1. Current status

RECOMMENDATIONS FROM THE IRRS AND INIR MISSIONS

90 staff. Average age ~30. Active but not experienced.

Challenging duties and functions:

• Drafting legal documents

• Evaluating applications

• Monitoring and auditing construction, commissioning,

and operation

• Assessing nuclear safety for NPP, research reactor,

radiation facilities, etc.

In 2009, we invited the IAEA to conduct IRRS mission. Among

others, the most important recommendations from the Mission

are:

• VARANS should be strengthened without delay its human,

financial resources, and technical capability to meet immediate

needs for regulating both existing activities and, in particular, for

the introduction of nuclear power.

• VARANS should be provided with adequate technical

expertise to conduct independent review and assessment, both

now and in the future

In 2012, we have got the following recommendations from IAEA

INIR Mission (areas for further action)

• Resolution of the conflict of interest between promoting and

regulating nuclear power should be issued in a timely manner

consistent with the nuclear power program requirements

• Regulations should be issued in a timely manner consistent with

the nuclear power program requirements

• VARANS should establish procedures to augment its regulatory

staff by technical support organizations

RCF Meeting on 15 April 2011: Vietnam was selected to be

the second recipient country after Jordan.

RCF Meeting on 1-2 March 2012: RCF Action Plan for

Vietnam was developed. Accordingly, support activities were

identified, including a Seminar on Nuclear Regulatory Body

in Hanoi (Jun 2012).

MAIN EVENTS

26-27 Jun 2012, a delegation led by IAEA DDG Flory and

OECD/NEA DD Yoshimura with international experts from 7

RCF member countries participated in meetings with Vietnam

Deputy Prime Minister, Minister of MOST, Vice Minister of MOIT,

MONRE, MOC, MPS, MOD, MOH, MOFA.

Meetings focused on sharing perspectives on governmental

responsibilities for:

nuclear regulatory authority.

MISSION RESULTS

Strong Recommendation on Regulatory Infrastructure

The existing situation in which the regulatory oversight of nuclear

power is spread across numerous ministries is complex and may

result in significant overlap, inefficiencies and gaps in regulatory

oversight.

There does not appear to be an effectively independent regulatory

authority.

Regulatory and promotional functions of the different ministries

should be separated.

MISSION RESULTS

Strong Recommendation on Technical Competence

Technical competence for nuclear power should be a top priority for

Vietnam. Scope should be expansive and include VARANS and all

other government organisations with regulatory oversight

responsibilities for the nuclear power programme.

SOLUTION

• A new centre on nuclear science and technology will be

established in cooperation with Russian Federation

• A project on regulatory technical competence development for

Vietnam will be approved in cooperation with Japan

• Continuous bi-lateral and international cooperation as well as

augmentation by technical support organizations

MISSION RESULTS

Strong Recommendation on Legislative Framework

Legislative framework should clearly define responsibilities and

authorities for each ministry responsible for nuclear power

within Vietnam. The different ministries should have clearly

established protocols for interactions during all phases of the

NPP, from selection of the technology, site selection, design

reviews, licensing for construction and operation, oversight

during operation, and decommissioning.

documents. In 2011-2012 three regulations have been issued, i.e.

• Circular No. 28 (Oct 2011) on nuclear safety requirements for site

its assessment

• Circular No. 30 (Dec 2012) on nuclear safety requirements for

design

Five final draft guides (technical standards) for siting are ready for

issuing soon
