SAMPLES

Samples are available upon request. Samples must be paid for or returned in good condition within 14 days. Custom

samples will only be supplied when customer places a firm or large order. We will try to provide custom samples as

close as to cusomer's specification request as possible. Requests for items fabricated to exact specifications for specific

jobs and/or bids are not returnable and must be paid for. All freight related to samples are the responsibility of the

customer.

GENERAL INFORMATION

All price shown are in US dollars, F.O.B JUSTCHAIR warehouse in Maspeth, New York. Pricing includes, assembly (except

table bases), normal packaging, cartons and pallets.

JUSTCHAIR warrants its wood products to be free of defects in materials and workmanship for a period of three (3)

years from date of invoice, while metal products free of defects have a period of five (5) year from date of invoice.

Warranty does not cover any product which has been altered or subjected to misuse, negligence or accident. The

limited warrant does not cover any upholstery, which is subject only to the warrant offered by the respective

upholstery manufacturers, or COM materials. Cuts and tears discovered after signing for receipt of upholstered

upholstered products are not covered. In case customer(s) elects to assemble the chair and/or barstools purchased

from JUSTCHAIR by them, warranty will be automatically voided and liabilities incurred thereafter shall be assumed by

the purchaser.

ORDERS AND PAYMENTS

All orders are subject to approval by JUSTCHAIR. 50% deposit is required at the time the order is placed. Total payment

is due prior to delivery or pick-up. Merchandises are shipped within five to seven (5-7) business days after the payment

is cleared. Please contact us three (3) days before if there are changes to the scheduled delivery. If changes are made,

it may result in an account of being put on “Hold” status or on delivery delay. Any alteration or custom orders require

50% to 60% deposit once order is placed. It cannot be changed or canceled once the order has been processed. Buyers

are subjected to 100% of charge upon cancellation. Acceptance of order must be clearly stated by both the buyer and

JUSTCHAIR. Order will be based on the expressed condition that buyer agrees to all of the terms and conditions as

outlined by JUSTCHAIR as evidenced by delivery of acknowledgement, invoice and product. All payments must be

received, accepted and acknowledged by JUSTCHAIR at Maspeth, New York.

All written quotes from JUSTCHAIR are valid for 14 days unless otherwise noted. Pricing is subject to change without

notice.

CUSTOM ORDERS

FREIGHT

Shipping will be made via JUSTCHAIR preferred carrier(s) unless customer carrier preference is indicated on purchase

order. JUSTCHAIR will provide Bill of Lading(s) and ship only to points within United States. All deliveries are Sidewalk

Delivery Only. Delivery Loading Time is a maximum of 2 hours. JUSTCHAIR is not responsible for damage in transit, or

delays in transit. Variances in order quantities or specifications must be communicated to JUSTCHAIR within 3-5 days of

receipt of order. Any shortage, or sign of damage, should be noted on the freight bill before accepting delivery. If

damage is discovered after delivery, customer should notify JUSTCHAIR at once to request inspection and claim

instructions. Concealed damage claims must be filed within 72 hours of receipt of shipment. Refusal to accept

merchandise from carrier does not relieve purchaser of responsibility for payment and filing claims in the prescribed

manner. All merchandise becomes the property of the purchaser upon delivery to the carrier.

CUSTOMER'S OWN MATERIAL (COM)

COM's are accepted at Grade 2 pricing. JUSTCHAIR has the right to add a 10% charge to COM's for patterned, striped,

directional. or material that is difficult to work with. Leather work will be quoted upon request. COM's should be clearly

labeled when forwarded to the factory. No material will be accepted COD or freight collect. A sample of the fabric

should be sent with the order stating supplier, pattern name, yardage suppliedm face of the material, and the direction

(if necessary) the material should run on the furniture. Due to the wide range of weaves and filaments used in

upholstery fabrics, we do not assume any responsibility as to wear, damages, seam slippage, fading, pilling, wrinkling,

dye variations or any other problems relating to COM covers. We assume that all covers have been inspected by the

seller of the cover and are up to their standards. While we will use our best judgment, our cutting the cover in no way

implies our approval, acceptance or assumption of any warranties as to wear or fitness of the cover for the usage

ordered.

Cusom orders cannot be cancelled or change once they have been started. Custom orders cannot be returned for any

reason once they have been shipped. Custom merchandise includes any items upholstered with a COM.

CANCELLATIONS

Acknowledged orders cannot be changed or cancelled without approval by JUSTCHAIR. All requests for changes or

cancellation must be submitted in writing. Orders is progress that need to be changed or canceled are subject to a

charge not to exceed 50% of the item's price. Custom orders and orders that are complete can not be canceled. Please

contact JUSTCHAIR immediately, to determine the change, if any, for cancellation of an order.

RETURNS

No merchandise may be returned without JUSTCHAIR's authorization. The factory will inspect warranty items for repair

or replacemtn only with prior written authorization. All items shipped back to the factory must be done on a prepaid

basis only. Request to return merchandise for reasons other than warranty inspection will be reviewed as to the nature

and scope of the return. Not all items will be eligible for return. Merchandise that had been used or put into service for

any length of time is non-returnable unless approved by JUSTCHAIR in advance. Custom, altered and non-stock items

are not returnable.
