marker/Directional Sign Iain Bartholomew suggested a gateway marker/directional sign be installed made of sandstone and old timber at the entrance to the Waverton Peninsula. Resolved to recommend: 1. THAT Council develop and install gateway directional signage and a welcoming/directional sign at the beginning of the park promoting the Waverton Peninsula. Moved by Iain Bartholomew, seconded by Sid French. Voting was unanimous.

7. Quarantine Depot

Government Property NSW has previously advised Council officers, in regards to the acquisition of the Quarantine Depot by Council, that the matter of disposal of the site by GPNSW is going through internal processes. Council officers have received no further update since that advice. Councillor Baker advised that Council at its meeting on 1 May 2017 resolved to contact the new local Member, Ms Felicity Wilson, to request a meeting with Councillors at the earliest opportunity. It was recommended that a formal request to renew talks at the State Government level, regarding acquisition of the site by Council, be undertaken at this meeting. Waverton Precinct will also lobby the local Member directly in relation to this matter. Resolved to recommend: 1. THAT the Waverton Peninsula Working Group request that Council at its meeting with the Local Member raise the matter of Council acquisition of the Quarantine Depot and ask her to undertake her best endeavours to move forward with this proposal. Moved by Bruce Donald, seconded by Ian Grey. Voting was unanimous.

8. Coal Loader Platform

a) Construction Progress The Landscape Architect/Projects Co-ordinator advised, based on the last update received, it was anticipated most works on the Platform should be finalised by early July 2017, weather permitting. Images of the works in progress were shown.

b) Opening The Director Open Space and Environmental Services advised that a report will go to Council in the near future regarding a date for the official opening of the Coal Loader Platform. At this stage the opening is expected to be 2 September 2017. It was suggested that Bob Carr be invited to the official opening given his interest in this project.

9. HMAS Waterhen

a) Base Upgrade Iain Bartholomew advised Waverton Precinct had received correspondence from the Minister of Defence who stated it was too early to tell when the base would be upgraded. It was noted the Base has a new Commander as of December 2016. The Base is on State Government land. b) Temporary Structure in Upper Car Park Compound The upper car park is on Commonwealth Government land. A tent has been erected on the understanding that medium sized patrol boats will be placed under the structure for major repairs (the structure provides weather protection). It is anticipated an update on this matter will be provided at the next Waverton Precinct meeting.

10. Western Harbour Tunnel

Councillor Baker advised that Council is very engaged with this matter. Planning staff are having daily discussions with Transport for NSW. The resolution from Council’s meeting on 1 May 2017 in relation to this matter was displayed for Working Group members to read at this meeting. It was recommended that Waverton Precinct and Council work together to gather information on this matter. Councillors met with Deborah Dearing from Greater Sydney Commission (GSC) in relation to the Draft District Plan on 1 May 2017. The GSC was not consulted about this plan and originally received three options from RMS for different routes although two options were not viable. Concerns about drilling, stacks, acquisition of public and private land were discussed. Councillor Baker advised that the Director City Strategy has requested that when direct information is received about the Western Harbour Tunnel, members take the name of the RMS Officer and pass this information on to Council. A further information session has been added at North Sydney Oval due to concerns about St Leonards Park. It is expected this meeting will be held in mid-June 2017.

RMS Update via email: The Western Harbour Tunnel project will continue to engage with North Sydney Council as one of the key stakeholders. The project team is currently holding a number of community information sessions. Information on the location of these information sessions where the public are able to speak with the project team and provide comments is provided on the project website at the link below.
