Constitutional Amendment number 45/2004 includedamong the conditions of admissibility of the extraordinaryappeal, the requirement of general repercussion of theconstitutional question raised,regulated by changes in the Code of Civil Procedure and the Rules of Procedureof the Supreme Court.

The General Repercussion Institute

The Court will refuse the matter, wich the constitutionalquestion does not offer general repercussion,in otherwords, exceed the subjective interests of the parties in terms of economic, political, social or legal matters.

The refusal means that the process will not conductwithin the STF, as traditionally occurred before theimplementation of this mechanism.

How does the General Repercussion work?

The analysis of the general repercussion is based in the manifestation or in the absence of the CourtJustices.As defined by RISTF, in article 323, the Relater ofthe process must submit, to the other Justices andelectronically, a copy of his manifestation of theexistence or not of the general repercussion.Received the manifestation of the Relater, the otherJustices will send, also by electronic way, within thecommon 20 (twenty) days term, demonstrations onthe issue of RG.
