Both proposed tracts will not change in use; therefore, the subdivision should not cause any negative impacts to drainage, traffic, or accessibility. Pertinent Regulations Section 2-1-101 (a-d) of the Laramie County Land Use Regulations governing the criteria for a subdivision permit. EXECUTIVE SUMMARY Steil Surveying Services, on behalf of Wearin Brothers Cattle Co, has submitted a Subdivision Permit & Plat application for “Wearin Ranch”, a replat of Lot 15, Riata Ranch at Campstool, Second Filing, located at 822 and 826 Arena Lane. DISCUSSION The Laramie County Comprehensive Plan (2016) identifies the area as Rural Ag Interface (RAI). Rural residential uses are primarily anticipated in these areas. Limited service commercial and retail uses are anticipated at major intersections. Density of uses shall be foremost based on availability and access to water. Due to lengthy response times, existing topography, and limited reliable water resources, cisterns are encouraged in any development in an RAI area, as well as utilizing fire-wise planning. The subject property is located outside the PlanCheyenne and zoned boundaries. Surrounding properties are either agricultural or residential uses, and range in size from approximately 5 to 150 acres. None of the existing site conditions will be affected by the proposed subdivision. Each tract has established and permitted well and septic systems. Public notice was published and neighbor notice letters were sent by certified mail. Staff received no comments from adjacent landowners. Agency comments received regarding clerical errors on the plat shall be addressed prior to the public hearing of the application before the Board. Staff finds the proposed Subdivision Permit and Plat is in conformance with the plans and policies of the Laramie County Comprehensive Plan and the Laramie County Land Use Regulations. The attached resolution shall serve as the Subdivision Permit upon approval by the Board. RECOMMENDATION and FINDINGS Based on evidence provided, staff recommends the Laramie County Planning Commission find that:

a. This application meets the criteria for a subdivision permit pursuant to section 2-1-101 (a-d) of the Laramie County Land Use Regulations.

b. This application meets the criteria for a plat pursuant to section 2-1-101 (e) of the Laramie County Land Use Regulations.

and that the Planning Commission recommend approval of the Subdivision Permit and Plat for Wearin Ranch to the Laramie County Board of Commissioners with the following condition:

1. A revised plat addressing agency comments shall be provided prior to the Board public hearing of the application.

PROPOSED MOTION I move to recommend approval of the Subdivision Permit and Plat for Wearin Ranch Subdivision to the Laramie County Board of Commissioners with condition 1, and adopt the findings of facts a and b of the staff report. PZ-17-00111 Wearin Ranch Subdivision Permit/Plat County Engineer: Scott Larson COMMENTS ATTACHED 06/22/2017 Engineer Review 1. I concur with the request for a waiver of a detailed drainage study and traffic study. Given the information provided, there should be no measurable difference with either for the proposed action. 2. There is an additional “with” in Note 5. Surveyor Review 1. Plat requirements state that “survey tie(s) by bearing/azimuth and the distance to the nearest public land survey system monument shall be accurately described”, and this is not provided. 2. As required, a proper notation of vacation is provided; however, this paragraph also requires the notation be titled “Statement to Vacate” and this was not done. 3. Plat requirements state that “the location of points of curvatures…shall be shown” and this was not provided for all curves. 4. The lot numbers for neighboring lots of the Riata Ranch at Campstool Second Filing are provided. In the same text style, to the east of the subject parcel, is the label “LOT 15 RIATA RANCH (RECORD OF SURVEY)”. If this label is in the correct location, it conveys the impression that only part of Lot 15 is being re-platted, with an undefined other portion remaining on the east side - or that the note refers to a different (or older version of) Lot 15. Some explanation or further delineation might be helpful. 5. As a final note, I did not see any mention of irrigation water rights on the subdivision so I assume there aren’t any on the subdivision. It might be a good idea to mention there are no water rights on the subdivision, since there is an irrigated field directly south of this parcel and the question may arise. A RESOLUTION TO APPROVE A SUBDIVISION PERMIT AND PLAT FOR WEARIN RANCH, A REPLAT OF LOT 15, RIATA RANCH AT CAMPSTOOL,

SECOND FILING, LARAMIE COUNTY, WY

WHEREAS, Wyoming State Statutes §18-5-201 to 18-5-208; §18-5-301 to 18-5-315 authorize Laramie County, in promoting the public health, safety, morals and general welfare of the county, to regulate the use of land through zoning in unincorporated Laramie County; and WHEREAS, the Laramie County Board of Commissioners adopted the Laramie County Land Use Regulations; and WHEREAS, the proposed subdivision is in accordance with section 2-1-101 (a-d) of the Laramie County Land Use Regulations; and WHEREAS, the proposed plat is in accordance with section 2-1-101 (e) of the Laramie County Land Use Regulations; and WHEREAS, this resolution is the subdivision permit for Wearin Ranch. NOW THEREFORE BE IT RESOLVED BY THE GOVERNING BODY OF LARAMIE COUNTY, WYOMING, as follows: The Laramie County Board of Commissioners finds that:

a. This application is in conformance with section 2-1-101 (a-d) of the Laramie County Land Use Regulations.

b. This application is in conformance with section 2-1-101 (e) of the Laramie County Land Use Regulations.

and the Board approves the Subdivision Permit and Plat for Wearin Ranch with the following condition:
