the minutes of January 5, 6, 15, and 19, 2016 meetings as distributed. Motion carried by voice vote, no dissent.

5. Public hearings, possible action, possible recommendation to County Board for consideration. A. Re-Open the public hearing of Rebecca Frisch, CPZ Director – to re-number and revise General Code of

Ordinances for Marathon County Chapter 22 Shoreland, Shoreland-Wetland, and Floodplain Code to comply with state and federal regulations. Adopt resolution.

Action: Motion / second by Duerr / King to re-open the public hearing for Chapter 22. Motion carried by voice vote, no dissent.

Discussion: DNR has reviewed and commented on the floodplain text. DNR has not reviewed and commented on the shoreland, shoreland-wetland text. Staff has incorporated DNR and Committee recommendations into this draft, shown by tracked changes for insertions/deletions. These are state-mandated regulations and staff has followed the state model ordinance. Corbett stated that any recommendations by DNR that change the meaning of the Chapter 22 will require that it be returned to Committee for approval.

Action: Motion / second by King / Cihlar to close the public hearing. Motion carried by voice vote, no dissent. Motion / second by Duerr / Maszk to recommend conditional approval of Chapter 22, subject to DNR approval, to the County Board. Motion carried by voice vote, no dissent.

Follow through: Staff will pursue comments by DNR regarding shoreland, shoreland-wetland text. Forward Chapter 22 to County Board for action at their next regularly scheduled meeting.

B. Re-Open the public hearing of Rebecca Frisch, CPZ Director – to repeal and recreate the General Code of Ordinances for Marathon County Chapter 17 Zoning Code.

(1) Zoning level of service alternatives Discussion: Committee reviewed the staff levels of service, identified as basic, enhanced, and high. Staff recommends the

implementing the enhanced level of service in order to provide towns and citizens a service to achieve the county’s strategic goals through planning and zoning. Enhanced level would provide staff and materials to not only implement the zoning code and provide administrative assistance, but also educate and engage town officials and local citizens through local meetings as to the changes, and their role in the zoning code and adoption of county zoning; assist in updating comprehensive plans relative to land use and zoning; train at the local level on the decision-making process of rezones and conditional use permits; and a minimum of quarterly general communication with towns. It is anticipated that deputy zoning administrator roles would remain the same. This request is for the 2017 budget year, with annual review. Staff will be administering two zoning codes for one year from the date of county board adoption.

Action: Motion / second by Duerr / Maszk to recommend implementation of the enhanced level of service for the 2017 budget. Motion carried by voice vote, no dissent.

Follow through: Staff will reference the enhanced level of service estimated costs as the fiscal impact on the resolution for adoption of the zoning code.

(2) Adopt resolution Discussion: Art Altenburg was sworn in and questioned why his property is being zoned as a 10 acre minimum rather than

2 acre minimum. Johnson stated that the town approved their zoning map by reviewing the parcels relative to size, current and future use, and made determinations to complement their comprehensive plan. Altenburg is able to apply for a rezone of his property. Questioning why he was not notified of this change beforehand so he could vote on it, Frisch stated that every landowner in the county zoned towns (+/- 9,000) were sent a mailing of all information

meetings and open houses. Altenburg was in attendance at the Knowlton meeting. Committee advised that he could express his concerns to the town by requesting to be on the town board agenda.

Staff has incorporated Committee recommendations into this draft, shown by tracked changes for insertions/deletions. The buffer screening section was discussed and is used mostly for industrial and commercial uses and vary on use intensity, with a required site plan review. Corbett could locate no language in Wisconsin that addresses tree encroachment. It is a property owner’s right to the use of the property. Tree overhang and roots would not affect public health and safety unless a public hazard (roadways, etc.). Damage caused by a neighbor’s tree could be a possible small claims action. Trees hanging over a boundary line could be cut back to the property line, but may require a survey to locate the exact property line. This topic is case law, not a zoning jurisdiction. Corbett said a tree planting setback is unenforceable.

In the event an independently zoned town wishes to adopt county zoning a question arose as to the status of existing conditional use permits (CUP) in the town. Corbett provided text which addresses the CUP and recommends the language be added to the code.

Corbett said if a town adopts county zoning the town does not have supplementary zoning power, but can enact a separate noise or wood burner ordinance. Some stand-alone town ordinances are allowed outside of zoning to promote health and safety, such as mobile homes outside mobile home parks, lot restrictions, and driveways.

Corbett recommends removing noise and outdoor wood burners from the code, saying the nuisance factor is subjective and extremely difficult to enforce.

Recently approved rezones required updates to the draft maps of the Towns of Day and Wien. The updated maps must be included in the Committee action.

Action: Motion / second by King / Duerr to close the public hearing. Motion carried by voice vote, no dissent. Motion by Duerr / Cihlar to recommend approval of the code.

Motion by Duerr / Maszk to amend the code to include the updated Town of Wien and Day zoning maps. Motion carried by voice vote, no dissent.

Motion by Duerr / King to amend the code by inserting text recommended by Corbett regarding status of conditional use permits for towns adopting county zoning. Motion carried by voice vote, no dissent.

The language on tree setbacks is intentionally not being addressed, leaving existing language in the code as a statement of policy.

Motion carried to recommend approval the code as amended to County Board, no dissent. Follow through: Forward Chapter 17 as amended to County Board for action at their next regularly scheduled meeting.

6. Policy discussion and possible action

A. Zoning, Shoreland, and Floodplain fee approval Discussion: Proposed fees were simplified, some categories were combined, and categories added to match the new

zoning code. Duerr suggested including a basic explanation of services to justify costs. Action: Motion / second by Cihlar / Maszk to approve fees as presented. Motion carried by voice vote, no dissent. Follow through: Staff will add a brief explanation of services and implement the fees as approved.

B. Proposed policy on CPZ rental equipment Discussion: The purpose of equipment rental is to assist users to install or maintain conservation practices. Use of the

machinery is sporadic and may not be beneficial for one user to purchase, but is beneficial if available to many users. Daigle identified 4 drills that are currently in use, with the Aitchison drill nearing the end of its usable years. Using these drills has a positive effect by reducing phosphorous levels in the soil. In response to Committee questions, Northcentral Technical College (NTC) has stored equipment on occasion, and can repair, but due to other obligations not necessarily on a timely basis. Other equipment is also available for rent, including a mulcher, cyclone seeder, and tree planter.

Action: Motion / second by King / Maszk to approve the equipment rental policy. Motion carried by voice vote, no dissent.

C. Chapter 18 Land Division and Survey Regulations proposed updates: Request for public hearing Discussion: Frisch advised that there are some quick fixes that could be done to the Land Division and Surveying

regulations which could make the code more usable and consistent, and is asking the Committee if they would like to address those changes before or after the 2016 building season. Chapter 18 affects all unincorporated areas of Marathon County.

Action: Motion / second by King / Cihlar place the public hearing for amendments to Chapter 18 on the March meeting agenda. Motion carried by voice vote, no dissent.

A. Wildlife Damage Abatement and Claims – 2015 – Tharman Discussion: Tharman unable to attend. Item will be on the March 2016 agenda.

B. Natural Resources Conservation Service (NRCS) and Farm Service Agency (FSA) – No report

C. Department of Natural Resources (DNR) – No report.

D. Comprehensive Plan update Discussion: Frisch summarized that, at the Committee’s direction, the Executive Committee held the public hearing for

the Comprehensive Plan, and the Plan will be moving to County Board for action at their February meeting.

Langenhahn arrived at 2:50 p.m.

King spoke with local senators and assemblymen at an agricultural conference relative to enacting legislation without being aware of the consequences to municipalities. He suggested that legislators be invited to Committee meeting(s) to discuss concerns.

Discussion: DNR reviewed the shoreland, shoreland-wetland text and provided comments on February 11th and February 15th which staff incorporated into this draft, and is shown by tracked changes for insertions/deletions. Staff reviewed the changes, some of which are simple reference corrections or wording clarification, and others revise or add new text. DNR recommendations for floodplain text were addressed and approved at the February 2nd Committee public hearing. The goal of the regulations is to protect shoreline areas. LCZ may choose to approve the changes as presented or delay a decision until March if they feel it necessary. After implementing the code, staff will have a better overall picture and concerns can be addressed after the building season.

Action: Motion / second by Cihlar / Maszk to recommend approval to County Board to re-number and revise the General Code of Ordinances for Marathon County Chapter 22 Shoreland, Shoreland-Wetland, and Floodplain Code, as amended by Land Conservation and Zoning Committee on February 16, to incorporate comments received from the DNR. Motion carried by voice vote, no dissent.

Follow through: Forward Chapter 22 to County Board for action at their next regularly scheduled meeting.

TO: Land Conservation and Zoning Committee FROM: Rebecca Frisch, CPZ Director DATE: March 1, 2016 SUBJECT: Land Division and Surveying Regulations Ordinance Revisions The Conservation, Planning and Zoning Department (CPZ) staff is asking for the Committee’s endorsement of

reviewing Chapter 18 Land Division and Surveying Regulations Ordinance for the purpose of improving the

administrative efficiencies and clarity of the regulations.

During the review, CPZ staff will begin by identifying the current policies that are in conflict with recent State

Statute changes and other items that may not be consistent with Marathon County policies and procedures. CPZ

staff believes that the development of regulatory policy and administration of standards concerning key elements

will influence our commitments to safety, prosperity and a properly built environment.

As part of this review, CPZ staff proposes to:

● Correct all inconsistencies between the existing ordinance and state statues;

● Develop recommendations on issues like private roads, the plat review process, right-of-way easements,

pre-planned buildable lots, and more;

● Create an Advisory Group of staff, local surveyors, and developers to review sections of the ordinance for

consistency and usability and make recommendations;

● Develop a draft ordinance and present back to LCZ by December 2016; and.

● Present a final ordinance for public hearing by February 2017.
