To rezone the property from A-2 (Large Agricultural Holding) to R-4 (Residential 4 Zone) for the creation of three lots of various sizes.

RECOMMENDATION: OPTION 1

1. THAT the Regional Board read Zoning Amendment By-law No. 2095, (Davy), 2013 for First and Second Time

2. THAT the holding of a public hearing be waived pursuant to s. 890(4) of the Local Government Act, and authorize performance of public notification pursuant to s. 893 of the Local Government Act.

The site is on the west side of Highway 97N, some 4miles south of the bridge over the Peace River. There is a considerable amount of forested area in this vicinity with some cleared areas being used for pasture. Oil and gas is found throughout the general area as well.

SITE FEATURES

LAND: The subject property is not in agricultural production and is heavily treed although parts have been cleared for residential use.

STRUCTURES: There is a residence and a shop.

ACCESS: Travis Sub Road off from Highway 97N.

CLI SOIL RATING: Class 4x. Class 4 soils have severe limitations that restrict the range of crops or require special conservation practices. Subclass x denotes soils having a limitation resulting from the cumulative effect of two or more adverse characteristics.

FIRE: Within the Taylor Rural Fire Protection Area.

COMMENTS AND OBSERVATIONS

APPLICANT: It is the intent of the landowner to subdivide their two parcels into 3 lots of unequal sizes: 1 x 4.61 acres and; 1 x 5.36 acres and; 1 x 5.19 acres. Two of these lots will be offered for sale to the public and one will be retained by the landowners.

ALR: The subject property is situated within the Agricultural Land Reserve. The Agricultural Land Commission approved application for Subdivision on March 28th 2014, Resolution # 127/2014.

OCP: The subject properties are designated MDR – Medium Density Residential under the North Peace Fringe Area Official Community Plan 1870, 2009. The following is an extract from this OCP:

The proposed new lots would be over 4 acres each; thereby complying with the above policy.Therefore an amendment to the OCP is not required.

ZONING: The subject property is zoned as A2 (Large Agricultural Holdings Zone) within the Peace River Regional District Zoning Bylaw No. 1343, 2001. This zone has a minimum parcel size of 63 ha (155 ac). Therefore, the proposal will require a zoning amendment to R4 accommodate the intended parcel sizes to be created by the proposed subdivision. The adjoining property to the south which is owned by the applicant is already zoned R4

IMPACT ANALYSIS

AGRICULTURE: The proposal will have minimal impact on the agricultural productivity of this parcel due to heavy tree cover and poor soil quality.

CONTEXT: This immediate area consists essentially of residential uses and therefore the further subdivision of this parcel is in character with the surrounding parcels.

POPULATION: The proposed subdivision may increase the population of the area by 2.7 people (based on Stats Can 2011 census estimate) per dwelling in Electoral Area D

TRAFFIC: The proposed subdivision may increase the vehicles of the area by 2, per dwelling (based on Stats Can 2011 census estimate) per dwelling in Electoral Area D

COMMENTS RECEIVED FROM MUNICIPALITIES AND PROVINCIAL AGENCIES

MINISTRY OF TRANSPORTATION: The Ministry has not yet received an application to subdivide from the land owner. Please advise the land owner to contact Lynn Norman (250-787-3335) or her email above to obtain a subdivision application package. The conditions for the proposed subdivision will be outlined through our process after we have received the application.

The Ministry supports the rezoning from A-2 to R-4- Residential. Direct access to the Alaska Highway from any of the proposed lots will not be permitted. Configuration of lots as submitted is not guaranteed and is dependent on review and approval by the Provincial Approving Officer.

A bylaw to amend the “Peace River RegionalDistrict Zoning Bylaw No. 1343, 2001.”

WHEREAS, the Regional Board of the Peace River Regional District did, pursuant to theProvince of British Columbia Local Government Act, adopt the “Peace River Regional DistrictZoning Bylaw No. 1343, 2001";

NOW THEREFORE the Regional Board of the Peace River Regional District, in openmeeting assembled, enacts as follows:

1. This by-law may be cited for all purposes as “Peace River Regional District ZoningAmendment Bylaw No. 2095 (Davy), 2013."

2.
