Gday again folks and what a week it's been on the island. This past seven days has seen the world cup final played out with Germany and the Argentineans battling it out for a full game and an eventual win being had in the first lot of extra time. The Germans, I think where extremely lucky to lift the cup and I'm sure they will still be partying now. All I know is most people were a bit slow on Monday morning from staying up and watching the game. At the end of the day 3.00am is way too early to start drinking beer with German friends in Bali, no

matter what the reason. Well done to the German team for their win and congratulations to all our German friends.

One of the biggest things that's happened over the last few weeks is the elections that have been run in Indonesia. I can safely say that in my almost 25 years living on the archipelago and watching several elections pass us by, this would have to be the one that has generated the most interest amongst the locals and expats. I have made it a point to not have this little newspaper become a political platform and it never ever will, but in this instance, I will say that almost everyone you speak with, from taxi drivers to the cleaning staff at McDonalds, has an opinion on this one. May the best man win and the Country get the direction that is best for it, over the next four year period.

Moving forward this week also sees the school holidays kick in to full swing with the roads and tour desks copping a beating. It's a great time of year to visit the island at the moment with the temperature being a little cooler and not so muggy along with one of the best benefits being the strength of the Aussie dollar. It's a great time to exchange a few bucks and head out and do some shopping. Your dollar goes that much further when you get a good rate. My advice is to make hay while the sun is shining and grab a few extra dollars worth before it drops down to a more normal level. Given the dollar is at such a good level it is a really good time to actually look at buying that second home or holiday house that the family has always talked about in Bali. There are so many options available and ready to suit every budget. If you're even thinking about it, I suggest you just start by making a call to an agent at the very least. We have a few real estate places at the back of the paper and we have had nothing but good reports from people that have actually done business with them, so it's probably the best place to start. I'm sure if you mention the Kuta Weekly advert they will try their best to get you a good deal. Thanks to Miss Tracy at “Bali Cool Property” and Mr Faye at ”Fayes Real Estate” for the ongoing support.

Lastly, Ramadan is almost over for another year which means the Idul Fitri celebration period is almost here. I think we have about 10 days to go before the time and we are all looking forward to the holiday period. For those that don't understand, let me try to explain in my basic way, this time of year is when our Islamic mates have just done a month's fasting, and reflecting on the many good things in life and now is when they relax and really enjoy their families, friends and all the fantastic things this life has to offer. It is almost like our New Year Celebrations which is a time to forgive and forget and move forward in a positive way. I find it a really very humbling thing to have it explained to me in a way that I can understand and I trust all our Muslim mates enjoy the time.

Ok folks that's about my lot for the week, so I will let you go back to whatever it is you do in paradise and would hope you all try your very best to remember, I am an acquired taste and if you don't like me, acquire some taste.

Indonesia Preparing to Require Pla in P a c k a g i n g f o r Alcoholic Beverages

Indonesia's Ministry o f Trade i s d ra f t ing legislation that will require “plain packaging” for a l c o h o l i c b e v e r a g e s containing between 20-55% alcohol and sold at hotels.

The legislation, if it comes into effect, will apply to both domestic and i m p o r t e d a l c o h o l i c beverages.

As reported by NusaBali, t h e M i n i s t e r o f T r a d e Muhammad Lutfi is keeping details of the legislation secret. The Indonesian legislation

would follow a trend in o ther na t ions , such as Aus t ra l i a , f o r c i ga re t t e packaging that is intended to reduce consumer appeal for potentially harmful products.

A l c o h o l i c b e v e r a g e s s o l d i n Indonesia is divided into three categories:

G r o u p A : Containing less than 5% alcohol

G r o u p B : Containing between 5-20% alcohol.

G r o u p C : Containing more than 20% alcohol.

According to the Director General of Domestic Trade, Sri Augustina, told the press

that the governor of Bali has the right to control the distribution of a lcohol ic beverages v ia provincial regulations.

Sriwijaya Air Seeking to Assume Old TigerAir Mandala Routes

The commercial director of Sriwijaya Air, Hasundungan Pandiangan, told NusaBali that the Airline has formally filed a request with the Indonesian Civil Aviation Department to be allowed to take over the domestic air routes abandoned with the closure of Tigerair Mandala Airlines.

The Sriwijaya Air official said the new routes have been carefully researched by the Airline in terms of market demand that remains strong.

The data, obtained by Fairfax Media's Ballarat Courier, showed while the vast majority of people with guns use them for hunting (137,465) and target shooting (40,692), firearms are also legitimately used for performing arts, re-enactments (285) and historical collection (635).

Victorians own almost 700,000 firearms including machine guns, rocket launchers and even cannons.

Victoria Police says there are more than 690,000 firearms registered in the state, roughly equivalent of one firearm for every nine people. More than half are rifles and almost a third are shotguns, but there are also 821 machine guns, 118 cannons and 27 rocket launchers.

Getting stranded on the runway when your flight gets hit with last-minute delays is enough to fray the temper of even the most sanguine flier.

But passengers o n o n e s e v e r e l y delayed flight this week found themse lves having an altogether m o r e u p l i f t i n g experience, when the pilot ordered pizza for the entire plane.

The Frontier Airlines flight was flying from Washington DC to Denver when bad weather forced the plane to land in Wyoming.

After languishing on the runway for an hour as passengers grew increasingly agitated the pilot made the surprise announcement.

"He said: 'ladies and

gentleman, Frontier Airlines is known for being one of the cheapest airlines in the US, but your captain is not cheap I just ordered pizza for the entire plane,'".

The plane was reported to have erupted in applause, and soon after around 50 pizzas were delivered to the plane while it stood on the tarmac.

Another passenger, Nadia

Kouri, tweeted: "Bad news: my Denver flight was sent to WY due to this storm. Good news: the pilot ordered pizza!"

Pilot Gerhard Bradner, who paid for the pizzas with his own money, he initially d e c i d e d t o c a l l Dominos to satisfy his own hunger, before placing the mammoth order instead.

" I f the need arises you need to take care of your

family; you need to take care of your passengers. They are my responsibility the moment they step on the aircraft until they get off the aircraft," he said.

The plane eventual ly arrived at its destination five hours later than scheduled, but, if current reports are to be believed, everyone on board was satisfied.

NRL fans, Steve Mortimer demand return to contested scrums after Warriors success against Eels

NRL fans have spoken. They love contested scrums and want to see more of them.

The response to the Warriors scoring a try after winning the ball by pushing through a Parramatta scrum has been overwhelming.

So much so that on a day when the World Cup final was played, foxsports.com.au had more than double the visitors to watch video of Saturday's contested scrum than it had to watch highlights of the world game's showpiece event.

And the people loved what they saw with 96 per cent of t h e 5 , 5 0 0 participants in a poll voting that they'd like to see more pushing in scrums.

In the old days, no player on a rugby league field lived for the scrum more than the hooker, bu t a t t i t u d e s h a v e changed so much that one of the best of them in modern times can think of nothing worse than a return to the days when the scrum was a genuine contest.

Manly's two-time premiership hooker Matt Ballin enjoyed the novelty of the Warriors' surprise tactic on Saturday but when asked would he like to see more of it, answered; “not really”.

“I don't want to be squashed in the scrum by those big blokes,” Ballin laughed.

“Everyone just comes to the scrum for a break at the moment. The Warriors obviously thought about it and put it on and it worked for them.”

Ballin believes a return to the past would be the catalyst for messy scrums and a massive increase in stoppages, side-effects that might dampen the fans' enthusiasm for change.

But like many fans, former champion halfback Steve Mortimer considers the current set up an “insult to the intelligence, and the integrity of NRL members and supporters” and is pushing to see that change.

“The scrum is a part of the DNA of both rugby union and rugby league,” Mort imer told foxsports.com.au.

“The difference at the moment is that rugby union have got theirs together and in rugby league

the formation of the scrum is an absolute insult to the intelligence, and the integrity of NRL members and supporters.

“Of all the massive changes since Super League, there's been some good changes and there's been some absolutely horrid changes and this is one of those horrid changes.

“Right now the scrum is an embarrassment. It looks absolutely shabby to the people watching the game and it's an insult to the integrity and the

intel l igence of r u g b y l e a g u e supporters.

“We need to get the players involved in the scrum contesting it again and the way to do that is by bringing back the differential penalty.”

M o r t i m e r s a y s b y p e n a l i s i n g h a l f b a c k s f o r

failing to feed the ball between the opposing frontrows, players and coaches would be forced to relearn the art of scrummaging.

“If I threw the ball in and got penalised and the other side's two points behind — they get a shot to score a try and win the game,” Mortimer explains, clarifying that the differential penalty would not allow teams to take a shot at goal.

“That would force the halfback to feed the ball between the front-rowers.

“You might see a lot of differential penalties until the players got better at it but it would add more excitement to the game and bring a purpose back to the scrum.”

And if other teams aren't prepared to give it a go, at the very least they'll have to be on guard when they face the Warriors, with coach Andrew McFadden admitting his side trains for it.

“It's something we do every now and then, a bit of scrummaging. It's not something we put a whole lot of time into,” McFadden told New Zealand broadcaster Radiosport after Saturday's success.

“The boys obviously saw an opportunity at that point in the game and we just wanted to get the ball back. The fact that we got the try was just a bonus.”

Collingwood president Eddie McGuire fires back at Sydney chairman Andrew Pridham

“I'm not sure he could draw a football, let alone knows much about the competition,” McGuire told The Daily Telegraph.

“At least in my s t o u s h e s w i t h ( f o r m e r S w a n s chairman) Richard Colless there was a bit of cut and thrust, b u t t h i s b l o k e (Pridham) has just turned up.

“I've given 17 years of unpaid s e r v i c e ( t o C o l l i n g w o o d ) p r o m o t i n g t h e game, my club and trying to promote other clubs. I wouldn't know this bloke if I fell over him.”

P r i d h a m l a u n c h e d a s c a t h i n g a t t a c k o n t h e omnipresent McGuire claiming he “dominated the agenda for reasons of self-interest” and that no one dared keep him to account.

Pridham, an investment banker who had been on the Swans board for 12 years before succeeding Colless, also referred patronis ingly to McGuire 's professional roles, saying: “We all know that being a footy club president and a game show host and football commentator is a very important occupation, but it's going a bit far when you start talking about the national interest”.

Fittingly given the level of banter to which the debate descended, McGuire finished his radio segment by saying “get stuffed Sydney”.

ULTIMATE Fighting Championship president Dana White could never stomach the idea of a female throwing punches inside the Octagon.

Three years ago, as he left his favourite Chinese restaurant in Los Angeles, White said he'd never allow any female to step a foot inside the cage.

Fast forward to today and 27-year-old Ronda Rousey is one of the UFC's biggest and most marketable stars.

She's the current women's bantamweight title holder and yesterday retained her crown with a 16-second knockout win over Alexis Davis at UFC 175 in Las Vegas.

That 16 seconds netted Rousey a cool $120,000 — and nine stitches to her knuckle — making her the highest paid female on the roster.

Far from his comments almost three years ago, White said: “She's important to women's sport, period.

“(Rousey's win) was just so explosive and crazy and fast and just,

you know, she's unbelievable.“She's a huge superstar, she's

one of the pound-for-pound best fighters in the world, and she's the most unique athlete that I've ever worked with in my whole life in every sense of the word.”

Rousey made history in early 2013 when she fought Liz Carmouche in the very first women's UFC fight.

Her following grew when she was appointed as head coach opposite Strikeforce rival Miesha Tate on the hit reality TV series The Ultimate Fighter (TUF).

After the series Rousey defended her belt against Tate with a submission win in the third round.

At UFC 170 in February Sara McMann lasted just over a minute before she was submitted too.

And Rousey's win yesterday was her 10th straight MMA win and fourth in the UFC. She has never lost a fight.

White told MMA Weekly late last year that he never would have opened up to the idea of females in the

UFC if it weren't for Rousey.“You could line up all the

greatest girls on Earth from here to Pluto, and she's the one that when I met her I said, 'This chick is insanely competitive and just a different animal.' And she's what it took to get women in the UFC,” White said.

“Hate her or not, the reason why all these girls fight in the UFC is because of her.

Used tyres driving a solution to pollutionIFW Recycling Corporation sees a clear opportunity in the polluted skies over China's industrial cities. According to CNN, inhabitants of Beijing are “choking as smog levels hit heavy or even worse levels.” I r o n i c a l l y , C h i n a i s simultaneously one of the world's biggest contributors to environmental pollution and largest producers of green energy technology.

Unfortunately for China, most of that technology is exported. As pollution problems continue to worsen, governments around the world are looking for any solution to solve their waste management problems. This is particularly true in countries like China that rely on coal fired plants to generate electricity. Wikipedia states that every year, over 260 million used tires end up in landfills across the world. In addition to the space they consume in the landfill, the tires contaminate groundwater and create toxic clouds of black grime when they ignite. Some jurisdictions purposely burn the tires in an effort to generate electricity.

The problems associated wi th used t i res have been accumu la t i ng fo r decades . According to Infohouse.com, over 75 percent of used tires end up in landfills every year. These tires are seen by most as an ever expanding problem, but to IFW Recycling Corporation these tires represent a clean, green and efficient source of fuel.

Living the Bali DreamLast week The Weekly printed a story about a couple mates over 70 years old from Perth who with some younger friends were cycling to Candi Dasa. Well they made the trip and had a ball on the way. The pushies all arriving before the “Motor Cycle” back up. Our host Tyo made us very welcome with drinks and a wonderful evening meal, much enjoyed by all which took away most of our aches & pains. After an early night we were ready and taking a few Greenies away we went to a beautiful little beach called White Sand Beach, not a tourist destination but beautiful for swimming with nice warungs for eating.

Back to the digs for showers and a few more Greenies then ready for a nights relaxation, played pool, chatted with all and sundry from many countries mostly Candi locals. But a few outsiders and some interesting indo ' s and o f

course sunk a few more greenies.

Next morning it was time to get saddled up again and head back home. Don't know if our trip down had been noticed by many, but on our ride back many people called out hello's and quite often sellers on the road side waiting for word cheered us on many offering to sell us petrol. At the brief afterward I think we all agreed. The experience was well worth the sore bums and tired legs and we saw many things most tourists. Don't hear about.

Allegedly held by a drug-addicted owner who used the beast to beg, Raju had been living on paper and plastic to fill its stomach according to reports.

Raju is now walking freely since conservationist activists made a daring night rescue following a court order from Uttar Pradesh Forest Department to remove the elephant from its abusive owner.

Aided by police and state

officials, the activists rescued the animal despite its handler and previous owner adding more chains to its legs and blocking roads to prevent its escape.

Rescuers worked for hours to gain the destitute Raju's trust, feeding it fruit to cajole it into a truck where they could carry it to freedom.

When Raju was being freed, rescuers from the UK charity Wildlife SOS saw tears rolling from its eyes.

"The team were astounded to see tears roll down his face during the rescue. It was so incredibly emotional for all of us," animal activist Pooja Binepal said.

"We knew in our hearts he realized he was being freed," he said.

The rescuers said elephants were intelligent animals that experienced e m o t i o n s , b u t t h e

char i ty 's co-founder Kart ick Satyanarayan said in this case it was "as if he felt hope for the first time in a very long time".

Poachers are said to trap elephants while they are babies, either shooting the mother or leaving it to grieve for days.

The activists said they baby elephants are then beaten until they submit to their owners, effectively breaking their spirits.

A new study at the University of Exeter suggests that exposure to hydrogen sulfide a.k.a. what your body produces as bacteria breaks down food, causing gas could prevent mitochondria damage. Yep, the implication is what you're thinking. People are taking the research to mean that smelling farts could prevent disease and even cancer.

The study, published in the M e d i c i n a l C h e m i s t r y Communications journal, found that hydrogen sulfide gas in rotten eggs

and flatulence could be a key factor in treating diseases.

"Although hydrogen sulfide gas is well known as a pungent, foul-smelling gas in rotten eggs and f la tu lence, i t is naturally produced in the body and could in fact be a healthcare hero with significant implications for future therapies for a variety of diseases," Dr. Mark Wood, a professor at the University of Exeter, said in a statement.

Whi le hydrogen sulfide gas is harmful in large doses, the study suggests that "a whiff here and there has the power to reduce risks of cancer, strokes, heart attacks, arthritis, and dementia by preserving mitochondria," Time reports. Dr. Matt Whiteman, a University of Exeter professor who worked on the study, said

He has also called it a "novelty song" that does not "really define me as well as album songs that probably don't get played". On being asked if he could do a follow-up about the next couple of years after the events that transpired in the original song, he commented "No, I wrote one song already and I don't think it was really that good to begin with, melodically." .

Blender magazine ranked "We Didn't Start the Fire" No. 41 on its list of the "50 Worst Songs Ever", a list that also includes songs from Paul McCartney and Simon & Garfunkel. They considered the production bombastic and stated that the song "resembles a term paper scribbled the night before it's due."

Land Laws in Bali Differ from the Rest of Indonesia? Not Really.Real Estate agents around Indonesia, and internationally, think that land laws in Bali are different from the rest of Indonesia, as foreigners can own freehold land! You can also own freehold land with a secondary title on top of it, being the Right of Use (Hak Pakai) and Right to Build (Hak Guna Bangunan). Some agents also state that recently there have been “changes in Indonesian land laws” that allows the nominee structure to be used for foreigners, heavily and rightfully contradicted by Discovery newsletter.

Look at the case of Susi Johnston for a sad set up, but the core issue here is that a nominee agreement went bad. Her case may very well set precedence for Indonesian law on this matter. There are currently 140 cases in court, or police reports involving nominee structures – about 7,000 or more properties in Bali are currently held under this structure.

All not true; Bali is very much part of Indonesia and its legal system, end of story. Try to go to a Notary or Lawyer in Jakarta and tell them you want to purchase a freehold property in Pondok Indah using a nominee to secure a freehold. They might be able to set up a foreign owned company (PT PMA) to secure Right of Use (Hak Pakai) or Right to Build (Hak Guna Bangunan) to own a property as a shareholder of such company.

However, the truth is that the Indonesian Agrarian law states: “Any attempt by a foreigner or a foreign entity to secure freehold land in any shape or form is void and the property belongs to the government”.The truth is that there is no need to circumvent the Indonesian law, just the mad perception out there in the property Industry in Bali. There are basically three options of ownership structures available for foreigners under Indonesian Law.1. Hak Pakai or Right of Use.

This is a residential title for Indonesians and foreigners. It is classified as a residential title and there are guidelines around the

number of units and size of land as well as qualifications of being “residential” in Indonesia, with some economical benefit towards the Indonesian economy.2. Hak Guna Bangunan or Right to Build.

This is a commercial title for villas or resort developments. There is no discrimination between an Indonesian company and a foreign-owned company on this land title, and a foreign-owned company can be 100% foreign owned.

Both these titles come with an

extension/renewal option after 25 and 30 years. This extension/renewal does not mean you buy the land again as it is your land, though there is a 0.2% payable tax based on the tax appraisal value of the land in that current time. Actually, the Indonesian law now has special benefits for foreigners and foreign investment, a l l o w i n g f o r a n a u t o m a t i c extension/renewal where all that is needed at the end of the first term is to go to the Indonesian land Office, BPN, and have the new certificate for the second period issued.

Some people question the strength of these two land ownership structures. However, even towards the end of the title's terms, one can freely sell the property to an Indonesian and get a freehold title again. Specifically to Right to build, during a transaction of the property one could also apply for a new 30 year term for the new owner.3. The third option for foreigners is a straight forward lease of land and/or property.

25 – 30 years is a normal length of lease and this will not

challenge the existing structure of the above mentioned foreign titles available. Some legal advisors would state that you can do longer leases as there are no arguments against that under Indonesian law. Others would argue and structure 2-3 agreements of 30 years each in order not to circumvent the spirit of the above mentioned titles. If one does not do this, one could choose to state that an extension after 25-30 years would be at that time market value, which is decided by the lease holder and lessor, as well as two to three

independent appraisers.Solutions to the ongoing discussions around Indonesian Agrarian laws are to possibly extend the Right of Use (Hak Pakai) title to 70 years, and Right to Build (Hak Guna Bangunan) to 85 years in one go with no need to formally renew/extend the certificates. This has actually happened already a few times, the first time in 2007, but the changes were rejected by the Constitutional

Court. Whether it will pass this time or not remains to be seen.

All in all, the existing Laws and regulations are, from a security perception, already sufficient for investors, and it's more about educating the market on the misperceptions around these titles as well as the risks in utilizing a nominee, as shown in several recent cases.

The main thing for any purchaser or investor to consider is the purpose and how they want to utilize the property, as well as their final exit plan, if any. One can also consider using an offshore holding company to further protect oneself as an exposed owner of land and assets, and this structure may also have some tax benefits at an eventual exit and sale of the property.

The central government, as well as provincial governments, are very well aware of the arising issues and are constantly considering regulations to discipline this. The sooner the better, it's not complicated, nor difficult. Without the right advice it's a jungle out there.
