An interesting case was on trialbefore Judge Leahy in chambers thismorning; it is the suit of Montezu-ma Camp No. 2, Woodmen of theWorld, Charles Tamme and O. A.

Larrazolo, intervenors, plaintiffs, vs.the Sovereign Camp Woodmen of theWorld, of the state of Nebraska.

On September 16, 1903, Thomas W.

Harrison applied to the grand lodgefor a change in the beneficiary of hlB

policy, aming Montezuma Camp No.2 as the beneficiary. T. W. Harri-son was a resident of Las Vegas,and had been a member of the local

lodge for some years. He carried apolicy of Jl.uOO in the insurance

of the sovereign lodge. Be-

ing ill for a number of years priorto his death, he transferred to thelocal lodge his insurance policy lor$1,000 and the local lodge agreed toexpend certain sums for his care andmaintenance, and to reimburse itselffrom the proceeds of the policy inthe event of the death of Mr. Harri-son.

After Harrison's death, the neces-

sary proofs were made, but the sov

ereign lodge refused to pay theamount of f 1,000 due on the policy,claiming that it had no right to doso under its charter and under thelaws of the state of Nebraska; thatthe amount of the policy could onlybe paid to blood relations, husbandor wife, or persons dependent uponthe insured. T. W. Harrison had no

relatives or dependents whatever,and it was for this reason he trans-ferred his policy to. the local lodge,and he did so with the consent andknowledge of the sovereign camp, Itis declared.

One of the questions for the courtto determine is whether the laws ofthe state of Nebraska or those of thestate of New Mexico shall control inthe enforcement of the policy.

SAME BLAZE TWICE'i

NIGHT UNNECESSARILY.

Last evening at 9:15 o'clock, analarm of fire was sounded, callingout both the East side and West side

departments to extinguish a fire inthe house owned by Leo Padilla atthe corner of Washington avenueand Ninth street. The fire was dis-

covered by Mr. and Mrs. C. H. Baily,who were on their way home. Rush-

ing to the Padilla house Mr. Bailyfound that the family was put Withthe assistance of Mrs. Baily he sentin an alarm then broke In the doorof the house and managed to saveconsiderable furniture.

By the time tne fire companies ar-

rived' the blue had made much head-

way, but, afver working for 30 min-

utes, the departments had the fireunder control, the all-ou- t signal beingsounded 40 minutes later. The Westside department remained on thefire one hour and 10 minutes and wasthere 45 minutes after the East sidedepartment had returned to the firestation. The East side departmentdid not lay any hose, as It was un-

necessary to do so. Several hundreddollars' damage was done.

It Is evident that some emberswere overlooked, for a short time after midnight an alarm was againsounded for the same fire, both departments responding. A slight blazewas discovered in the rafters of thehouse, which was quickly etiaLguished by the East side departmentwith the chemical apparatus attachedto the hose wagon. No hose was laidfor the second fire.

Three times during the last sismonths the departments

' have beencalled out a second time to extin-

guish fires which they had supposedly put out, two of these alarms beingsent in during the past four weeks.Efficiency. Is one" of the main feat-

ures of a good fire department, and,as there is plenty of water on handand also good water pressure, thereis no reason for the overlooking of

any fire by the members of eitherof the departments. Las Vegans thinkit better for the firemen to makea good job of it when attempting to

extinguish the fire the first timethan to have to be called out In the

When the last vote had been cast.Senator O'Gorman ofered a resolutionthat Archbald be removed from thebench and be forever ineligible topublic office. Senator Root movedthat the doors be closed for deliberations and the court went into executive Bession.

The senate prepared today to' voteon 1C3 charges in the . impeachmenttrial of Judge Robert W. Archbaldshortly after 1 o'clock this afternoon. Conviction requires a two-third- s

vote on any one of the charges.

The penalty in case of conviction,unless notified by subsequent actionof the senate, is immediate removalfrom office and prohibition againstholding another position of publichonor or trust.

The Impeachment proceedingistarted early In 1912. The house call-

ed upon President Taft for a copyof the charges and in May, throughthe judiciary committee, began theinvestigation that ended in recom-

mendations for impeachment. On

July 7, the house voted to impeachJudge Archbald and the case waslaid before the senate July 15.

The charges accuse him of havingused his judicial influence to securefavors from railroads that were liti-

gants before him; of having accept-ed favors from lawyers practicing inhis court, end of having been guiltyof other misconduct as a judge.

Archbald admitted practically allthe facts as to negotiations for culm

properties, but in each case main-

tained that the business negotiationswere innocent in themselves and thathe did not misuse his judicial power.
