Bolton Township, Cowley County, KansasNotice to Bidders

Notice is hereby given that Bolton Township in Cow-ley County, Kansas is soliciting bids for an Arkansas Riv-er Streambank Stabilization Project to protect an adjacent township road. The project consists of approximate 250 feet of new construction requiring rock along the river-bank and one new bendway weir in the river, as well as repair to some of the existing weirs. The Township has an existing funding agreement with NRCS EWP Project #5027. Bolton Township is the sponsor. All federal, state, and county regulations must be complied with. Require-ments for bid, performance, labor, materials, bid and performance bonds, and liability and workers compen-sation insurance are in the bid proposal documents.

Occidental Chemical CorporationNotice to Bidders

Occidental Chemical Corporation, Inc. (OxyChem) of Wichita, Kansas is currently seeking bidders for a rail yard construction project at their facility in Wichita, Kan-sas. The bid package will include bid documents, plans, and specifications. Bid-ders are required to be AVETTA-certified before a sub-mitted bid will be accepted. Bid packages for the proj-ect are expected to be sent to all interested bidders on or about August 31, 2020.

The work consists of the following major items: ap-proximately 13,600 track feet of new rail construction, nine turnouts, and all necessary civil/earthwork to con-struct a suitable railbed per the construction documents. This project is the recipient of a KDOT State Rail Service Improvement Fund program grant, and the contract for work will be directly with Occidental Chemical Corpora-tion, Inc. Notice Concerning Proposed Kansas Air Quality Class I Operating Permit Renewal

Notice is hereby given that the Kansas Department of Health and Environment (KDHE) is soliciting comments regarding a proposed air quality operating permit. Cha-nute Municipal Power Plant #3 has applied for a Class I operating permit renewal in accordance with the provi-sions of K.A.R. 28-19-510 et al. The purpose of a Class I permit is to identify the sources and types of regulated air pollutants emitted from the facility; the emission lim-itations, standards, and requirements applicable to each source; and the monitoring, record keeping, and report-ing requirements applicable to each source as of the ef-fective date of permit issuance.

Chanute Municipal Power Plant #3, PO Box 907, Chan-ute, KS 66720, owns and operates a fossil fuel based elec-tric power generation located at 4302 S. Plummer, Chan-ute, Neosho County, KS 66720.

The U.S. Environmental Protection Agency has a 45-day review period, which will start concurrently with the public comment period, within which to object to the proposed permit. If the EPA has not objected in writing to the issuance of the permit within the 45-day review period, any person may petition the administrator of the EPA to review the permit. The 60-day public petition pe-riod will directly follow the EPA’s 45-day review period. Interested parties may contact KDHE to determine if the EPA’s 45-day review period has been waived.

Any such petition shall be based only on objections to the permit that were raised with reasonable specificity during the public comment period provided for in this notice, un-less the petitioner demonstrates that it was impracticable to raise such objections within such period, or unless the grounds for such objection arose after such period. Notice Concerning Kansas/Federal Water Pollution Control Permits and Applications

In accordance with Kansas Administrative Regula-tions 28-16-57 through 63, 28-18-1 through 17, 28-18a-1 through 33, 28-16-150 through 154, 28-46-7, and the au-thority vested with the state by the administrator of the U.S. Environmental Protection Agency, various draft water pollution control documents (permits, notices to revoke and reissue, notices to terminate) have been pre-pared and/or permit applications have been received for discharges to waters of the United States and the state of Kansas for the class of discharges described below.

The expansion includes a new carbon contact basin which will replace the existing carbon contact basins. In compliance with Kan-sas and federal law, KDHE has approved an antidegradation for this facility for increased concentrations and mass of some pollutants to the receiving stream. The proposed action is to reissue an existing State/NPDES permit for an existing facility. This facility treats well water from two on-site wells. The treatment process consists of two Reverse Osmosis (R.O.) units to reduce contaminants in the raw water. There are cartridge filters before the R.O. units. The finished water is chlorinated and pumped to two water storage tanks. Domestic wastewater is not discharged on site. The proposed permit contains limits for pH, as well as moni-toring for flow, chloride, total suspended solids, and nitrate.

Persons wishing to comment on the draft documents and/or permit applications must submit their comments in writing to the Kansas Department of Health and En-vironment if they wish to have the comments considered in the decision-making process. Comments should be submitted to the attention of the Livestock Waste Man-agement Section for agricultural related draft documents or applications, or to the Technical Services Section for all other permits, at the Kansas Department of Health and Environment, Division of Environment, Bureau of Water, 1000 SW Jackson St., Suite 420, Topeka, KS 66612-1367.

All comments regarding the draft documents or ap-plication notices received on or before September 19, 2020, will be considered in the formulation of the final determinations regarding this public notice. Please re-fer to the appropriate Kansas document number (KS-AG-20-187/188, KS-Q-20-149/150) and name of the appli-cant/permittee when preparing comments.

After review of any comments received during the public notice period, the Secretary of Health and Envi-ronment will issue a determination regarding final agen-cy action on each draft document/application. If response to any draft document/application indicates significant public interest, a public hearing may be held in confor-mance with K.A.R. 28-16-61 (28-46-21 for UIC).

available on the Kansas Department of Transportation (KDOT) website at https://kdotapp.ksdot.org/Proposal/Proposal.aspx. The website will allow the contractor to request approval from KDOT to bid as a prime contrac-tor and be included on the “Bid Holders List,” or to be in-cluded on the “Non-Bid Holders List” as a subcontractor/supplier. KDOT’s approval is required to bid as a prime

contractor. To bid as a prime contractor, KDOT needs to be notified of the intent to bid no later than the close of business on the Monday preceding the scheduled letting date. Failure to obtain prior approval to bid as a prime contractor on any projects listed below will be reason to reject your bid. Request for ProposalsBackground and Purpose of Project

The Kansas Department of Transportation (KDOT) is seeking a consultant to provide construction inspection services for project 70-21 KA 3954-01. The project is lo-cated on I-70, 0.29 Miles east of Rain Road (Exit 286) in Dickinson County. This project replaces Bridge #030 and Bridge #031 over Chapman Creek.Schedule/Deadlines

Request for Proposals (RFPs) are due on or before 12:00 p.m. (CST) August 28, 2020, to be delivered via email to [email protected]. Evaluation and ranking of submissions will occur on or about September 5, 2020, after which time all firms that submitted will be notified of the ranking. Negotiations with the most highly ranked firm to commence on or about September 10, 2020. An agreement should be in place on or about September 24, 2020. The contractor is expected to start the project around the end of August 2020 or early September 2020.Scope of Services to be Performed

The project manager/inspectors must be capable in-specting the whole project, which includes bridges, HMA commercial grade, traffic control, grading, CCP pavement, guardrail, CMS or AASHTOWare data entry, all project records, all project paperwork, and final pa-perwork, etc. Project records and paperwork including but not limited to: diary, pay quantities, certifications, sample identifications, change orders, pay estimates, monitoring subcontractor payments, and monitoring contractor’s payrolls, etc. Records and paperwork must be submitted accurately and timely. Anticipated staff-ing needs: provide project management and all inspec-tors as needed to ensure inspection and material testing for this project are done correctly. The number of re-quired inspectors will fluctuate throughout the project depending on the contractor’s schedule and how they pursue the work. Submit the names and information of the project manager and the inspection staff. Construc-tion is anticipated to be completed at the end Novem-ber 2022. Work may be suspended for the winters and resume in springs. Provide all the equipment necessary to inspect and test materials.

Instructions for ProposalNo costs shall be contained in the RFP. The RFP must

not exceed four (4) pages total (including any cover let-ter, index, etc.) and 2MB to address the pertinent topics. RFPs submitted will consist of the technical proposal and a completed and signed Special Attachment No. 7 (“Certificate of Final Indirect Costs”), a completed and signed Special Attachment No. 8 (“Tax Clearance Certif-icate”), and a signed Special Attachment No. 10 (“Policy Regarding Sexual Harassment”). Completed Special At-tachments do not count against the four-page technical proposal submission. All these forms are attached to the original email announcement.

RFPs shall indicate the consultant’s ability to meet the project inspection needs described above. RFPs shall de-scribe any processes or procedures, including best practic-es, that will be used to perform tasks and to produce the desired results described above under “Scope of Services to be Performed.” The RFP shall also include items such as:

• Project manager• History of providing inspection services on similar

projects• Availability of staff• Familiarity with KDOT standards and specifications• Any subconsultant and their role in performing the

services on the project• Names, certifications, and experience of all inspec-

tors that will be assigned to the project• Anticipated time to close out project paperwork

Evaluation FactorsRFPs will be evaluated based on the factors listed be-

low, evenly weighted, to rank the most qualified firm in order of preference as first, second, third, etc. Evaluation factors include:

1. How the consultant plans to meet the fluctuating inspection needs of the project;

2. Employee names (project manager), certifications, and qualifications proposed for services;

3. Past performance history on similar projects (list project numbers) for KDOT;

4. Anticipated time to close out project paperwork.;5. Proximity of inspectors to project;6. Types of direct expenses anticipated (lodging, mile-

age, etc.).The highest ranked firm will be asked to enter into

negotiations with KDOT for an agreement. In the event KDOT cannot reach agreement with the highest ranked firm, it will terminate negotiations with such firm and commence negotiations with the next highest ranked firm, and so on, until either agreement is reached for a satisfactory scope of services for a fair and reasonable price, or KDOT decides to pursue other alternatives.Exhibits to this Technical Proposal Request

Notice of Hearing on Proposed Administrative Regulations

The Kansas Department of Transportation (KDOT) will conduct a public hearing at 2:00 p.m. Thursday, October 22, 2020. The public hearing is being held to consider the adoption of proposed new KDOT Article 45 regulations 36-45-1, 36-45-2, 36-45-3, 36-45-4, 36-45-5, 36-45-6, 36-45-7, 36-45-8, and 36-45-10, regarding escort vehicle service providers, escort vehicle drivers, and escort vehicles. These regula-tions are being proposed as temporary regulations and as permanent regulations.

This 60-day notice of the public hearing shall consti-tute a public comment period for the purpose of receiv-ing written public comments on the proposed rules and regulations. Economic Impact: The regulations are anticipated to have a minor economic impact on escort vehicle service providers and escort vehicle operators. An escort vehicle operator is required to successfully pass a training course as set forth in K.S.A. 8-1921. There are no anticipated eco-nomic impacts to the Kansas Department of Transpor-tation. All upgrades to current websites were able to be completed under the existing contract for the implemen-tation of K.S.A. 8-1921.
